THAT the minutes of a regular meeting of the General Purpose and
Administration Committee held on April 22, 1991 be approved.

As required under the new Planning Act [Section 34(12)], Council is holding
a public meeting prior to either adopting or rejecting the following:
(a) Proposed Zoning By-law Amendment - Part Lot 30, Concession 3, former
Township of Darlington - G .M. Sernas & Associates on behalf of 715982
and 727114 Ontario Limited; and
(b) Proposed Zoning By-law Amendment - Part Lot 10, Broken Front
Concession, former Town of Bowmanville - John Wallace.

The Chairman asked if there were any persons present wishing to speak to
these matters. Several people indicated a desire to speak.
Before proceeding with these matters, the Chairman asked the Deputy Clerk
to advise on the manner of notice.
The Deputy Clerk advised that:
(a) Public notices were mailed to all property owners within 120 metres by
April 2, 1991;
(b) Notices of the public meetings were posted on each of the sites by
April 2, 1991; and
(c) The notices comply with the regulations under the Planning Act.
The Chairman announced that any persons wishing further notice of the
passage of the by-law, if passed, to leave their name, address and telephone
number with the Deputy Clerk before they leave.
The Chairman called on the Director of Planning and Development to briefly
describe the purpose and effect of the by-laws and how the by-laws
accomplish the stated purposes.
The purpose and effect of the by-laws are as follows:
(a) G.M. Sernas & Associates on behalf of 715982 & 727114 Ontario Limited
- to rezone a 0.68 acre property from "Agricultural" to "Holding-Urban
Residential Type 3 '(H)R3" as a result of a proposed rea1ignment of a
proposed street in a plan of subdivision; and
(b) John Wallace - to rezone a 1784 square metre lot from "Residential
Shoreline Exception "RS-1" and "Environmental Protection (EP)" to allow
the construction of a single family dwelling previously destroyed by fire.
The Chairman announced that questions may be asked concerning the
manner of notice or the purpose and effect of the by-laws and that all
questions must be asked through the Chair.
The Chairman announced that Committee would hear from the objectors,
then anyone in support, with the applicant speaking last.

No one spoke in opposition to or in support of this application.
Tooy BigIieri, G.M. Bernas & A................ 110 Scotia Court, Unit 41,
Whitby, LlN 8Y7, appeared on behalf of the applicant to answer
questions from the Committee and noted concurrence with the
recommendations contained in Report PD-106-91.
(b) John Wallace - Report PD-107-91
Noone spoke in opposition to or in support of this application.
John Wa1lare, 52 West Beach Road, Bowmanville, L1C 3K3, the
applicant, referred to Paragraphs 7.2 and 7.3 of Report PD-107-91 and
informed the Committee that his property has not been affected by
shoreline erosion. He advised that he had been living in the dwelling on
a permanent basis until it was destroyed by fire and it is his intention to
build a new house as soon as possible because his insurance company
has indicated that coverage only applies for one year from the date of
destruction by fire. He indicated that he would be willing to entertain a
reasonable otTer of purchase for his property from the Town of
Newcastle. He would also be willing to dedicate some portion of his land
for the purposes of a road allowance but would prefer that the road be
widened to the north.
(a) Kevin Tunney, Tunney Planning, 340 Byron Street South, Whitby,
LlN 4P8, appeared on behalf of Liza Developments and indicated support
for the recommendations contained in Report PD-108-91. He advised that
this project received draft approval approximately two years ago and that
the application now being considered by the Committee has been
amended to increase the subdivision by 16 units which, in his estimation,
provides a more equitable mix of housing. He requested the Committee's
approval of the application.

THAT the application to amend the Town of Newcastle Comprehensive
Zoning By-law 84-63, as amended, submitted by G.M. Sernas and

back to Sta1f for further processing and the preparation of a subsequent
report upon receipt of all outstanding comments; and
THAT the Durham Region Planning Department, all interested parties
listed in Report PD-106-91 and any delegation be advised of Council's
decision.
