Moved by Councillor O'Toole, seconded by Councillor Scott
THAT the minutes of a regular meeting of the General Purpose and
Administration Committee held on January 3, 1994, be approved.

Pursuant to Section 34, Subsection 12 of the Planning Act, the Municipality of
CIarington Council, through its General Purpose and Administration Committee,
is holding a Public Meeting for the following Rezoning Applications:
(a) Proposed Zoning By-law Amendment - Part Lot 16, Concession 1, former
Township of Darlington - 829426 Ontario Limited - Markborough
Properties/West Bowmanville Developments; and
(b) Proposed Zoning By-law Amendment - Part Lot 16, Concession 1, former
Township of Darlington - Willsonia Industries Limited.
Before proceeding with this matter, the Chairman asked the Deputy Clerk to
advise on the manner of notice.

The Deputy Clerk advised that public notices for the rezoning applications were
sent by first class mail on or before December 27, 1993 to all property owners
within 120 metres of the subject properties in accordance to the latest municipal
assessment record
The Chairman announced that all persons who wish further notice of the
passage of the by-law should leave their name, address and telephone number
with the Clerk's Department.
The Chairman announced that the Director of Planning and Development would
describe the purpose and effect of the proposed amendments, then the objectors
would be heard, followed by the supporters and the applicant.
(a) Report PD-4-94 - 829426 Ontario Limited - Markborough Properties/West
Bowmanville Developments - the purpose and effect of the application is to
permit the development of a 18,580 m' (200,000 sq. ft.) retail commercial
shopping facility.
Laurie Wheeler, Fasken, C".anq>beD, Godfrey, Barristers and Solicitors,
Toronto-Dominion Bank Tower, P.O. Box 20, Toronto-Dominion Centre,
Toronto, M5K IN6, advised that Mr. Roger Elliott is late for the meeting
due to inclement weather and requested that he be allowed some latitude
pertainiog to his late arrival to the meeting and he be allowed to address
members of the Committee.

THAT the order of the agenda be altered to allow the public meetings and
the Planning and Development section of the agenda to be considered later
in the meeting in an endeavour to allow more time for any participant who
may have been delayed because of inclement weather.

fmancing of the project to provide an extension of the pathway under the
Edward Street bridge in the 1994 Budget submission;
THAT staff be authorized to execute the letter of intent (Attachment # 1 to
Report CS-03-94); and
THAT the Newcastle Lions Club be advised of Council's decision.

Council for approval to implement the change.

Roger Elliott, Fasken, CampbeD, Godfrey, Barristers and SnIWt-ors, Toronto-
Dominion Bank Tower, P.O. Box 20, Toronto-Drnn;n;on Centre, Toronto,
M5K IN6, appeared on behalf of Bowmanville Mall to voice his continuing
objection to this application for the record. He advised that this is not an
appropriate time to proceed with a proposal of this nature, scale and
significance. He noted that approval of this application will have a
devastating effect to the Central Business District and could even effect
closure of the Bowmanville Mall. He requested that the Committee give
consideration to the possible negative implications of approving this
proposal.
Noone spoke in favour of this application.
John E. Davies, Shopping Centre Group, Markborough Properties Inc.,
1 Dundas Street West, Suite 2800, Toronto, M5G 2J2, the applicant, advised
that he did not wish to address Members of the Committee at this time.

(b) Report PD-5-94 - Willsonia Industries Limited - the purpose and effect of
the application is to permit the development of a 3,716 m' (40,000 sq. ft.)
retail commercial shopping facility.
Roger Elliott, Fasken, Campbell, Godfrey, Barristers and Solicitors, Toronto-
Dnmmill{'l Bank Tower, P.O. Box 20, Toronto-Dominion Centre, Toronto,
M5K IN6, advised that he is not familiar with the specifics of the tenant
mix or proposed uses and therefore it is difficult for him to determine the
degree of his objection.
Noone spoke in support of this application.
Ron Worboy, 163 Simcoe Street North, P.O. Box 21, Oshawa, LlH 7K8,
appeared on behalf of Willsonia Industries Inc. and requested that Members
of the Committee endorse the recommendations contained in Report
PD-5-94. He noted that, since the inception of this proposal, the intention
has been to develop uses which are compatible to that of the Bowmanville
Recreation Complex; i.e., sports or recreation store and a restaurant. He
introduced R. Martinda1e, Greer Galloway, 1415 Highway #2, Court.iee,
LlE 2J6 who displayed an artists' rendering and informed Members of the
Committee that it is his intention to submit a site plan to the Municipality
before the January 31 commencement of the OMB hearing. He advised
that the same architectural flavour will predominate throughout the entire
proposal and that he has attempted to follow the intent of the Secondary
Plan in every respect.

THAT Report PD-7-94 be tabled to the General Purpose and

February 7, 1994 to allow for consideration by all Members of the
Committee.

Resolution #GPA-33-94

THAT Report PD-8-94 be received;
THAT interim and ultimate Provincial trail alignments be endorsed
between the OshawalTownline and Bond Head, save and except for the
trail between Bennett Road and Cobbledick Road (Section 9);
THAT Staff's submission for funding in 1994 to the Waterfront
Regeneration Trust be endorsed;
THAT the sum of $60,000, be allocated from the Public Works Lot Levy
Reserve Account 5001-36-X and $4,790 from the Planning Department 1994
Legal Fee Account 7702-X-242 as the Municipality's contribution for
implementation of the CIarington's Interim Waterfront Trail;
THAT Staff be directed to provide the estimated maintenance costs as part
of the 1994 budget discussions exclusive of budget guidelines;
THAT Staff be authorized to negotiate with private landowners, Ontario
Hydro, Central Lake Ontario Conservation Authority, Ministry of Natural
Resources, and Management Secretariat Board to secure access
agreements/easements;
THAT the Waterfront Regeneration Trust, the Ministry of Natural
Resources, Ontario Hydro, Management Secretariat Board, Central Lake
Ontario Conservation Authority and Ganaraska Region Conservation
Authority be forwarded a copy of Report PD-8-94 and Council's decision.
