Call to Order Chairperson Paul Allore called the meeting to order at 7:00 pm 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting 3. Applications: 3.1 A2016-0004 Dana Snow 1640 Concession Road 9, Enfield Part of Lot 31, Concession 9 Former Township of Darlington Benan Hanondi, the applicant’s agent, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No persons appeared in opposition to this application. Moved by Jim Vinson, seconded by Todd Taylor “To approve the application to permit the construction of a deck and detached garage by increasing the maximum lot coverage from 15% to 32% and by increasing the maximum lot coverage for accessory structures from 10% to 13.6%.” Carried Committee of Adjustment February 18, 2016 Page 2 3.2 A2016-0005 Marlene/Harry Shillings 8358 Highway 35/115 Southbound, Clarke Part of Lot 24, Concession 8 Former Township of Clarke Harry Schillings, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. Moved by Gord Wallace, seconded by Todd Taylor “To approve the application to facilitate a condition of a decision of the Land Division Committee by permitting an increase in the maximum permitted lot area for a residential lot within an “Agricultural (A)” zone from 7,000 square metres to 10,771 square metres.” Carried 3.3 A2016-0006 Tim Green 4548 Concession Road 3, Clarke Part of Lot 35, Concession 3 Former Township of Clarke Prior to the commencement of the meeting, it was brought to the Committee’s attention that the applicant was confused as to where his property lines were located on the subject property. This resulted in the application being filled out incorrectly and additional information being required in order for the Municipality to process the application. Therefore, the Municipality amended their recommendation, to recommend the Committee table the application to allow the applicant time to confirm boundaries and discuss the application with Staff. Tim Green, the applicant, made a verbal presentation to the Committee regarding the application. The applicant described that he had been made aware that his property lines were not situated where he originally thought they were. The applicant explained that he has been in contact with his lawyer and a surveying company and has access to the information the Municipality requires in order to continue to process the application. He further described that he is willing to work with the Municipality, as he wants the minor variance application to be accurate and precise. No one spoke in opposition to the application. Paul Allore, Chairperson, explained why the Municipality has recommended tabling the application and asked if the applicant has any concerns with this. Tim Green expressed no concerns with tabling the application to a further meeting of the Committee of Adjustment. Moved by Jim Vinson, seconded by Todd Taylor Committee of Adjustment January 21, 2016 Page 3 “To table the application to permit the construction of an attached garage by reducing the required rear yard setback from 10 metres to 5 metres, to a future meeting of the Committee of Adjustment in order to allow the applicant time to discuss the application with Staff.” Carried 3.4 A2016-0007 Erik & Margaret Strand 2444 Trulls Road, Courtice Part Lot 31, Concession 2 Former Township of Darlington Erik Strand, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. Moved by Todd Taylor, seconded by Gord Wallace “To approve the application to permit the construction of a detached garage by increasing the maximum permitted height for an accessory building from 4 metres to 4.5 metres and by increasing the maximum permitted total floor area for all accessory buildings from 60 square metres to 84.3 square metres, subject to the condition that the existing 9 square metre shed and 15 share metre tent structure are removed within 3 months of the issuance of a building permit.” Carried 3.5 A2016-0008 Marion Giedroc 3719 Rundle Road, Darlington Part Lot 22, Concession 3 Former Township of Darlington Marian Giedroc, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance provided more detail than what was outlined in the report prepared for this application. The applicant provided the committee with a letter describing the why he requires the structure, and that he is willing to remove all existing structures on the premises. His reasoning’s, as described by the applicant and listed in the letter are as follows:  To store personal items (tractor, lawn-mowing equipment, trailer, boat and a ski-doo),  To be used as a hobby farm/animal shelter (horses, sheep, chickens and rabbits), and  To be used as a woodworking space for his hobby as well as a potential commercial operation to aid local farmers. Committee of Adjustment January 21, 2016 Page 4 The applicant’s letter also describes that due to an arm injury he is being forced into early retirement. Additional to the letter, the applicant provided the committee with a letter stating that he has been suffering from chronic lower back pain. No one spoke in opposition to the application. Paul Allore, Chairperson, explained why the Municipality has recommended tabling the application and asked if the applicant has any concerns with this. Marian Giedroc expressed no concerns with tabling the application. Moved by Todd Taylor, seconded by John Bate “To table the application to permit the construction of an accessory building by increasing the maximum permitted total floor area for all accessory buildings from 120 square metres to 353 square metres, to a future meeting of the Committee of Adjustment in order to allow the applicant time to discuss alternatives to this proposed with Staff.” Carried 4. Adoption of Minutes of Previous Meeting Moved by John Bate, seconded by Gord Wallace “That the minutes of the regular meeting of the Committee of Adjustment, held on January 21, 2016, be approved 5. Other Business: André O’Bumsawin is away with notice. Appeal date for the foregoing applications is March 9, 2016 Next Meeting of the Committee of Adjustment is March 10, 2016 6.
