The special meeting of Council was convened for the purpose of holding a public
meeting in accordance with the Planning Act, prior to adoption of the Clarington
Official Plan.
DECLARATIONS OF INTEREST
PUBLIC MEETING
Councillor Novak stated that she would be making a declaration of interest at any
time Deferral #6 is being discussed.
Frank Harris, R.R. #5, Bowmanville, L1C 3K6, addressed Council on behalf of
landowners adjoining Part Lot 8, 9 and 10, Concession 3, and requested tbat this
property be included in the Urban Boundary identified in the Official Plan. He
indicated that the Region and the Province identify this land as developable.
Mike McQuaid, advised Council that discussions are ongoing with the Region
with respect to the Durham Regional Official Plan. He requested that the
Clarington Official Plan, Section 16.2.2 be worded to read as follows:

"The node identified as Mosport Park on Map A is bounded by Concession 10 on
the north, Mosport Road on the east, Darlington/Clarke Townline on the west
and Skelding Road (Concession 8) on the south. The predominant use of land
shall be for a major event oriented tourist attraction node, primarily serving
Regional, Provincial and International visitors.
a) Permitted uses include:
Motor vehicle racing;
Vehicle testing and facilities, and driver instructions;
Concerts;
Exhibition uses such as: Product display, conferences;
Fairground uses such as: Amusements, concession stands;
Camping;
Sporting activities;
Cross-Country skiing, bicycle racing, hiking, hot air ballooning,
Professor James Lovekin, P.O. Box 189, 3 King Street West, Colborne, KOK ISO,
indicated that he is in agreement with what the Official Plan provides for on his
property located on the north side of Highway 35/115, Special Policy Area. He
questioned the opposition from Queen's Park in the designation of this property,
and requested that Queen's Park disclose what this opposition is. Professor
Lovekin vowed that he would donate $25,000 to registered charities if this
opposition could be settled prior to Christmas 1995.
Doug Taylor, 1610 Concession Road 7, Enniskillen, LOB lJO, requested
recognition of Bradley's Corner as a rural residential cluster. He indicates that
Durham Region designates the area as wide open spaces, however, Clarington has
designated it as agricultural. Mr. Taylor outlined the land uses in the area and
stated that none of these are allowed in prime agricultural areas. He requested
that Council re-evaluate the designation now that all supporting evidence that was
requested has been presented.
John Bolahood, 74 King Street West, Oshawa, L1H 1A6, addressed Council on
behalf of Ginael Holdings Limited and requested that the 60 acres of land located
at Baseline Road and Green Road be zoned as either residential or highway
commercial. He indicated that the property abutting his is designated as
greenspace and highway commercial and property across the street is designated
residential. The present designation of prestige employment area is not
complimentary to these uses.
Rick Daniels, 3142 Hancock Road North, Courtice, L1C 2M1, stated that the
Official Plan is good for all residents of the Municipality, however, it is his
opinion that there is not enough protection for watersheds, woodlots and rural
areas located within the Plan. He requested that proper studies completed prior
to development proceeding as neighbourhoods are being eroded.

Bill Manson, W.D.M. Consultants, 20 Clematis Road, Willowdale, M2J 4X2,
addressed Council on behalf of Newcastle Co-Tenancy, Courtice Heights and
Oceanfront Developments. He indicated that two of his clients, Newcastle
Co-Tenancy and Oceanfront Developments have no concerns with the
recommended Official Plan. The majority of the concerns raised by Courtice
Heights have been addressed with the exception of the following:
. In the development consisting of 110 townhouse units, passive
recreational is not possible.
. Subdivisions 18T-90214 and 18T-94027 - A minor adjustment to the
population density from 2,900 to 3,190 (975 units to 1057 units) is
requested.
Peter Van Loan, Fraser and Beatty, P.O. Box 100, 1 First Canadian Place,
Toronto, M5X 1B2, addressed Council on behalf of Courtice Heights
Developments, owners of properties located in the northeast portion of the
Courtice planning area. He requested that the population identified for the
Hancock neighbourhood (Map E-1) be reviewed in the context of his client's
detailed applications and studies to ensure the Official Plan reflects them.
Niva Rowan, RR #1, Newtonville, LOA lJO, thanked Council on behalf of
STORM (Save the Oak Ridges Moraine) Coalition for a planning document
which reflects much of STORM's mandate for long-term protection of the Oak
Ridges Moraine. They are, however, sorry to see the section on environmentally
sensitive areas which was included in the May 1994 Draft Official Plan, eliminated
in the Final Recommended Official Plan. She indicated that section and the
section on woodlots have been locked together in the new Official Plan under
Natural Features with very little of the qualifying and interpretive information
which was contained in the May Draft. She commended Council on the chapter
regarding Aggregate Resources, however, stated that the Coalition is concerned
that extraction can occur in any of the Aggregate Resource areas shown on
Map D, provided an Official Plan Amendment is filed.
Kathy Guselle, RR #1, Newtonville, LOA lJO, addressed Council on behalf of
SAGA (Save the Ganaraska Again). Ms. Guselle commented that Section 4 -
Natural Environment and Resource Management is an excellent section, however,
she notes that groundwater recharge and discharge areas and headwater source
areas, which had been included in the Draft Plan of May 1994, are missing from
the new Section 4.7.1 now entitled Natural Features. Also missing from Section 4
is any provision for the determination of the actual boundaries of the natural
features other than what is shown on Map C. She indicated the organization's
pleasure with the addition of "Significant Landscapes, Vistas and Ridgelines" to
the definition of Cultural Heritage Resources and stated it is gratifying to see
such forward thinking provisions for the Oak Ridges Moraine. Ms. Guselle raised
concern, however, with the lack of criteria for the designation of Environmental
Protection Areas. She is pleased to see that the headwaters area of the
Ganaraska River is protected from extraction with regard to Section 20.2.3 -
Subwatershed Plans. Ms. Guselle stated that subwatershed plans and master
drainage plans are two different things and the latter should not substitute for the
former.

In Section 24.12 a definition occurs for Natural Heritage System, however,
Ms. Guselle could not find any mention of it within the text. She indicated that it
is SAGA's hope to see a Natural Heritage System delineated for the Ganaraska
area through the process of a watershed plan that will cross jurisdictional
boundaries and eventually be incorporated in each municipality's official plan.
Councillor Novak made a declaration of interest with respect to the next
delegations of Fred Finlayson, Cliff Curtis and Kerry Meydam; vacated her chair
and refrained from discussion on the subject matter. Councillor Novak indicated
that she resides in the area subject of the three delegations.
Fred Finlayson, 14 Timberlane Court, Courtice, LIE 2H1, addressed Council on
behalf of the citizens of Timberlane, Prince Rupert, Courtice North and Friends
of the Farewell Creek with respect to the Tonno Construction site (Area D6).
He advised Members of Council that this was a wonderful wooded area before it
was totally c1earcut and they were falsely told that this action was necessary to
accommodate the proposed farmland site. He stated that staff and other
environmental departments have identified serious issues which have not been
properly addressed in this area. He listed the residents' concerns as follows:

The subject property was previously very significant in terms of sustaining
habitat for wildlife until it was clearcut. If any development is to take
place on the lands, the residents are of the view that the developer should
be required to revegetate a significant area, particularly along the top of
the bank of the creek and beyond to the east.

The probable effect on groundwater needs to be better established.
.
Density of the proposal appears to be too high to the residents as only
part of the proponent's holdings is developable.
.
It is their belief that urban development such as is proposed, should not
be directly adjacent to rural development as now exists on Timberlane
Court.
.
The high density urban development which is proposed, would put strain
on the present infrastructures, in particular roads and schools.
.
It is their understanding that staff at both the Regional and Municipal
level have not supported this development and, in fact, the only support
that has come forward is from Regional politicians.
Representatives from the Ministry of Natural Resources had suggested that they
will have the money for funding of a watershed study. However, recently they
have been informed that these funds are not available which is reason enough
that all development for this particular area should be frozen.

Cliff Curtis, 3280 Tooleys Road, Courtice, LIE 2L3, advised Council that he has
previously appeared with respect to issues within the Official Plan which affect his
property: woodlots and a proposed separate school location. He is pleased that
staff have recommended revisions to the woodlot boundaries which will satisfy his
concerns. However, the issue of the separate school location is still unresolved.
Presently, the separate school is recommended to be established in an existing
residential area on the west side of Tooleys Road. In order to implement this,
the separate school board need to acquire at least four existing residential
properties and demolish the existing housing stock. Furthermore, the proposed
location is not adjacent to an existing or proposed park so the recreational area
requirements will be substantially increased and the facilities will not be of benefit
to the community as a whole. The location proposed for the school will impede
the orderly extension of municipal services for residential development north of
the school site. Furthermore, it is dangerous to establish a school on Tooleys
Road due to the traffic speeds. Mr. Curtis understands that the separate school
board recognizes these problems and has requested that the proposed site be
located within a plan of subdivision east of Farewell Creek. He fully supports this
relocation and asks that Council approve it.
Kerry Meydam, 3828 Trulls Road, Courtice, LIE 2L3, voiced her concerns about
proposed development in north Courtice. She stated that reasons given by most
Councillors for extending the urban boundary to include the D6 area including
the fact that it would be the only way we could be assured of having a watershed
study done. We have now been informed that it is questionable whether a
watershed study will be completed due to a lack of funding. She indicated that all
development should be frozen for north Courtice until such time as a watershed
study and management plan are complete and urged Council to reconsider their
approval of a living area designation for area D6.
Tony Bernardo, 5751 Ochonsky Road, Orono, LOB 1MO, addressed Council on
behalf of the Orono Fish and Hunt Club. Mr. Bernardo indicated that since the
previous meeting with respect to the Official Plan, he has had discussions with
Walter Frank who has agreed to obtain a document from each purchaser of his
proposed development stating that they are aware of the noise which will emanate
from the Orono Fish and Hunt Club. Mr. Bernardo stated that the Club is
satisfied with this arrangement.
Councillor Novak made a declaration of interest with respect to the delegation of
Stan Racansky; vacated her chair and refrained from discussion on the subject
matter. Councillor Novak indicated that she resides in the area subject of the
delegation.
Stan Racansky, 3200 Hancock Road, Courtice, LIE 2M1, addressed Council on
behalf of Friends of the Farewell. He stated that their future depends on
Council's decision as to whether or not their basic need, water for their wells, is
going to be maintained or it will cease due to the planned drainage of Courtice
north. He stated that if Council finds at this time funding is unavailable for a
watershed study, development should be frozen in that area. Also, Mr. Racansky
stated that they would like to see the addition of a new section which would state
that the M.T.O. will complete a comprehensive hydrogeology study by an
independent consultant on the area of the 407/401 link. In an effort to protect
nature, the Friends of the Farewell would like to see that the open space system,
Section 14, be added to the Regional Plan to ensure that the health of the people
and the eco system in each area of our municipality is maintained.

The meeting reconvened at 10:55 a.m.
John Genest, Malone Given Parsons, 140 Renfrew Drive, Suite 201, Markham,
L3R 6B3, addressed Council on behalf of Selby/Amberglen. Mr. Genest
distributed a letter dated December 5, 1995, from Victor Doyle, Ministry of
Municipal Affairs and Housing, advising that the Ministry is willing to lift
Deferal #5 subject to a new policy being added to the proposed Clarington
Official Plan. He indicated that municipal staff have stated that they cannot
support the suggestion at this time and Mr. Genest requested Council's support of
this new policy, thereby amending the Official Plan to incorporate the lands in the
north end of Newcastle Village within the Municipality's 2021 Urban Area
Boundary.
Joseph Victor, Creighton, Victor, Alexander, Hayward and Morrison, 235 King
Street East, Oshawa, L1H 1C5, addressed Council on behalf of his client,
Geraldine Cornish and Messrs. G. and E. Leaver, the owners of lands described
as Part of Lot 14, Concession 3, now known as Part 2, Plan 1OR-2976. His clients
object to the designation of their lands as Environmental Protection Area, noting
that lands lying to the east and to the south of their lands have been designated
as Medium Density Residential. It is their position that the characteristics and
topography of their land does not differ considerably from those lands and,
therefore, should carry the same designation.
Bob Hann, Valiant Property, 177 Nonquon Road, 20th Floor, Oshawa, LlG 3S2,
addressed Council with respect to property located on the northeast corner of
Highway 2 and Townline Road, and requested some flexibility on the 8m laneway
requirement. He stated that the laneway is necessary for internal traffic
movement for shoppers and to limit the number of exits/entrances from
Highway #2. He requested that the laneway exit onto Nash Road rather than
T ownline Road as suggested.
Gail Waisglass, P.O. Box 401, 209 Dundas Street East, Suite 308 Whitby,
L1N 5S4, addressed Council on behalf of owners of lands located in Part Lots 7
and 8, Broken Front Concession, former Township of Darlington, and voiced
their objection to Section 8.1 of the Port Darlington Secondary Plan, particularly
the second sentence of the policy statement which proposes that the waterfront
greenway will comprise a minimum width of 40m developable land beyond the
regulatory shoreline area. In the Port Darlington Secondary Plan presented to
Council in May 1992, the waterfront open space system was proposed to having a
minimum width of 7.5m of developable land. In the Draft Official Plan of May
1994, no minimum width of the waterfront greenway was indicated. Public
Consultation Report #7 which was subsequently adopted by Council contained a
position that "the precise location of the boundary of the waterfront greenway,
will be determined through consideration of detailed development applications."

They were dismayed to find that the Council adopted recommendation was not
carried into the recommended Official Plan and requested that the second
sentence of Section 8.1 of the Port Darlington Secondary Plan be revised to
reflect Council's adopted position as quoted above.
Bill Daniels, Kaitlin Group, 1029 McNicholl Avenue, Scarborough, M1W 3W6,
advised Council that Kaitlin Group has just recently acquired the property of the
Port of Newcastle Marina from Bramalea Limited. He stated that there is a
question of the density and requested that the density be amended to reflect the
density recommended at the time the offer was made to purchase the property,
i.e., population of 3,100, unit maximum of 1,075. Mr. Daniels also addressed
Council with respect to property located on the north side of Highway #2 at
Green Road which consists of 1,300 feet of frontage on Highway #2. He
requested that this property be designated as Special Purpose Commercial which
would allow for development of a home improvement centre, automotive use, car
dealership, etc. Mr. Daniels indicated that they are willing to construct an
information booth on the site and at such time as they are finished with the
building, they would transfer ownership of it to the municipality.

The meeting reconvened at 1:15 p.m.
Les Drover, 6 Timberlane Court, Courtice, LIE 2H1, addressed Council
representing several dozen families who reside in the Timberlane Court area. He
indicated that most moved to north Courtice to enjoy the relief from urban
growth, concrete, car-cluttered parking lot streets, wall-to-wall people, crime,
fences, etc. He stated that the urban boundary line has been pushed north to
Pebblestone under what they feel is now defunct reasoning, i.e., to receive funding
from the Province to conduct a proper watershed study for the area. Now they
are under the understanding that the funding for a proper and complete study is
not available and request that the Council reconsider their decision to alter the
urban boundary line.
Lorn Butterfield, 2981 Regional Road 20, Bowmanville, LlC 3K6, addressed
Council on behalf of the North Clarington Ratepayers' Association.
Mr. Butterfield advised that representatives of Mosport, the North Clarington
Ratepayers' Association, the Municipality and the Region of Durham have been
meeting in an attempt to come to an agreement with respect to the node
designation in the Regional Plan pertaining to Mosport Park. He stated that the
North Clarington Ratepayers' Association cannot support the wording as put
forward by Mosport Park earlier in the meeting as Mosport Park has not
endorsed the verbal agreement which was arrived at.

Bob Stephenson, 170 Given Road, Newcastle, LIB 1LO, expressed his pleasure
that the entire Foster neighbourhood is included in the Newcastle Village Urban
Area. He feels that this change is consistent with decisions that have been made
and a direction that has been established for the urban development of the
Village over the last 25 years.
David Rice, Ridge Pine Park, 17 Dean Street, Brampton, LSW 1M?, addressed
Council with respect to the Special Policy Area B (Wilmot Creek). He stated
that this area reflects the area where homes are in fact built today, however, they
are negotiating with Ontario Hydro to relocate a portion of their golf course
under the Hydro Corridor. Mr. Rice requested that the Special Policy Area be
extended as far north as the urban boundary.
James Parkin, MacNaughton, Hermison, Britton, Clarkson, 171 Victoria Street
North, Kitchener, N2H 5L5, addressed Council on behalf of St. Marys Cement.
Mr. Parkin indicated that St. Marys is re-affirming their support for the
recommendations contained in the Generation Trust Waterfront Report.
James Parkin, MacNaughton, Hermison, Britton, Clarkson, 171 Victoria Street,
North, Kitchener, N2H 5LS, addressed Council on behalf of Aggregate Producers
of Ontario. Mr. Parkin indicated that the Oak Ridges Moraine is the most
important sand and gravel extraction area in the Greater Toronto Area, and the
consumption of the aggregates is far exceeding the rate of replacement. He
requested that the entire land form not be treated equally, but that the needs be
measured and the wetlands and woodlots policies be reviewed. He requested
consideration through special zoning be given to aggregate plants.
S. Matherew, 11 Stanley Court, Unit 1, Whitby, LIB 8P9, addressed Council on
behalf of Otto Provenzano, the owner of land located at 1678 Highway 2,
Courtice. Mr. Matherew requested that this property be included in the main
central area, as this would be a continuation of the present designation.
Mel Garland, Box 21, R.R. #2, Orono, LOB 1MO, advised that he feels that the
recommended Official Plan is an impressive document, however, the wording
regarding aggregate resources is too strong. In his opinion, the policies contained
within the report, would not allow another aggregate company to locate within the
municipality. Also, Mr. Garland stated that in his opinion, the section dealing
with Economic Development is too vague.

THAT Report PD-145-95, Public Consultation Report #8 and the Recommended
Official Plan, be received for information;
THAT the regular Council Meeting of January 29, 1996, be scheduled for
adoption of the new Clarington Official Plan; and
THAT the deputations be acknowledged and be advised of the adoption date of
the Clarington Official Plan.

The special Council meeting was called for the purpose of discussing the
construction of the Courtice Community Complex.
DECLARATIONS OF INTEREST
There were no declarations of interest made at this meeting.
DELEGATIONS
Brad Greentree, 95 Devondale Street, Courtice, LIE 2A1, pled with Council to
proceed with the construction of the Courtice Community Complex.
Craig Brown, Chairman, Clarington Public Library Board, advised that the Board
is committed to work with Council to address the operating costs of the Library
expansion in Courtice. He indicated that Courtice did not exist at the time the
libraries were amalgamated in 1974, however, presently Courtice holds one
quarter of the population of the Municipality. Therefore, this service is badly
needed in that area. The Board shares Council's concerns regarding the financial
impact, however, they have identified that the operating budget of the facility can
be decreased by $100,000 by implementing various methods.

Ian Smith, 113 Foxhunt Trail, Courtice, LlR lEI, Chairman, Courtice
Fundraising Committee, advised Council that he still wishes to continue to work
with Council and staff to see this project become a reality. He indicated that the
complex would provide an identity for Courtice.
Resolution #C-876-95
Moved by Councillor Hannah, seconded by Councillor Novak
THAT Report ADMIN-35-95 be received;
THAT staff be directed to implement one of the following options regarding the
Courtice Community Complex:
a) Stop the construction of the facility indefinitely, to allow the Municipality
time to adjust to the cuts and determine whether more cuts are to come
in the 1996 and 1997 Provincial budgets. This will involve some costs to
pay for the excavation work done to date and potentially some penalties
or legal challenges from the contractor. Architectural fees will also have
to be addressed.
b)
Proceed with the completion of the foundation and cover it over until the
Municipality can afford to proceed with completion of construction and
operation.
c) Proceed with the construction for a scaled down version of the Complex
in order to operate only one component, either the Library or the Core.
This too could entail additional costs or penalties regarding the
excavation work in that a different type of foundation may be needed. A

d) Proceed with the construction of the Complex at its original size, and
close the building until the Municipality can accommodate the
operational cost of one or both of the components.
THAT the Clarington Older Adults Committee be requested to submit a normal
annual operating budget to staff for consideration in a report back to Council in
January 1996 which will address the option of proceeding with an Older Adults
Centre; and
THAT the following be notified of Council's decision: Don Welsh for the
Clarington Older Adults, Ian Smith, the Chairperson for the Courtice Fundraising
Committee, Craig Brown, Chairperson for the Clarington Library Board.
