Before proceeding with this matter, the Chairman asked the Deputy Clerk to
advise on the manner of notice.
The Deputy Clerk advised that public notice for application PLN 15.2,
Bowmanville Waterfront Study, was published in the local newspapers.
Additionally, notice was mailed to all who notified staff .and Committee of
their interest in the Study.
The Chairman announced that any persons wishing further notice of the
passage of the by-law, should leave their name, address and telephone
number with the Deputy Clerk before they leave.
The Chairman announced that the Director of Planning and Development
would describe the purpose and effect of the proposed amendment, then we
will hear the consultant, the objectors, followed by the supporters.
(a) Bowmanville Waterfront Study: Draft Port Darlington Secondary Plan _
Report PD-103-92 - the purpose and effect of the Bowmanville Waterfront
Study is to establish objectives and policies which are to serve as a guide
for the future development of those lands within the southern sector of
Bowmanville, adjacent to Lake Ontario.

278, Brampton, L6V 21.1, and the Port Darlington Waterfront Master Plan
was displayed for the benefit of the Committee. Mr. Johansen referred to
the Port Darlington Planning Area Secondary Plan which has been
prepared in association with Hugh Stansbury Woodland Ltd., Jack B. Ellis
and Associates Ltd and Michael Michalski Associates. The Committee
was advised that it has been two years since the inception of this plan.
Since the submission of the first draft, refinements and modifications have
been made. Four stages led to the preparation of the Secondary Plan:
Background, Plan Development, Public Consultation and Implementation.
Mr . Johansen highlighted the boundaries of this unique and historical
area and the establiaIunent of goals by the steering committee. A
comprehensive plan was developed which encompasses land use, access,
environmental protection, improvement of present facilities, recreational
uses, tourism, employment and residential uses. A collective road system
will improve access to this area. The historical road system will also be
emphasized It is the intent to enforce the land marsh as an
environmental unit and to maintain the harbour area. A trail system will
connect parks and open spaces. A hotel site will be included as part of
the tourism orientation. Provision has been made in the plan to include a
school site in the residential area The guidelines for the implementation
process will address: residential, hotel, marina, commercial core and
park/open space areas. Mr. Johansen made specific reference to St.
Marys Cement, Wilmot Creek, Port Darlington Harbour Company and the
West Shoreline which should be improved because of severe flooding.
Satisfactory erosion measures can be developed. He advised that the Port
Darlington Planning Area Secondary Plan is an ambitious 20 - 30 year
plan which creates a long-term vision for the residents of the Town of
Newcastle.

Gordon White, Group 2, Box 21, R.R.#2, Bowmanville, LIC 3K3,
circulated a letter dated May 4, 1992 wherein he expressed the following
concerns:
1. St. Marys Cement lands should be included in the Port Darlington
Secondary Plan because of its impact of vibration, noise and dust on
lands in the Secondary Plan Area
2. He questioned the validity of the need for a marina.
3. The limitation that the Secondary Plan places on the ability to expand
and improve the infrastructure servicing The Cove and Cedarcrest.
Mr. White questioned the essence of the overall plan in that it is
aggressive in its planning for lands lying to the east of the harbour and is
void of anything that will promote change to the deplorable conditions on
the west side of the harbour.
David y""..... 103 West Beach Road, Box 2, R.R.#2, Bowmanville,
LIC 3K3, expressed a serious concern pertaining to existing wells drying
up if development takes place in this area.

Mavis Carlton, Group 2, R.R.#2, Bowmanville, LIC 3K3, circulated a
letter dated May 4, 1992 wherein she commends the authors of the
Secondary Plan for their recognition of this area as being significant. She
is concerned that the Secondary Plan, however, is providing very carefully
for future development of a very limited part of the Iakefront area, but is
denigrating the current residential areas and ignoring the largest part of
the Bowmanville waterfront. She questioned the "rather large allowance
for high and medium density housing for the area" located in the near
vicinity of Highway #401, the C.N.R. tracks and, more recently, by the
Province of Ontario Right-of-Way. A further concern is the provision for
industrial and office space which she feels are unnecessary.

John Wmters, Group 1, Box 2, R.R.#2, Bowmanville, LlC 3K3, circulated
a letter and documentation reflecting the past history of the Port
Darlington area He referred to Section 1.2 of the Secondary Plan which
makes no mention of the issues raised or attempt made to address the
concerns raised by the residents which include the hazard created by an
unprotected shoreline. Another major concern is the deterioration of the
properties on the east and west beaches. He advised that Sections 2.2.4,
2.2.5 and 2.5.2.2 fail to focus on the importance of recapturing the history
and character of Port Darlington. Reference was made to Section 2.5.2.3
and he suggested that the extension of village commercial should be
supported in any direction which makes good planning sense. He noted
that, in Section 2.8.1.5, it is not reasonable to deny services to the West
Beach. Pursuant to Section 3.7.1, he asked if he would be allowed to
rebuild his home should it be demolished by fIre and would he continue
to have access to his property if the road patterns were changed. He
added that the report fuils to address the economic impacts on existing
business in the Port Darlington area, namely the existing marina and
Wiggers Yachts. He also addressed the dangerous situation which exists
on the East and West Beach because of the breakwater which is
constructed of large irregular rocks.

Charmaine Dunn, Box 53, Group 2, Bowmanville, LlC SKa, circulated a
letter dated May 4, 1992 wherein she expresses a concern that Section
2.2.1 is a direct contradiction of Planning Section 2.3.1.7 which states that
"lands subject to flooding from Bowmanville and Soper Creeks, or by the
waters of Lake Ontario...shall not be considered for Park dedication". She
does not understand why these lands have been designated as Town Park
throughout this plan. Section 2.2.4 notes that land acquisition of the East
and West Beach is desirable...it may not be a priority area for acquisitions
and CLOCA notes that fmancial support for acquisition may be a
deterrent. Page 27 recommends that this area be acquired by CLOCA
and Page 33 refers to land acquisition by CLOCA with possible fmancial
assistance from the Provincial, Regional and Town of Newcastle. In her
estimation, there is no continuity in these recommendations. Section 5.2
states..."to minimize future increases in acquisition costs for a public
agency." She fmds this statement unacceptable and unethical. She
requested the deletion of the words "height" and "floor area" in Paragraph
A of Section 2.3.1.4. She requested clarification of Section 2.5.1. She
further reiterated that the plan appears to solely accommodate the
developers for their fmancial gain and rejects the established home
owners.
Tom Vanuszewski, 14 SuIkara Court, Toronto, M4A 2G9, a consultant and
planner retained by N ewcastle-On- The-Lake, congratulated the authors of
the Secondary Plan on the contents of the Report. He, however, noted
that he was not given the opportunity to provide input prior to the
presentation of the Secondary Plan and there are recommendations
contained in the report which are contrary to his clients' interests. The
proposed marina was eliminated from Newcastle-On-The-Lake's
submission for economical and environmental reasons. He has no
objection to the inclusion of the Marina in the Bowmanville Waterfront
Study if it does not stop development in Lots 5 and 6 while studies are
undertaken. He informed the Committee that the proposed densities are
insufficient thus rendering the project economically unviable. He added
that the requirement for public land and facilities is too high and should
be recalculated on the basis that the population occupying this area will
be mostly composed of adults thus reducing the need for a school on this
site. He further noted that the 30-metre width requirement of the road
systems is too generous.
A ooncerned resident questioned the need for a third marina on the
waterfront, specifICally in front of her house. She advised that the
residents need more parks, not hotels and condominiums. She requested
that the project be stopped.
Rev. Frank W. Ltv-khart, Trinity United Church, 116 Church Street,
BowmanviIle, advised the Committee that members of his congregation
have expressed strong support for the development of the Bowmanville
Waterfront. At the present time, residents do not have easy access to the
Iakefront as they are deterred by "No Trespassing" signs. Although he has
some concern pertaining to the flooding of the two creeks, he commended
the authors of the Secondary Plan on their vision for the Bowmanville
Waterfront.

Rick CaJboun, District Plannu,g Co-ordinator, l\I;niRt<y of Natural
Resources, Lindsay District, 322 Kent Street West, Lindsay, K9V 4T7,
advised that the purpose of his presentation was to advise Members of the
Committee on the programs of the Ministry of Natural Resources and to
answer any questions. He informed the Committee that the Ministry of
Natural Resources is in the process of re-organizing its internal operations
and that a fourth Wetlands Policy Statement will be submitted to the
Cabinet for their approval in the near future. The diversified mandate of
the Ministry of Natural Resources includes the preservation of fish and
wildlife resources, forest and forest management, protection of aggregates,
management and disposition of crown lands, provincial parks, recreation
areas and natural heritage areas. The Ministry has extensive input into
the Town of Newcastle Official Plan for economic, social and
environmental reasons. He encouraged communication between the Town
and the Ministry in order to recognize and address all of the mutual
concerns in a satisfactory manner.
Valerie Cramner, Durham Region Non-Profit Housing Corporation, 1615
Dundas St. East, 4th Floor, Lang Tower, West Bml.m,g, Whitby,
LlN 6A3, was present to discuss N on-Profit Housing Programs in Ontario
and answer questions from the Committee. She advised that Durham
Region N on-Profit Housing Corporation is funded 100% by the Province.
The rental projects integrate a mix of market rent and subsidized rent
tenants from municipal, co-op and private non-profit groups. The amount
of integration is determined on a percentage of subsidized and market
rent. There are three stages for the non-profit producer: 1 - the
development stage process; 2 - the management of the property and 3 -
rents from market rent, subsidized rent and subsidy from the Province.
Annual budgets for each project are approved by the Board of Directors
and forwarded to the Ministry of Housing for their approval. It is of
paramount importance to Durham Region Non-Profit Housing Corporation
that the design, high quality construction, landscaping and maintenance of
the property be conducted in a highly professional manner. Two full-
time property managers continually monitor and inspect each project
which is manned by a full-time superintendent and back-up
superintendent. The Durham Region Housing Authority works hard
towards being good neighbours and makes every effort to be responsive to
the concerns of the residents.

(a) Pat Corkum, 23 Freeland Avenue, Bowmanville, LlC 4R9, and Stan
Zerdin, 33 Fenwick Avenue, Bowmanville, LIC 4S2, made reference to
Mr. Zerdin's letter to the Town dated March 11, 1992 wherein he
expressed several concerns pertaining to the Non-Profit Housing Project
located in his neighbourhood He advised that surrounding residents refer
to the N on-Housing Project as the "Green Monster" as all of the roofs
have been painted green and he advised that this development is not
compatible with the existing neighbourhood. He questioned why lands
zoned "hazardous" would be rezoned to allow the construction of this
project.
(b) Dr. Wendy Korver, Bowmanville Veterinary Clinic, 360 King Street East,
BowmanviIIe, LIC 3K5, referred to her letter dated January 30, 1992 and
circulated a petition which she advised contains approximately 1,000
signatures of residents who protest the current decision being supported
by the Town Council to suspend after hours emergency services by the
Animal Control Facility. She feels that this decision will cause
unnecessary and excessive suffering for injured pets or wildlife and will
pose a significant public health endangerment. She suggested that the
Town renegotiate the Uuion Agreement whereby the cost of contacting
Animal Control OffICers after hours would be reduced or that a
Committee composed of Council Members and Veterinarians be
established in an attempt to resolve this situation.

newspaper editorials and a survey of Lot 30, Concession 5, former
Township of Clarke, prepared by Brown and Coggan Ltd. He described
the background history of his application for the severance of his lot and
the frustrations he has experienced in dealing with the Region, the Land
Division Committee and the Town of Newcastle. He advised that he was
a "victim" of the Town's By-laws and was denied severance based on
erroneous information as he sees no logical reason as to why his
application for severance was not approved.

THAT Report ADMIN-5-92 be received;
THAT Council supports the recommendation of the City of Etobicoke contained in
Attachment #2 to Report ADMIN-5-92 and that the City of Etobicoke be so
advised;
THAT the proposed legislation should be amended to assign a dollar value to the
terms "remote" and "insignificant" used in Section 4(0) of the Act;
THAT the proposed legislation should continue the Court's power to relieve a
member from the consequence of a breach of it in cases of bona fide error or
inadvertence;
THAT the proposed legislation should require the Ministry of Municipal Affairs to
establish an advisory service available free of charge to members of councils to
provide advice as to the interpretation of the Act and whether the disclosure and
abstention requirements of the Act apply in the particular circumstances;
THAT the proposed legislation should be amended to provide that a member
relying on the advice given by the Ministry's advisory service should be deemed
not to violate the Act if the advice is followed in good faith;
THAT the Declaration of Elected Office provided in the proposed legislation
should be amended to delete the statement that the offICial concerned understands
the Act;
THAT any new legislation regarding mandatory disclosure of assets not be
required in mid-term of the present Council but be made effective on the date of
registration of the candidates for the 1994 Municipal Elections;
THAT a copy of Report ADMIN-5-92 be forwarded to the Honourable Dave
Cooke, Minister of Municipal Affairs as the Town's position regarding the
proposed new legislation; and
THAT all of the above recommendations be approved, FORTHWITH.
