Resolution #GPA-552-91 Moved by Councillor Wotten, seconded by Councillor Hannah THAT the minutes of a regular meeting of the General Purpose and Administration Committee held on July 22, 1991 be approved. "CARRIED" As required under the new Planning Act [Section 34(12)], Council is holding a public meeting prior to either adopting or rejecting the following: (a) Proposed Zoning By-Jaw Amendment - Part Lots 33 and 34, Concession 2, former Township of Darlington - 765400 Ontario Limited; (b) Proposed Zoning By-Jaw Amendment - Part Lot 28, Concession 2, former Village of Newcastle - Durham Region Non-Profit Housing; 7.l ; . . . Before proceeding with these matters, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that: (a) Public notices were mailed to all property owners within 120 metres by August 9, 1991; (b) Notices of the public meetings were posted on each of the sites by August 9, 1991; and (c) The notices comply with the regulations under the Planning Act. The Chairman announced that any persons wishing further notice of the passage of the by-Jaw, if passed, to leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of Planning and Development to briefly describe the purpose and effect of the by-Jaws and how the by-Jaws accomplish the stated purposes. The purpose and effect of the by-Jaws are as follows: (a) 765400 Ontario Limited - to permit the development by way of Plan of Subdivision of 95 single family lots and 50 street townhouse units; (b) Durham Region Non-Profit Housing - to permit the development of a semi-detached dwelling; (c) 841221 and 841222 Ontario Ltd. - to permit, through a phased development, a fully integrated resort hotel, conference facilities, condominiums and retail commercial facilities; and (d) 921010 Ontario Limited (Westlake) - to permit the development of a Plan of Subdivision consisting of 40 residential lots. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-Jaws and that all questions must be asked through the Chair. The Chairman announced that Committee would hear from the objectors, then anyone in support, with the applicant speaking last. In''; L ,i l, . . . G.P.& A Minutes PUBLIC MEETINGS - 3- September 9, 1991 (a) 765400 Ontario Limited - Report PD-189-91 Noone spoke in opposition to or in support of this application. The applicant was called but was not present. (b) Durham Region Non-Profit Housing - Report PD-190-91 Darin Carswell, 32 Andrew Street, NewcastJe, LlB 103, informed the Committee that he was advised by a real estate agent, before purchasing his home, that this property could not be zoned to allow this development. He requested clariflClltion pertaining to various aspects of the application and noted a concern pertaining to devaluation of his property should this proposal be approved John Garvin, 20 Andrew Street, NewmstJe, LlB 1J4, is presently building a house located on a lot which backs onto this proposal. He indicated that a Needs Assessment Study has not been done and that this facility is being built to accommodate developmentally handicapped residents from Ajax and Whitby who are now housed in a Cobourg facility which is being phased out. He noted that the facility does not have the appearance of a duplex but looks like an institution. Narda Hoogk""'P> 276 Mill Street North, Newcastle, LlB 1J3, who lives west of the proposed development, indicated that this dwelling is not compatible with the existing residential pattern. She questioned paragraph 6.3 of Report PD-190-91 which states that the Ganarasks Region Conservation Authority has no objection to the proposal. She was advised by this Authority, upon her request for a lot severance, that this area is considered to be a "hazard area". She questioned whether this facility will eventually become a "halfway house". Jean Graham, Durham Growers, 345 Mill Street North, Newcastle, LlB 1J3, appeared on behalf of Durham Co-op Cold Storage located across the street from the proposal. She noted concerns pertaining to the safety of residents due to the heavy truck traffic emanating from this business establishment and made reference to the constant noise from the cooling fans operating in this building. A resident conf1l'ffied that there are 10 - 12 trucks every morning driving in and out of Durham Co-op Cold Storage and cIarification was requested on details of the application. A resident of Mill Street questioned if free water and sewer connections would be offered to local residents if this application is approved. Noone spoke in support of this application. PUBLIC MEETINGS . . - 4- September 9, 1991 Valerie Cranmer, Durham Region Non-Profit Housing Corporation, 1615 Dundas Street East, .th Floor, Box 623, Whitby, LlN 6A6, introduced the Architect, Janis McElrea and Ann Beauclerc of the D' Arcy Place Development Centre. An artist's rendering and floor plans of the project were dispJayed for the benefit of the Committee. The architecture of the building will complement the existing neighbourhood by giving the appearance of a ranch bungalow. These two five-bedroom units are separated by a solid wall with no access between units other than through the front or back door. The building is located 25' from the road allowance and parking on each side of the building will accommodate two vehicles per unit. Each unit has a separate entry and a separate patio in the backyard. Each unit is designed to accommodate five clients ranging in age from 25 - 50. Forty percent of the lot area in the backyard will be open space. The applicant is of the opinion that a significant amount of fencing is unwarranted. A meeting with local residents was held and the applicant will attempt to address their concerns which pertain to architectural design of the building and hedges versus fencing. The building will be owned by Durham Non-Profit Honsing but managed by D'Arcy Place Development Centre who have been in existence in Cobourg since 1940 and operate under the guidelines of the Ministry of Consumer and Commercial ReJations. (c) 841221 and 841222 Ontario Ltd. - Report PD-191-91 Noone spoke in opposition to this application. Bill Stewart, 25 Bennett Road, BowmanvilJe, LIe 3K5, resides in close proximity of this proposed development and referred to this project as being "long overdue". He is willing to contribute his time and effort towards helping to bring this project to fruition. His main concern is with the additional traffic and he requested that no motorized vehicles be allowed on the trails. Larry Gold, Walker, Gold, Fox & Schwarz, Barristers & Solicitors, 2040 Yooge Street, Snite 300, Toronto, M4S lZ9, appeared on behalf of the applicant and advised that considerable refmement has been undertaken since the initiation of this application 18 months ago, due to the multi- government levels and new concepts in terms of waterfront development. Clarification of governmental policies and the application of policies which conflict with one another has made the process more difficult. A Preliminary Landscape Plan and Preliminary Grading Plan of "Newcastle on the Lake Hotel and Condominium Resort" were dispJayed with the following Site Statistics: - Total Site Area: 57.20 acres - Crombie Trail Area: 5.06 acres - Public Park Area: 6.79 acres The applicant is willing to co-operate and work with Staff in an endeavour to meet the Ministry of the Environment and Conservation Authorities guidelines and standards. PUBLIC MEETINGS . . - 5 - September 9, 1991 The Committee was informed that the scheme dispJayed is the sixth project undertaken by the applicant since application was made 18 months ago. Lands towards the lake will be used by the public who will enjoy waterfront trails and walking paths. To maximize the view of the lake, the site offers 10 acres or more of clear land. Density of buildings is still under review. Mr. Gold requested that the Committee take positive steps to resolve the policy inconsistencies of governmental agencies and determine the steps to be taken to move matters along more quickly. Councillor Wotten made a declaration of interest with respect to the following matter; vacated his chair and refrained from discusSion and voting on the subject matter. Councillor Wotten owns property in close proximity of the subject site. (d) 921010 Ontario Limited (Westlake) - Report PD-192-91 James H. Kapteyn, 6168 Solina Road, R.R.#I, Hampton, LOB lJO, a resident of SoJina Village since 1974, was present on behalf of a number of residents of SoJina Village. He referred to a petition dated June, 1987, with approximately 130 signatures rejecting the concept of SoJina being a "Hamlet for Growth". He noted the need for a greater industrial base since his property taxes have increased by 700% since 1974. His concerns include the loss of farmland, monitoring of water supply and the Jack of justification for designating additional residential zoning. He requested that the Committee retain the present zoning designation. Jean Behan, 198 Switzer Drive, Osbawa, appeared on behalf of I. and C. Bray, Mr. and Mrs. G. Bray, Mr. and Mrs. J. Gordon and Mrs. J. Smithson and advised of her support for this application for the following reasons: - better for taxes - 70% of farmland has not been farmed for 20 years - no problems with water supply have been experienced by local residents - the area can easily accommodate the additional traffIC generated by 40 additional homes. She advised that she is a real estate agent. Conroy Dowson, Conroy Dowson plAnning Consultants, 203 Rushton Road, Toronto, MOO 3J2, appeared on behalf of the applicant and circulated documentation containing 71 signatures of persons who have no objection to the proposed Westlake residential development for the hamlet of Sollna. He introduced his co-ordinating team consisting of a hydrogeologist, civil engineer, agronomist and entrepreneur. He advised that all technical issues reJating to the Ministry of Health, Ministry of the Environment, Ministry of Natural Resources, Conservation Authorities and Regional Works can be adequately addressed and resolved. He stated that the Hamlet of SoJina is the only Hamlet which will access the proposed 401 interchange to the south. '-') (' :"" /, I"', . . . G.P.& A Minutes PUBLIC MEETINGS DELEGATIONS - 6- September 9, 1991 The former planning history of the Hamlet of Solina indicates that originally, lots were approximately 1/4 acre in size; at a Jater stage, the norm became 3/4 of an acre and, the application being considered, would generate 1 1/4 acres per lot - this will not adversely impact the structure of the Hamlet. He noted that the integrity of the agricultural land is not in jeopardy since a great percentage of the land is not being farmed at the present time. A map of the present Hamlet of Solina was dispJayed and it was noted that there will be a cooling pond and that parkland will be dedicated according to the Town's requirements. (b) Conroy Dowsan, Conroy Dawson Pbmnmg Consultants, 203 }b'Rhtnn Road, Toronto, MOO 3J2, re: Report PD-l28-91 - appeared on behalf of Steve PustiJ, President, Penwest Developments, 390 Bay Street, Suite 1710, Toronto, M5H 2Y2, and referred to a decision made by Council on June 10, 1991 pertaining to the denial of a revised Plan of Subdivision 18T-76011. He requested that the matter be referred back to Staff to allow the applicant to negotiate a more suitable solution. (c) Kevin Tunney, Tunney ptAnn;ng, 340 Byron Street South, Whitby, LlN 4P8, re: Report PD-194-91 - appeared on behalf of Stolp Homes and North Development Group and requested that these two developers be excluded from any consideration of further deJay by the Town for zoning and official plan amendment applications. (d) John Wallace, 52 West Beaeh, Bowmanville, LIe 3Ka, re: Report PD-209-91 - requested that the Committee approve his application to amend the Town of Newcastle Comprehensive Zoning By-Jaw by allowing him to demolish the existing fll'e damaged dwelling and to construct a new single detached dwelling. He referred to paragraph 2.1 of Report PD-209-91, stating that the measurement of "833 sq. ft." was erroneous. He noted that the Town of Newcastle Public Works Department, Town of Newcastle Fire Department, the Regional Works Department and the Regional Planning Department have not provided negative comments with respect to the proposed zoning by-Jaw amendment. However, the Community Services Department has recommend that the application be deferred until the Town's Waterfront Study and the Royal Commission's Study have been completed. His year round residence has been destroyed by fire and if he is not allowed to rebuild he cannot collect the remainder of his insurance claim. Jr( L- ' ! ,~_; . . .
