PUBLIC HEARINGS Proposed Zoning By-law Amendment, Part of Lot 34, Concession 5, former Township of Darlington - Louise Haass The Chairman announced the purpose of the public meeting. As r~ui~ under the new Planning Act (Section 34(12), Council is holding a public meeting prior to either adopting or rejecting the proposed zoning by-law amendment for Part of Lot 34, Concession 5, former Township of Darlington. The Chairman asked if there were any persons present wishing to speak to this matter. No one was present to speak to this amendment. Before proceeding with this matter, the Chairman asked the Clerk to advise on the manner of notice. The Clerk advised that: a) Public Notice was mailed to property owners within 120m of the subject property by March 4, 1988; b) Notice of the public meeting was posted on the property by March 4, 1988; c) The Notice complies with the regulations under the Planning Act. . . . . . ; G.P.A. The Chairman called on the Director of Planning to briefly describe the purpose and effect of the by-law, and how the by-law accomplishes the stated purpose. The proposed zoning by-law amendment would change the zone category of a .32 ha parcel of land in Part of Lot 34, Concession 5, former Township of Darlington, from Agricultural (A) to an appropriate zone to permit the development of one (1) additional non-farm related residential lot. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-law, and that all questions must be asked through the Chair. No questions were asked. The Chairman announced that Committee would now hear from obectors, first explaining that Council wished input prior to a final decision. No one appeared in objection, in support of the application, or on behalf of the applicant. The Chairman asked if there were any persons present wishing to speak to this matter. Five persons indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Clerk to advise on the manner of notice. The Clerk advised that: a) Public Notice was mailed to property owners within 120m of the subject property by March 4, 1988; b) Notice of the public meeting was posted on the property by March 4, 1988; c) The Notice complies with the regulations under the Planning Act. . . . . The proposed zoning by-law amendment would change the zone category of a 2.09 ha parcel of land in Part of Lot 24, Broken Front Concession, former Township of Darlington, from "General Industrial (M2)" to an appropriate zone to permit the development of a hot mix asphalt plant and ready mixed concrete batch plant with open storage for aggregates. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-law, and that all questions must be asked through the Chair. No questions were asked. The Chairman announced that Committee would now hear from objectors, first explaining that Council wished input prior to a final decision. Objectors" Mr. Keith Phillips, R.R. #2, Bowmanville, Ontario, L1C 3K3, advised Committee that he is concerned about additional truck traffic and the noise and fumes caused by such traffic. The land is presently zoned industrial but Mr. Phillips feels that High Tech industry should be sought. He is also concerned about the lack of water in the area. Mr. Phillips distributed a copy of a petition to the Committee. Mr. Harold Whorms, Lot 23 Concession 1, R.R. #2, Bowmanville, Ontario, L1C 3K3, advised the Committee that his family settled in the area to enjoy a country-like style of living. He stated, that the exhaust, noise, traffic and health risks related to this development will have adverse effects on the residents of the Base Line Community. Mr. Irwin Hamilton, Solicitor, 1 Division Street, Bowmanville, Ontario, appeared on behalf of John Simon, requesting that this item be referred back to staff for further report. Mr. Lewis Aldrovandi, 38 Arkona Drive, Toronto, Ontario, informed the Committee that he owns property at the end of Solina Road. He objects to the type of industry being proposed for this area because of the dust and smoke produced. Supporters Mr. & Mrs. A. Schlacht, R.R. #2, Bowmanville, Ontario, forwarded a letter of support to the Committee. They indicate that the land has been zoned industrial since 1913 and property owners should have been aware of this when they purchased their homes. . . . . G.P.A. MInutes PUBLIC HEARINGS - 4 - April 5, 1988 Mr. B. Cummings and Mr. A. Vintins, Miller Paving Limited, stated that their company has been in operation for 50 years and have always enjoyed very positive relationships with the municipalities they are located in. Mr. Cummings stated that their plants are always aesthetically pleasing. Engineering reports must still be submitted to staff and, if there is insufficient water, Mr. Cummings indicated that Miller Paving will drop the ready-mix concrete plant from their proposal. He indicated, that the trucks would never travel on Solina Road or east of the plant on the Base Line. There being no further speakers, the Chairman concluded this portion of the public meeting. ***************************************** Proposed Zoning By-law Amendment, Part of Lot 25, B.F.C., former Township of Clarke - James and Sandra Hendry The Chairman announced the purpose of the public meeting. The Chairman asked if there were any persons present wishing to speak to this matter. Four persons indicated a desire to speak to this amendment. MInutes PUBLIC HEARINGS - 5 - April 5, 1988 The proposed zoning by-law amendment would change the zone category of a 17.5 ha parcel of land in Part of Lot 25, Broken Front Concession, former Township of Clarke, from "Agricultural (A)" to an appropriate zone to permit the development of Twenty-Nine (29) Estate Residential Lots. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-law, and that all questions must be asked through the Chair. No questions were asked. The Chairman announced that Committee would now hear from objectors, first explaining that Council wished input prior to a final decision. Obj ectors Mrs. Lynda MacGregor, P.O. Box 9, Newcastle, LOA 1HO, appeared before the Committee on behalf of Boulton Street and Mill Street residents. They are concerned with the increased volume of traffic this development will generate on Lakeshore Road and Boulton Street, health hazards to their wells and septic systems and the rezoning of prime agricultural land to residential. She stated that there is already land in the area zoned for residential development which has not yet been built on. Mr. Gregory Ward, R.R. #3, Newcastle, Ontario, submitted a letter of objection to this development. He is concerned about the loss of prime agricultural land and setting a dangerous precedent for future developments. He stated that the increased volume of traffic is another concern, because Lakeshore Road is a country road and not designed for heavy traffic. Mr. Ward is also concerned that the septic systems for the development will seep toward the lake. Mr. Irwin Hamilton, Solicitor, 1 Division Street, Bowmanville, Ontario, appeared on behalf of several residents in the area. He stated that, primarily, rezoning agricultural land to residential is poor planning. He indicated that there is poor water supply in the area, the development would require storm sewers, would impact on adjoining land and it does not comply with the Durham Regional Official Plan or the Ministry of Agriculture & Food's Code of Practice. Supporters Agent for the Applicant, Mr. Ron Strike of Strike & Strike, Barristers, 38 King St. W., Bowmanville, Ontario, distributed a letter of support from Farncomb and Reginald Le Gresley. Mr. Strike stated that, because of the harbour being developed, the entire area will be zoned residential. He indicated that Biddle & Associates are investigating the possibility of extending the municipal water with the cost to be borne by the applicant. Also, the applicant is willing to contribute toward the reconstruction and improvement of the roads in the area. Mr. Strike stated that the development would enhance the appearance of the area. . . . . G.R.A. The proposed Neighbourhood Development Plan Amendment would change the designation of a .736 hectare (1.81 acre) parcel of land located in Part of Lot 30, Concession 3, former Township of Darlington, now Courtice Urban Area", from "Convenience Commercial" to "Local Central 'Area." The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-law, and that all questions must be asked through the Chair. Minutes PUBLIC HEARINGS DELEGATIONS - 7 - April 5, 1988 A letter from Mr. Pasquale Gelsomino, Solicitor for Mr. and Mrs. Francesco Long, was read into the record. The concerns raised were that the amendment not affect their lands, that any development not create any new discharge on their lands of water or other material, that Black Creek which runs through their lands is not affected by any new discharge caused by the development, and that no waste or other material whatsoever ends up on their lands or in the creek. Mr. Bill Manson was present on behalf of Courtice Heights Developments Limited to answer questions from the Committee. There were no questions. Ms. Frances Chung, Mr. Frank Goh and Mr. Ken Armstrong, Go Transit, made a presentation to Committee on the GO Transit Bus Route changes. Currently the GO Shuttle Services runs between Bowmanville and Oshawa every 60 minutes,in peak periods. They are recommending that the Bowmanville to Oshawa Shuttle run every 40 minutes with continuing service from Oshawa to the Whitby Rail Station every 20 minutes. It is also recommended that an express service run from Bowmanville to the Whitby Rail Station, along Highway 401, every 40 minutes. Ms. Chung indicated that the bus could run along Highway 2 to Waverley Road if desired, however, Committee suggested that the Liberty Street, Base Line Road, Waverley Road, Highway 401 route would be the preferred route. The Committee advised Ms. Chung to discuss the growth in the Courtice Area with Planning Staff to ensure that the service provided in that area will be adequate. Mayor Winters made a declaration of interest with respect to the delegation of Yvonne Hamlin, Goodman and Carr relating to the South Bowmanville Industrial Park; vacated his chair and refrained from discussion on the subject matter. The Mayor indicated that he has been threatened with legal action if he voted on tbiLlssue~____ ____ Ms. Yvonne Hamlin of Goodman, Carr, appeared before the Committee on behalf of the three owners of the South Bowmanville Industrial Park. Ms. Hamlin brought the Committee up-to-date on the events which have taken place in regard to this application. She stated that in October 1987, Council voted that the rural road cross- section be used for servicing of the development and yet tonight, Committee is recommending the urban road cross- section be used. Ms. Hamlin indicated that the first industry that was to go into the development has been lost because of the amount of time that has lapsed. Mr. Dennis Szechy and Ms. Alina Bridgeman of Inducon Consultants, were present to answer questions. . . . . G.P.A. Minutes - 8 - April 5, 1988 DELEGATIONS Mr. Jim Tedford, Community Relations Officer, Ganaraska Region Conservation Authority, made a presentation to the Committee on the Gypsy Moth Control Program. Me indicated that the Gypsy Moth has entered the Town of Newcastle in numbers large enough to warrant spraying. The moths eat all leaves off trees and needles off pine trees. Mr. Tedford distributed to Committee a handout explaining the approaches to control the problem, the Northumberland County GyP?y Moth Budget, the Nine County Co-operative Gypsy Moth Prqgram, and a copy of an agreement between the Ministry of Natural Resources and the County of Northumberland. Mr. Tedford stated, that the Ministry will pay 75% of direct spray costs and 80% of the administration costs, with the landowner paying the remainder of the spray costs and the municipality paying 20% of the administration costs. He indicated, that in 3 to 4 years one full time employee will probably be needed to monitor the program. The Region.of Durham must support the program and an agreement must be signed before any land can be sprayed. "CARRIED" Resolution HGPA-234-88 Moved by Councillor McKnight, seconded by Councillor Hubbard THAT the Clerk be authorized to purchase a donor plaque as related to the contributors of the Newcastle Fitness Centre and that the necessary funds be drawn from the outstanding balance of the Splash Account, and further that any shortfall in expenditures be drawn from the contingency account. "CARRIED" . ;; G.P.A. Minutes . . . . - 15 - April 5, 1988 OTHER BUSINESS Mayor Winters made a declaration of interest with respect to the Interim Lan~fill Site Search. The Mayor is the owner of land in the vicinity of one of the possible locations of the landfill site. Mr. Dennis Hefferon of Walker, Poole, Milligan, informed the Committee that Metropolitan Toronto is investigating two sites within the Town of Newcastle for an interim LANDFILL SITE. The locations being considered are south of Highway 401 on Lake Road and south of Highway 401 east of Courtice Road. Some Members of the Committee had been informed that the location at Highway 401 and Lake Road was no longer being considered. Mr. Hefferon stated that he would clarify this as soon as possible. The Committee received for information The Municipality of Metropolitan Toronto's Works Committee Report No.5. Resolution HGPA-235-88 Moved by Councillor Stapleton, seconded by Mayor Winters 1. THAT the Council of the Town of Newcastle forthwith, inform the Municipality of Metropolitan Toronto, that it strongly opposes the consideration of any site within the Town of Newcastle for the purpose of a Metropolitan Toronto LandfiI I Faci I ity; 2. THAT Mr. D. Hefferon of the firm of Walker, Poole, Milligan forthwith, continue to monitor the actions of Metropolitan Toronto regarding its search for interim landfill sites in the Town of Newcastle and appear on the Town's behalf as a delegation at any Metropolitan Toronto Committee and/or Council Meetings, where appropriate, to convey the position of the Town of Newcastle; and 3. THAT The Honourable James Bradley, Minister of the Environment be advised of these actions.
