Newcastle Council, through its General Purpose and Administration
Committee, is holding a Public Meeting for the following Rezoning
Applications:

Concession, former Town of Bowmanville - Thomas Greenslade.
Before proceeding with this matter, the Chairman asked the Deputy Clerk to
advise on the manner of notice.
The Deputy Clerk advised that public notices for all rezoning applications
were sent by first class mail on or before August 10, 1992 to all property
owners within 120 metres of the subject property in accordance with the
latest municipal assessment record. In addition, notices were also posted on
sites prior to August 10, 1992. This notice procedure is in compliance with
Ontario Regulation 404/83.
The Chairman announced that all persons wishing further notice of the
passage of the by-law should leave their name, address and telephone number
with the Clerk's Department before they leave.
The Chairman announced that the Director of Planning and Development
would describe the purpose and effect of the proposed amendments, then the
objectors would be heard, followed by the supporters and the applicant.
(a) Wayne Jeffrey - Report PD-182-92 - the purpose and effect of the
application is to permit the development of a Plan of Subdivision
comprised of 114 single family units; 98 semi-detached units; 25 street
townhouse units; and a future development block for an additional 61
townhouse units.

reference to a letter dated September 8, 1992 to the Town of Newcastle,
wherein the Gouldburns and Mr. & Mrs. Adema requested information
pertaining to the construction schedule of this project and expressed
concerns pertaining to flooding and ponding taking place on her property
as a result of this development. She requested that the developer install
appropriate fencing on the eastern and southern boundary of her
property to replace the existing tree and shrub screening and the
installation of water and sewer mains along Highway #2. She also noted
that the developer should repair, to her satisfuction, any damage done to
her property.
Noone spoke in support of this application.
Bryce Jordan, G.M. Bernas and A"""";At."., 110 Scotia Court, Unit 41,
Whitby, LlN SY7, was present to answer questions from the Committee
and noted that the Region of Durham has indicated that the installation
of sewer and water mains along Highway #2 would be possible. The
applicant is willing to adhere to all the requirements of the Town of
Newcastle.

(b) Oshawa Viking Rugby Club - Report PD-183-92 - the purpose and effect
of the application is to permit the development of two (2) rugby playing
fIelds and associated club house.
EvyIin Stroud, 89 Little Avenue, Bowmanville, L1C 1J4, expressed
opposition to this proposal because prime agricultural land will be taken
out of production. The Ministry of Agriculture has indicated that 80% of
this parcel of land is now being used for agricultural purposes and she
expressed her preference for the use of major open space for this type of
activity.
No one spoke in support of this application.
Glenn Elliott, 55 GIPnAhhPy Drive, Courtice, LlG 2B5, appeared on
behalf of the applicant and informed the Committee that the 10 or 12
acres located at the southern portion of this 30-acre parcel will be
developed for the use of a rugby field. This land is very wet and has not
been agriculturally viable. The Oshawa Viking Rugby Club has owned
the land for approximately three years and it is not currently being
farmed. He extended an invitation to the Town of Newcastle to schedule
some events on this site when the fIeld is not being used by the Oshawa
Viking Rugby Club.
(c) 656150 Ontario Ltc!. (Dinnerex Inc.) - Report PD-184-92 - the purpose
and effect of the application is to permit "General Commercial (C1)" uses
in addition to the "Special Purpose Commercial" uses allowed within the
"C5" zoning category.
EvyIin Stroud, 89 Little Avenue, Bowmanville, L1C 1J4, requested
clarillcation of the "C-5" zoning category.
Noone spoke in support of this application.
Joe Wood, 656160 Ontario Ltc!. (Dionerex Inc.), 355 ,j\dPIAii!f!' Street
West, 2nd Floor, Toronto, M5V 1S2, appeared on behalf of the applicant
to answer questions from the Committee.
(d) Thomas Greenalade - Report PD-185-92 - the purpose and effect of the
application is to permit the construction of a single family dwe1ling unit.
Noone spoke in opposition to or in support of this application.
Ian MaeDougall, 58 Clegg Street, Ottawa, K1S OH8, advised that
Mr. Greenslade purchased this property in 1988 with the intent of
demolishing the existing older home and building a retirement home.
He circulated nine letters of support from adjacent residents who state
that the application in no way jeopardizes the spirit of development in
the neighbourhood or the safety and well being of the community and,
they have no objection to the proposal by Thomas Greenalade to build a
single family home on this site. He advised that a plan for the septic
system is now available and he is willing to hook-up the abutting owners
to the municipal water system at his expense.

requested the Committee to vote in favour of the name change from
"Concession Road 4" to 'Tobacco Road" to acknowledge the 48-year tobacco
farming history in this area
(c) Magda ZnPbnm,. IlR. #4, BowmanviJle, L1C 3K5 - re: Report
PD-188-92 - concurred with the comments made by Joan Tax.
(d) John pI-............ 2900 CoD: ;nn Road 4, IlR. #4, BowmanviJle,
L1C 3K5 - reo Report PD-188-92 - circulated a letter dated September 2,
1992 wherein nine residents of Concession Road 4 expressed opposition to
the name change to Tohacco Road. He also made reference to the
Durham Health Unit, Canadian Statesman and Cancer Society expressing
opposition to the proposed name.
(e) Everett O'ReiIly, 2963 ~nn Road 4, IlR. #4, BowmanviJJe,
LlC 3K5 - re: Report PD-188-92 - articulated opposition to the name
change and questioned the wisdom of including 13 properties in a poll
when, in fact, only 5 residents would be directly affected by the name
change.

PD-192-92 - advised prior to the meeting that he would not be in
attendance.
(g) Brian Hales, 96 Munroe Street, Newcastle, LIB 1J2 - reo Report
PD-192-92 - objected to the proposal submitted by Bowling Green
Developments for the following reasons:
the residents are opposed to this development
the development is too close to the railway line
the lots created will be less than half the size of the existing lots
the density is too high
the development will create a dangerous traffic situation, and
the proposal is not compatible with the existing neighbourhood.
(h) Scott CoIIocutt, 345 North Street, Newcastle, LIB 1J2 - re: Report
PD-192-92 - advised that his driveway abuts the northern edge of the
property being developed and that the 20-year old spruce trees now
standing on the property will have to be cut to allow development of this
site. He would have no objection to the development of this property if
the layout was to complement and enhance the existing housing
component.

(i) Verdon Kent, 338 Mill Street, Neweastle, Lm 1J3 - re: Report
PD-192.92 - advised that when this parcel of land was purchased, an
application for the severance of seven lots had been approved and
residential development rather than condos would be more suitable for
this site.
G) Tom Januszewski, 14 Sulkara Crt., Toronto, M4A 2G9 - re: Report
PD-196-92 - appeared on behalf of 841221 and 841222 Ontario Limited,
the owners and applicants for approval of the residential and recreational
project known as Newcastle-on-the-Lake, located approximately 1/2 km
south of the proposed waste processing site. Mr. Januszewski advised
that he wished to retract a statement made in a letter dated August 25,
1992, to the Town of Newcastle, wherein he referred to Detox
Environmental Ltd as being a toxic waste disposal and processing site as
this statement was made based on information received through the news
media He requested that a hearing by the Environmental Assessment
Board be held to fully inform and abate the fears of everyone concerned.

(k) Phyllis Baker, President, WiJmot Creek Homeowners A.........umtlfl. 11 Cabot
Crt., Neweastle, Lm 1A7 - re: Report PD-196-92 - circulated a letter
dated August 24, 1992 wherein she states that "the members of the
Wilmot Creek Homeowners' Association wish to inform of the concerns of
the proposed expansion of the Detox facility located approximately 1 km to
the west of Ridge Pine Park." She requested that a hearing by the
Environmental Assessment Board be held and that the residents be
advised of all future hearings held on this matter.
(I) Norm KeiI, Detox Emiroomental Ltd., P.O. Box 458, BowmanviIJe,
LlC 3Z2 - re: Report PD-196-92 - advised that Detox Environmental Ltd.
has applied for a permit to process and transfer a variety of chemical
waste materials at the Bowmanville Plant. The materials will be brought
into the plant, bulked, sorted, combined, processed and shipped for
recycling, reuse or alternate disposal. Detox will not handle any explosive,
pathological, radioactive or P .C.B. wastes. Nothing will be buried or
incinerated at this site. The appearance of the building and signage will
not change. The Ministry of the Environment regularly monitors the
inventory of the materials contained on the site. A study undertaken by
Proctor and Redfern indicates that the traffic generated by this enterprise
will not adversely affect the surrounding residents. Emergency measures
for safety practices and procedures are being undertaken in the event of
an industrial spill Detox has been in business for 3-1/2 yrs and has
always operated at the Bennett Road site. Detox is a licensed waste
hauler and has fIve trucks in operation. Included in Detox clients are
Goodyear, Dennison and Lear. Mr. Keil requested that the Committee
support his application.

(m)Joan Pilniuk, 13 The Cove Road, Newcastle, LlB 1B9 - re: Report
PD-196-92 - circulated a letter wherein she expressed, on behalf of the
residents of Wilmot Creek, that their quality of life is being threatened
and the residents' safety is in jeopardy because of this application. She
noted that three shifts per day, seven days a week of truck traffic
increases the possibility of a spill or an accident. The residents share the
same access road as the vehicular traffic of Detox. She indicated that

the residents strongly disagree with paragraph 4.1.1 of Report PD-196-92
which refers to Detox "without offensive characteristics and compatible
with the amenity of other uses of the Urban Area". With regard
paragraph 5.4 which states that "in order to address the concerns of the
residents we understand representatives from Detox have met with the
residents recently" she stated that no public dialogue has been held
between Wilmot Creek homeowners and representatives of Detox. She
requested that Report PD-196-92 be tabled for one week to allow more
time to the residents for the preparation of a written petition in
opposition to this prqject.

R.R. #2, Box 14, Route 2, Bowmanville, Lie 3K3 - re: Report PD-196-
92 - circulated a letter dated September 8, 1992, requesting that the Town
of Newcastle take a fll'Dl position with the Ministry of the Environment to
have an Environmental Assessment Board Hearing to explore all technical
aspects and ensure that all safeguards are undertaken. She expressed
concerns pertaining to monitoring of the emissions, odours, adverse effects
of a fIre at the spill containment area, safety training of employees,
monitoring of ground water, contingency plans for the clean up of the
facility if the business should discontinue, closure and clean up costs, and
backup disposal arrangements should the Canadian border close for waste
movement. She requested that the Staff recommendation which reads
"that the Town can fmd no justification for not holding a hearing by the
Environmental Assessment Board" be amended to: "requests that a
hearing in fact be held in order to identify the risks and to ensure that all
precautions are taken.'

Tomina to permit the development of a 14 lot rural residential development in
Part Lot 20, Concession 2, former Township of Darlington, be denied;

estimated cost to the Town of $57,500;
THAT the funds for this work be obtained from the capital accounts for street
lights, Account Number 7230-210-X in 1992 and be collected as an underlevy
through the 1993 mill rate; and
THAT Ms. Ann Cataford, Ministry of Transportation, be advised of Council's
decision and be provided with a copy of Report WD-70-92.
