HomeMy WebLinkAbout12-10-2020 MinutesClarftwn Minutes of the Committee of Adjustment Corporation of the Municipality of Clarington December 10, 2020 Municipal Administrative Centre, Council Chambers 40 Temperance Street, Bowmanville Preliminary Note In response to the Province's Emergency Order and to maintain physical distancing during the COVID-19 pandemic, this Committee of Adjustment meeting took place in an electronic format. Members listed as being "electronically present," as well as applicants and members of the public, participated though the teleconferencing platform Microsoft Teams, which allows participation through a computer's video and audio, or by telephone. Call to Order Chairperson, Todd Taylor, called the meeting to order at 7:00 pm. 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting. Applications: 3.1 A2020-0051 Owner/applicant: Alan Johansen 11 Church Street, Bowmanville Chairperson, Todd Taylor, asked staff if the applicant was aware of the Staff Report tabling the application. Planning Staff Member, Toni Rubino, advised that the applicant received the comments and had no objections to the tabling of the application. The applicant had called to indicate that he was unable to attend the meeting. No other Committee Members had questions or comments. No other persons spoke in support or opposition of the application. Motion to table as recommended moved by Dave Eastman, seconded by Gord Wallace. Full text of decision: "That application A2020-0051 for a minor variance to Section 12.2 d. i) of Zoning By-law 84-63 to reduce the front yard setback from the minimum required 4.5 metres to 4.1 metres to the dwelling be tabled for a period of up to sixty (60) days, to allow the applicant more time to satisfy municipal requirements relating to the reinstatement of a second parking space." "Carried" 3.2 A2020-0055 Owner/applicant: Perry Jackman, Hollee Homes Inc. Agent: Bobbi Ann Brooks, Top Floor Design 3 Pine Street, Bowmanville Agent Bobbi Ann Brooks participated via the Teams app with audio only. Ms. Brooks gave a verbal presentation to the Committee in favour of the application, which provided similar arguments and details as in the recommendation report prepared for this application. Local resident Sean Szoradi participated via the Teams app with audio only. He expressed concerns that a semi-detached dwelling was not in keeping with the character of the neighbourhood and that the local park already causes a overflow of parking onto Pine Street. Mr. Szoradi also asked if the severance had taken place. Ms. Brooks advised that the area is zoned for a semi-detached dwelling. Committee Member, Gord Wallace, asked Staff about the status of the severance. Planning Staff Member, Toni Rubino, clarified that while a severance was approved to sever what is now 3 Pine Street from 112 Duke Street, a severance for the semi- Minutes from December 10, 2020 Page 3 detached building would not take place until the foundation was poured for the semi- detached building. Committee Member, Gord Wallace, asked Staff if the proposal complies with the parking regulations in the Zoning By-law. Planning Staff Member, Toni Rubino, advised that the proposal provides two outdoor and one indoor parking space per dwelling unit which complies with the Zoning By-law's requirements for two outdoor parking spaces per dwelling unit. Local resident, Chris Vesters, participated via the Teams app with audio only. He expressed concerns that a semi-detached dwelling was not in keeping with the character of the neighbourhood and that the applicant should comply with the landscaping requirement. Planning Staff Member, Toni Rubino, clarified that a semi-detached dwelling is permitted within the zoning and in order to comply with the established building line in the Neighbourhood Character Overlay and parking requirements, that the front yard landscaped open space is slightly deficient. Mr. Vesters asked if the variances were approved and the applicant obtained a Building Permit if they would have to comply with the zoning as that was not the case for the dwelling at 112 Duke Street. Planning Staff Member, Toni Rubino, clarified that the applicant would be required to build what was approved at the building permit stage and that to approve a building permit application the proposal would be required to comply with the Zoning By-law. No other Committee Members had questions or comments. No other persons spoke in support or opposition of the application. Motion to approve as recommended moved by Dave Eastman, seconded by Shelley Pohjola. Full text of decision: "That the revised application A2020-0055 for a minor variance to Sections 12.2 a. ii)., and 12.2.1. d. ii) of Zoning By-law 84-63 to reduce the lot area from the minimum 550 square metres to 540 square metres and to reduce the minimum landscaped open space in the front yard (soft landscaping) from the required 50% to 47% to facilitate the development of a semi-detached dwelling at 3 Pine Street be approved as it is minor in nature, desirable for the appropriate development or use of the land and maintains the general intent and purpose of the Zoning By-law, the Durham Region Official Plan and Clarington Official Plan" "Carried" Minutes from December 10, 2020 Page 4 4. Adoption of Minutes of Previous Meetings, November 26, 2020. Moved by Dave Eastman, seconded by Shelley Pohjola. "That the minutes of the Committee of Adjustment, held on November 26, 2020 be Approved." "Carried" 5. Other Business • Appeal date for the foregoing applications is December 30, 2020. • Next Meeting of the Committee of Adjustment is to be determined. 6.
