HomeMy WebLinkAbout2021-02-18Clarftwn Minutes of the Committee of Adjustment Corporation of the Municipality of Clarington February 18, 2021 Municipal Administrative Centre, Council Chambers 40 Temperance Street, Bowmanville Preliminary Note In response to the Province's Emergency Order and to maintain physical distancing during the COVID-19 pandemic, this Committee of Adjustment meeting took place in an electronic format. Members listed as being "electronically present," as well as applicants and members of the public, participated though the teleconferencing platform Microsoft Teams, which allows participation through a computer's video and audio, or by telephone. Electronically present: Todd Taylor Toni Rubino Annette Van Dyk Shelley Pohjola Dave Eastman John Bate Gord Wallace Noel Gamble Regrets: None 1. Call to Order Chairperson Acting Secretary -Treasurer Meeting Host Member Chairperson, Todd Taylor, called the meeting to order at 7:00 pm. 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting. Member Member Member Member Minutes from February 18, 2021 Page 2 3. Applications: 3.1 A2020-0051 Owner/applicant: Alan Johansen 11 Church Street, Bowmanville Chairperson, Todd Taylor, asked the applicant if he was aware of the condition in the Staff Report. Applicant, Alan Johansen, participated via the Teams app with audio only. Mr. Johansen indicated that he was not aware of the condition in the staff report. Committee Member, Shelley Pohjola, asked Staff if they considered tabling the application given that the parking issue had not yet been resolved. Planning Staff Member, Toni Rubino, advised that there has been significant discussion between various staff departments and that it was determined that the conditional decision would allow the setback variance to advance while imposing a timeframe to remedy the parking space concerns. Committee Member, Shelley Pohjola, asked Staff if there was an urgency to obtain approval. Planning Staff Member, Toni Rubino, advised that there was no urgency in obtaining approval. Applicant, Alan Johansen, asked Staff what the condition in the Staff Report was. Planning Staff Member, Toni Rubino, advised that during a site visit staff measured the parking space and it did not comply with the 2.75 metre width requirement per the Zoning By-law as it measured 2.1 metres. Further, Staff noted that per by Zoning By-law that the driveway is required to be maintained with a stable surface. No other Committee Members had questions or comments. No other persons spoke in support or opposition of the application. Motion to table moved by Shelley Pohjola, seconded by John Bate. Full text of decision: "That application A2020-0051 for a minor variance to Section 12.2 d. i) of Zoning By-law 84-63 to reduce the front yard setback from the minimum required 4.5 metres to 4.1 metres to the dwelling be tabled for a period of up to sixty (60) days, to allow the applicant more time to satisfy municipal requirements relating to the reinstatement of a second parking space." "Carried" Minutes from February 18, 2021 Page 3 3.2 A2020-0058 Owner/applicant: Shaoib Sheikh Agent: Leno Mercieca 33 Bonathon Street, Bowmanville Chairperson, Todd Taylor, asked if the applicant was present. Meeting host, Annette Van Dyk, indicated Mr. Sheikh was not present. No other Committee Members had questions or comments. No other persons spoke in support or opposition of the application. Motion to table as recommended moved by Noel Gamble, seconded by Gord Wallace. Full text of decision: "That application A2020-0058 for a minor variance to section 3.1.g. iv) of Zoning By-law 84-63 to facilitate the construction of a deck by increasing the permitted projection into the rear yard setback from 1.5 metres to 2.2 metres; to permit an accessory structure (pergola) by reducing the rear yard and interior side yard setback from 0.6 metres to 0.3 metres; and allowing an overhang projection of up to 0.15 metres for the accessory structure (pergola) be tabled for a period of up to sixty (60) days to allow for proper giving of notice under the Planning Act" "Carried" 3.3 A2020-0001 Owner/applicant: Francesco Barone Agent: Paul Poulsson 3493 Concession Road 3, Newcastle Paul Poulsson, the agent, participated via the Teams app with audio only. He gave a verbal presentation to the Committee in favour of the application, which provided similar arguments and details as in the recommendation report prepared for this application. No other Committee Members had questions or comments. No other persons spoke in support or opposition of the application. Motion to approve as recommended moved by Shelley Pohjola, seconded by John Bate. Full text of decision: "That application A2021-0001 for a minor variance to Section 3.1.c. of Zoning By-law 84-63 to permit the existing accessory building (garage) by increasing the maximum permitted height from 4.5 metres to 5.1 metres be approved as it is minor in nature, desirable for the appropriate development or use of the land and maintains the general intent and purpose of the Zoning By-law, the Durham Region Official Plan and Minutes from February 18, 2021 Page 4 Clarington Official Plan." "Carried" 4. Adoption of Minutes of Previous Meeting, January 20, 2021. Moved by Noel Gamble, seconded by Gord Wallace. "That the minutes of the Committee of Adjustment, held on January 20, 2021 be Approved." "Carried" 5. Other Business • Appeal date for the foregoing applications is March 10, 2021. • Next Meeting of the Committee of Adjustment is to be determined. 6.
