As required under the new Planning Act [Section 34(12)], Council is holding
a public meeting prior to either adopting or rejecting the following:
(a) Proposed Official Plan Amendment and Zoning By-law Amendment _

(b) Proposed Zoning By-law Amendment - Part Lot 31, Concession 2, former
Township of Dar1ington - Claret Investments;

(c) Proposed Official Plan Amendment and Proposed Zoning By-law
Amendment - Part Lot 8, Broken Front Concession "A", former Township
of Clarke - Heritage Durham Development Corp.; and
(d) Proposed Zoning By-law Amendment - Part Lot 35, Concession 2, former
Township of Dar1ington - N ewcastJe Townline Centre.
The Chairman asked if there were any persons present wishing to speak to
these matters. Several people indicated a desire to speak.
Before proceeding with these matters, the Chairman asked the Deputy Clerk
to advise on the manner of notice.
The Deputy Clerk advised that:
(a) Public notices were mailed to all property owners within 120 metres by
March 8, 1991;
(b) Notices of the public meetings were posted on each of the sites by
March 8, 1991; and
(c) The notices comply with the regulations under the Planning Act.
The Chairman announced that any persons wishing further notice of the
passage of the by-law, if passed, to leave their name, address and telephone
number with the Deputy Clerk before they leave.
The Chairman called on the Director of Planning and Development to briefly
describe the purpose and effect of the by-laws and how the by-laws
accomplish the stated purposes.
The purpose and effect of the by-laws are as follows:
(a) Roadside Developments Ltd - to permit the development of a six (6)
storey - eighty nine (89) unit condominium apartment building with 433
square metres of ground floor commercial uses;
(b) Claret Investments - to permit the development by Plan of Subdivision,
of seven (7) single family dwelling lots, one (1) two family dwelling lot
and sixteen (16) townhouse dwelling units, totalling 25 dwelling units;
(c) Heritage Durham Development Corp. - to permit the development by
Plan of Subdivision, of twenty-one (21) single family detached dwelling
lots and a commercial block; and
(d) Newcastle Townline Centre - to permit the development of a
commercial/retail plaza with ground floor retail/commercial uses and
second floor office uses.

The Chairman announced that questions may be asked concerning the
manner of notice or the purpose and effect of the by-laws and that all
questions must be asked through the Chair.
The Chairman announced that Committee would hear from the objectors,
then anyone in support, with the applicant speaking last.
(a) Roadside Developments Ltd. - Report PD-64-91
Joe Duesbmy, 122 Duke Street, Bowmanvi11e, LlC 2W2, who resides
across the street from the proposal, noted various concerns pertaining to
entrances, shadow effect of the proposed building, construction debris on
the roads, architecture of the building, garbage and the possibility of the
site becoming a hangout for teenagers.
Noone spoke in support of this application.
Allan Rae, 510 Eastern Avenue, Toronto, M4M 1C7, displayed an artist's
rendering of the proposed building which will be six storeys high and
located on Baseline Road between Liberty Street and Duke Street.
Liberty Street and Baseline Road will access the site and it was noted
that a 3-metre appropriation for widening will eventually have to be
made. Shadow studies of the project will be submitted to the Town in
the near future. The developer will ensure that roads are maintained
and kept clear of construction debris and mud. Adequate storage will be
provided on the site. The developer has purchased a property on the
north west comer of Duke Street, adjacent to the park, which will
improve siting and access and allow for a better frontage. The applicant
will provide a fInal plan for site development review in the near future.
(b) Claret Investments - Report PD-65-91
EvyIin Stroud, 89 Little Avenue, BowmanvilJe, LlC 1J9, requested
clarification of paragraphs 6.2 and 6.4 of Report PD-65-91 pertaining to
Conservation Authorities.
No one spoke in support of this application.
The applicant addressed the Committee and expressed a desire to resolve
all concerns.
(c) Heritage Durham Development Corp. - Report PD-66-91
R. Kaiser, 27 Garrock Avenue, Toronto, M4K 1M!, advised that he has,
for seven years, owned thirteen acres of land to the west of this proposal.
He questioned whether this development is compatible with the planning
principles of the Master Plan. This parcel is composed of prime
agricultural land and should remain as is. He stated that this project
may be profItable in the short term but questioned whether it is right
for the community at large.

R. Tismaresky, 4617 T ...k....hore Road, R.R.#8, Newcastle, LlB lLO,
advised that he, since 1953, has owned agricultural land adjacent to the
proposal. He expressed concern that development of the agricultural
land will affect his livelihood as his farm is cultivated for the purpose of
growing grain for his beef cattle.
Evylin Stroud, 89 Little Avenue, Bowmanvi11e, L1C 1J9, expressed
concern for the project as it is situated on prime agricultural and
environmentally protected lands. She also made reference to the
concerns raised by the BowmanvilJe Beach residents because of the
erosion of the Lake Ontario Shoreline and fears that the same situation
will occur in this instance.
Noone spoke in support of this application.
Lawrence Gold, Solicitor, 2040 Yonge Street, Suite 300, Toronto,
M4S lZO, was present to answer questions from the Committee.
(d) Newcastle Townline Centre - Report PD-67-91
Robert Hann, 177 Nonquon Road, 20th Floor, Oshawa, L1G 5A6, advised
that he is the owner of Kingsway Plaza and queried the ability of his
tenants to remain viable and able to stay in business if too many stores
are approved. Too much competition can result in vacant stores which
are boarded up thus promoting vandaJism. He requested that an
independent market analysis, based on growth projection, be prepared,
paid by the applicant and administered by Town Staff for a totally
unbiased opinion. He added that his preference for this site would be a
type of market which caters to automobile usages.
Noone spoke in support of this application.
Ray Abbott, 172 King Street East, Suite 303, Oshawa, LlH lB7,
appeared on behalf of the applicant and displayed an artist's rendering of
the project. He stated that the proposed use is in conformity with the
zoning and that a market analysis study was prepared two years ago.
The project will offer larger warehouse type of uses and tenants will be
charged a reasonable rent. The top floor of the second building will be
used for offices. He advised that he has spoken with some residents of
Bridle Court who appear to have no objection to the project. Parking
spaces for customers would be allotted at the front of the building and
twenty six parking spaces for employees would be located at the rear of
the building.

David Ferguson, Manager to Area Co-ordinating Offire, Ministry of
Transportation, 3rd Floor, Ferguson Block, 77 Wellesley Street West,
Toronto, M7A 1Z8, gave a 30 minute slide presentation and advised that
on November 26, 1990, the Minister of Transportation announced that it
would be initiating a government subsidized special Bus/GO Rail Link to
serve the diverse public transportation needs of people living in
Peterborough and Durham Region. This would be done in conjunction
with private bus carriers and in consultation with municipalities to
provide frequent reliable service. He addressed the following:
- purpose of his presentation
- service principles
- 1986 Journey to Work summary
- Peterborough-Port Perry bus services ridership/cost comparison
- conclusions of options review
- proposed services
- the process for implementation
- request for advice.
Mr. Ferguson circulated a copy of his presentation for the benefit of the
Committee.
John L. Cox, PIaroroirog Consultant, 45 Speedwle Avenue East, Guelph,
NlH 1J2, gave a 45 minute slide presentation on the draft of the
Municipal Housing Statement (Report PD-80-91) which is intended to
provide assistance to municipalities in matters relating to the provision
and maintenance of housing. Tbe Municipal Housing Statement consists
of two main components: a housing market analysis and houaing policy
strategy. His presentation included the following:
- role of the Municipal Housing Statement
- background
- initial finding and issues
- population projections
- household projections
- Town of Newcastle housing targets
- housing units approved or under construction/year end 1990
- assisted housing
- current housing issues in the Town of Newcastle
- limited supply of rental apartment units
- need for additional senior housing accommodation
- public education on housing issues is limited.

(a) Frank Shane, R.R.#1, Box 16, Hampton, LOB YO, noted concurrence
with the contents of Report PD-78-91 except for paragraph 9.3 which
states that "there is clearly insufficient front yard set back to permit the
continued display of motor vehicles in this location". Mr. Shane requested
permission to continue displaying cars in the front yard. He also referred
to paragraph 9.4 which states that "Staff have concluded that a curb
(paved) bordering the perimeter of the vehicle display area would be
appropriate". He indicated that crushed gravel would reduce water run-
off more efficiently than a paved curb.
(b) Alina Bridgeman, Esquire Deve1opmPrlt..., 805 T ..k"""nre Boulevard East,
Toronto, M4M lEI, re: Report PD-81-91 - advised the Committee that
the subject property was acquired in 1989 and that she is under the
impression that Lambs Road was not the preferred alternative for the
proposed future interchange at Highway 401. She requested that the
Committee not detract and lessen the importance of industrial
development. She questioned the issue of fairness when one developer
who owns 45 acres is requested to set aside 7.5 acres within the proposed
subdivision for the purpose of accommodating the future proposed
interchange at Lambs RoadlHighway 401.
(c) Bob Cameron, R.R.#5, Bowmanvi11e, L1C 3K6, circuJated a letter dated
April 5, 1991 to the Committee wherein he states that there is a water
spring located in the former Township of Darlington on Lot 5,
Concession 8. At the present time this has become overgrown with long
grass and weeds. The little spring has apparently been in existence since
the year 1890. He requested that the Committee upgrade the spring to
stop surface water from entering the system and asked if the grass could
be cut or perhaps a few patio slabs laid around the area

THAT Report TR-25-91 be received;
THAT Sta1f be authorized to proceed with the acqnisition of the computer
equipment and software as outlined in the approved 1991 Capital Budget
tota1ling $75,000 from Computerland Canada; and
THAT procedures set out in the Purchasing By-law #82-92, Section 5,
Paragraph 4, regarding tendering, be waived for the purpose of the 1991
computer equipment acquisition, FORTHWITH.

THAT Council authorize Sta1f to investigate the possibilities of a
public/private partnership proposal for a Community Facility within the
Courtice Urban Area; and
THAT Sta1f be authorized to erect a sign on the site of the proposed
facility (Courtice Road and Highway #2) announcing the project.

THAT Report WD-31-91 be received;
THAT the Blue Box Recycling Program in the Town of Newcastle be
restricted to the urban areas of Courtice, Bowmanville, Newcastle Village
and Orono and that the rura1 areas of the Town be serviced by recycling
depots (Igloos) located at the Town of Newcastle Public Works Depots in
Hampton, Bowmanville and Orono, the Newcastle Village and Enniskillen
Fire Ha11s and at N ewtonville, Mitchell Corners, Kendal and the Wlhnot
Creek Development;
THAT Sta1f investigate and report on additional recycling sites to service
the residents across the municipality;
THAT the maximum number of containers permitted for collection of
garbage by the Town be reduced from six to five effective July 2, 1991;
THAT subsequent to the implementation of this change, the impact on
the users be evaluated from the viewpoint of reducing the number of
containers even further;
THAT the appropriate advertisements be placed in the local newspapers
to advise the public of the changes; and
.
THAT a copy of Report WD-31-91 be forwarded to Ruth Grier, Minister
of the Environment, Durham Region, Helen MacDonald, Suzanne Elston,
John Velduis and Kristen McCrea and that they be advised of Counci1's
decision.

WHEREAS the Council of the Town of Newcastle supports the proposed
reconstruction of Highway #2 within our municipality;
WHEREAS the Ministry of Transportation does not plan on
reconstructing the railway underpass at the easterly limit of the Village of
Newcastle;
WHEREAS the restrictions of the underpass are not conducive to a major
provincial highway and have led to serious accidents and confusion in the
past;

WHEREAS the Council of the Town of Newcastle is very concerned that
no action is being contemplated to improve the safety of this underpass
for the motor vehicle operators of our municipality and the province of
Ontario;
NOW THEREFORE the Council of the Town of Newcastle urges the
Ministry of Transportation not to leave the said underpass in its accident
prone constricted condition, but to enlarge it as part of the reconstruction
program of Highway #2.
