vacated his chair and refrained from discussion on the subject matter. Cbuncillor
Stapleton's In-laws own property and conduct a business across the street from the

The Chairman asked if there were any persons present wishing to speak to this
matter. One person indicated a desire to speak.
Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on
the manner of notice.
The Deputy Clerk advised that:
a) Public notice was mailed to property owners within 120m of the subject
property on February 20, 1989,
b) Notice of the public meeting was posted on the property by February 20, 1989,
and
c) The notice complies with the regulations under the Planning Act.
The Chairman announced that any person wishing further notice of the passage
of the by-law, if passed, to please leave their name, address and telephone
number with the Deputy Clerk before they leave.
The Chairman called on the Director of Planning to briefly describe the purpose
and effect of the by-law, and how the by-law accomplishes the stated purpose.
The purpose and effect of the application is to extend the boundaries of the Hamlet
of Newtonvil1e and permit the development of a twenty-nine (29) lot Residential
Subdivision and Commercial Block.
The Chairman announced that questions may be asked concerning the manner of notice
or the purpose and effect of the by-law and that all questions must be asked through
the Chair.
The Chairman announced that Ccmmittee would now hear from objectors, first
explaining that Council wishes input prior to a final decision.
Mr. W. Frank, General Delivery, Newtonville, Ontario, advised the Committee that he
lives directly across the street from the proposed development and objects only to
the commercial portion of the zoning by-law amendment as he feels that it is not
appropriate.
No one spoke in support of the application.
Mr. R. W. Bruynson, Bruynson Inc., Suite 302, 74 Simcoe Street South, Oshawa,
Ontario, LlH 4G6, appeared before the committee as the Agent for the Applicant. He
noted that a Retail Study Survey and Retail Engineering Report are being
undertaken. He stated that surface and ground water drainage concerns will be
addressed.
The Chairman concluded the public meeting.

The Chairman announced the purpose of the public meeting.

a public meeting prior to either adopting or rejecting the proposed zoning by-law
amendment for Part Lot 35, Concession 3, former Tbwnship of Darlington.
The Chairman asked if there were any persons present wishing to speak to this
matter. No one indicated a desire to speak.

(a) Amend the TOwn of Newcastle Official Plan and Courtice North Neighbourhood
plan by deleting the "Elementary School" symbol from each document, and
(b) Approve a rezoning application to permit the development of a twenty-four (24)
lot residential subdivision.
The Chairman announced that questions may be asked concerning the manner of notice
or the purpose and effect of the by-law and that all questions must be asked through
the Chair.
The Chairman announced that Ccmmittee would now hear from objectors, first
explaining that Council wishes input prior to a final decision.
No one spoke in objection to or in support of the application.

The Chairman announced the purpose of the public meeting.

The Chairman announced that Committee w:>uld now hear from objectors, first
explaining that Council wishes input prior to a final decision.
Mr. R. Baker, R.R. i6, Bowmanville, LIe 3K7, advised the Committee that he lives
directly across the street from the proposed development. He is of the belief that
the approval of this proposal w:>uld create a community within a community. Because
this semi-rural setting is located on a hill, the location of the proposed driveway
w:>uld hinder the view of vehicular traffic by pedestrians, especially children,
thereby creating a hazardous situation. Mr. Baker's preference for the development
of this site, w:>u1d be single family dwellings.

PUBLIC HEARINGS
No one spoke in support of the application.
Mr. Sam Gust, 138 Queen Street, Bowmanville, Ontario, informed the Ccmmittee that
the proposed development is of medium density rather than high density. In order to
address the concerns relating to traffic hazards, the entrance to the proposed site
could be re-1ocated 200 feet north of the proposed location.
The Chairman concluded the public meeting.

amendment for Part Lot 35, Concession 3, former Tbwnship of Darlington.
The Chairman asked if there were any perscns present wishing to speak to this
matter. No one indicated a desire to speak.
Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on
the manner of notice.
The Deputy Clerk advised that:
a) Public notice was mailed to property owners within 120m of the subject
property on March 1, 1989,
b) Notice of the public meeting was posted on the property by March 1, 1989,
and
c) The notice complies with the regulations under the Planning Act.
The Chairman announced that any person wishing further notice of the passage
of the by-law, if passed, to please leave their name, address and telephone
number with the Deputy Clerk before they leave.

PUBLIC HEARINGS
Mr. J. Schmegner, R.R. 14, Bowmanville, Ontario, LIe 3K5, addressed the Committee
and advised that he owns a 156 acre cow-calf operation and mink farm adjacent to this
site. Because of the problems of the vehicular traffic on his property originating
from people visiting Mosport Park, he requested that a buffer zone be established
to separate Mosport Park and his property and that appropriate fencing be installed
by Mosport Park.
No one spoke in support of the application.
Mr. Bernard Kamin, 250 Dundas Street West, Suite 202, Tbronto, Ontario,
MST 2Z5, informed the Ccmmittee that he has never officially received complaints
from nearby residents and cannot control the actions of people outside the
Mosport property. Although he is willing to address the concerns of nearby
residents and arrive at a mutually satisfactory conclusion, it is not his intention
at the present time to fence the boundary line of the proposed area.
The Chairman concluded the public meeting.

The Chairman asked if there were any persons present wishing to speak to this
matter. One person indicated a desire to speak.

objection to this development as long as the existing open ditch remains as is and
is not filled in, because this ditch has been the solution to the drainage problems
encountered in this area.
No one spoke in support of the application.
Mr. David Gillespie, 214 Dundas Street East, P.O. Box 208, Whitby, Ontario, LlN 2H8,
requested that the project be tabled until an Official Plan Amendment is made.

Mayor Hubbard informed the Committee that a meeting will be held at the Regional
Municipality of Durham, Wednesday, April 5, 1989, pertaining to the 911 Emergency
Response Telephone Service. This issue has not been addressed and she requested that
a report by the Fire Department be prepared so that documentation may be presented
to the Region. Councillor Stapleton requested that the report be presented to the
1989 Budget discussions, on Friday, April 7, 1989 for review by the Ccmmittee.

2. Ccncerns respecting the cut-backs on the swimming program for the handicapped -
nursing homes and hospital,
for review by the General Purpose and Administration Ccmmittee.
