As required under the new Planning Act [Section 34(12)], Council is holding
a public meeting prior to either adopting or rejecting the following:
(a) Proposed Zoning By-law Amendment - Part Lot 28, Concession 1, former
Village of Newcastle - Bramalea Limited;
(b) Proposed Zoning By-law Amendment - Part Lot 24, Broken Front
Concession "B", former Township of Clarke - Jack Matthews; and

(c) Proposed Zoning By-law Amendment - Part Lot 14, Concession 1, former
Town of Bowmanville - Timber Bay Properties Inc.
Before proceeding with these matters, the Chairman asked the Deputy Clerk
to advise on the manner of notice.
The Deputy Clerk advised that:
(a) Public notices were mailed to all property owners within 120 metres by
October 18, 1991;
(b) Notices of the public meetings were posted on each of the sites by
October 18, 1991; and
(c) The notices comply with the regulations under the Planning Act.
The Chairman announced that any persons wishing further notice of the
passage of the by-law, if passed, to leave their name, address and telephone
number with the Deputy Clerk before they leave.
The Chairman called on the Director of plHnn;ng and Development to briefly
describe the purpose and effect of the by-laws and how the by-laws
accomplish the stated purposes.
The purpose and effect of the by-laws are as follows:
(a) Bramalea Limited - to permit the development by plan of subdivision of
(25) single family dwelling units, (5) blocks for public open space and (2)
blocks for private open space;
(b) Jack Matthews - to facilitate the creation of one (1) additional non-farm
rural residential lot; and
(c) Timber Bay Properties Inc. - to permit the development of 117
Townhouse units by plan of subdivision.
The Chairman announced that questions may be asked concerning the
manner of notice or the purpose and effect of the by-laws and that all
questions must be asked through the Chair.
The Chairman announced that Committee would hear from the objectors,
then anyone in support, with the applicant speaking last.

(a) Bramalea Limited - Report PD-248-91
Gordon Carveth, 612 Mill Street South, R.R.#8, Newmstle, LIB lLO,
reiterated his concerns which were articulated at the General Purpose
and ArlminiRtration Committee Meeting of July 8, 1991. He advised that
he does not object to the erection of 25 houses as long as the existing
road conflguration remains the same. He is strongly opposed to a four-
lane highway.
Noone spoke in support of this application.
Maureen McCawley, VICe-President, Bra.....,- Limited, 1867 Yonge
Street, Toronto. M4S lY5, advised that Bramalea owns two parcels of
land in this area; 250 acres to the south and 30 acres which represents
the development of this site. Thirteen percent of this parcel will be
residential and the balance will be open space. A traffIC study has been
undertaken by R. V. Anderson and Stage 1 of this report refers to two
alternative road patterns: one four-lane highway or two two-lane
highways.

Noone spoke in opposition to or in support of this application.
Irwin HAmat..... Barrister & Snlicitor, P.O. Box 39, 1 Division Street,
Bowmanville, LIC 3K8, appeared on behalf of the applicant to answer
questions from the Committee.
(c) Timber Bay Properties Inc. - Report PD-250-91
George VICe, 34 Martin Road South, R.R.#6, Bowmanville, LIC 3K7,
advised that he has been a 37-year resident of this area and has never
experienced a problem with his well He noted that if the grading is
altered this could create pollution of surrounding wells. He suggested
that fencing be installed in order to protect his land from people
operating snowmobiles and dirt bikes. He expressed disapproval of the
"dust bowl" created by the construction in the summertime.
Noone spoke in support of this application.
Bob Annaert, D.G. Biddle & J\"""";Ates, 96 King Street East, Osbawa,
LlH 1B6, advised that preliminary grading and engineering plans are
being prepared. He noted concurrence with the recommendations
contained in Report PD-250-91.

pursuant to her written request of June 28, 1990 that a tree be planted
on her property, she has made several verbal requests to various
members of Staff of the Town of Newcastle and, to date, no tree has
been planted.
(b) Reg Webster, G.M. Bernas & .,A"".".;gt-es Ltd, 110 Scotia Crt., Unit 41,
Whitby, LlN 8Y7, circulated a letter dated November 13, 1991 on behalf
of a Committee representing approximately 28 developers, the Urban
Development Institute (UD!) and Durham Home Builders Association
(DHBA). The letter recommends some 35 suggested revisions to the
Town of Newcastle subdivision agreement. Mr. Webster requested that
Staff review the proposal, meet with the Committee on this matter and
that a subsequent report be submitted to Council in January, 1992.

ADMINISTRATION CONT'D.
THAT Recommendation 13 should be clarified with respect to the
question of a potential for a fmancial gain or loss;
THAT Recommendation 15 not be adopted and in its place each council
be given the power by by-law to assign a dollar value to the term
"remote or insignificant";
THAT Recommendation 30 insofar as it would remove the present saving
provision from the Act respecting "inadvertence' or "bona flde error of
judgement" not be adopted;
THAT Recommendation 37 respecting the oath of office of a member not
be adopted;
THAT the Ministry establish an advisory service available free of charge
to members of Councils to provide advice as to the interpretation of the
Act and whether the disclosure and abstention requirements of the Act
apply in the particular circumstances. The Act should be amended to
provide that a member relying on the advice given by the Ministry's
advisory service should be deemed not to violate the Act if the advice is
followed in good faith;
THAT Recommendation 16 should be amended to permit a council by
by-law to determine a "community of interest" of the ward councillors
with the electors of the ward generally in advance of the consideration by
council of a particular matter. If such a by-law is passed, the Act should
provide that the ward councillors concerned may participate in the
consideration and decision on the matter in question without
contravening the Act;
THAT Recommendations 33 and 34 be amended to provide for flnancial
support to municipalities by the provincial government, to allow the
municipalities to consider, prepare and tailor-make a code of employee
conduct which is suitable for the municipality in question;
THAT Recommendation 32 should not be adopted in its present form but
rather that each municipality should be given a permissive power by
by-law to prohibit the employment of a former member of Council by the
municipality concerned, for a period of time which would be set out in
the by-laW;
THAT Recommendation 36 should not be adopted until Council has a
greater opportunity to consider its implications than the opportunity that
has been made available to it by the Minister to this date; and
