The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by John Bate, seconded by Andre O'Bumsawin "To approve the application to permit the construction of an accessory building by increasing the maximum permitted total floor area for all accessory buildings from 120 square metre to 159 square metres and by increasing the maximum height for accessory Committee of Adjustment May 12, 2016 structures from 4.5 metres to 5.15 metres, subject to the condition that the owner remove the existing accessory building from the property within six months of the date of the decision of the Committee of Adjustment (November 12, 2016), as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood. "Carried" 3.2 A2016-0026 Kimberley and Anthony Hall 7316 Langstaff Road Part Lot 5, Concession 7 Former Township of Clarke Page 2 Kimberley and Anthony Hall, the applicants, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by Jim Vinson, seconded by Todd Taylor "To approve the application to permit the construction of a deck projecting 2.44 metres into an "Environmental Protection (EP) Zone" as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and it not detrimental to the neighbourhood." "Carried" 3.3 A2016-0027 James Thurston 228 Millburn Drive, Bowmanville Part Lot 16, Concession 1 Former Township of Darlinaton James Thurston, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by Andre O'Bumsawin, seconded by Todd Taylor "To approve the application to permit the construction of a deck in the rear yard of a single detached dwelling by increasing the Committee of Adjustment May 12, 2016 Page 3 maximum permitted lot coverage from 40% to 45% as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." "Carried" 3.4 A2016-0028 Klaus Anselstetter 1283 Church Street Part Lot 28, Concession 1 Former Township of Newcastle Villaae Fernando Vizza, agent for the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. Committee member Todd Taylor clarified if the applicant was aware and okay with the recommended condition to approval outlined in the staff report and Mr. Vizza stated that he was. No one spoke in opposition to the application. Moved by Todd Taylor, seconded by Andre O'Bumsawin. "To approve the application to permit an increase in the maximum permitted floor area for all accessory structures from 60 square metres to 78 square metres, subject to the condition that the owner remove the three existing sheds from the property within six months of the date of the Committee of Adjustment (November 12, 2016), as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." "Carried" 3.5 A2016-0029 Lynette Brett and Brandon Hunt 23 Richard Davies Drive, Bowmanville Part Lot 14, Concession 3 Former Township of Darlington Lynette Brett, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. Committee member Todd Taylor noted that the proposed deck projection figures in the report were different from those mentioned by the applicant in the verbal description of the project. Staff member David Addington stated that staff had adjusted the applicant's proposed deck projection to accurately reflect what was on the drawings presented by the applicant in the application for minor variance as there was an error in what the Committee of Adjustment May 12, 2016 Page 4 applicant had initially applied for. The Committee member was satisfied with this explanation. No one spoke in opposition to the application. Moved by Jim Vinson, seconded by John Bate. "To approve the application to permit the construction of a deck by increasing the maximum permitted deck projection into the required rear yard setback from 1.5 metres to 2.65 metres and by increasing the maximum lot coverage from 45% to 46.5%." "Carried" 3.7 A2016-0030 David & Janice Penney 60 Deerpark Crescent, Bowmanville Part Lot 9, Concession 1 Former Town of Bowmanville David Penney, the applicant, made a verbal presentation to the Committee regarding the application. The explanation for the proposed variance was similar to what was outlined in the report prepared for this application. No one spoke in opposition to the application. There were no questions from the Committee members. Moved by Todd Taylor, seconded by Andre O'Bumsawin. "To approve the application to permit the construction of an addition to a single -detached dwelling by reducing the minimum required rear yard setback from 7.5 metres to 7.2 metres and to permit the construction of a carport by reducing the minimum required side yard setback from 1.2 metres to 0.6 metres as it meets the intent of the Official Plan and Zoning By-law, is minor in nature and is not detrimental to the neighbourhood." "Carried" 4 Adoption of Minutes of Previous Meeting Moved by Todd Taylor, seconded by Andre O'Bumsawin. That the minutes of the regular meeting of the Committee of Adjustment, held on January 21, 2016, be approved. 5 Other Business Committee of Adjustment May 12, 2016 Gord Wallace is away with notice. Appeal date for the foregoing applications is June 1, 2016 Next Meeting of the Committee of Adjustment is June 9, 2016 6 Adjournment Moved by Todd Taylor, seconded by Andre O'Bumsawin.
