Call to Order Chairperson Member Member Member Member Acting Secretary -Treasurer Chairperson, Todd Taylor called the meeting to order at 7:00 pm. 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting. 3. Applications: 3.1 A2018-0071 Applicant/Owner: Richard Bouma, R Bouma Construction 69 Lambs Lane, Bowmanville Part Lot 12, Concession 2 Bowmanville The applicant, Richard Bouma, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. There were no questions from the Committee or members of the public in objection or support. Chairperson, Todd Taylor asked whether the applicant is aware of the condition on page eight of the Staff Report as part of the recommendation for approval. The applicant replied in the affirmative. Moved by John Bate, Seconded by Shelly Pohjola. Committee of Adjustment Minutes December 20, 2018 Page 2 "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. The application to permit the construction of a semi-detached dwelling by increasing the maximum permitted total lot coverage from 35% to 43% and increase the maximum permitted height from 8 metres to 8.68 metres is approved subject to the following conditions: 1. That the building permit be applied for and issued with Proposed Front Elevation B, as submitted to staff on December 12, 2018." "Carried" 3.2 A2018-0072 Applicant: William Vogel Owner: Salem United Reformed Church 2607 Concession Road Part Lot 11, Concession 3 Former Township of Darlin The applicant William Vogel made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. There were no questions from the Committee or members of the public in objection or support. Moved by Gord Wallace, Seconded by Shelley Pohjola. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. The application to permit the construction of an addition to an existing Place of Worship by reducing the required rear yard setback from 15 metres to 11.2 metres by increasing the maximum permitted coverage from 5% to 12% is approved, subject to the following condition: 1. That the existing temporary portable be removed from the property within six (6) months of the date of the issuance of a building permit for the addition." The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. There were no questions from the Committee or members of the public in objection or support. Moved by Jim Vinson, Seconded by Gord Wallace. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. The application to permit the construction of a deck by increasing the permitted deck projection into the rear yard from 1.5 metres to 2.83 metres is approved subject to the following condition: 1. The applicant obtains a building permit for the deck within one month of the Committee's decision." "Carried" 3.4 A2018-0075 Applicant/Owner: Punia Group Inc. Agent: n Architecture Inc. 6 Spicer Square, Bowmanville Part Lot 14, Concession Broken Front The owner's agent made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. There were no questions from the Committee or members of the public in objection or support. Moved by Shelley Pohjola, Seconded by John Bate. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. Committee of Adjustment Minutes December 20, 2018 Page 4 The application to permit development on a vacant commercial lot by reducing the minimum required exterior side yard setback from 6 metres to 2.35 metres and by reducing the minimum distance from the intersection to the nearest point of ingress and egress from 50 metres to 42 metres is approved." "Carried" 4. Adoption of Minutes of Previous Meeting Moved by Shelley Pohjola, seconded by John Bate. "That the minutes of the meeting of the Committee of Adjustment, held on November 29, 2018, be approved." 5. Other Business: • Appeal date for the foregoing applications is January 9, 2019. • Next Meeting of the Committee of Adjustment is January 31, 2019. 6.
