Present Were: Mayor A. Foster, Councillor S. Cooke, Councillor R. Hooper, Councillor J. Neal, Councillor W. Partner, Councillor C. Traill, Councillor W. Woo until 11:11 AM Staff Present: C. Clifford, A. Allison, R. Albright, J. Caruana, D. Crome, F. Horvath, M. Marano, N. Taylor, G. Weir, A. Greentree, J. Gallagher, M. Chambers 1 Call to Order Mayor Foster called the meeting to order at 9:30 AM. 2 New Business — Introduction Councillor Neal added a New Business item, regarding outdoor skating rinks, to the New Business — Consideration section of the agenda. 3 Adopt the Agenda Resolution #GG -001-17 Moved by Councillor Neal, seconded by Councillor Hooper That the Agenda be adopted as presented, with the addition of the New Business item regarding outdoor skating rinks; and That the correspondence from Shannon Everett, regarding Report LGL -002-17, OMB Appeal - Fourteen Estates (Newtonville) forwarded by the Municipal Clerk in an email dated January 1, 2017 to Members of Council, be added as Item 9.3, Communication for Direction. Carried 4 Declaration of Interest There were no declarations of interest stated at this meeting. 5 Announcements Members of Council announced upcoming community events and matters of community interest. - 1 - Clarington General Government Committee Minutes January 3, 2017 6 Adoption of Minutes of Previous Meeting Resolution #GG -002-17 Moved by Councillor Hooper, seconded by Councillor Woo That the minutes of the regular meeting of the General Government Committee meeting held on November 28, 2016, be approved. Carried Resolution #GG -003-17 Moved by Councillor Partner, seconded by Councillor Cooke That the minutes of the special meeting of the General Government Committee meeting held on December 9, 2016, be approved. Carried 7 Delegations 7.1 Stuart Day Regarding Report LGL -002-17, OMB Appeal - Fourteen Estates (Newtonville) Stuart Day was present regarding Report LGL -002-17, OMB Appeal — Fourteen Estates (Newtonville). He made a verbal presentation to accompany a handout. Mr. Day explained to the Committee that he is in opposition to the Council decision regarding the location of the park for the Fourteen Estates Development in Newtonville. He added that he has submitted an appeal to the Ontario Municipal Board (OMB). Mr. Day reviewed the guidelines for parks in the Clarington Official Plan and noted that parks should be located as centrally as possible to the areas which they serve. He advised the Committee that he feels many of the residents support the Option 1 location of the park in the draft plan of the subdivision. Mr. Day added that Option 2 moves the park further away from the majority of residents in the area. He explained that the average resident will have a 1.3 kilometre walk to the park with Option 2 and with Option 1 the furthest resident is 530 metres away from the park. Mr. Day reviewed the park access with both locations and noted that the dedication of park land will be reduced by 50% with Option 2. He referred to the Planning Services Report and noted that both Staff and the property owner feel that Option 1 is the best location to serve the community. Mr. Day concluded by noting that he has spoken to many residents and 24 area homeowners have signed his petition in support of Option 1. 7.2 Patricia Likogiannis Regarding Report LGL -002-17, OMB Appeal - Fourteen Estates (Newtonville) Patricia Likogiannis was present regarding Report LGL -002-17, OMB Appeal — Fourteen Estates (Newtonville). She noted that she attended the Committee meeting in June, 2016 and she still has the same concerns with Option 1 as a location for the park. -2- Clartw-n General Government Committee Minutes January 3, 2017 Ms. Likogiannis explained that many of the area residents support Option 2. She stated that she believes both Option 1 and Option 2 are centrally located. Ms. Likogiannis added that she is concerned with the proposed path on Payne Crescent as it is a dangerous location. She explained that she feels Ida Brown Parkette serves the same residents as Option 1, however it is not used as they do not want to cross Highway 2. Ms. Likogiannis believes that Option 2 is more centrally located and is the best option for the area residents. She explained that she is concerned with having a park across from her property as it is will result in increased noise, garbage, and will be used for "partying". Ms. Likogiannis added that she would prefer no park in the area however, if there needs to be a park, that Option 2 is the best option as it is on a quiet crescent and is the safest location. She concluded by stating there is existing greenspace in the area that is used for playing and walking dogs and that Option 2 is an adequate size for the area. Alter the Agenda Resolution #GG -004-17 Moved by Councillor Woo seconded by Councillor Partner That the Agenda be altered to consider Report LGL -002-17, OMB Appeal — Fourteen Estates (Newtonville), at this time. Carried Closed Session Resolution #GG -005-17 Moved by Councillor Woo, seconded by Councillor Partner That, in accordance with Section 239 (2) of the Municipal Act, 2001, as amended, the meeting be closed for the purpose of discussing a matter that deals with: x litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board; and x advice that is subject to solicitor -client privilege, including communications necessary for that purpose. Carried Rise and Report The meeting resumed in open session at 10:28 AM with Mayor Foster in the Chair. Mayor Foster advised that one item was discussed in "closed" session in accordance with Section 239(2) of the Municipal Act, 2001 and no resolutions were passed. -3- Clarington Recess Resolution #GG -006-17 General Government Committee Minutes Moved by Councillor Partner, seconded by Councillor Woo That the Committee recess for 10 minutes. Carried The meeting reconvened at 10:51 AM with Mayor Foster in the Chair. 22.1 LGL -002-17 OMB Appeal - Fourteen Estates (Newtonville) Resolution #GG -007-17 Moved by Councillor Partner, seconded by Councillor Woo That Confidential Report LGL -002-17 be received; January 3, 2017 That paragraph 2 of Resolution #PD -114-16 (as adopted by Council through Resolution #C-191-16) be rescinded; That the Municipal Solicitor be directed to advise the Ontario Municipal Board that the Municipality supports the relocation of the park in Draft Approved Plan of Subdivision 18T-87083 to the 1.16 hectare park site on the north side of the approved Jones Avenue extension (identified as Option 1 in Report PSD -050-16) and that all other conditions of draft approval remain applicable; and That staff be directed to advise all persons who received notice of Council's July 4, 2016 decision of its new position respecting the location of the park. Carried 7.3 Hida Manns Regarding the Durham Environmental Advisory Committee Environmental Awards Hida Manns, Durham Environmental Advisory Committee, was present regarding the Durham Environmental Advisory Committee Environmental Awards. She made a verbal presentation to accompany a handout. Ms. Manns provided an overview of the award and noted that the nominations continue to increase each year. She reviewed the various award categories and explained the nomination process. Ms. Manns concluded by reminding the Committee that the award ceremony is on May 11, 2017. Carried Councillor Woo left the meeting at 11:11 AM. 9 Communications — Direction 9.1 Lynn Dollin, President, Association of Municipalities of Ontario (AMO) — Federal Infrastructure Phase 2 Incrementality Resolution Resolution #GG -013-17 Moved by Councillor Hooper, seconded by Councillor Partner Whereas municipal governments' infrastructure is critical to our collective economic health; And Whereas stable, predictable and formula- based infrastructure funding allows municipal governments to plan and schedule investments in infrastructure; And Whereas Ontario municipal governments have asset management plans which set out a municipality's longer term capital plan which reflects the infrastructure priorities of these asset management plans; And Whereas a federal incrementality rule interferes with municipal long-term infrastructure priorities and diminishes the value of municipal asset planning and management; Now therefore be it resolved that the Municipality of Clarington calls on the federal government to provide long-term, predictable, and formula -based funding in its Phase 2 programs for municipal governments; and That the Municipality of Clarington calls on the federal government to change incremental requirements in Phase 2 to recognize in Ontario that a municipal government' asset management plan meets a municipal incremental infrastructure requirement.
