Council Minutes DELEGATIONS - 2 - December 19, 1988 Resolution iC-90l-88 Moved by Councillor Deegan, seconded by Councillor Wotten THAT Mr. Mace Armstrong be added to the list of delegations. "CARRIED" Mrs. Helen MacDOnald and Mrs. Suzanne Elston made a formal report to Council regarding the activities undertaken during Ontario Recycling Week, November 14 - 20, 1988. They submitted for Council's information, an activities sheet summarizing actions taken during Recycling Week. Councillor Hamre presented to Mrs. MacDonald and Mrs. Suzanne Elston citations of merit on behalf of the Mayor and Members of CounciL Mr. Paul Tucker and Mr. Mathew Hately made a presentation to COuncil regarding wheelchair accessibility in the Town of Newcastle with the use of a video of a person confined to a wheelchair attempting to gain access to several public buildings within the Town. They concluded that one in four stores within the Town have provided ramps for the handicapped. Mrs. Ann Dreslinski, Orono D.B.I.A., appeared before Council seeking assistance for the clean-up and partial development of the proposed Woods Walk park in Orono. The D.B.I.A. is asking the Town to consider a grant in 1989 of $3,000.00 to assist with the clean-up and development and having the property surveyed as to its boundaries which would eliminate any danger of encroaching on privately owned land. Mr. Derek Barnett, Clarke Museum & Archives, presented Council with a Limited Edition Woodblock Print of the Old Kirby School House which is home to the Clarke Museum & Archives. Mr. David scott, Committee of Clarke Constituents expressed the Committee's concerns regarding the proposed Laidlaw Waste Management Systems Ltd., to expand its landfill facility north of Newtonville in the Region of Durham. Mr. Scott requested that Council endorse the letter he prepared to The Honourable James Bradley, Minister of the Environment, urging that a consolidated hearing not be granted until such time as Laidlaw has complied with the planning Act and provided a rezoning application, an application to amend the Official plan and a Certificate of Approval from the Ministry of the Environment. Mr. and Mrs. Iliffe indicated that they have a country home on a large lot and that their dogs do not disturb the neighbours in the area. They indicated to Council that if the by-law should be passed, they would be forced to to give up their dogs or move to a different area. Mr. Clarke wilbur submitted to Council a signed petition in support of the passage of the by-law restricting the number of dogs to three per household. He stated that people in his area are moving because of the smell and noise generated from dogs presently in the area. Mr. Mace Armstrong, representing the Bowmanville Minor Hockey Association, Recreation League, Figure Skating and the Junior 'C' Hockey Team, addressed Council regarding the rental fees at the Recreational Complex. Mr. Armstrong stated that the Bowmanville Toros are hosting the Fourth Annual xmas Classic Tournament and they would like to have all of the activities in the Recreational Complex, however, they cannot afford the rental fee, and he requested the fee be waivered. Newtonville Hamlet plan - Municipal Water Supply 35.23.102. - 12 - December 19, 1988 The Fire Chief gave a verbal report on the MOE investigation at Baseline Road and Highway t57. He indicated that there is petroleum products leaking into Bell manholes in that area and that the Ministry will forward a complete report in late January 1989. Resolution tC-929-88 Moved by Councillor Hamre, seconded by Councillor stapleton THAT the Commissioner of Planning of the Region of Durham be advised that the following modifications be made to the Town of Newcastle Official Plan Hamlet policies as it pertains to the Hamlet of Newtonville: 1. THAT the existing development envelop for Newtonville be maintained, save and except for the addition of the Sander's property to be included in the development area as indicated on the sketch attached to the Director of Planning's Memorandum dated December 19, 1988, as the Sander's property was included in the Study Area for water 2. THAT all development in Newtonville be serviced with municipal water supply and private waste disposal system and that once all municipal water supply capacity is used up, there shall be no further development in Newtonville irrespective whether or not lands are designated for development; 3. THAT notwithstanding the policies of the plan requiring a minimum lot size of one acre, lot size in Newtonville can vary between 0.5 to 1 acre provided the applicant/ developer can, through an Engineering Study, demonstrate to the satisfaction of the Ministry of the Environment, Health Department, Region and the Town, that the soil condition can support the reduced lot size and further, that there will be no ground water contamination; 4. THAT a continuous ground water monitoring program be established and in the event there is evidence of soil and ground water contamination resulted from development, there will be no further development allowed in the Hamlet until such time all problems related thereto are addressed to the satisfaction of the Region, the Ministry of the Environment, and the Town. Re: Dredging Bowmanville Harbour - 13 - December 19, 1988 Resolution iC-930-88 Moved by Councillor Hamre, seconded by Councillor Hooper WHEREAS an application has been made to the Central Lake Ontario COnservation Authority to permit the dredging and placing of material from the Bowmanville Harbour; and WHEREAS the Town has undertaken a study to explore long-term solutions and possibilities for the Bowmanville Harbour surrounding water's edge, and the general area in and around same, and this study is presently being prepared; and WHEREAS it is imperative that any activity within the area subject to the study does not jeopardize the outcome and implementation of the results of the study; and WHEREAS an opportunity presently exists to enhance through the completion of proper planning studies this general area of the Town and in particular Bowmanville Harbour from the point of view of providing land and water based recreation and related activities including a recreational small craft harbour and marina; and WHEREAS it would be in the Town's best interest to establish performance standards regarding the continuation of the Bowmanville Harbour as a recreational small craft harbour; and WHEREAS the Town of Newcastle is the responsible authority regarding the land use of the Bowmanville Harbour, surrounding water's edge and general areas: NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE: 1.
