Call to Order Chairperson Member Member Acting Secretary -Treasurer Chairperson, Todd Taylor called the meeting to order at 7:00 pm. 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting. 3. Applications: Member Member Member 3.1 A2019-0020 Applicant: Nicolas Swerdfeger, Barry Brian Associates Owner: Newcastle Lodge for Seniors and Family Dwellings 165 King Avenue East, Newcastle Village Part Lot 27, Concession 1 Former Village of Newcastle The applicant made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. There were no questions from the Committee or members of the public in objection or support. Moved by John Bate, Seconded by Shelly Pohjola. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. The application to permit to a proposed expansion of Newcastle Lodge for Senior and Family Dwellings by reducing the required third storey setback from 1 metre to 0.3 metres from the second storey Committee of Adjustment Minutes June 6, 2019 building fagade facing King Avenue East, and permitting canopies that intrude 0.6 metres into the required 2 metres setback to the front lot line is APPROVED. "Carried" 3.2 A2019-0021 Applicant: Michael Bice (Ontario Fence and Deck) Owner: Calvin and Paulette Smith 31 Whitehand Drive, Newcastle Part Lot 29, Concession 2 Former Township of Clarke The applicant submitted a letter to the Committee regarding the application. The letter discussed his support and rationale for the proposed variance. There were no questions from the Committee or members of the public in objection or support. Moved by Shelley Pohjola, Seconded by John Bate. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. The application to permit a proposed deck by increasing the permitted lot coverage from 40% to 44% is APPROVED. "Carried" 4. Adoption of Minutes of Previous Meeting Moved by Shelley Pohjola, seconded by Todd Taylor. "That the minutes of the meeting of the Committee of Adjustment, held on May 16, 2019, be approved." 5. Other Business: x Glynn Green, Gord Wallace and Dave Eastman are absent with notice. x Appeal date for the foregoing applications is July 17, 2019. x Next Meeting of the Committee of Adjustment is June 27, 2019. x The Committee would like to amend the meeting minutes from April 18, 2019 for A2019-0014 to include a statement referencing the number of decks that comply with the existing zoning regulations. These decks were part of the site plan approval for the development. x The Committee suggested that Staff attempt to put C of A reports and agendas online for greater accessibility to the public. x Staff must ensure that the owner/applicant/agent and all interested parties listed on the report receive a copy of the Staff Report prior to the meeting with ample time Committee of Adjustment Minutes June 6, 2019 6.
