Call to Order Minutes of the Committee of Adjustment Corporation of the Municipality of Clarington August 22, 2019 Municipal Administrative Centre, Council Chambers 40 Temperance Street, Bowmanville Shelley Pohjola Dave Eastman Gord Wallace Isabel Lima Todd Taylor John Bate Chairperson Member Member Acting Secretary -Treasurer Chairperson, Shelley Pohjola called the meeting to order at 7:00 pm. 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting. 3. Motion A motion to swear in Mark Jull and Isabel Lima as Acting Secretary/Treasurer of the Committee of Adjustment. Moved by Dave Eastman, seconded by Gord Wallace. 4. Applications: 4.1 A2019-0027 Applicant: Clark Consulting Services Owner: Brian Jensen 1941 Concession Road 10, Darlington The applicant, Clark Consulting Services, was not present at the meeting. Committee members had no questions for staff. No other persons spoke in support or opposition of the application. Moved by Gord Wallace, seconded by Dave Eastman. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application to facilitate a Land Division application by increasing the maximum permitted lot area of an agricultural parcel from 40 hectares to 57.09 hectares on the retained lot be TABLED for up to 6 months to rectify the building encroachment on the Union School Road allowance and to require additional Public Notice." "Carried" 4.2 A2019-0028 Applicant: Donald Luxton Owner: Donald Luxton 142 Ontario Street, Bowmanville The applicant, Donald Luxton, gave a verbal presentation to the Committee in favour of the application. He explained that the proposed addition will allow his daughter and grandchildren to live there. No other committee members had questions or comments. No other persons spoke in support or opposition of the application. Moved by Dave Eastman, seconded by Gord Wallace. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Interim Control By-law and the Official Plans. The application to permit the construction of an addition to an existing dwelling by increasing the permitted floor area of the addition from 25.0% of the existing dwelling to 85.9% of the existing dwelling be APPROVED." "Carried" 4.3 A2019-0029 Applicant: David & Helen Tonkin Owner: David & Helen Tonkin 31 Washburn Path, Courtice The applicant, David Tonkin, gave a verbal presentation to the Committee in favour of the application. He described the work he would like to complete through this variance, which he stated is a deck and a modular sunroom. Committee Member Shelley Pohjola asked the applicant if he read the Staff Report regarding the minor variance application. The applicant, David Tonkin, said he did not read the report but he did receive a call from the Clarington Planning Services Department in regards to the application being tabled. The applicant explained that he sees this as a setback issue, but understands that a precedent may be set. Committee Member Gord Wallace explained to the applicant that the report was recommended to be tabled as there are issues with stormwater management, changes to the original grading plan, and the influence this application will have on future applications within the neighbourhood. Minutes from August 22, 2019 Page 3 The applicant asked the Committee Members if there is a timeline in which this issue would be addressed. Committee Member Shelley Pohjola asked staff to address the question. Staff stated that the timeline was unsure, but that the Clarington Planning Services Department wishes to arrange a meeting with the developer and the condominium corporation to discuss the stormwater management issues. The applicant, David Tonkin, explained that the deck and modular sunroom were of reasonable size. The applicant stated that a standard for the neighbourhood needs to be set. No other committee members had questions or comments. No other persons spoke in support or opposition of the application Moved by Dave Eastman, seconded by Gord Wallace. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application to permit the construction of a deck and a sunroom by reducing the minimum required rear yard setback from 6 metres to 3.05 metres be TABLED until an assessment has been made on the impact of additions of decks and additions on the overall stormwater management scheme for the entire site." "Carried" 4. Adoption of Minutes of Previous Meeting Moved by Dave Eastman, seconded by Gord Wallace. "That the minutes of the Committee of Adjustment, held on July 18, 2019, be APPROVED." "Carried" 5. Other Business: • Appeal date for the foregoing applications is September 11, 2019. • Next Meeting of the Committee of Adjustment is September 12, 2019. During this meeting Mark Jull and Isabel Lima were sworn in as Acting Secretary/Treasurer of the Committee of Adjustment. Todd Taylor is away with notice. John Bate is away with notice. 6.
