Wotten, seconded by Councillor Stapleton THAT the minutes of a regular meeting of the General Purpose and Administration Committee held on December 3, 1990 be approved. "CARRIED" As required under the new Planning Act [Section 34(12)], Council is holding a public llleeting prior to either adopting or rejecting the following: (a) Proposed Zoning By-law Amendment - Part Lot 24, B. F. Concession, former Township of Clarke - Curd; (b) Revised Proposed Zoning By-law Amendment - Part Lot 10, Concession 2, former Town of BowmanvilJe - Schickedanz; '; , I; I ,_ v ,. . . Comer of Townline and Nash Roads and along Highway No.2 between Townline Road and Varcoe Road/Dar1ington Blvd. - Town of Newcastle; and (d) Proposed Zoning By-law Amendment - Part Lots 8 & 9, Concession 3, former Township of Darlington - Credit Point Developments. The Chairman asked if there were any persons present wishing to speak to these matters. Several people indicated a desire to speak. Before proceeding with these matters, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that: (a) Public notices were mailed to all property owners within 120 metres by December 7, 1990; (b) Notices of the public meetings were posted on each of the sites by December 7, 1990; and (c) The notices comply with the regulations under the Planning Act. The Chairman announced that any persons wishing further notice of the passage of the by-law, if passed, to please leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of Planning and Development to briefly describe the purpose and effect of the by-laws and how the by-laws accomplish the stated purposes_ The purpose and effect of the by-laws are as follows: (a) Curd - to permit the development of two (2) additional non-farm rural residential lots; (b) Schickedanz - to permit the development by Plan of Subdivision of 41 single family dwelling units, 82 semi'detached units, and 38 street townhouse units; all totalling 161 units; (c) Town of Newcastle - to implement part of the recommendations of the Highway No_ 2 Corridor Study. Specifically, the proposed zoning changes are: (i) To rezone those lands at the vicinity of the southeast comer of Nash Road and Townline Road from 'Low Density R1" to "R3-1O Medium Density Exception"; ./ .~ - -, ,-. ,,~ ~ ~ . . . Minutes PUBLIC HEARINGS - 3 - January 7, 1991 (ii) To rezone those lands on the northside of Highway No. 2 between Townline Road to Varcoe Road from "R1 Low Density" to "Special Purpose Commercial Exception (C5-8)"; (ill) To rezone those lands on the south side of Highway No. 2 approximately mid block between Townline Road and Dar1ington Boulevard from "Special Purpose Commercial (C5)" to "Special Purpose Commercial Exception (C5-8)"; and (iv) To introduce special provisions for all "C5-8" zones including establishment of permitted base uses, increase frontage requirement from 30 metres to 40 metres, and establish a minimum floorspace of 600 square metres for an individual commercial establishment; and (d) Credit Point Developments - to permit the development by Plan of Subdivision of 152 single family linked units, 140 semi-detached units, and 154 street townhouse units; 175 units within a Medium Density Block; a school, and an Open Space Block. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-laws and that all questions must be asked through the Chair. The Chairman announced that Committee would hear from the objectors, then anyone in support, with the applicant speaking last. (a) Curd - Report PD-1-91 Donna WJgl1lOI'e, 31 Elgin Avenue, Toronto, M5R 1G5, referred to her letter dated January 2, 1991 wherein she opposes this application for the following reasons: 1. Protection of the Bond Head Bluffs; and 2. Respect of Zoning Restrictions and local and Regional guidelines. Noone spoke in support of this application. Sam L. Cureatz, Barrister & Solicitor, 19 Ontario Street, Bowmanvi11e, L1C 282, appeared on behalf of the applicant and advised the Committee that it is his intention to amend this application by requesting the creation of one additional non-farm rural residential lot located to the west of the existing property. The creation of one lot would only require a rezoning change rather than an Official Plan Amendment. ,i...,J . . . G.P.A Minutes PUBLIC HEARINGS - 4 - January 7, 1991 (c) Town of Newcastle - Report PD-3-91 Mrs. Lucy Wu;jadlik, 10 Bridle Court, LIE 2B1, circulated a letter dated January 6, 1991 to the Committee on behalf of the residents of Bridle Court. She requested that Report PD-3-91 be tabled for a period of time because six home owners of Bridle Court were not included on the mailing list and those who did received notices did not have adequate time to prepare and submit comments to the Town. She requested that a night meeting be scheduled with Town Staff to allow the residents to ask questions and have their concerns addressed. Robert Hann, Valiant Property Management, 177 Nonquon Road, 20th Floor, Oshawa, L1G 382, owner of Kingsway Village, stated that, if Report PD-3-91 is tabled, he will withold his comments until such time as the Report is brought back before the Committee for consideration. Ed VanHees, 1811 Panline Blvd. - Apt. 6, Ann Arbor, M"...h;g;oro, appeared on behalf of his parents who reside on Foxhunt Trail. He circulated seven photographs of his parents' property and noted the lack of privacy experienced by his parents because of diverse engineering problems. Removal of trees has left the property harren. Infilling has altered the drainage flow and flooding from storm sewers is taking place on the property. The lighting resembles centre field at Skydome. Pedestrian traffic will use the property as a walkthrough. Roadways and traffic circulation are presently extremely heavy. The slope created be infilling is already eroding onto his parents' property. He observed that the solution to the problem would be the erection of a retaining wall made of interlocking stone and a 4' - 5' wooden fence. John Wilson, 1421 King Street East, Oshawa, LlK 1A3, a resident of the south side of Highway No.2, requested that the Committee deal with the south side of Highway No. 2 separately. Noone spoke in support of this application. (d) Credit Point Developments - Report PD-4-91 Evylin Stroud, 89 Little Ave~ Bowmanvi11e, L1C 1J9, expressed opposition to this application because the lands are zoned Environmentally Protected and Agricultural. E. B. Dareb, R.R.#4, BowmanvilJe, LlC 3K5, expressed concern with the high density which this development would create and requested that Mearns Avenue southbound be opened. ",,)'-.-t . . . G.P.A. Smith, Rose, 1400-111 Richmond Street West, Toronto, M5H 2G4, appeared on behalf of Mr. Brick who owns property immediately to the east of this proposaL He noted that these are Environmentally Sensitive lands and determination of hazard lands and valleys (Soper Creek) have not yet been addressed. He stated that approval of this application in its present state would encourage all future breaches of the sensitivity of the land. He noted the following concerns: - the status of Mearns Ave. - parkland requirements have not been met - comments must be received by the Central Lake Ontario Conservation Authority - link single family dwellings are not allowed in the zoning by-law - the school site is not adequate - the possibility of an influx of a large number of people residing in an environmentally sensitive area He requested that the Committee not proceed with this application. Sernas & j\".."..;"t"" Ltd., 110 Scotia Crt., Unit 41, Whitby, LlN 8Y7, advised the Committee that paragraph 4.3, Page 3 of Report PD-4-91 was erroneous in that an Official Plan Amendment Application was submitted to the Region on October 4, 1990. Mayor Hubbard made a declaration of interest with respect to the following item; vacated her chair and refrained from discussion and voting on the subject matter. Mayor Hubbard's brother owns property abutting the subject land. Councillor Wotten chaired this portion of the meeting. (b) Schickedanz - Report PD-2-91 No one spoke in objection to or in support of this application. John Kennedy, Marsba1J, M....ldiro. MnrooW..m Limited, 275 Duncan Mills Road, Don Mills, M3B 2Y1, appeared on behalf of the applicant and advised that he concurs with the recommendations contained in Report PD-2-91 and that the applicant can adhere to the requirements of the Town. Mayor Hubbard chaired this portion of the meeting. . . . G.P.A Minutes DELEGATIONS - 6- January 7, 1991 (a) Paul DeJager, 72 Kurve Inn Road, R.R.#2, Newcastle, LOA mo, advised that he concurs with the recommendations contained in Report PD-5-91. (b) Dale Watson, 37-53 Hetherington Group, 53 Hetherington Dr., BowmanvilJe, LlC 3R2, referred to a petition signed by 223 residents and submitted on March 19, 1990 opposing the proposal submitted by Michael Zygocki Limited on Quinn Drive, BowmanvilJe. The residents' concerns included traffic congestion, high density, noise, air and garbage pollution, statement from the Board of Education being too vague and the general lack of human compassion factor associated with this application. He requested that the recommendations contained in Report PD-8-91 be denied. (c) Elmer l:t.....tirog, 20 Frederick Ave., BowmanviJJe, L1C 2B9, circulated a letter dated January 7, 1991 opposing the BowmanvilJe Valley Co- operative Homes Inc. proposal. He referred to page 2 of Report PD-292-90 stating that the property is located west of Barbara Street; the report did not mention that the site is also located west of properties on both Frederick Ave. and Edsall Ave. Page 10 of the report states that a 1.2 metre chain link fence would be erected. Residents were told that a 1.8 metre fence would be recommended. He questioned the meaning of the term "fence along the valley top-of-bank". A major concern is the possibility of a child from the new complex falling into the creek. (d) Be.. Wells, 6 Barbara Street, Bowmanvi11e, L1C 2E4, expressed concerns with Report PD-292-90 which were previously voiced by written comments to the Town. She indicated that this development is not fair to existing residents because of the increase in density, the percentage of affordable housing associated with the project, depreciation of house values and the type of homes being built in a single family dwelling area. Existing residents have not yet seen a drainage plan for the proposal. (e) Bing Wong, c/o Suite 302, 101 Dundas Street West, Whitby, LlN 2M2, - reo Report PD-292-90, advised that because of the lengthy two year process in dealing with this application he has no other alternative than to refer the matter to the Ontario Municipal Board. G.P.A Minutes DELEGATIONS - 7 - January 7, 1991 (f) Nancy ArmsLrong, 19 :r..-nmhe Drive, BowmanviIJe, LIe 3S8, a long time resident of the Town of N ewcastJe requested that the Committee put an end to pound seizures. She advised that the public at large was not aware of the 72 hour restraining limitation on animals found at large and stated that this recent finding is very disturbing as it is not only a betrayal of trust the animals have towards their owners but a betrayal of the pet owners. Although the purchase of tags and licences are a precaution for the safety of the animal they are not a guarantee that these pets will not be transported to strange and confmed surroundings after having known the security and safety of a good home. There should be more awareness and education between the residents and the Animal Control Facility. (g) Bryan Kozman, AnimaJ Alliance of C........i1A, 33 Yorkville Drive, Bowmanville, L1E 2A8, addressed Committee on behalf of the organization which has been in existence for approximately five to six months. Their organizational goal is to raise public awareness throughout the Province of Ontario on people's pets being used for research. He referred to a petition containing 2,600 signatures presented to the Council of the City of Oshawa and circulated a petition with 713 signatures stating opposition to pets being supplied for research. He noted that the cost of animals is a very minimal portion of the total cost of research. He advised that major European countries and 14 American states have banned pound seizures. Since the issue of animals being sold for research has been raised in Oshawa, the adoption rate has increased by 70%. A meeting with the Ministry of Agriculture and Food has been scheduled to be held on January 24, 1991. He further noted that 63.7% of Provincial candidates surveyed responded as being opposed to pound seizures and pets being sold for research purposes. "CARRIED" (h) Laurie Davis, AnimaJ Alliance of Omail", 1640 ~w Ave., Suite 1916, Toronto, M4G 4E9, requested that the Town of Newcastle follow Oshawa's lead in banning pound seizures. - I .) ! G.P.A. Minutes . DELEGATIONS . . - 8 . January 7, 1991 (i) Liz White, Animal A1liance of o.m..I,,> 1640 Bayview Ave~ Suite 1916, Toronto, Toronto, M4G 4E9, concurred with the previous speakers' comments and clarified the meaning of the term pet. She indicated that she recognizes Council's dilemma in this decision but feels that Provincial legislature is outdated and should be amended. Her request was threefold: 1. That Council request the Provincial Government to change the law on animals being sold for research as this law is morally and ethically wrong. 2. Since there is no cat by-law in place, that Newcastle stop sending cats for research purposes. 3. That a moratorium be placed for a period of time on sending animals for research. She offered the services of her organization in helping to establish a foster-care, adoption or rescue program for animals in the Town of Newcastle. G) Dr. Ron Urquart, Veterinarian fuspector, Ministry of Agriculture & Food, 801 Bay Street, Toronto, circulated a brochure on the AnimaJs for Research Act which contains the history, scope and objectives of the Ministry pertaining to "nim"l~ being sent for research. He informed the Committee that the AnimaJs for Research Act is nearly 20 years old. He indicated that the Act requires the use of anaesthetic and analgesics to prevent an animal from suffering unnecessary pain and is monitored with great care. He further indicated that when animal control picks up a dog or cat with a tag or nameplate, the poundkeeper must take all reasonable steps to fmd the original owner. The minimum redemption period is three full days, in addition to the day of pick-up, and any day the pound is closed to the public. Municipalities can lengthen the redemption period. The pounds are inspected by Government Inspectors whose specialty is animal care. These inspections are unannounced. A dog or cat, which is turned over to the pound by its owner, cannot be sold to research if euthanasia of the pet is requested by the owner. (k) Ann Walker, Toronto Hospital Veterinary Staff, Toronto, read the contents of a letter composed by Pierre Berton wherein he expresses that Council will be doing itself and the Community a great disservice if it gives in to the Animal Right Activists. The increase "in life expectancy has come about as a result of scientifIC work that has depended almost entirely on the use of animals in the laboratories and the scientific research areas of the universities". He referred to the scientifIC discoveries of Louis Pasteur, Dr. Frederick Banting, and Dr. Charles Best made possible by the use of animals in research. Experimentation on animals was indispensable in fmding cures for diphtheria, small pox, tuberculosis, rheumatic fever, and other diseases. He further states "suppose we reach the point, as we will, when we want to test a vaccine for AIDS. Should the vaccine be tested on human beings or should it be tested on a chimpanzee? The animal rights people make no bones about the fact that it should be tested on a human being." (- :.) (.... . . . G.P.A. Minutes DELEGATIONS - 9- January 7, 1991 OJ George Cackette, ea.....lUm Diabetes A........u.6on, 178 Simcoe St. N., Oshawa, L1G 489, concurred with the written comments made by Pierre Berton. He advised that his son is a diabetic and that diabetes is the third largest killer. The Canadian Diabetes Association raises approximately $5,000,000.00 yearly for research purposes and experimentation on dogs is essential since they acquire some of the same diseases as human beings. (m) Dr. G. Harapa, University of Toronto, King's Simcoe Hall, College Circle, Toronto, M5S 1Al, circulated a brochure entitled "AnimaJs, Research and Health". He advised that animals are used in research only when absolutely necessary. They are needed to test the effectiveness and safety of: - drugs, such as antibiotics - therapies, such as chemotherapy - devices, such as pacemakers and artifIcial joints - surgical procedures, such as organ transplants. University of Toronto researchers must abide by the rules set down by the Government of Ontario and the Canadian Council on Animal Care. All new research personnel are required to take a University course on proper animal care, which outlines their legal and ethical responsibilities as well as the principals of humane care. All researchers are obliged to ensure that the animals under their care do not suffer unnecessary pain or distress. Under the law, an animal turned over by its owner to a pound to be put to sleep is not available for research purposes. Cats, dogs and primates constitute less than 1% of all research animal" at the university. (n) dlID Kenyon, DVM, MRCVS, Asst. Vree-president, Research, The Toronto HOBpital, 585 University Avenue, Toronto, M5G 2C4, was called but was not present. (0) Gordon White, Group 2, Box 21, R.R.#2, Bowmanville, LIC 3K3, advised that he concurs with the recommendations contained in Report WD-1-91 and expressed a sense of urgency and concern with the erosion problem. He supports the option of pursuing an alternate solution. (p) David W. Rice, Ridge Pine Park Inc., c/o Rice Construction Co. Limited, 17 Dean Street, Brampton, L6W 1M7, requested that the Committee defer its decision on Report WD-2-91 because of the legal ramifications associated with the denial of this application. He requested that he be allowed sufficient time to address the Town's concerns. . . . G.P.A. Minutes DELEGATIONS Sale of Animals for Research 68.29.7 - 10 - January 7, 1991 (q) Jack Marsh, Regional Manager, Laidlaw Waste Systems Limited, informed the Committee that the legal description contained in Report WD-3.91 should be "between Concessions 2 and 3, Lot 11". He described the report as "incomplete and inaccurate". He noted that his request for a copy of the Town's policy on road closure was denied. He made the following points: - full and open discussions with Town officials before a decision is made on this application - that the Town's concerns be discussed with the applicant - Lot 11 as shown on attachment No.1 to Report WD-3.91 is owned by Laidlaw Waste Systems (Durham) Limited not the Region - he has not seen a previous Town denial of a similar application - he requested that the Committee deny the recommendations made in Report WD-3-91 and approve the application. He introduced Mr. John McDermott who gave a brief chronological history of the application to close the unopened road allowance between Concessions 2 and 3, Lot 11. He requested that a copy of the Town's policy on road closure be forwarded to him. He indicated that a title search made last year clearly indicates Laidlaw as the owner of Lot 11.
