Resolution #GPA-612-93 Moved by Councillor Dreslinski, seconded by Councillor Novak THAT the minutes of a regular meeting of the General Purpose and Administration Committee held on October 18, 1993, be approved. "CARRIED" Pursuant to Section 34, Subsection 12 of the Planning Act, the Municipality of Clarington Council, through its General Purpose and Administration Committee, is holding a Public Meeting for the following Rezoning Application: (a) Proposed Zoning By-law Amendment - Municipality of Clarington. Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that a public notice for the rezoning application was placed in local newspapers on or before September 29, 1993. In addition, notice was mailed by fIrst class mail to all motor vehicle sales establishments listed in the Municipality's April 1993 edition of the Business Directory. This notice procedure is in compliance with Ontario Regulation 404/83. 201 G.P. & A Minutes . - 2- November 1, 1993 PUBLIC MEETING CONT'D. DELEGATIONS . . The Chairman announced that all persons who wish further notice of the passage of the by-law should leave their name, address and telephone number with the Clerk's Department. The Chairman announced that the Director of P1amrlng and Development would describe the purpose and effect of the proposed amendment, then the objectors would be heard, followed by the supporters and the applicant. (a) Municipality ofC1arington - Report PD-147-93 - The purpose and effect of this application is to permit all automobile dealers the opportunity to sell motor boats and trailers in addition to the selling of automobiles. Noone spoke in opposition to or in support of this application. (a) Ron Kitchen, 86 Simcoe Street South, Oshawa, Lill 7L5 - re: Report PD-149-93 - introduced Mr. Paul Langley, one of the applicants. He gave a slide presentation depicting an aerial overview of the lands encompassed in the subject application. Mr. Kitchen indicated that he does not agree with the concept that his client's lands should be used as a buffer for the gravel pit operation and Burketon Estates. In his estimation, the slides clearly demonstrate that the gravel pit operation is adequately screened with trees. In his opinion, the gravel pit operation cannot extend closer to Durham Road 57 because the Hydro Tower in its path would have to be knocked down. Mr. Langley indicated that he purchased the property in 1982 and built the existing residence in 1986. He noted that he is willing to build an entrance for the future homes onto Concession Road 10 if he is requested to do so. Mr. Kitchen further advised that the offIcial policy allows for two entrances per side of the road, per mile and that his client's needs would not exceed this policy. (b) A1an~, 1787 ~ Road 10, R.R. #2, Blackstock, LOB 1BO - re: Report PD-152-93 - appeared on behalf of the residents of the area and noted that he had a document containing approximately 900 signatures of persons who are opposed to this application. He requested that previous resolutions be rescinded and the me be closed on this matter. He informed Members of the Committee that he owns a farm located approximately 1 km from the subject site. He noted opposition to this application for the following reasons: the existing roads are not suitable and the additional traffic would require upgrading of the roads; costs of increased road maintenance; major environmental concerns pertaining to contamination of the headwaters of the Bowmanville Creek and the Oshawa Creek; difficulty in controlling spillage; potential fire hazards to the adjacent forest; and health risks. He noted that the Ministry of the Environment turned down this site in 1977 and that the Ron Canter report cOnIll'1lled the application as premature. 2U2 . . . G.P. & A Minutes DELEGATIONS CONT'D. - 3- November 1, 1993 (c) Harvey Ambrose, Courtire Auto Workers, 800 Colonel Sam Drive, Oshawa, L1H 8A9 - re: Report PD-152-93 - advised that he will submit the necessary documentation for a rezoning application before the end of the week. His intent was to wait for the approval of the Region of Durham Official Plan which would remove the requirement for an Official Plan Amendment. "CARRIED" Resolution #GPA-614-93 Moved by Councillor Dreslinski, seconded by Councillor O'Toole THAT Report PD-148-93 be received; THAT the request submitted by The Kaitlin Group Ltd on behalf of Martin Road Holdings Ltd., for removal of Part Lot Control on Lots 2 - 10 inclusive, Lots 12 - 19 inclusive, Lots 37 - 42 inclusive, Blocks 44 - 46 inclusive and Blocks 51 - 56 inclusive on Plan 40M-1734 be approved; THAT the By-law attached to Report PD-148-93 be approved and forwarded to the Regional Municipality of Durham pursuant to Section 50(7) of the Planning Act; and THAT the interested parties listed in Report PD-148-93 and any delegation be advised of Council's decision.
