Call to Order Member Member Member Chair Acting Secretary -Treasurer Chair Todd Taylor called the meeting to order at 7:00 pm 2. Disclosures of Pecuniary Interest There were no pecuniary interests stated for this meeting 3. Applications: 3.1 A2016-0050 2353235 Ontario Limited 302 Given Road, Newcastle Village Part of Lot 32, Concession 2 Former Township of Clarke Applicant Heidi Stephenson made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the staff report prepared for this application. Committee Member Shelley Pohjola asked the applicant if she knew what conditions were applied to the Land Division file associated with this application and whether there was a Heritage Impact Study completed for the dwelling at 302 Given Road. The applicant was not aware of the conditions of Land Division but understood obtaining a minor variance was one of the conditions. Planner, David Addington noted that variances were often included as conditions of Land Division applications. The applicant responded that a Heritage Impact Study had been completed. There were no further questions or comments from the Committee members and there were no members of the public appearing in support or objection to the application. Moved by Andre O'Bumsawin seconded by John Bate. "Based on our review of the application and the agency comments submitted, the application is deemed minor in nature, meets the intent of the Official Plan and Zoning By-law and will not be detrimental to the character of the neighbourhood. The application is APPROVED to permit the creation of a lot by reducing the minimum lot area for the severed parcel from 40 hectares to 0.66 hectares and reducing the minimum lot frontage from 100 metres to 35.99 metres and by reducing the minimum lot area for the retained parcel from 40 hectares to 4.34 hectares as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." Carried 3.2 A2016-0055 D.G Biddle & Associates Ltd. 2198 Nash Road, Darlington Part of Lot 19 & 20, Concession 3 Former Township of Darlington The Applicant was not present to introduce the application to the Committee. There were no members of the public present in support or objection to the application. There were no questions from the Committee members. Moved by John Bate, seconded by Shelley Pohjola. "Based on our review of the application and the agency comments submitted the application to permit an existing accessory building by increasing the maximum permitted total floor area for all accessory structures from 90 square metres to 206.21 square metres and by decreasing the minimum required side yard setback to the existing accessory building from 1.2 metres to 0 metres by TABLED to a future meeting of the Committee of Adjustment to provide the applicant with the opportunity to meet with staff to discuss the various issues." Carried 3.3 A2016-0056 Jeff and Sara Parkinson 27 Lynwood Avenue, Courtice Part Lot 29, Concession 3 Former Township of Darlington Applicant, Jeff Parkinson, made a verbal presentation to the Committee regarding the application. The explanations for the proposed variances were similar to what was outlined in the staff report prepared for these applications. Chairman, Todd Taylor asked the Applicant if he realize Staff had recommended a condition to remove the container on the property within 6 months of the approval of the application and the Applicant stated that he was aware and was okay with this condition. There were no questions from the Committee or members of the public in objection or support. Moved by Shelley Pohjola, seconded by Andre O'Bumsawin. "Based on our review of the application and the agency comments submitted, the application is deemed minor in nature, meets the intent of the Official Plan and Zoning By-law, meets the intent the Interim Control By-law and will not be detrimental to the character of the neighbourhood. The application is APPROVED to permit the construction of a bungaloft addition to the front and side of the existing dwelling in compliance with the Urban Residential Type One (R1) zone regulations subject to the condition that the shipping container currently located on the property be removed within 6 months of the date of approval of this application." Carried 4. Adoption of Minutes of Previous Meeting Moved by Shelly Pohjola, seconded by James Vinson. "That the minutes of the regular meeting of the Committee of Adjustment, held on August 4, 2016 be approved." 5. Other Business: Appeal date for the foregoing applications is September 14, 2016 Next Meeting of the Committee of Adjustment is September 15, 2016 6.
