MUNICIPALITY OF CLARINGTON General Purpose & Administration Committee June 21, 1994 ROLL CALL Present Were: Also Present: PUBLIC MEETING Minutes of a Special Meeting of the General Purpose and Administration Committee held on Tuesday, June 21, 1994 at 7:00 p.m., in the Bowmanville Recreation Complex Mayor D. Stockwell Director of Planning and Development, F. Wu Deputy Clerk, M. Knight Mayor Hanue chaired the meeting. Pursuant to Section 17 of the Planning Act, the Municipality of Clarington Council, through its General Purpose and Administration Committee, is holding a Public Meeting with respect to the Clarington Draft Official Plan. Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that public notices with respect to the Clarington Draft Official Plan, were placed in the following newspapers: Courtice News, Clarington This Week, Canadian Statesman and the Orono Times. during the weeks of May 18, 25 and June I, 1994. This notice procedure is in compliance with Ontario Regulation 402/83. The Chairman announced that the Director of Planning and Development would make a brief presentation of the Clarington Draft Official Plan. LU9 . . . Special G.P.& A. Minutes - 2 - June 21, 1992 DELEGATIONS The Director of Planning and Development gave a slide presentation which highlighted the following: Official Plan Review Process Public Consultation Process - Household Survey Draft Official Plan - Challenge and Constraints Plan Frameworks Strategic Directions - Environmental and Resource Management Urban Growth Management (Map) Strategic Directions - Housing Strategic Policies - Economic Development Heritage Conservation Land Use Policies - Residential Neighbourhood - Central Areas - Employment Areas - Rural Settlement Areas - Agricultural Areas (Map) - Green Space System (Map) - Aggregate Resources (Map) Special Policy Areas Special Study Areas West Side Creek Marsh (St. Mary's Cement Property) Infrastructure Policies - Transportation System Infrastructures and Service Policies - Park and Community Facilities Implementation - Six Major Implementation Tools Where do we go from here? The Director of Planning and Development advised that submissions pertaining to the Draft Official Plan will be received from members of tbe public until October 30, 1994. Mayor Hamre described the history of the St. Mary's Cement operations from its origin to this present day. Kirk Kemp, 4553 Middle Road, Bowmanville, L1C 3K2, appeared on behalf of his father and stated that they have farmed their land all of their life. He requested clarification as to why some of his land has been designated as "Major Open Space!! when, in his opinion. it is not. He also raised concerns pertaining to the proposed location of the high school. He has been an apple orchard grower in the area for many years and requested a commitment from Members of the Committee that, if the adjacent area starts being developed, the boundary which allows residential development be expanded to include his property. LIO . . . Special G.P.& A. Minutes - 3- June 21, 1994 DELEGATIONS Mario Veltri, 1038 Pinetree Court, Oshawa, advised that he has been heavily involved in the development industry within the Municipality of Clarington for the past 30 years. He noted that because developers must have a 5/10 year inventory he purchased 65 acres of land at a premium price in 1989. This land is located at the northeast comer of Highway 57 and Concession 3. He advised that he, as part of the Northbrook Planning Group, has made financial contributions to service the area with oversize trunk sanitary sewers as requested by the Region of Durham. He requested that his lands be included in the designation of "Residential" in order to allow him to develop the lands now, not 20 years from now. He advised that Mr. Bob Carruthers would address Members of the Committee later in the meeting. Gordon White, Group 2, Box 21, R.R. #2, Bowmanville, advised of his two requests to Members of the Committee. The first request being made, is on behalf of the Port Darlington Community Association and he urged Members of Committee to strengthen the wording of Paragraph 16.3.2 contained in the Clarington Draft Official Plan. He also noted that members of the Port Darlington Community Association have discovered that there are provisions contained in the Mineral Aggregate Extraction Act which permits the Minister to place restrictions on existing licences. He requested that the Municipality of Clarington make its interest to the Province very clear in preserving the marsh. Mr. White advised that his family purchased 28 acres of land known as the "Cove" in 1913. Over the years, parcels of land have been developed to meet his family unit's needs. He requested that the Cove be recognized as a neighbourhood area which will allow development in the future as was allowed in the past. Henry Elkens, 4740 Main Street, Orono, LOB 1MO, appeared on behalf of five of his neighbours who are also tobacco growers. He described various crops and related ideal soil conditions stating that his land is certainly not prime agricultural land. He noted opposition to the designation of "Prime Agricultural Land" and requested that his land remain "Major Open Space." David Ashcroft, 63 Cedar Crest Beach Road, Group 5, Box 36, R.R. #2, Bowmanville, L1C 3K3, articulated support for the preservation of the West Side Creek Marsh and requested that the existing owners of properties located on Cedar Crest Beach Road be allowed to improve or construct additions to their homes so that the condition of these homes does not eventually deteriorate. Leah Houston, 137 Cedar Crest Beach Road, Bowmanville, L1C 3K3, appeared on behalf of "Youth In Action" and advised that the Municipality's Draft Official Plan states that the main use of the area of the West Bowmanville Creek Marsh shall be for aggregate extraction. Ms. Houston requested tbat the section relating to the West Side Creek Marsh be amended to read "Designation for new Aggregate Extraction shall not be permitted." L. 1 1 . . . DELEGATIONS Special G.P.& A. Minutes June 21, 1994 - 4 - Denis Kavanaugh, 68 Spry Avenue, Bowmanville, L1C 3Y3, expressed support for the preservation of the West Side Creek Marsh. He referred to paragraph 6.5.2 of the Clarington Draft Official Plan, stressing the importance of leaving the lands surrounding the Bowmanville Creek in their natural state to preserve these environmentally protected lands. Bob Carruthers, R.R. #1, Bowmanville, L1C 3K2, circulated documentation from the N orthbrook Planning Group, a group composed of Mr. and Mrs. R. Carruthers, Mr. Mario Veltri, Mr. and Mrs. M. Marshall and Mr. K. Kemp. He advised that Northbrook Planning Group was formed in 1989 to co-ordinate the advancement of the development of their lands north of the Third Concession, east of Regional Road 57 and west of Liberty Street. These lands were designated for future development in the 1976 Durham Official Plan and an amendment to this plan was submitted by Northbrook Planning Group in September, 1989. He advised that the cost-sharing agreement amongst landowners commenced in October 1990 and $176,730 has been expended to date for construction of the oversize trunk sanitary sewers. Total cost of completion of this installation will amount to $334,000. He advised that the designation of these lands under the Clarington Draft Official Plan would not allow development until the year 2011 and requested that the designation be changed to allow for development in five years or sooner. Resolution #GPA-418-94 Moved by Councillor Dreslinski, seconded by Councillor Hannah lHAT the Committee recess for 10 minutes. "CARRIED" The meeting reconvened at 9:55 p.m. Mark Battle, 25 Hunt Street, Bowmanville, L1C 2W8, requested that lands adjacent to the Bowmanville creek be designated "Major Open Space" with zero development taking place in this area. He further suggested that this area could also be managed and maintained by groups such as the Horticultural Societies and the Boy Scouts. John Bolahood, President, Ginael Holdings Limited, 74 King Street West, Oshawa, L1H 1A6, advised that he owns 60 acres located at Baseline and Green Road and requested that the "Prestige Employment" designation be expanded to permit other uses. LI2 . . . Special G.P.& A. Minutes DELEGATIONS ADJOURNMENT - 5 - June 21, 1994 Rick Dankmeyer, 4 Loscombe Drive, Bowmanville, LIC 3Y1, concurred with the remarks made by Mr. Mark Battle. Lance Thornton, 34 John Scott Avenue, Bowmanville, L1C 4K9, concurred with the remarks made by Mr. Battle and suggested that this space could be used as a picnic area.
