Administration Committee held on January 18, 1993, be approved.

Pursuant to Section 34, Subsection 12 of the P!anriing Act, the Town of
Newcastle Council, through its General Purpose and Administration
Committee, is holding a Public Meeting for the following Rezoning
Applications:
(a) Proposed Zoning By-law Amendment - Part Lot 31, Concession 2,
former Township of Darliogton - Aiexandris Investments; and
(b)(i)
Proposed Zoning By.law Amendment - Part Lot 27, Concession 3,
former Township of Darlington - Courtice Heights Developments
Pursuant to Town procedures, the Town is also holding a Public Meeting for
the following Neighbourhood Plan Amendment Applications:

Before proceeding with this matter, the Chairman asked the Deputy Clerk to
advise on the manner of notice.
The Deputy Clerk advised that public notices for the rezoning applications
were sent by fll"st class mail on or before January 1, 1993 to all property
owners within 120 metres of the subject property in accordance with the
latest municipal assessment record. In addition, notices were also posted on
the sites prior to January 1, 1993. This notice procedure is in compliance
with Ontario Regulation 404/83.

Public notices for the Neighbourhood Plan applications were placed in local
newspapers on January 6, 1993. Written notice was circulated to all assessed
property owners within Courtice North N eighbourhood 3C and to those
within a 120 metre radius surrounding the whole site. In addition, notices
were also posted on sites prior to January 1, 1993.
The Chairman announced that all persons wishing further notice of the
passage of the by-laws should leave their name, address and telephone
number with the Clerk's Department before they leave.
The Chairman announced that the Manager, Development Review Branch,
P!anriing and Development Department would describe the purpose and effect
of the proposed amendments, then the objectors would be heard, followed by
the supporters and the applicant.
(a) Alexandris Investments - Report PD-21-93 - the purpose and effect of
this application is to permit the development of a plan of subdivision
consisting of one (1) single family dwelling; forty four (44) semi-detached
units and twelve (12) townhouse units, totalling 57 units.

R. Martindale, The Greer Galloway Group, 1415 King Street, Courtice,
LIE 2J6, appeared on behalf of Mr. Dick Vooys who owns a five-acre
parcel of land located immediately south of the subject property. He
verbalized opposition to this application because the plan is premature_
The Regional Works Department have advised him that the subject site
is too close to Y orkville Drive and there is no access from this subdivision
to Trulls Road. No road pattern has been established. He also
expressed opposition to the design portion of this proposal stating that
the road is 23 metres wide when, in fact, the minimum width
requirement is 26 metres. This unnecessarily restricts the design of his
clients' lands which will become locked into a road pattern without his
clients' consent. He requested that the applicant be required to rectifY
any well interference at his expense and that a fence be installed along
the southern portion of the development to deter vandalism.

Noone spoke in support of this application.
The applicant was present but did not wish to address the
Committee.
Courtice Heights Developments - Report PD-23-93 - the purpose
and effect of the application is to permit the development of 95
single detached units, 28 semi-detached units and 23 towllhouse
units for a total of 146 units.
Courtice Heights Developments - Report PD-22-93 - the purpose
and effect of the Official Plan Amendment is:
- to establish a Local Central Area with 2508 m2 (27,000 sq. ft.) of
commercial uses;
- to increase the target population of N eighbourhood 3C from 1900
to 4585;
- to designate medium and low density residential areas; and
- to redefine the Hazard Lands areas.
The purpose and effect of the N eighbourhood Plan Amendment is
to establish a neighbourhood development plan for Courtice North
Neighbourhood 3C north of Nash Road and to modify the existing
neighbourhood development plan for the lands south of Nash Road.
The applicant has proposed three residential categories based on
the following criteria:
- Low Density I - maximum of 10 units per ha
- Low Density II - 11 to 23 units per ha
- Medium Density - maximum of 41 units per ha
Wyndlaod Consultants Ltd. - Report PD-24-93 - the purpose and
effect of this application is to amend the N eighbourhood Plan to
permit a thirty three (33) lot plan of subdivision.
Evylin Stroud, 89 Little Avenue, Bowmanville, Lie 1J9, re:
Reports PD-22-93, PD-23-93 and PD-24-93 - expressed opposition
to the proposals because they are located on Environmentally
Protected and Prime Agricultural lands. She referred to the
contents of Paragraphs 8.4, 8.5, 9.3 and 9.4 of Report PD-22-93
and made specific reference to Paragraph 8.6 which states that
"surveys conducted during November of 1991 did not identifY
critical wildlife habitat, rarelunusual vegetation communities or
significant species"...she questioned the wisdom of conducting this
type of survey during November rather than in the springtime.
She feels that it would be a good idea to hire a consultant to
review the whole area

Pam Callus, 3452 Courtice Road, Courtice, LIE 2L6, re: Reports
PD-22-93, PD-23-93 and PD-24-93 - circulated a letter dated
February 1, 1993, on behalf of her hushand, Jim Osborne, wherein
they voice opposition to the proposal to increase the target
population of Neighbourhood 3C from 1900 to 4400. She stated
that "the proposed increase amounts to irresponsibility and violates
the current feeling in the Community that we must work with the
environment and not against it"...she referred to a 50 acre plot in
the northwest comer of this neighbourhood planning area which
possessed unique tree species and was a private woodlot collection.
The present owners clear cut 50 acres of this forest and, after a
rainfall, thousands of litres of water pour off this land. Pam Callus
also circulated a letter of opposition dated January 31, 1993 from
Vicki and Roger Bergman, 3358 Courtice Road, Courtice, LIE 2L7.
Elena Racarsky, 3200 HanrfV"J,: Road, Courtice, LIE 2M1, re:
Reports PD-22-93, PD.23-93 and PD-24-93 - expressed opposition
to all three proposals stating that drainage of the land will be
adversely affected if this area is developed. She has noticed that
wild animal species have decreased dramatically since the
developer has cleared the land of the trees and some of the
remaining trees are now affected by disease. She referenced
section 8.6 of Report PD-22-93 which states that an environmental
analysis entitled "Preliminary Environmental Overview
Assessment" was conducted in November, 1991 and the analysis
did not identify "critical wildlife habitat, rarelunusual vegetation
communities or significant species"...and requested that this
analysis be conducted during the springtime because November
was an inappropriate time of year.
Elmer Pollard, 3051 Courtice Road, Courtice, LIE 2H8, . re:
Reports PD-22-93 and PD-23-93 - spoke in support of these
applications, stating that since the 25 acre parcel has been cleared
of the trees and brush, the drainage on his land has been greatly
improved.
William ManRllfl, ~ect Manager, WDM Consultants, 20 C1PmatiR
Road, WilIowdale, M2J 4X2, re: Reports PD-22-93 and PD-23-93 -
advised the Committee that the 25 acre parcel of land was
purchased in 1973 by Courtice Heights Developments. Since
September, 1991, various studies have been conducted:
- John Bousfield produced a N eighbourhood P!anriing Concept 3C
which addresses the entire 200 acre parcel and surrounding area
- trees, vegetation, wildlife, bird life and reptiles;
- W. Gibson and Associates - a study of the impact that this
development will have on ground water tables and domestic
wells;
- G.M. Sernas conducted a study pertaining to sanitary sewers and
storm drainage and determined that the present systems in place
are sufficient to service the future population; and
Grading and detail of the topography was also reviewed to
determine the suitability of the commercial component of the
area

Mr. Manson expressed his williogness to contribute fmancially to
the study to be conducted by the Region of Durham.
He noted that this development is not premature for the following
reasons:
- the watermain currently exists on Nash Road;
- Sanitary Sewers are now in place;
- the Master Drainage Study has been approved; and
- the road works are slated for construction.
Sam Dechukwu, WyndIand ConRI11bmts Ltd, 5 Lavington Drive,
Suite 7, Weston, M9R 2H1., re: Report PD-24-93 - circulated a
map of the subject 9 acre site and advised that the application for
a 33 lot subdivision is considered low density single fumily units.
He advised that the parcel in question is located outside the
environmentally protected lands. He requested that this project be
allowed to proceed now rather than in the context of the Town of
Newcastle's Official Plan Review.

West, Unit 50, Brampton, L7A 1A2 - requested that the Town of
Newcastle issue a letter of support for the establishment of a
commercial hall to hold bingos, seven days per week, in a location
previously leased by a furniture store on King Street. Bingo
Country would then conduct a feasibility study at an approximate
cost of $10,000.00 to address miscellaneous factors, including
traffic.
(b)
Kevin Tunney, Tunney Planning, 340 Byron Street South, Whitby,
LlN 4P8 - circulated a document entitled 'Notice of Public
Workshop' advising of a workshop to be held on Wednesday,
February 17, 1993 at the Courtice Secondary School Pursuant to
the authorization by the Town of Newcastle for the preparation of
a comprehensive land use plan for the southwest portion of the
Courtice Urhan Area, Tunney Planning Inc., in association with
Cosburn Gibberson, Landscape Architects, G.M. Sernas and
Associates, Consulting Engineers and Cansult Group Limited,
Transportation Engineers, have now completed Phase I -
Background Study and Phase IT - Options Report. The Public
Workshop is being held to provide information to the residents and
seek their input.

Helen MacDonald, R.R. #1, Newtonville, LOA lJO - re: Report PD-
28-93 - circulated a letter dated February 1, 1993 and appeared on
behalf of the Committee of Clarke Constituents. She verbalized
support for the contents of Report PD-28-93 and emphasized the
following points:
.
Section 1 - "...displacement of the Stapleton Family's dairy
operation... is beyond logic"...
Section 2 - "...the identification of the Lsidlaw Expansion Lands
as a candidate site excludes the site from the more vigourous
reviews anticipated...this process appears to diminish community
participatory status".
Section 3 - "there are a number of puzzliog contradictions and
inconsistencies...as they relate to the weighting of the sites for
geologylbydrogeology and agriculture".
"...there have been ongoing concerns regarding ground water
pollution from the existing site and it appears that these
concerns are not factored into the criteria evaluation."
- "...Newtonville Public School is more than an education
institution for local children. ...the school is a major community
centre utilized beyond the school community resulting in a larger
population being alfected throughout the year through large
increases in vehicular traffic. H
"...the hall route, which passes directly by the school, acts not
ouly as a route for the N ewtonville Public School buses, but also
for many other buses which service five elementary schools and
two high schools."
"we are particularly concerned with a perceived conflict of
interest with the consulting firm which undertook the social
impact assessment for the 1. W.A, the Institute of Environmental
Research, which, we recall, also conducted the social impact
assessment for Lsidlaw's infill proposal and some of the public
consultation vis-a-vis Lsidlaw's major expansion proposal."
In conclusion, she stated: "most importantly, we are deeply
concerned that this site will be selected by default rather than
established by fact."
