Resolution #GPA-205-94 Moved by Councillor Dreslinski, seconded by Councillor Hannah THAT the minutes of special meetings held on March 4, 7 and 11, 1994 and a regular meeting held on March 7, 1994, be approved. "CARRIED" Pursuant to Section 34, Subsection 12 of the Planning Act, The Municipality of CIarington Council, through its General Purpose and Administrative Committee, is holding a Public Meeting for the following Rezoning Applications: (a) Proposed Zoning By-law Amendment - Part Lot 28, Concession 5, former Township of Clarke - Francis Quantrill; 2U1 G.P.& A Minutes . PUBLIC MEETINGS CONT'D. - 2- March 21, 1994 (b) Proposed Zoning By-law Amendment - Part of Lots 33, 34, 35, Concession 9, former Township of Clarke - Mosport Park Ltd; and (c) Proposed Zoning By-law Amendment - Part of Lot 11, Concession 1, former Town of Bowmanville - Robert Pinheiro on behalf of Bethesda House of Mercy. Pursuant to Section 17(2), and Section 21(1) of the Planning Act, the Municipality is also holding a Public Meeting for the following Municipality of Clarington Official Plan Amendment application: (a) Amendment No. 57 to the OffICial Plan of the former Town of Newcastle - Strategic Policies for Lake Ontario Waterfront. Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on the manner of notice. . The Deputy Clerk advised that public notices for the rezoning applications were sent by first class mail on or before February 18, 1994, to all property owners within 120 metres of the subject property in accordance to the latest municipal assessment record. In addition, notices were also posted on sites prior to February 18, 1994. This notice procedure is in compliance to Ontario Regulation 404183. Public notice for the official plan amendment application was placed in local newspapers on February 16, 1994. In addition, notices were mailed to all parties who had made submissions or who had expressed an interest in the Waterfront Study. This notice procedure is in compliance with Ontario Regulation 402183. The Chairman announced that the Director of Planning and Development would describe the purpose and effect of the proposed amendment, then the objectors would be heard, followed by the supporters and the applicant. (a) Report PD-29-94 - Francis Quantrill - the purpose and effect of the application is to permit the development of (2) two additional residential lots with private sewage disposal systems and private water supply systems. Noone spoke in opposition to or in support of this application. Francis Quantrill, 5955 Main Street, Orono, LOB lMO, - advised that he retired two years ago and he intends to build a new residence for himself. . Lu2 G.P.& A Minutes . PUBLIC MEETINGS CONT'D. (b) Report PD-30-94 - Mosport Park Ltd. - the purpose and effect of the application is to allow in addition to the permitted "Motor Vehicle Race Track", the temporary use of certain portions of Mosport Park lands for: 1. outdoor music festivals, concerts and entertaimnent events with ancillary or accessory uses, for up to 50,0000 persons per day for a period of three (3) years; and 2. camping facilities and ancillary or accessory uses in conjunction with outdoor music festivals, concerts and entertaimnent events for up to 25,000 persons per night for a period of one year. - 3 - March 21,1994 . Anton Krebelj, 28 Gregory Road, Ajax:, LIS 3B4 - appeared on behalf of his parents who own approximately 100 acres in close proximity of Mosport Park Limited He noted that he and his family are opposed to the application for temporary rezoning because the proposed use is not family oriented. He advised that rock concerts, in conjunction with uncontrolled use of alcohol and overnight camping are all factors which are conducive to violence. He informed Members of the Committee that, now, when rock concerts are held, patrons are admitted through a gate, checked for alcohol and drugs and do not have access to their cars until they have left the site. The use that Mosport Park is proposing does not happen in the 1990's. He elaborated on the past history of events which have taken place at Mosport Park and noted that patrons have set up tents on private property, started fIres to keep warm, destroyed fences and crops, and generally had a total disregard for the local residents. He advised that the following factors, i.e., lack of public transportation, uncontrolled use of alcoholic beverages, lack of police protection, overnight camping, and attendance of approximately 50,000 people, are a "total recipe for disaster". He advised that the three year temporary rezoning to hold rock concerts is inappropriate and, should this request be approved, it should be on a "per event" basis and the applicants should be required to fence off their property and set a bond. Lorn Butterfield, R.R. #5, Bowmanvi11e, L1C 3K6 - concurred with the remarks made by Anton Krebelj and advised that, not only are a few people upset with this application, but neighbours for miles around. He indicated that approval of this application would be an infringement on the local people's rights. Murray Gill, R.R. #5, Bowmanvi11e, L1C 3K6 - advised that he owns property located south of the Mosport property and, in the past, patrons of Mosport Park Limited have torn his fences down, set up tents and started fires on his property and advised that, in his estimation, Mosport has never demonstrated good corporate citizenship. He shared the concerns verbalized by Anton Krebelj. . ilJ) G.P.& A Minutes . PUBLIC MEETINGS CONT'D. Pat Neal, R.R. #5, Bowmanville, L1C 3K6 - resides two miles west of the Mosport Park property. He referred to a music event "Heat Wave" held on August 23, 1990, and circulated photos to demonstrate the littering and lack of consideration by Mosport Park patrons. He advised that various unpleasant and frightening incidents occurred as a result of the "Heat Wave" event. He was unable to obtain fmancial retribution from the "damage fund" for the destruction of his corn field, and his fumily even received verbal telephone threats from Mosport Park patrons. -4- March 21,1994 Dave H1umJdamf, 2802 Regiona1 Road 20, Bowmanville, L1C 3K6 - concurred with the comments made by Pat Neal and added that he caught three individuals in his garage attempting to steal his outboard motor. He noted that local police protection is inadequate to handle such large crowds. Noone spoke in support of this application. . Bernard KRm;", Mosport Park Ltd, 825 Dennison Street, Markham, L3R 5E4 _ advised that Mosport Park has been in existence since 1965 and it is not Mosport's intention to sell the property. He hopes to have a good relationship with the neighbours and to address all of their problems. He referred to an event which was held last year on the Markham fairgrounds, where 30,000 to 40,000 people camped overnight. He indicated that the promoters of the rock concerts, Concert Productions International is a very responsible organization with outstanding and excellent credentials. Not only would they be responsible for the promotion but for the safety of the people. He is attempting to ameliorate road signage and effect measures for liquor and drug checks of patrons. He has worked extensively with the police department vis-a-vis crowd control He will review the demarkation of the property and correct the situation on the south side. He advised that approximately three to four events would be held annually if the application is approved. George Rusty, Solicitor for Mosport Park Limited . advised that Mosport Park have been holding musical and racing events for 34 years and reiterated this organization's active and sincere efforts to negotiate with municipal officials and members of staff re: crowd control, health issues, policing and protection and compliance with all legal licensing and zoning matters. He noted the need for ongoing communication and the economic benefit to the community. . 2U4 G.P.& A Minutes . PUBLIC MEETINGS CONT'D. - 5- March 21, 1994 (c) Report PD-31-94 . Robert Pinheiro on behalf of Bethesda House of Mercy - the purpose and effect of the application is to permit the establishment of a criais care centre. Brad HnPlri11. 74 Church Street, BowmanviIIe, L1C 1T1 - referred to a letter of objection dated March 8, 1994, and enclosed petition containing approximately 34 signatures. He advised that presently, the residents now have two psychiatric outpatient care facilities on Church Street and neighbours are concerned about the potential problems which could result if the Crisis Care Centre for women and children is allowed to locate in this neighbourhood. He stated: "our neighbourhood's capacity to accommodate persons with specia1 needs is being over extended." He indicated that discussions held with Mr. Robert Pinheiro have only increased the residents' concerns. Evelyn Stroud, 89 Little Avenue, Bowmanville, L1C lJO - advised that she is a member of the Board of Directors for Denise House and also associated with Focus which is a woman's group. She was concerned with the lack of information pertaining to security apd safety of the residents of the proposed Crisis Care Centre and the lack of a mission statement to clarify the use of this property. She noted that Focus is willing to help and assist and suggested that members of staff liaise with the Four Shelters Committee. . Ron Parker, 3 Ontario Street, BowmanviIIe, L1C 2R9 - advised that he and his family have been residents of Ontario Street for eight years. He is concerned about the safety of his three small children who are under the age of six if this application is approved. He noted that the facility is inappropriate, that it is too small and there is no backyard to accommodate children of the women housed by this facility. Don Gilhooly, 7 Ontario Street, Bowmanville, LtC 2R9 - referred to the letter dated March 8, 1994, and a petition containing approximately 34 signatures which have been forwarded in opposition to this application. He advised that the neighbours have been putting up with residents from the two psychiatric facilities whose residents knock on doors and ask for coffee and cigarettes while using foul and abusive language. Although gentle persuasion has been successful in the past he questioned whether this method would be successful with the proposed House of Mercy. He further noted that the address of this house has become public knowledge and is concerned that the location has not been kept a secret. Marlene Buttery, 20 Wellington Street, BowmanviIIe, LtC IV2 - articulated concerns with the unsuitability of the property, private funding and lack of provincial regulations. She noted that her fears increased after speaking with the applicant who suggested that she contact a facility of similar nature located in Cobourg. N eighbours of the Cobourg fucility advised that they "try to make the best of a good or had situation" and they often have to look after the grounds of the facility. . iUS G.P.& A Minutes . PUBLIC MEETINGS CONT'D. Francine Nit-holas, 113 King Street East, BowmanviDe, LlC IN4 - circulated a letter dated March 17, 1994, from Roxann Barnes on behalf of 25 club members of the Business and Professional Women's Club of Bowmanville. Francine Nicholas read the contents of the letter which stated that: - 6- March 21, 1994 production and security of the women and children must be paramount 'The Bethesda House of Mercy' takes dignity away from women who are a1resdy victims women and other groups providing such services do not seem to have been consulted as a privately operated shelter, who will regulate the service provided? the proposed property is too small and there is no room for expansion the proposed property offers no handicap access and no secured, protected parking and building access counseling and care should be provided on a non-religious basis. . Francine Nicholas also circulated a letter dated March 15, 1994, from A11iance House, Women's Shelter and Support Services Inc. She advised that A11iance House has been working diligently on a similar project for the past year and a half and it is unfortunate that her group had never been contacted by the applicant. She further noted that a shelter is not enough, their service provider must be non-judgemental, women positive and able to offer accountability, accessibility, choice, equality, responsibility and respect for differences. She requested that the Besetha House of Mercy address their concerns and when these have been alleviated, the members of the A11iance House will support fully the Bethesda House of Mercy and work cooperatively if requested Gillian Barfoot, 75 King Street West, Apt. 6, Newcastle, LlB lL2 - stated that, although she strongly supports any initiative and realizes the great need for women's shelters, she addressed issues of accessibility, accountability, safety and security of the location of this facility. PUBLIC MEETINGS CONT'D. - 7- March 21, 1994 The meeting reconvened at 1:30 p.m. No one spoke in support of this application. Robert Pinheiro, 2 Luverme Court, Bowmanvine, LIC 4C9,- the applicant, indicated evident and urgent need for a women's shelter in the Municipality. He advised that he is well versed on the subject of women's shelters and has been in contact with similar facilities located in Keswick, Bracebridge, Kitchener and Cobourg. The necessary precautions pertaining to safety and protection will be undertaken. He noted that Cobourg has been very few instances of violence and that Denise House has not experienced an incident for the past 30 days. He advised that women from all religious denominations will be welcomed to this facility. He has liaised with Bowmanville Memorial Hospital, Nursing Services, Police and Fire Departments and is wil1iog to adhere to all of the regulations and to be accountable to the community. He circulated a letter dated March 9, 1994, from Green Haven, shelter for women, who advised that they have not had an issue with an intruder affecting the neighbours or putting them at risk since they opened their doors in October, 1991. Mr. Pinheiro advised that his non-denomination, non-profit organization submitted their mission statement with their application for rezoning. He noted that a member of staff will be present at the facility 24 hours a day. . (d) Report PD-32-94 - Municipality of Clarington - the purpose and effect of the application is to amend the Official Plan of the former Town of Newcastle to incorporate strategic policy direction for the future of CIarington's Waterfront. The policies address a number of issues related to the waterfront in particular public access, the protection of natural and cultural heritage values, active and passive recreational opportunities and the Waterfront Trail and Greenway. Amendment 57 is a policy amendment in that it only contains strategic policy direction. There is no specific land use designation proposed at this time. This will be done in conjunction with the preparation of the new Official Plan which will be released in mid May. Erskine Duncan, 27 Bolton Street, Newcastle - appeared on behalf of several other residents of Bond Head and advised that a lot of money has been sent by the residents and the municipality on shoreline protection. He suggested that the wording pertaining to waterfront Iakefilling should be more restrictive and the word "disallow" should be used rather than "discourage". James Parkin, 171 VJctoria Street, Kitchener, W2H 5C5 - appeared on behalf of St. Marys Cement and circulated a "fact sheet" pertaining to St. Marys Cement, dated November 3, 1993, and a document dated March 21, 1994, with St. Marys requested wording. He requested that the following wording be added to section 2.3.4.3: I, -: L U I . G.P.& A Minutes . PUBLIC MEETINGS CONT'D. - 8- March 21, 1994 "Council recognizes that the Mineral Aggregate Resources Policy Statement and the Durham Regional Official Plan requirement to identifY and protect existing licensed quarries is part of the policy framework that must be considered in developing land use policies and future land use designations." He further requested that section 2.3.7 of the policy be modified as follows: "...however, erosion control works with limited Iakefilling or projects that would provide tourism or economic benefits may be considered subject to appropriate studies satisfactory to relevant Federal and Provincial agencies. II The Chairman announced that all persons wishing further notice when these applications are to be dealt with by the Committee in subsequent meetings, should leave their name and address with the Clerks Department. He noted that the residents are willing to work with the committee and members of staff to arrive at an acceptable short term solution in 1994. . (b) Nick MPnAin1<. G.M.
