Resolution #GPA-124-92 Moved by Councillor O'Toole, seconded by Councillor Hooper THAT the minutes of a regular meeting of the General Purpose and Administration Committee held on February 3, 1992 be approved. "CARRIED" Pursuant to Section 34, Subsection 12 of the Planning Act, the Town of Newcastle Council, through its General Purpose and Administrative Committee, is holding a Public Meeting for the following rezoning applications: (a) Proposed Rezoning Application - Part Lot 8, Concession 1, former Township of Clarke - Quadrillium Corporation; 201 . . . G.P.& A Minutes PUBLIC MEETINGS - 2 - February 17, 1992 (b) Proposed Rezoning Application - Part Lot 30, Concession 3, former Township of Darlington - 84860 1 Ontario Limited; and Pursuant to Section 17(2), and Section 21(1) of the Planning Act, the Town is also holding a Public Meeting for the following Town of Newcastle Officlal Plan Amendment application: (c) Proposed Official Plan Amendment Application - Part Lot 11, Concession 1, former Town of Bowmanville - Roadside Developments Ltd Before proceeding with these matters, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that: (a) Public notices were mailed to all property owners within 120 metres by January 17, 1992; (b) Notices of the public meetings were posted on each of the sites by January 17, 1992; (c) In addition, public notices for the proposed Official Plan Amendment Application were p1sced in local newspapers which comply with Ontario Regulation 402/83; and (d) The notice procedure complies with Ontario Regulation 404/83. The Chairman announced that any persons wishing further notice of the passage of the by-law, if passed, to leave their name, address and telephone number with the Deputy Clerk before they leave. The ehairman announced that the Manager of Strategic Planning would describe the purpose and effect of each of the proposed amendments, followed by comments from any objectors, supporters and the applicant speaking last. (a) Quadrillium Corporation - Report PD-43-92 - the purpose and effect of this application is to rezone the subject lands to an appropriate zone to permit the development of a 30 unit residential subdivision. Doris T""'I'lrin.., 32 Jones Avenue, NewtonviIle, LOA lJO, informed the Committee that the original plan indicated that a road between the school and Highway 401 was to have been constructed prior to commencement of construction. The revised plan does not reflect the installation of this road and this will create a heavy vehicular traffic situation on Jones Avenue. She also advised that her neighbour had expressed a concern pertaining to Lots 17 to 24 not being large enough to accommodate septic tsnks. 20 t) . . . EvyIin Stroud, 89 Little Avenue, Bowmanville, L1C 1J9, noted objection to development taking place on prime agricultural and environmentally sensitive lands. Noone spoke in support of this application. Kevin Tmmey, Tmmey Planning:, 340 Byron Street South, Snite 200, Whitby, L1N 4P8, advised the Committee that he is willing to work with staff on an alternate construction access point to the development to alleviate traffic congestion on Jones Avenue. (b) 848601 Ontario Limited - Report PD-44-92 - the purpose and effect of this application is to rezone the subject lands to an appropriate zone to permit the development of 42 townhouses, 20 semi-detached units, 15 single family units, all totalling 77 units. EvyIin Stroud, 89 Little Avenue, Bowmanville, Lle 1J9, objected to development taking place on prime agricultural and environmentally sensitive land. She referred to Section 5.1 of Report PD-44-92 which states that: "Regional Council shall select and retain a qualified Environmental Consultant to prepare an Environmental Impact Study at the expense of the proponent." and Attachment # 1, a Draft Plan of Subdivision, which shows that the subject site is surrounded by environmenta1ly protected land. She noted that various developers request zoning by-law amendments to develop small parcels of environmentally protected land, thus resulting in a large parcel of environmentally protected land being disturbed. Noone spoke in support of this application. Anthony BigIieri, G.M. Sernas & A.,.,...;,.tes, 110 Scotia Court, Whitby, LlN 8Y7, appeared on behalf of the applicant and displayed a Draft Plan of Subdivision. He advised that the northern portion of the development has been removed from the proposal A park with walkways to the two alljacent subdivisions is being proposed The floodline will not affect the park. He articulated his willingness to work with staff to address all concerns. (c) Roadside Developments Limited - Report PD-45-92 - the purpose and effect of this application is to introduce a High Density symbol on the subject property and to exceed the maximum allowable density permitted by the High Density designation. Christine p..1......nn...., 2187 Highway #2, BowmanviIIe, advised that she and her husband own property at 139 Liberty Street. Because of the erection of the apartment building across the street, they have found it difficult to rent this house to perspective tenants. Noone spoke in favour of this application. '-"n ~UJ . . . PRESENTATION Allan Rae, Architect Ine., appeared on behalf of the applicant and advised that this will be a residential condominium development. He is willing to work with stsff with regards to density and vehicular access. Carolyn Wnntllann. c/o Hough Stansbury Wnntllanil Limited, 916 The East Mall, Suite B, Etobicoke, M9B 6K1. gave a slide presentation and noted the following points regarding the Recreation/Leisure Master Plan (Report CS-08-92): - the RecreationJLeisure Services Master PIan has taken approximately 1 112 years to prepare - miscellaneous meetings with groups in the Town of Newcastle and telephone surveys were undertaken - the Master Plan incorporates the whole framework of parks and open space perspective - Recreation opportunities for existing and future residents were considered - family and seniors outing in a natural environment were reviewed - the natural and landscape heritage were considered to be as importsnt as the heritage of buildings - the waterfront area has been underprotected - special precincts were incorporated into the Master Plan - the park hierarchy system, including Regional Parks (Conservation Authorities) were reviewed - a framework is needed for future network of trails and open space sYstem - a more comprehensive approach and more emphasis on co-ordination is required for the museums and the library - although the Town offers excellent cultural programs there is fear of "Volunteer Burnout" - liability is a great concern to all - the Newcastle Community Services Advisory Board, in its present state and mandate, should be phased out and a new Community Liaison group established; and - heritage cultural co-ordination is needed. G.P.& A Minutes DELEGATIONS - 5 - February 17, 1992 Mayor Hamre informed the Committee that thirty students from Bowmanville High School were in attendance to hear the comments made by speakers pertaining to the proposed Highway 407, as part of a school project. Resolution #GPA-126-92 Moved by Councillor N oval<, seconded by Councillor Dres1inski THAT the agenda be altered to hear delegations (i) to (p) at this time. "CARRIED" (i) Bruce Taylor, R.R.#1, "F.nn;Alnllen, LOB lHO - re: Report PD-238-91 - circulated a letter dated February 17, 1992 which states that: - "for the stable growth and economic health of this Town and its resident taxpayers, it is imperative we have adequate transportation routes into and out of this area in place for the future. - the significant increase of trucks transporting the products of gravel pit extraction from resources outside our Town are significantly deteriorating our local road structure. These roads are maintained in the major portion by our property tax dollars. - we need ttnot never", "not 25 - 30 years from now" but "now" arterial roads to carry this through the Town traffic. - the proposed route has the least impact on the environment when compared to other routing areas. - at the current rate of decrease of farming operations in the Town, 20 - 30 years from now there will be few farm operations left which actively produce agricultural product whether we have a highway constructed or not. - there is a substantial risk the Town, with its many communities, will become a stalled haven for aging social program users who drain our property taxes if growth is not encouraged" He referred to the proposed Highway 407 as being "the least worst solution" and requested that the recommendations contained in Report PD-238-91 be approved. G) Bon Trent, 8399 MiddIe Road, R.R.#1, Bowmanville, LlC 3K2 - reo Report PD-238-91 - expressed opposition to the proposed most northerly Highway 407 route and made the following comments: - there would be volumes of traffic travelling the link from Highway 401 to Highway 407 through rural routes - this Highway would destroy the Oak Ridges Moraine - the northerly route would damage and pollute creeks - selection of this route would rob Bowmanville of much needed industry - servicing of this area would be diftIcult - selection of the northerly route would fragment the area; and '"" r. :'~ C::JJ G.P.& A Minutes - 6- February 17, 1992 . DELEGATIONS CONT'D. - it is costing the Town of Newcastle time and money to rehash this proposal. He requested that the Committee approve the recommendations contained in Report PD-238-91. (k) Roy Forrester, 5301 Main Street, Orono, LOB lMO - reo Report PD-238-91 - advised that alternate means of transportation are needed. High occupancy lanes could be created on major roads and, public transit, rather than "one car - one occupant," can be used. The results of a survey conducted by the Canadian Auto Association with 40,000 replies indicated that 63% called for more public transportation spending. He noted that, if a route is selected, his preference is for the southern route. . (1) Lynn HeIpord, Concerned Citizens Committee, 3190 TownIine Road. R.R.#2, Orono, LOB 1MO - reo Report PD-238-91 - circulated a copy of the Ontario Food Land Guidelines and a map of the Highway 407 proposed route and the north route. He advised that the Town of Newcastle will not "shrivel up and wither" if Highway 407 does not go through. He has delved into this issue with the Towns of Ajax, Pickering, Oshawa and Whitby who have noted some objection to this project. Highway 407 does not guarantee more industrial development in the Town of Newcastle. He referred to this project as a "crime against the laws of nature by destroying the farmland." (m) Karen McArthur, R.R.#5, Bowmanville, L1e 3K6 - reo Report PD-238-9l - was called but was not present. (n) Jan Montgomery, R.R.#2, Orono, LOB lMO - reo Report PD-238-91 _ referred to the auto industry as being a major energy consumer and polluter. She advised that approval of the proposed Highway 407 would be encouraging this activity which is "old world thinking". She stated that we have the "ability to create our world and if we ignore the warning signs around us, we must change or perish." She requested the Committee to say "no" to the approval of this project because if "new ways of living are not created, we will not have a future." (0) Garnet Rickard, R.R.#4, BowmanviI1e, L1e 3K5 - reo Report PD-238-91 - circulated a letter with attachments of newspaper articles entitled "MTC Unimpressed by Newcastle Complaints About Highway 407 Plan" and "Rae Delivers Budget Chop". He made the following comments: . - "Highway 407 - Can we afford it? What are the benefits? Our economy is weakening. Our social problems are increasing. Our environment is suffering. - Communities will become stronger, local identity will return, a massive highway such as Highway 407 through this Town will be unnecessary. - Our first and most important option is to preserve our best agriculture land to feed the millions that some people forecast will live here in the future. Legros, 1678 Bloor Street, Courtire, LlE 2N1 - re: Report PD-4 7 -92 - advised that his property abuts the subject site to the west and he has been a resident of this area for 17 years. He has enjoyed a good neighbourly relationship with the applicant for many years. He referred to this project as not being an enlargement or expansion of the existing use and advised that he is in opposition to a use that is substantially different from the present use. He objects to this proposal because the flea market does not conform, carries the existing use to Sundays and his property will be adversely affected by the traffic generated by the flea market. (b) Randy Henry, 172 King Street East, Oshawa, LlH IB7 - re: Report PD-4 7 -92 - displayed a copy of the floor plan and advised that the Saturday and Sunday flea market hours will be from 9:00 am. to 5:00 p.m. The auction is expected to be held one night per week. His brother resides inunediately to the east and his mother lives directly across from the site, therefore it is his intention not to disturb the surrounding neighbourhood. He noted that this is a three-year rezoning and not a permanent use. eouncillor Hannah made a declaration of interest with respect to Report PD-55-92; vacated his chair and refrained from discussion and voting on the subject matter. Councillor Hannah is a member of a gun club. (c) Bill Funston, 160 Beaver Street South, Newcastle, LIB 1C4 - reo Report PD-55-92 - advised that his wife appeared before the Committee on October 20, 1991 to express her concerns with their neighbour using a long bow and a cross bow in their backyard Since this time, this activity has progressed from being a hobby to giving lessons to customers. Intimidating remarks have been made to his wife by these customers and he has changed jobs to be home every evening because his wife is feeling threatened. 20/ . . . (d) Conservation Offi<:er McQuay, Ministry of Natural Resoun:es, 322 Kent Street West, Lindsay, K9V 4T7 - reo Report PD-55-92 - advised that, although he strongly agrees with prohibiting certain archery type activities for the safety of residents, he is of the opinion that the proposed fIrearms by-law is too restrictive and places the hunter in a situation of breaking the law. The by-law restricts the farmer and his inunediate family from protecting their property. He noted that hunters are needed because the Ministry does not have the capability to control the recent explosion of the Canada Geese population and hunting is an important management tool in this process. (h) Bruce Wood, 4275 Too1eys Road, Courtiee, LlE 1Z4 - reo Report PD-56-92 - circulated a letter he received from the eentral Lake Ontario Conservation Authority, dated October 10, 1991, pertinent attschments and a home video made on May 10, 1990 (on me in the Clerk's Dept.). He advised that in 1985, the Ministry of the Environment approved guidelines prohibiting asphalt fill in residential areas. Subsequently the Ministry sent the Town a letter requesting it remove the rill from the property. In his estimation, these are conflicting statements. He advised that the asphalt and debris were pushed onto his property as a result of development taking place on his neighbour's land and he commenced civil action on February 13, 1992. "CARRIEDII Resolution #GPA-161-92 Moved by Councillor Dres1inski, seconded by Councillor Novak WHEREAS at the invitation of Mr. Patrick MacCulloch, Chairman of the Siting Task Force Low Level Radioactive Waste Management, Mayor Diane Hamre, Councillor David Scott, the Town's Administrator and the Town's Solicitor attended a meeting in Toronto on February 7, 8 and 9, 1992 convened by the Task Force, attended by members of the Task Force and its Staff, by representatives of the Councils of the other source municipalities, the Town of Port Hope and Hope Township, as well as by representatives of the Councils of the possible volunteer municipalities of Deep River, Geraldton and Hornepayne; WHEREAS at the meeting of Council held on February 10, 1992, Mayor Hamre delivered a verbal report on the meeting, noting that it was convened to determine the willingness of the municipalities concerned to participate in Phases Four and Five of the Cooperative Siting Process for the removal of low-level radioactive waste from the source municipalities and relocation of it in one or more volunteer municipalities, as well as to determine the terms of participation in the process; WHEREAS Mayor Hamre reported that the results of the meeting were such as to generally satisfy the conditions set out in Council's Resolution of December 10, 1990 for participation of the Town in Phases Four and Five of the Cooperative Siting Process, and accordingly she had advised that, subject to Council's conf1rIlllltion, the Town would be participating in Phases Four and Five; WHEREAS the Cooperative Siting Process involves the appointment by Council, after consultation with the Siting Force, of a Community Lisison Group for the Town to hold office for three years to be responsible both to Council and to the Siting Task Force, to use staff, consultants and rmancial resources to be made available by the Siting Task Force, and with terms of reference remaining to be settled in detail which will be brought before Council for its approval at a subsequent meeting; . . .
