Minutes Resolution #C-273-88 Moved by Councillor Hubbard, seconded by Councillor Stapleton THAT the Minutes of a regular meeting of Council held on Monday, March 28, 1988, be approved as read. "CARRIED" Delegations Resolution #C-274-88 Moved by Councillor McKnight, seconded by Councillor Cowman THAT Mr. Ron Strike be added to the list of delegations and be heard regarding the O.P.A., Rezoning and Subdivision Applications of James and Sandra Hendry (Item #5 of the G.P.A. Committee Report to Council on April 11/88). "CARRIED" Mayor Winters made a declaration of interest with respect to the delegation of Ken Smith, relating to the South Bowmanville Industrial Park; vacated his chair and refrained from voting on the subject matter. ,IheMavor indicated that he has been threatened with legal action if he voted on this~lssLie-:----~- - ~ . . . . Council Minutes Delegations Communications - 2 - April 11, 1988 Councillor Cowman chaired this portion of the meeting. Mr. Ken Smith, appeared before Council, requesting that the urban road cross-section be approved for the South Bowmanville Industrial Park. Mr. Smith indicated, that as a taxpayer, he is in favour of the Town paying the construction costs for this road now rather than being in the position of having to upgrade the road 10 or 15 years from now. Mayor Winters resumed the chair. Mr. Henry Haass representing Mrs. Louise Haass, appeared before Council requesting approval of the Rezoning Application submitted by Louise Haass. Mr. Haass indicated, that the subject property is not good for agricultural purposes and is presently being used only as a driveway. Mr. Bob Bonnell, R. R. #6, Bowmanville, Ontario, LIe 3K7, was not present. Mr. Ron Strike on behalf of James and Sandra Hendry, appeared before Council requesting that Item #5 of the G.P.A. Committee Report to Council be tabled for a period of two to three months. Mr. Strike indicated that he is certain the concerns the residents in the area raised about this application can be resolved. "CARRIED" Resolution #C-277-88 Moved by Councillor Hamre, seconded by Councillor Wotten THAT the communication dated March 17th 1988, from Mr. G. C. Yeo, Superintendent of Instruction, The Northumberland and Newcastle Board of Education, 834 D'Arcy Street, P.O. Box 470, Cobourg, Ontario, K9A 4L2, requesting that the week of April 17th to 23rd, 1988, be declared "Education Week" in the Town of Newcastle be received; AND THAT the request referred to herein be approved and Mr. Yeo be advised of Council's decision. "CARRIED" Resolution #C-278-88 Moved by Councillor Hubbard, seconded by Councillor Stapleton THAT the communication dated March 24, 1988, from Mr. G.B. Harness, P.Eng., Maintenance Engineer, Regional Municipality of Durham, Box 623, Whitby, Ontario, L1N 6A3, requesting that Council pass a resolution authorizing the publication of a notice regarding the destruction of noxious weeds be received; AND THAT the request be approved and the following resolution be passed: NOW THEREFORE BE IT RESOLVED THAT this Council authorizes the publication of a Public Notice, regarding the destruction of weeds under the provision of the Weed Control Act of the Province of Ontario and directs the Regional Weed Inspectors to cause noxious weeds or weed seeds to be destroyed in such a manner as they may deem proper and that the expenses incurred by the said Weed Inspectors in the discharge of their duties shall be placed on the Collector's Roll of this municipality against the respective parcels concerned and that such amounts shall be collected in the same manner as taxes under The Municipal Act. Cheeseman, Weir & Foulds, Barristers & Solicitors, regarding Official Plan Amendment and Rezoning Application of Terry Klawitter, Part Lot 15, B.F.C., former Township of Darlington, be referred to the Planning Department for consideration in conjunction with the Official Plan Amendment Application. Shaver, P.Eng., Senior Project Manager, Ministry of Transportation of Ontario be received; and THAT the Town of Newcastle hereby approves in principle the Project Team's proposed Conceptual Widening Alternative for Highway 401 between Brock Road in the Town of Pickering and Courtice Road in the Town of Newcastle, calling for a 12-1ane core-collector configuration (3 core lanes and 3 collector lanes in each direction) between Brock Road and Regional Road 23 and a basic 10-1ane configuration (5 lanes in each direction) from Regional Road 23 easterly to Courtice Road; AND FURTHER THAT newall-direction interchanges be introduced at Pickering Beach Road, Regional Road 23, Stevenson Road and Simcoe Street, with the existing Highway 401 interchanges at Harwood Avenue, Park Road and Ritson Road being closed. "CARRIED" Resolution #C-285-88 Moved by Councillor Hubbard, seconded by Councillor Stapleton THAT Report PD-76-88 be received; and THAT the application submitted by Louise Haass to Rezone a parcel of land located in Part of Lot 34, Concession 5, former Township of Darlington, to permit the development of an additional non-farm residential lot be denied, as the proposal does not conform to the provisions of the Durham Regional Official Plan, the Town of Newcastle Rural Cluster Policy, nor the Ministry of Agriculture and Food - Agricultural Code of Practice. Council Minutes Reports Item #13 Item #17 Gypsy Moth Program - 7 - April 11 1988 Resolution #C-290-88 Moved by Councillor Hamre, seconded by Councillor Wotten THAT Staff Report PD-31-88 be forwarded for consideration to the Council Meeting of April 25, 1988; AND WHEREAS the said lands are being listed at current market value, that the Director of Planning, the Director of Public Works, and the Treasurer meet with the developers of the South Bowmanville Industrial Park to discuss the financing of services relating to draft conditions of subdivision approval and local road improvements and report back to the General Purpose and Administration Committee by April 18, 1988. "CARRIED AS AMENDED" Resolution IC-292-88 Moved by Councillor Cowman, seconded by Councillor Stapleton THAT Resolution #C-291-88 be amended by adding the words "where necessary" to the first paragraph after the words "Region-wide Policy" and by adding a third paragraph as follows: AND FURTHER THAT the Region of Durham be advised that the Council of the Town of Newcastle endorses such a program. "CARRIED" Resolution #C-295-88 Laidlaw Landfill Site Moved by Councillor Cowman, seconded by Councillor Hamre WHEREAS the Council Minutes of March 28, 1988, reflect Mr. David Scott's presentation, supported by a petition signed by 250 people, opposing the proposed expansion of the Laidlaw Landfill Site; AND WHEREAS the matters of concern were summarized as follows: . a) Contamination of the environment; b) Destruction of agricultural lands; and c) Unacceptable risk to the community. NOW THEREFORE BE IT RESOLVED THAT Laidlaw Waste Systems Limited and the Regional Municipality of Durham be advised that the Town of Newcastle is opposed to the application to expand the Laidlaw Landfill Site. Council Minutes By-laws Other Business Recycling Metropo Ii tan Toronto Landfill Site - 9 - Apri I 11, 1988 Resolution HC-296-88 Moved by Councillor McKnight, seconded by Councillor Stapleton THAT leave be granted to introduce the following by-laws, and that the said by-laws be now read a first time: 88-42 being a by-law to amend By-law 87-156, entitled a by-law to provide for the licensing, regulating and keeping of dogs; 88-43 being a by-law to amend By-law 86-112, being a by-law to establish a street name map and a street name inventory for roads in the Town of Newcastle. THAT The Honourable John Eakins, Minister of Municipal Affairs, be requested that no change be made to Section 66 of The Municipality of Metropolitan Toronto Act or the Regional Municipality of Durham Act which would allow for the acquisition by Metropolitan Toronto of sites within the Town for landfill purposes without the approval of the Council of the Town of Newcastle; . . . . Council Minutes Other Business Metropolitan Toronto Landfill Site - 10 - April 11 1988 2. THAT The Honourable James Bradley, Minister of the Environment, be informed that the Council of the Town of Newcastle is alarmed at the lack of communication or consultation by the Municipality of Metropolitan Toronto regarding its consideration of sites within the Town for the purpose of a Metropolitan Toronto Landfill Facility and that should Metropolitan Toronto ~y for any exemption from the Environmental Assessment Act, such application should be denied; 3. That Mr. Dennis Flynn, Chairman of the Municipality of Metropolitan Toronto be informed that the Council of the Town of Newcastle regrets the autocratic behaviour of the Municipality of MetropoUtan Toronto regarding its selection of sites within the Town for consideration as Landfill Facilities without prior consultation with the Town Council and responsible Town Officials; 4. THAT the Regional MuniCipality of Durham be advised of the Town's concerns and be requested to refrain from discussing sites with the Municipality of Metropolitan Toronto, its officials and its consultants, regarding any possible landfill sites within the Town unless the Town is notified and given a reasonable opportunity to participate in such discussions; 5. THAT a copy of the Resolution be sent to: The Honourable James Bradley, Minister of The Environment; The Honourable John Eakins, Minister of Municipal Affairs; Chairman and Members of Council of the Municipality of Metropolitan Toronto; Comptroller, M. Resolution HC-301-88 Moved by Councillor McKnight, seconded by Councillor Stapleton THAT leave be granted to introduce By-law 88-50, being a by-law to confirm the proceedings of the Council of the Town of Newcastle at this meeting held on the 11th day of April 1988, and that the said by-law be now read a first time.
