<br />1-:', jC~,;-"'. - ~ <br /> <br />J..:?o'f~ ,f21 <br /> <br />THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON <br /> <br />BY-LAW NO. 2003-188 <br /> <br />being a by-law to establish the composition of the <br />Clarington Public Library Board and to repeal By-law 85-85 <br /> <br />WHEREAS Section 9(1) of the Public Libraries Act, R.S.O. 1990, provides that a <br />public library board shall be composed of at least five members appointed by the <br />municipal councils; <br /> <br />NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE <br />MUNICIPALITY OF CLARINGTON ENACTS AS FOLLOWS: <br /> <br />1 . THAT the Clarington Public Library Board shall be composed of nine (9) <br />members. <br /> <br />2. THAT Council shall appoint two (2) of its members to serve on the <br />Clarington Public Library Board. <br /> <br />3. THAT the remaining seven (7) appointments be filled by residents of the <br />municipality who are qualified to be appointed in accordance with Section <br />10 (1) of the Public Libraries Act and who have submitted applications <br />seeking appointment pursuant to the publication of a public notice of <br />vacancies on the board published by the Municipal Clerk. <br /> <br />4. THAT, in accordance with Section 10 (3) of the Public Libraries Act, the <br />term of appointment shall be for a term concurrent with the term of the <br />appointing council, or until a successor is appointed, and a board member <br />may be reappointed for one or more further terms. <br /> <br />5. THAT, in accordance with Section 10 (4) of the Public Libraries Act, the <br />appointments shall be made at the first meeting of council in each term, <br />but if the council fails to make the appointments at its first meeting, it shall <br />do so at any regular or special meeting held within 60 days after its first <br />meeting. <br /> <br />6. THAT, in accordance with Section 14(1) of the Public Libraries Act, the <br />first meeting of the Board in a new term shall be called by the chief <br />executive officer appointed under Subsection 15(2) of the said Act. <br /> <br />7. THAT, in accordance with Section 24(1) of the Public Libraries Act, the <br />Clarington Public Library Board shall submit to the appointing council, <br />annually on or before the date and in the form specified by the council, <br />estimates of all sums required during the year for the purposes of the <br />board. <br /> <br />8.
