ALTERATION OF AGENDA MINUTES DELEGATIONS Resolution #C-214-91 Moved by Councillor Hooper, seconded by Councillor Wotten THAT the agenda be altered by renumbering Communication Item I . 2 to Communication Item D - 12. "CARRIED" Resolution #C-215-91 Moved by Councillor Wotten, seconded by Councillor Stapleton THAT the minutes of a regular meeting of Council held on March 25, 1991, be approved. "CARRIED" Joseph Cornachia, Ashdale Capital Corporation, advised the Clerk's office that he would not be attending the meeting. Council Minutes . DELEGATIONS . COMMUNICATIONS . - 2- April 15, 1991 Nino Scanga was called but was not present. Ms. Shirley Sylvester appeared before Council on behalf of Wayne Einhorn, Family Trust Corporation Realtor, 335 Bayly Street West, Ajax, LIS 6M2, with respect to parking problems which have arisen for the Family Trust Office in Bowmanville since "No Parking" signs were erected on Queen Street. Ms. Sylvester proposed that the enforcement of the "No Parking" by-law for Queen Street not be enforced until such time as an acceptable compromise is reached. Kim Lauzon, 52 Stanford Crescent, Newcastle, LlB lE9, addressed Council with her concerns as they relate to dogs running in parks and requested that a "Poop and Scoop" provision be included in the Town's by-laws. Florence Nadean, 16 Silver Street, Bowmanville, LIC 3C3, addressed Council in opposition to the recommendations contained in Item # 16 of Report #1 (Report PD-78-91). Ms. Nadeau indicated that the applicant has removed the fence along the boundary of her property without her consent and, in so doing, has ruined her flower bed and garden. Also, she has noticed several trespassers in her backyard since this fence has been removed. Ms. Nadeau raised concerns with respect to gravel encroaching onto her property from the applicant's property and her basement being flooded because of the applicant washing vehicles on his front lawn. Ms. Nadeau requested that, in the event Council approves the recommendation, a fence be erected at the cost of the applicant. Nick Mensink, G.M. Sernas, 110 Scotia Crt., Unit 41, Whitby, LIN SY7, addressed Council in opposition to the recommendations contained in Item #5 of Report #1 (Report PD-68-91). Rather than denying the application, Mr. Mensink requested that Council allow the application to follow the due process as outlined in the Planning Act. "CARRIEDII Resolution #C-231-91 Moved by Councillor Hamre, seconded by Councillor Hooper THAT Report PD-78-91 be received; THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 64-63, as amended, submitted by Susan and Frank Shane be approved and that a zoning by-law amendment be brought forward for Council's approval at such time as the applicant has entered into a Site Plan Agreement to the Town's satisfaction; THAT a paved berm not be a requirement for the site plan; THAT parking of vehicles be allowed in the front of the building; THAT the applicant agree to save harmless the Town from any liability and this be included in the site plan agreement; and THAT the interested parties listed in Report PD-78-91 and any delegation be advised of Council's decision. REPORTS Item #22 Waste Reduction E07.251.GE . . - 8- April 15, 1991 Resolution #C-232-91 Moved by Councillor Hamre, seconded by Councillor Hooper THAT Report WD-31-91 be received; THAT the Blue Box Recycling Program in the Town of Newcastle be restricted to the urban areas of Courtice, Bowmanville, Newcastle Village and Orono and that the rural areas of the Town be serviced by recycling depots (Igloos) located at the Town of Newcastle Public Works Depots in Hampton, Bowmanville and Orono, the Newcastle Village and Enniskillen Fire Halls and at Newtonville, Mitchell Comers, Kendal and the Wilmot Creek Development; THAT staff investigate and report on additional recycling sites to service the residents across the municipality; THAT the maximum number of containers permitted for collection of garbage by the Town be reduced from six to fIve effective July 2, 1991; THAT, subsequent to the implementation of this change, the impact on the users be evaluated from the viewpoint of reducing the number of containers even further; THAT the appropriate advertisements be placed in the local newspapers to advise the public of the changes; and THAT a copy of Report WD-31-91 be forwarded to Ruth Grier, Minister of the Environment, Durham Region, Helen Macdonald, Suzanne Elston, John Veldhuis and Kristen McCrea and that they be advised of Council's decision.
