That Report LGS-002-22 and any related communication items, be received; 2. That the By-law attached to Report LGS-002-22, as attachment 1, be approved; and 3. That all interested parties listed in Report LGS-002-22 and any delegations be advised of Council's decision. Municipality of Clarington Report LGS-002-22 Report Overview Page 2 To appoint designated staff within Ganaraska Region Conservation Authority (GRCA) and Pro -North Security as parking officers. 1. Background 1.1 In order to perform parking enforcement duties on private property, Section 15(1) of the Police Services Act, RSO 1990, c. P. 15, requires that persons be appointed by the Municipality. 1.2 Council appointments in the most recent past (Report CLD-015-19) have been general, in that they were not site specific nor person specific; but rather specific to a named agency (e.g. Nemesis Security, Paragon Security). This streamlined approach has proven to be successful and efficient for the Municipality and the external agency; eliminating the need to approach Council for appointments with each employee change. 2. Discussion 2.1 Municipal Staff have been approached by the Ganaraska Region Conservation Authority to have GRCA Provincial Offences Officers appointed by Council, in order to have the authority to enforce Clarington's Traffic By-law on GRCA lands within Clarington. GRCA has not been previously appointed in Clarington. 2.2 This request was made in response to resolution 37/21 passed at the GRCA Board of Directors meeting held September 16, 2021. 2.3 This is a similar request to one previously made by the Central Lake Ontario Conservation Authority, who have since been appointed by Council. 2.4 GRCA Provincial Offences Officers are authorized to enforce the provisions of the Conservation Authorities Act and Trespass to Property Act but are limited in their ability to address the matter of illegally parked vehicles on lands within their jurisdiction. 2.5 Staff have also been approached by Pro -North Security (Terry Chirsky); requesting appointment by Council, in order to have the ability to provide parking enforcement at properties within Clarington that they have been contracted to provide security services on. Only Security Guards licensed pursuant to the Private Security and Investigative Services Act, 2005 would be eligible to perform parking enforcement duties. Pro -North Security has not been previously appointed in Clarington. Municipality of Clarington Report LGS-002-22 Page 3 2.6 Provincial Offences Officers and Security Guards captured under a general appointment receive training from Municipal Staff prior to being authorized to perform private property parking enforcement. 2.7 Sites/properties that may be enforced by the respective agency are inspected by Municipal Staff to ensure appropriate and adequate signage is installed prior to any parking enforcement taking place thereon. 2.8 Staff recommend that a general appointment by-law be enacted for both the Ganaraska Region Conservation Authority and Pro -North Security. 3. Conclusion It is respectfully recommended that the By-law attached to Report LGS-002-22 as Attachment 1 be approved to appoint Ganaraska Region Conservation Authority and Pro -North Security as Private Parking Officers. 5. The Corporation of the Municipality of Clarington By-law 2021-004 Being a By-law to appoint private Parking Enforcement Officers Whereas subsection (1) of section 15 of the Police Services Act, R.S.O. 1990, c PA 5, provides that, "A municipal council may appoint persons to enforce the by-laws of the municipality"; And whereas Council deems it desirable to appoint the Ganaraska Region Conservation Authority to act as private property parking enforcement officers for property under their ownership and jurisdiction; And whereas Council deems it desirable to appoint Pro -North Security to act as private property parking enforcement officers at properties within Clarington they have been contracted by the owner to provide security services thereon; And whereas all provincially licensed Security Guards and designated GRCA Provincial Offences Officers receive municipal training, and all sites are inspected by the Municipality to confirm requisite signage; Now therefore the Council of the Corporation of the Municipality of Clarington hereby enacts as follows: That Ganaraska Region Conservation Authority and Pro -North Security are hereby appointed as Private Parking Enforcement Officers for the purposes of Section 11, Section 14 and Section 46 of the Clarington Traffic and Parking By- law 2014-059, as amended. 2.
