THAT the minutes of a regular meeting of the General Purpose and
Administration Committee held on January 6, 1992 be approved.

Pursuant to Section 34, Subsection 12 of the Planning Act, the Town of
Newcastle Council, through its General Purpose and Administrative
Committee, is holding a Public Meeting for the following rezoning
applications:
(a) Proposed Zoning Application - Part Lot 15, Concession 3, former
Township of Dar1ington - Peter Brooks; and

(b) Proposed Zoning Application - Part Lots 11 and 12, Concession 3,
former Township of Clarke - Laidlaw Waste Systems (Durham) Limited.
Pursuant to Section 17(2), and Section 21(1) of the Planning Act, the Town is
also holding a Public Meeting for the following Official Plan Amendment
application:
(c) Proposed Official Plan Amendment Application - Part Lots 11 and 12,
eoncession 3, former Township of Clarke - Laidlaw Waste Systems
(Durham) Limited.
Before proceeding with these matters, the ehairman asked the Deputy Clerk
to advise on the manner of notice.
The Deputy Clerk advised that:
(a) Public notices were mailed to all property owners within 120 metres by
December 20, 1991;
(b) Notices of the public meetings were posted on each of the sites by
December 20, 1991; and
(c) The notice procedure complies with Ontario Regulation 404/83.
The Chairman announced that any persons wishing further notice of the
passage of the by-law, if passed, to leave their name, address and telephone
number with the Deputy Clerk before they leave.
The Chairman announced that the Director of Planning and Development
would describe the purpose and effect of each of the proposed amendments,
followed by comments from any objectors, supporters and the applicant
speaking last.
(a) Peter Brooks - Report PD-24-92 - the purpose and effect of this
application is to permit the development of two (2) additional single
family dwellings.
Noone spoke in opposition to or in support of this application.
The applicant was present to answer questions from the Committee.
(b) Laidlaw Waste Systems (Durham) Limited - Report PD-25-91 - the
purpose and effect of these applications is to permit the operation of a
"Waste Management Facility" including the recognition of the existing
land rill site as well as to permit landfIlling on a 1.4 acre site between
the two existing waste mounds.

Ben Kortekaas, R.R.#1, Orono, LOB lMO, advised that his residence is
located to the north of this site and that, for the last decade, the local
citizens have requested denial of various applications made by Laidlaw.
He noted that surrounding residents have spent many dollars and much
emotional energy opposing Laidlaw's proposals. He expressed fun
support for the staff recommendations contained in Report PD- 25-92 to
deny this application.
Judith Lowes, R.R.#1, Newtonville, LOA lJo, who resides to the east of
this site, advised that this is the fIfth time a member of her family has
expressed opposition to Laidlaw's proposals. She concurred with the
remarks made by Mr. Kortekaas and further suggested that, because
dumping has taken place at night, investigations should be undertaken
to determine what has been buried on this site.
Normunds Berzins, R.R.#1, Orono, LOB lMO, appeared on behalf of the
Committee of the Clarke Constituents and stated fun support for the
staff recommendations contained in Report PD- 25-92 to deny this
application.
Helen MacDonald, R.R.#1, Newtonville, LOA lJO, articulated support
for the staff recommendations contained in Report PD-25-92 to deny the
application and read "The Lorax" by Dr. Seuss. She requested that the
Committee deny the application made by Laidlaw and give serious
consideration to all future applications which might adversely impact
the environment. She offered to work in partnership with the
Committee to protect the environment and protect her rights to clean
water and fresh air as "we are borrowing the land from our children."
Noone spoke in support of this application.
The applicant was present to answer questions from the Committee.
Cliff Lumley, P _ Eng., Ministry of Transportation, Central Region, 3rd
Floor, Atrium Tower, 1201 Wilson Avenue, Downsview, M3M lJ8,
introduced various members of the Highway No. 407 project team and
informed the Committee that the Technically Preferred Highway 407
Route represents approximately 10 years of work. He circulated the
following documentation:

He advised that the Ministry of Transportation and the Highway 407
Project team are willing to hold more Public Meetings to allow for
residents' input, if requested by Council. He requested that, at some
future point in time, Council formally give written endorsement of their
Preferred Highway 4071Transit Transportation Corridor.
(a) He1en MacDonald, R.R.#1, NewtonviIle, LOA lJO - re: Reports
PD-31-92 and PD-33-92 - expressed support for the staff
recommendations contained in Report PD-31-92 to deny Laidlaw Waste
Systems' Leachate Forcemain Proposal. She advised that the status
report on the N ewcast1e Waterfront Study (Report PD-33-92) and the
application by Laidlaw pertaining to the Leachate Forcemain proposal
are very closely interrelated and referred to Laidlaw's application as
"putting the cart before the donkey". She feels that the Graham Creek
is negatively impacted by Leachate emanating from the Laidlaw site.
Leachate which is now transported to the sewage treatment plant and
the contents of which are later emptied into Lake Ontario further
creates global impact.

(e) Kevin Tunney, Tunney Pbonnu,g. 340 Byron St. So, Whitby, LlN 4P8 -
re: Report PD-13-92 - circulated a letter from Jim Blair, Director,
Strategic Planning Branch, Region of Durham, addressed to the
Ministry of Agriculture and Food stating that "the subject amendment
application, (Stolp Homes) through the actions of Regional Council on
June 5, 1991 has been approved within the context of the new plan."
He also circulated a letter from Janet Anderson, District Manager,
Ministry of Agriculture and Food stating that "if these lands become
designated for urban purposes, the Ministry will not have any site
specific concerns on the plan of subdivision. There are no barns that
would cause an Agricultural Code of Practice concern." Mr. Tunney
requested that applications OPA 89-32, Rezoning Application
DEV 89-49 and Plan of Subdivision l8T-89037 filed by Stolp Homes be
exempt from the recommendations contained in Report PD-13-92 and
that staff continue to process these applications in accordance with
Council's previous direction of July 3, 1989.

LlH 1B6 - reo Report PD-13-92 - appeared on behalf of Halminen
Homes and 3D Development Corporation. He advised that Halminen
Homes owns a parcel of land comprised of 60 acres located on the east
side of Trul1s Road and South of Highway No.2, 15 acres of which are
currently located outside the Urban Area Boundary. He requested that
the N eighbourhood Plan be extended to include all of these holdings.
He requested that the 60 acre parcel of land owned by 3D Development
Corporation located at Bloor Street and Townline Road also be included
as part of the current Urban Area and that these two applicants be
exempt from Paragraph 3 of Report PD-13-92 and be allowed to
continue through the development process.
(g) Bryce Jnrdan, G.M. Bernas & ~ates, 110 Scotia Crt., Unit 41,
Whitby, LlN 8Y7 - reo Report PD-13-92 - indicated that, pursuant to
his delegation to the General Purpose and Administration Committee
on January 6, 1992 wherein he requested that Town staff participate
and provide input into the Environmental Impact Study, he has been
advised that staff will co-operate.

WHEREAS Maxi Drug has submitted a site plan application to the Town
for approval of a drug store at the corner of King Street and Lambert
Street;
AND WHEREAS the Town would normally require road widening as a
condition of site plan approval;
AND WHEREAS Maxi Drug requested the Town to waive the road
widening requirements due to site constraints;
AND WHEREAS this is an extraordinary time that the Town needs to
be flexible in its approach to stimulate the local economy;
NOW THEREFORE, the Town resolves that road widenings will not be
required for the Maxi Drug site plan application and further that access
be granted on King Street.

Invoicing by the Town of Newcastle for all costs related to any fire on
any property used for an illegal landfill/dump site.
All costs incurred by the Town of Newcastle for manpower related to
Fire Department operations shall be the responsibility of the property
owner.
All costs incurred by the Town of Newcastle for damaged or destroyed
equipment, including the use of any and all chemicals and foam shall be
the responsibility of the property owner.
All costs incurred by the Town of Newcastle for outside agencies or
equipment required for prompt and complete control, containment and
extinguishment of any fire shall be the responsibility of the property
owner.

All costs incurred by the Town of Newcastle for equipment necessary for
proper control, contsinment and extinguishment of any fire on any
property used as a legal landfill/dump site shall be the responsibility of
the property owner.

THAT Report WD-8-92 be received;
THAT requests for all-way stops to act as speed control devices at the
intersections of Auburn LanelPebblebeach Drive; Glenabbey Drivel
Pinedale Crescent; Glenabbey DrivelBruntsfield Street; Glenabbey Drivel
Auburn Lane; Glenabbey Drive/Robert Adams Drive; and Robert Adams
Drive/Hampstead Gate, which are unwarranted based on Provincial
guidelines, be denied;
THAT Durham Regional Police be provided with a copy of Report
WD-8-92 and be requested to strictly enforce the existing Maximum
50 km/hour speed zones on Glenabbey Drive and other residential
collector type roadways in the Courtice area;
THAT the request to lower the speed limit on Glenabbey Drive from
50 km/hour to 40 km/hour be denied;
THAT the request to prohibit heavy trucks from entering Glenabbey
Drive be denied; and
THAT the concerned residents listed in Report WD-8-92 be advised of
Council's decision and be provided with a copy of Report WD-8-92.

Management Act, 1991 and be forwarded to the Standing Committee;
THAT the Mayor and/or any appropriate staff be authorized to present
the Town's submission regarding Bill 143 to the Standing Committee, if
an appointment can be arranged; and
THAT a copy of the Town's submission to the Standing Committee
regarding Bill 143 be forwarded to the Regional Municipality of Durham.
