Resolution #GPA-620-91 Moved by Councillor Wotten, seconded by Councillor Stapleton THAT the minutes of a regular meeting of the General Purpose and Administration Committee held on September 23, 1991 be approved. nCARRIEDIt As required under the new Planning Act [Section 34(12)], Council is holding a public meeting prior to either adopting or rejecting the following: (a) Proposed Zoning By-Jaw Amendment - Part Lot 14, Concession 1, former Town of Bowmanville - 542985 Ontario Limited; (b) Proposed Zoning By-Jaw Amendment - Part Lot 25, Broken Front Concession, former Township of Darlington - Keith Crago; and 20J G.P.& A Minutes . PUBLIC MEETINGS . . - 2- October 7, 1991 (c) Proposed Zoning By-Jaw Amendment - Part Lot 28, Concession 2, former Village of Newcastle - Durham Region Non-Profit Housing. Before proceeding with these matters, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that: (a) Public notices were mailed to all property owners within 120 metres by September 12, 1991; (b) Notices of the public meetings were posted on each of the sites by September 12, 1991; and (c) The notices comply with the regulations under the Planning Act. The Chairman announced that any persons wishing further notice of the passage of the by-Jaw, if passed, to leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of plRnning and Development to briefly describe the purpose and effect of the by-Jaws and how the by-Jaws accomplish the stated purposes. The purpose and effect of the by-Jaws are as follows: (a) 542985 Ontario Limited - to permit the development of 22 townhouse units; (b) Keith Crago - to permit the existing dog kennel; and (c) Durham Region Non-Profit Housing - to permit the development of one semi-detached dwelling (two units), to be used by developmentally handicapped persons. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-Jaws and that all questions must be asked through the Chair. The Chairman announced that Committee would hear from the objectors, then anyone in support, with the applicant speaking last. "11")7 LV___ . . . G.P.& A Minutes PUBLIC MEETINGS - 3 - October 7, 1991 (a) 542985 Ontario Limited - Report PD-224-91 Gord Baker, 71 Martin Road South, &.&.#6, Bowmanville, LlC 3K7, circulated a letter dated October 3, 1991 opposing the application for the following reasons: - the erection of 22 townhouses which face north with their hack yards abutting the existing neighbourhood's north fence line - the location of a garbage disposal area directly in front of his home - increased noise level generated from traffIC; and - the proposed type of fencing along the hack yards. He added the area is currently zoned to allow single family and linked units and should stay that way. Noone spoke in support of this application. Bryce Jordan, G.M. Sernas and A~t""\ 110 Scotia Court, Unit 41, Whitby, L1N SY7, dispJayed a map of the Bowmanville Urban Area and a Site Plan, noting that the junction of Martin Road and Highway #57 will eventually be closed off. He advised that a development of 22 townhouses is appropriate for this site and that the consultant has spent 2-1/2 years trying to address the concerns of the surrounding residents. There will be 56 parking spaces for the 22 townhouse units and the garbage bin will be enclosed in a structure. The height of the fence will be reduced and the architecture of the houses be of a modernized victorian appearance. (b) Keith Crago - Report PD-225-91 Noone spoke in opposition to or in support of this application. The applicant was called but was not present. (c) Durham Region Non-Profit Housing - Report PD-226-91 John Garvin, 20 Andrew Street, Newcastle, L1B 1J4, reiterated his concerns of September 9, 1991 to the Committee which include: - surrounding lots are too 1arge - the slope of the property is too great - decrease property values - increased violence - loss of view - residents are from Ajax and Whitby rather than from the Town of Newcastle. Jean Graham, Durham Growers, 345 Mill StreetNorth, NewcastJe, LlB 1J3, appeared on behalf of Durham Co-op Cold Storage located across the street from the proposal. She suggested that the width of the street, Jack of sidewalks and the truck traffic are all safety hazards to the future residents of the facility. Z03 G.P.& A Minutes . PUBLIe MEETINGS . . - 4 - October 7, 1991 Narda HnogJ<arnp, 276 Mill Street North, NewcastJe, L1B 1J3, considers this area to be a "hazard area" and questioned the Ganaraska Region Conservation Authority's approval of this application. She also questioned the "Public Meeting' process wherein people opposed to an application speak fll'st with the applicant speaking last. She advised that applicants' comments are sometimes erroneous and residents opposing the project are not given the opportunity to cha1lenge these comments. Thomas Nortoo, 66 Andrew Street, NewcastJe, L1B 1J3, expressed concerns pertaining to water runoff from the creek in the spring time and additional parking and vehicular traffIc generated by the trucks to and from the Durham Co-op Cold Storage. An area I""$idPnt questioned why this type of development could not be undertaken in an area already zoned for this purpose. Darren Carswell, 32 Andrew Street, Newcastle, LlB 1J3, expressed the following concerns: - the slope of the property will have to be altered which will adversely affect his property - loss of view - train tracks are a threat; and - property values will decrease. Two letters of support for this proposal were circulated, one dated October 6, 1991 from Ronn Young, Pastor, Newcastle Fellowship Baptist Church and one from Marlene Spruyt dated October 4, 1991. Valerie Cramner, Durham Region Non-Profit Housing. 1615 Dundas Street East, 4th Floor, Lang Tower, Whitby, L1N 6A3, advised that several sites had been studied and this is the most appropriate site for the proposed facility. She advised that the offer of purchase for the land is conditional upon the rezoning application being approved. The architect dispJayed an Artist's Rendering and floor plans of the project. There will be five bedrooms in each unit therefore accommodating five clients per unit of the semi-detached dwelling. Distinct patios on either side of the building and mature trees will complement the structure. This will be a group home for developmentally handicapped individuals who have some physical disabilities as well. She requested that the Committee table Report PD-226-91 until such time as the applicant has had the opportunity to address the concerns of the surrounding residents. 204- G.P.& A Minutes . DELEGATIONS . . - 5- October 7, 1991 (a) Alex Scott, 61 TownIine Road South, Courtice, L1E 2J1, introduced Robert who addressed the Committee and requested permission, as part of a Community reJated environmental project, to paint small caution yellow fish over storm drains. These fish would serve to remind citizens to correctJy dispose of their hazardous household waste. Too many people change their oil or anti-freeze and carelesaly allow these materials to drain on the ground and eventually into the sewer system. If a cautionary yellow fish was dispJayed on the curb over the sewer, people would consider the proper method of disposal instead of the easy way out. (b) Debbie Nowlan, 29 Jones Avenue, Newtonvi1Ie, appeared on behalf of Ken Slater, Kinrow Investments Inc., and described the history and background of the application for the Newcastle Family Resource Centre. She advised that, on September 11, 1991, a meeting was held with Mr. R. Willsher, Planning Staff and the applicant wherein 13 of the 16 demands made by the residents were met by the applicant. She advised that the applicant has shown great patience in an honest attempt to meet all of the concerns of the residents and requested that the application be processed as expeditiously as possible. "CARRIED" . )14 . . . G.P.& Jl Minutes FIRE DEPARTMENT - 15 - October 7, 1991 Mayor Hubbard chaired this portion of the meeting. As chairman of the Fire Department, Mayor Hubbard addressed the issue of the resignation of the Deputy Fire Chief and introduced Mr. D. M. Carr, Fire Services Advisor, Fire Advisory Services, Office of the Fire Marshal, who circulated a document dated December 10, 1990 entitled "Review of Municipal Fire Services". Mr. Carr made a presentation on the factors to be considered during a review of the Municipal Fire Services. The review would include an evaluation of the organization, methods, practices, staffing, apparatus, equipment, communications, fll'e stations of the municipality, fire prevention and other appropriate by-Jaws, water supply for fll'e suppreasion purposes and traffic conditions which affect fll'e department operations. The Master Plan would take approximately six months from start to finish and would be conducted at no cost to the municipality.
