Resolution #GPA-326-91 Moved by Councillor Stapleton, seconded by Councillor Deegan THAT the minutes of a regular meeting of the General Purpose and Administration Committee held on May 6, 1991 be approved. "CARRIED" As required under the new Planning Act [Section 34(12)], Council is holding a public meeting prior to either adopting or rejecting the following: (a) Proposed Zoning By-law Amendment - Part Lot 9, Concession 2, former Town of Bowmanville - McDonaldIFarrow; (b) Proposed Zoning By-law Amendment - Courtice West Highway No.2 Corridor Study; and G.P.& A Minutes . PUBUC MEETINGS . . - 2 - May 21, 1991 (c) Proposed Zoning By-law Amendment - Part Lot 8, Broken Front Concession, former Town of Bowmanville - Carholme Investments Ltd. Before proceeding with these matters, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that: (a) Public notices were mailed to all property owners within 120 metres by April 19, 1991; (b) Notices of the public meetings were posted on each of the sites by April 19, 1991; (c) With respect to Application DEV 90-094; the Public Notice was mailed to all property owners in accordance with the latest municipal assessment records by April 30, 1991; and (d) The notices comply with the regulations under the Planning Act. The Chairman announced that any persons wishing further notice of the passage of the by-law, if passed, to leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of Planning and Development to briefly describe the purpose and effect of the by-laws and how the by-laws accomplish the stated purposes. The purpose and effect of tbe by-laws are as follows: (a) McDonaldJFarrow - to permit the development of four (4) semi-detached dwelling units; (b) Courtice West Highway No.2 Corridor - to implement part of the recommendations of the Highway No.2 Corridor Study; and (c) Carholme Investments Ltd. - to permit the development of a 363 sq.m. Lube Warehouse and offICe for bulk sale and storage of petroleum. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-laws and that all questions must be asked through the Chair. The Chairman announced that Committee would hear from the objectors, then anyone in support, with the applicant speaking last. 202 G.P.& A Minutes . PUBLIC MEETINGS . . - 3 - May 21, 1991 (a) McDonald/Farrow - Report PD-113-91 Paul Riggin.., 32 Mann Street, Bowmanvi11e, LIC 2H5, spoke on behalf of some of his neighbours and stated his preference for link homes rather than semi-detached dwe1lings. He advised that the erection of semi-detached homes would devalue the surrounding properties and would be a detriment to the established neighbourhood. Ke1Iy Marr, 21 Mann Street, Bowmanvi11e, LIC 2H, noted her preference for link homes and expressed concern that semi-detached houses might remain unsold and empty which would be a detriment to the quality and comfortable atmosphere of the surrounding area Noone spoke in support of this application. (b) Courtice West Highway No.2 Corridor - Addendum to Report PD-3-91 Lucy N"lfliadJik, 10 Bridle Court, Courtice, LlE 2B1, circulated fIve letters of objection to this proposal and read the contents of her letter dated May 21, 1991 wherein she notes the following concerns: - a preference for the erection of single family homes by the same builder - devaluation of her home if multi-family and medium-density dwelling units are built greater traffic congestion in the areas of Nash Road and Townline Road an increase in crime and vandalism and loss of safety for her children opposition to a walkway leading to Highway No.2 or to Townline Road Strong opposition to any taverns, pinball arcades or video game outlets which would have the potential of becoming 'local hangouts' for juveniles - appropriate lighting should plazas or offICe buildings be permitted - opposition to garbage being stored behind these buildings. She advised that the residents' concerns are genuine and legitimate and should be taken into consideration as various developers' applications are submitted and considered. Alins Bridgeman, Carholme Imestmeots Ltd, 805 T ...k......moe Blvd. E_, Toronto, M4M 1B2, introduced representatives from Imperial Oil Limited in attendance at the meeting and displayed an Artist's Rendering of the proposal She advised that the previous application received so much opposition from surrounding residents that a new 1.5 acre site was found at the comer of Butler Court and Lake Road. She explained that the Zoning By-law Amendment was being requested to permit a 363 square metre Lube Warehouse and Office for bulk sale and storage of petroleum. This would entail a 24 hour per day operation only for the use of commercial operators. The visual amenity of the site would be protected due to the slope of the land. She requested that the Committee give favourable consideration to this proposal. (a) John Ril-kpll. 93 Liberty Street North, Bowmanvil1e, Lle 2L8, noted concurrence with the contents of Report CS-22-91. (b) Jayson Schwarz, 2040 Yooge Street, 3rd Floor, Tonmto, M4S 1Z9, re: Report PD-114-91 advised that he is in receipt of a letter dated May 14, 1991 from the Senior Municipal Law Enforcement Officer requesting adherance to the Property Standards By-law by removing all the debris from the site located at Temperance and We1lington Streets. He advised the Committee that he is involved in a law suit and is financially unable to adhere to the Town's request until such time as the legal proceedings have been resolved. He requested that the Town effect the clean-up of the property and place related costs on the Tax Roll for this property. OTHER BUSINESS . . - 12- May 21, 1991 Resolution #GPA-350-91 Moved by Councillor Stapleton, seconded by Councillor HAnnAh THAT Sta1f investigate the possibility of inserting a clause in the Town's Standard Agreement which would require an applicant to issue a Performance Bond or Letter of Credit to be applied towards the cost of the removal of debris from the property after demolition has taken place, if the applicant fails to meet his obligations.
