The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by Jim Vinson, seconded by Andre O'Bumsawin "To approve the application to permit the construction of a sunroom addition by reducing the minimum required rear yard setback from 7.5 metres to 5.17 metres as it meets the intent of Minutes from June 30, 2016 the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood. Carried 3.2 A2016-0035 Nicholaas Vanseggelen 78 Hunt Street Part Lot 11, Concession 1 Former Town of Bowmanville Page 2 Julie Vanseggelen and Perry Jackman, the applicant and contractor for the applicant respectively, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by John Bate, seconded by Jim Vinson. "To approve the application to permit the expansion of a legal non -conforming use in an "Environmental Protection Zone" by allowing an addition to an existing single detached dwelling by increasing the total footprint to 146.23 square metres, decreasing the interior side yard setback from 4.55 metres to 1.3 metres, decreasing the rear yard setback from 19.5 metres to 15.76 metres as it meets the intent of the Official Plan and Zoning By- law, is minor in nature and is not detrimental to the neighbourhood" Carried 3.3 A2016-0036 Crystal Gillman 528 George Reynolds Drive, Courtice Part Lot 27, Concession 3 Former Township of Darlington Crystal Gillman, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by Andre O'Bumsawin, seconded by Gord Wallace. Minutes from June 30, 2016 "To approve the application to permit the installation of a pool by reducing the required setback for accessory structures from 4 metres to 1.2 metres and to permit the construction of a shed and cabana by reducing the required setback for accessory buildings from 4 metres to 0.6 metres as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." Carried 3.4 A2016-0037 Zegers Construction Ltd. 3681 Concession Rd. 4, Clarke Part Lot 25, Concession 3 Former Township of Clarke Page 3 Dan Zegers, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. Committee member Todd Taylor clarified if the applicant was aware and okay with the recommended condition to approval outlined in the staff report and Dan Zegers stated that he was. No one spoke in opposition to the application. Moved by John Bate, seconded by Gord Wallace. "To approve the application to permit the expansion of a legal non -conforming farm by adding a 140 square metre farm storage building to the property subject to the condition that the two shipping containers are removed from the property within six months of the date of approval of this application, as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." Carried 3.5 A2016-0038 Leslie Macpherson 4858 Trulls Road, Mitchell Corners Part Lot 31, Concession 4 Former Township of Darlington Leslie Macpherson, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. Minutes from June 30, 2016 Page 4 Committee member Todd Taylor clarified if the applicant was aware and okay with the recommended condition to approval outlined in the staff report and Leslie Macpherson asked for a six month extension to the condition to remove the shipping containers as he needs them to build the garage due to the complications with the grading and engineering. The containers are storing his possessions that will be stored in the garage once built. Planning staff, David Addington, asked if the applicant could have the containers moved within 8 months and applicant stated that 10 months would be the earliest. The Committee was satisfied with this condition as was the applicant. No one spoke in opposition to the application. Moved by Gord Wallace, seconded by John Bate. "To approve the application to permit the construction of a detached garage by increasing the maximum permitted height at the south-east corner and across the south side of the garage to a maximum width of 10 metres from 4.5 metres to 6.5 metres subject to the condition that the two existing shipping/cargo containers be removed from the property within ten months of the date of approval of this application as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." Carried 3.7 A2016-0039 511060 Ontario Limited 1 Jollow Drive, Bowmanville Part Lot 9, Concession 2 Former Town of Bowmanville Frank Veltri, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by Jim Vinson, seconded by Andre O'Bumsawin. Minutes from June 30, 2016 "To approve the application to permit the construction of a single detached dwelling by increasing the maximum permitted porch projection into the portion of the exterior side yard formed by the site triangle from 1.5 metres to 2.5 metres as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." Carried 3.8 A2016-0040 511060 Ontario Limited 2 Jollow Drive, Bowmanville Part Lot 9, Concession 2 Former Town of Bowmanville Page 5 Frank Veltri, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by Jim Vinson, seconded by Andre O'Bumsawin. "To approve the application to permit the construction of a single detached dwelling by increasing the maximum permitted porch projection into the portion of the exterior side yard formed by the site triangle from 1.5 metres to 2.52 metres as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." Carried 3.9 A2016-0041 Paul Robitaille 118 Harry Gay Drive, Courtice Part Lot 27, Concession 3 Former Township of Paul Robitaille, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. Minutes from June 30, 2016 Page 6 Committee member Todd Taylor clarified if the applicant was aware and okay with the recommended condition to approval outlined in the staff report and Paul Robitaille stated that he was. Additionally, Todd Taylor noted an inconsistency in the staff report where it was written that the application was to increase the lot coverage to 45% in the Recommendation. Planning staff, David Addington indicated that this was a typo and the application was to increase the lot coverage to 48.1 %. There were no further questions from the Committee members. Moved by Jim Vinson, seconded by Gord Wallace. "To approve the application to permit the construction of a deck and garden shed in the rear yard of a single detached dwelling by increasing the maximum permitted lot coverage from 40% to 48.1 % and by increasing the maximum permitted deck projection into the rear yard setback from 1.5 metres to 2.87 metres subject to the condition that the existing garden shed is moved to a minimum of 2 metres from the rear property line within 3 months of the date of approval as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." Carried 4 Adoption of Minutes of Previous Meeting Moved by Jim Vinson, seconded by John Bate. That the minutes of the regular meeting of the Committee of Adjustment, held on July 20, 2016, be approved. 5 Other Business Todd Taylor and Andre O'Bumsawin will be away for next meeting. Jim Vinson will chair the next meeting Appeal date for the foregoing applications is July 20, 2016 Next Meeting of the Committee of Adjustment is July 14, 2016 6 Adjournment Moved by Andre O'Bumsawin, seconded by John Bate.
