Call to Order Vice Chairperson, André O’Bumsawin called the meeting to order at 7:00 pm 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting 3. Applications 3.1 A2017-0044 Applicant: Top Floor Design – Bobbi Ann Brooks Owner: Gary Sartoris 16 Elgin Lane, Hampton Part Lot 18, Concession 5 Former Township of Darlington Applicant, Bobbi Ann Brooks made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the Staff report prepared for this application. Member, André O’Bumsawin asked the planner whether there were any proposed sidewalks on the adjacent streets at Perry Street and Elgin Lane. Planner, Amanda Watson responded that there is no planned sidewalks for either Perry Street or Elgin Lane. There were no further questions from the Committee or members of the public in objection or support. Moved by John Bate, Seconded by Shelley Pohjola. “Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plan. The application to permit the construction of an attached garage by reducing the minimum required exterior side yard setback in the “Residential Hamlet (RH) Zone” from 6 metres to 4.5 metres is approved.” “Carried” 3.2 A2017-0045 Applicant: 1494339 Ontario Ltd. / Foley Group Owner: David and Heather Brown and Mark Foley 50 Darlington Boulevard, Courtice Part Lot 35, Concession 2, Former Township of Darlington Applicant, Mark Foley made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the Staff report prepared for this application. The applicant made a further comment regarding Section 2.1 of the Staff Report, which should be amended to say southerly instead of northerly. There were no questions from the Committee or members of the public in objection or support. Moved by Shelley Pohjola, Seconded by James Vinson. “Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plan. The application to reduce the minimum required lot frontage from 15 metres to 14.54 metres to facilitate a future Land Division application for a new building lot is approved.” “Carried” 3.3 A2017-0046 – 2888 Trulls Road, Courtice A2017-0047 – 2888 Trulls Road, Courtice Applicant/Owner: Holland Homes Inc. Part Lot 31, Concession 2 Former Township of Darlington Agent, Katrina Metzner, made a verbal presentation to the Committee regarding the applications. The explanations for the proposed variances were similar to what was outlined in the report prepared for these applications. There were no questions from the Committee or members of the public in objection or support. Both applications were approved unanimously by the Committee. A2017-0046 2888 Trulls Road, Courtice Moved by James Vinson, seconded by Shelley Pohjola. “Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plan. The application A2017-0046 to facilitate a condition of a Land Division application by reducing the minimum required lot frontage on the retained lot from 15 metres to 14.1 metres is approved.” “Carried” A2017-0047 2888 Trulls Road, Courtice Moved by James Vinson, seconded by John Bate. “Based on our review of the application, all verbal comments received and the agency comments submitted, the application is deemed minor in nature, is considered desirable for the appropriate development and use of the land and maintains the general intent and purpose of the Zoning By-law and the Official Plan. The application by reducing the minimum required lot frontage on the severed lot from 15 metres to 14.1 metres is approved.” “Carried” 4. Adoption of Minutes of Previous Meeting Moved by Shelley Pohjola, seconded by John Bate. “That the minutes of the meeting of the Committee of Adjustment, held on July 20, 2017 be approved.” 5. Other Business: Appeal date for the foregoing applications is August 30, 2017. Next Meeting of the Committee of Adjustment is to be determined. Brief discussion regarding process of Land Division Applications that require a minor variance. o It was explained to the Committee that the process is not regulated and we will continue to see applications that have Land Division Approval and applications that have yet to apply to the Land Division Committee. 6.
