Resolution #GPA-567-94 Moved by Councillor Dreslinski, seconded by Councillor Hannah THAT the minutes of a regular meeting of the General Purpose and Administration Committee held on September 6, 1994, be approved. "CARRIED" Pursuant to Section 17(2), Subsection 21(1) of the Planning Act, the Municipality of C1arington Council, through its General Purpose and Administration Committee, is holding a Public Meeting for the following Official Plan Amendment and Neighbourhood Plan Amendment Applications: (a) OPA 87-27/C, NPA 87-D4/CS and NPA 91-041/CS - Part Lots 33 and 34, Concession 2, former Township of Darlington - Three D Developments (705400 Ontario Ltd.) (b) OPA 89-32/C and NPA 94-01/CSW - Part Lot 35, Concession 1, former Township of Darlington - Stolp Homes (Newcastle) Developers Inc. 2n) . . . G.P.& A. Minutes - 2- September 19, 1994 PUBLIC MEETINGS CONT'D These applications wi II be considered in the context of Amendment No. 59 to the Official Plan of the former Town of Newcastle. This Amendment applies to lands in Part Lots 33, 34 and 35, Concessions 1 and 2 in the former Township of Darlington. Also under consideration is Amendment #5 to the Courtice South (Neighbourhood 2) Plan and the adoption of Courtice Southwest (Neighbourhood 4) Plan. These documents are the result of the Southwest Courtice Planning Study undertaken by Tunney Planning Ltd. Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on ~he manner of notice. The Deputy Clerk advised that publ ic notices for all official plan amendment applications were placed in local newspapers on or before August 17, 1994. In addition, notices were mailed to interested parties who had previously registered with the Municipality. This notice procedure is in compliance with Ontario Regulation 402/83. The Chairman announced that the Director of Planning and Development would describe the purpose and effect of the proposed amendment, then the objectors would be heard, followed by the supporters and the applicant. (a) Report PD-l1 0-94 - Stolp Homes (Newcastle) Developers Inc. and Three D Developments - the purpose and effect of the application is that Amendment #59 extends the Courtice Urban Area boundary and establishes land uses, population targets, and road classifications for this area. The Amendment also provides for policies on residential areas and densities, phasing, stormwater management and the preparation of neighbourhood plans which apply generally to the Courtice Urban Area. Amendment #5 to the Courtice South (Neighbourhood 2) Plan redefines the boundaries, amends land use and road designations, adjusts residential density categories and incorporates various technical modification in conformity with proposed Amendment #59 to the Official Plan. The new Courtice Southwest (Neighbourhood 4) Plan provides comprehensive detailed land use designations and policies for the development of this new Neighbourhood in conformity with proposed Amendment #59 to the Official Plan. 202 G.P.& A. Minutes . PUBLIC MEETINGS CONT'D . . - 3 - September 19, 1994 Hugh Neill, 2111 Prestonvale Road, Courtice, L lE 2S2 - circulated a petition containing approximately 105 signatures stating that... "we, the residents of Prestonvale Road, want our road to remain a local road. We feel our road is too busy now and the new subdivisions should disperse their own traffic". He also circulated a letter which stated that the present designation of the road is based on previous agreements with the Town to leave Prestonvale Road a residential street. He noted that the residents of Prestonvale Road should not be forced to take additional traffic, noise, pollution, inconvenience and loss of road frontage property or be forced to move away to allow developers to develop great large parcels of property without supplying arterial roads. Elsie Mayne, 1440 Bloor Street, Courtice, L 1E 2N6 - advised that she has operated a horse farm at this location for 30 years and does not want her life style altered by "crammed" residential development. She would like the wide open spaces to remain untouched. George West, 2640 Prestonvale Road, Courtice, L1 E 2R9 - requested Members of the Committee not to allow developers to utilize the residents' front yards to widen the road for their financial gain. He suggested that Townline Road should be bridged and extended to Bloor Street. In his opinion, traffic on Prestonvale Road would not be a problem if the barricade on Robert Adams Drive was removed. Rob Whitehead, 2406 Prestonvale Road, Courtice, L 1E 2S 1 - advised that h~ moved to Prestonvale Road five years ago because, at that time, it was a quiet street in a peaceful neighbourhood with well treed large lots. He feels that Prestonvale Road has become a "speed zone" and fears for the safety of his wife and three children. Robert Cowie, 2682 Prestonvale Road, Courtice, L 1 E 2R9 - expressed concerns because his sidewalk is immediately adjacent to the road and is a safety hazard. He advised that traffic should not be diverted from Glenabbey Road which is a collector road to Prestonvale Road which is a local road. Barb Cowie, 2682 Prestonvale Road, Courtice, L 1 E 2R9 - see ked clarification as to why a local road would be widened from 8.5 metres to 10 metres thus creating a situation where, on her side of the road, there is no boulevard and the sidewalk is immediately adjacent to the road. Jan Hawryszko, 2588 Prestonvale Road, Courtice, L 1E lWl - requested clarification on how many feet would be removed from his front yard if the designation of Prestonvale Road is changed from local to arterial road. Vicky Groeneveld, 1463 Bloor Street, Courtice, L 1E 2N7 - advised that she has been a resident of Bloor Street living on a one acre parcel for 10 years. Her preference would be that the land remain agricultural and she expressed concerns pertaining to traffic and safety hazards. She requested that the density of housing be lowered to allow development of larger estate residential homes. 203 G.P.& A. Minutes . PUBLIC MEETINGS CONT'D . DELEGATIONS . - 4- September 19, 1994 William D. Manson, W.D.M. Consultants, 20 Clematis Road, Willowdale, M2J 4X2 - appeared on behalf of Courtice Heights Developments who own 50 acres of land located north of Highway #2 between Courtice Road and Hancock Road. He suggested that it would be more appropriate to deal with the Courtice area as a whole and will be submitting written comments on this matter. Ann Cowman, 55 Darlington Boulevard, Courtice, L 1 E 2J5 - advised the proposed plan indicates that there will be only two access points to the F2rewell Creek and suggested that specific policies be adopted by the Municipality to allow vehicular traffic to park so that occupants of cars can access the Farewell Creek area. She also suggested that funds should be set aside in a reserve fund to develop trails along the Farewell and Black Creeks. Jerry Sumara, 50 Robert Adams Drive, Courtice, L 1 E 1 Rl - noted that he takes great exception to the amount of vehicular traffic on his street through the night with no policing. He feels that there is no cohesive plan in place to allow north/south vehicular traffic flow patterns. He suggested that Townline Road be open to the south and that a four lane highway is needed for northlsouth traffic flow. John A. Page, 200 Bond Street West, Oshawa, L 1J 2L7 - appeared on behalf of a financial advisory firm which represents some 60 individuals who own a parcel of land located at the southwest quadrant of the proposal. He expressed support for the recommendations contained in Report PD-ll 0-94. David Simon, 2418 Prestonvale Road, Courtice, L lE 2S1 - noted that when he purchased his property, there was an unopened road allowance and suggested that if this road is opened, his house will light up like a christmas tree as the lights will shine into his large picture window in the living room. He requested that he be advised as to whether or not there will be a road opened at this location. Jack Crosbie, Penta Stolp Corporation, 100 Allstate Parkway, Suite 201, Markham, L3R 6H6 - appeared on behalf of Stolp Homes, The Freedman Family and Three D Development. He advised that the developer has done everything possible to meet the Municipality's requirements pertaining to land fill, drainage, environmental issues and feels that this is a "strong" plan. He expressed support for the recommendations contained in Report PD-110-94 would the exception of Paragraph x "c" 5. He suggested that the following wording be deleted from the recommendations..."the preference for development of previously designated urban lands in Neighbourhoods 1 to 3"... (a) Mrs. Kelly Pinheiro and Elizabeth Courneyea appeared on behalf of Mr. Robert Pinheiro, 2 Lavern Court, Bowmanville, L lC 4C9 - expressed support for the recommendations contained in Report PD-112-94. (b) Mr. N. Berzins, Clarke Constituence Committee, R.R. #1, Orono, LOB lMO - was called but was not present. 204 . . . G.P.& A. Minutes September 19, 1994 - 5- DELEGATIONS CONT'D (c) Peter Abramczuk, President, Oshawa Durham Homebuilders Association, 44 Rebecca Court, Bowmanville, L lC 4N7 - appeared on behalf of approximately 130 builders and developers who are concerned that the recommended option contained in Paragraph 2c of Report PD-l08-94 as this will create a financial burden on the construction industry. He requested that development charges be frozen for a further six months. (d) Niva Rowan, STORM and SAGA, R.R. #1, Newtonville, LOA lJO- circulated documentation dated September 19, 1994 wherein she requested that aggregate extraction not be allowed in the Ganaraska Forest, and in the Natural Core and Corridor areas. (e) John Wilson, 1421 Highway #2, Courtice, L 1E 2J6 - advised that his two properties and that of his neighbour's were rezoned from "Cl" to "C5" years ago and now it will be rezoned back to "Cl". He noted that, to develop the property, financing will be more readily made available under the "Cl" designation and the Municipality is requesting a $750 application fee to rezone the lands. He requested that the Committee waive this fee. PUBLIC WORKS DEPARTMENT "CARRIED" Amendment to Consol idated Traffic By-law 91-58 Regarding Parking at Division Street and Silver Street T02.5274.MU Councillor Hannah chaired this portion of the meeting. Resolution #GPA-588-94 Moved by Councillor O'Toole, seconded by Councillor Novak THAT Report WD-49-94 be received; THAT the time during which a fee is required for parking at the Division Street Parking Lot in Bowmanville be changed from 24 hours a day, 7 days a week, to 9:00 a.m. to 6:00 p.m., Monday to Friday, except during public holidays; THAT the two (2) hour limit, which is now in force at the Silver Street Parking Lot, be removed to permit extended parking periods and that a fee be required for parking from 9:00 a.m. to 6:00 p.m., Monday to Friday, except during public holidays; THAT the proposed by-law attached to Report WD-49-94 be forwarded to Council for approval to implement the above two recommendations; and 211 . . . Minutes - 12- September 19, 1994 PUBLIC WORKS DEPARTMENT CONT'D ADMINISTRATION OTHER BUSINESS Canada Ontario Infrastructure Works Program THAT a copy of the correspondence be forwarded to the Bowmanville Business Improvement Area. "CARRIED" Councillor Scott chaired this portion of the meeting. There were no reports considered under this section of the Agenda. Resolution #GPA-589-94 Moved by Councillor O'Toole, seconded by Councillor Hannah Whereas the Council of the Municipality of Clarington, while recognizing the benefit of the infusion of capital dollars into the economy provided by the Canada Ontario Infrastucture Works Program, is also concerned with the negative financial impact on this Municipality as a result of substantial increases in construction tender costs. The Council of the Municipality is hereby requesting that any future capital grants of this nature by the Provincial or Federal Government, be structured in such a way as to fit into the normal grant mechanisms and protocol such that the potential for creating an inflated market would be reduced and in addition, that the timing of the completion of such projects be left to the discretion of the Municipality such that maximization of grant dollars can be achieved with tenders called to match seasonal efficiencies; and THAT the Ministry of Municipal Affairs, Ministry of Finance (Federal and Provincial), the Association of Municipalities of Ontario and Gord Mills, M.P.P, be advised of Council's decision.
