Call to Order Chairperson Vice Chairperson Member Member Chairperson, Todd Taylor called the meeting to order at 7:00 pm 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting 3. Applications 3.1 A2018-0003 Agent: Morgan Donneral Owner: Landomills Farms Ltd. 1886 Concession Road 7 Part Lot 25, Concession 7 Former Township of Darlington Member John Bate Agents, Morgan and Darryl Donneral made a verbal to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the Staff report prepared for this application. Member, Andre O'Bumsawin, stated that the Minimum Distance Separation (MDS) requirements are required for a reason, therefore, how does this proposal affect the neighbours? Agent, Darryl Donneral, explained the proposed expansion in more detail. He explained that the proposed expansion it to be a more humane approach to dairy farming, resulting in healthier and happier animals. Further, the additional manure will be composted. Agent, Morgan Donneral stated that composted manure has much less odour than other methods of manure storage, so should affect the neighbours less. Member, Andre O'Bumswin, asked Staff from a zoning and planning perspective, is this acceptable? Planner, Amanda Tapp, explained that the agents had extensive conversations with Planning Staff prior to applying for the minor variance application. Through this expansion, the animals will be housed further than they are being housed today. For these reasons and others listed in the Staff report, Staff are supportive of the proposed reductions. Member, Andre O'Bumswin, asked whether the applicants are aware of any neighbouring concerns. Mr. Donneral responded by stating they had discussions with their neighbours, who have no concerns. Further, they received a letter in support from the neighbouring property Owner located at 1893 Concession Road 7. The letter was submitted to Staff on the floor in support of the application. There were no further questions from the Committee or members of the public in objection or support. Moved by James Vinson, Seconded by Andre O'Bumsawin. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. The application to permit an extension of a livestock barn by reducing the minimum required agricultural setback from 150 metres to 95 metres from the dwelling located at 1893 Concession Road 7 and from 150 metres to 140 metres from the dwelling located at 1925 Concession Road 7 is approved." "Carried" 3.2 A2018-0004 Applicant: The Biglieri Group Ltd. Owner: Averton Homes (Bowmanville) Inc. 63 Lyle Drive, Bowmanville Part Lot 9, Concession 2, Former Township of Darlington Representative for the applicant, Brent Smith made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. There were no questions from the Committee or members of the public in objection or support. Moved by Gord Wallace, Seconded by Andre O'Bumsawin. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. The application to permit the construction of a townhouse block by reducing the exterior side yard setback from 4 metres to 3.6 metres is approved." "Carried" 3.3 A2018-0007 Agent: Your Own Design Owner: Gun -Woo Rhee 7650 Old Scugog Road, Enniskillen Part Lot 19, Concession 7 Former Township of Darlington Representative for the agent, John Kraeton made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. There were no questions from the Committee or members of the public in objection or support. Moved by Andre O'Bumsawin, Seconded by James Vinson. "Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plans. The application to permit the construction of a single detached dwelling by increasing the maximum height from 10.5 metres to 11.6 metres is approved." "Carried" 4. Adoption of Minutes of Previous Meeting Moved by Andre O'Bumsawin, seconded by Gord Wallace. "That the minutes of the meeting of the Committee of Adjustment, held on January 25, 2018 be approved." 5. Other Business: x Appeal date for the foregoing applications is March 7, 2018. x Next Meeting of the Committee of Adjustment is to be determined. 6.
