PRESENTATIONS
(a) Glenn Case, Port Granby presented an update on the Port Granby, Low Level Radio
Active Waste, Environmental Study Report and provided the Committee Members with
a handout supporting the presentation. He discussed the following issues: the project
purpose and legal agreement framework, preferred option development, environmental
assessment, design and licensing. The draft EA Study Report will be presented to the
public on February 22, 2005 at the Newtonville Hall.

2.0 LOCATION
2.1 The lands subject to the amendments are located on north side of Aspen Springs
Drive, between West Side Drive and Martin Road in Bowmanville, being Part Lots 15
& 16, Concession 1, in the former Township of Darlington. (see Attachment 1).
3.0 BACKGROUND
3.1 On February 24, 2004, applications to permit four 4-story apartment buildings on 3.6
hectares of land was originally received. The application was put on hold, at the
applicant's request, due to negotiations with the GO Transit for a train station car
park to be located on the east side of the subject land.
3.2 After having completed a land negotiation with GO Transit, the applicant submitted a
revised application for the high density proposal on October 29, 2004. The revised
applications propose a total of 271 dwelling units in three 4-story apartment
buildings. A site plan application has not been submitted, however, the concept
plan indicates both surface and underground parking and landscaped court yards in-
between the buildings.
3.3 The subject lands were previously draft approved for the development of a crescent
shaped street containing a total of 64 single and semi-detachedllink dwellings.
4.0 SITE CHARACTERISTICS AND SURROUNDING LAND USES
4.1 The subject site is currently vacant.

5.0 OFFICIAL PLAN POLICIES
5.1 The lands are designated "Living Area" within the Durham Regional Official Plan.
Lands designated "Living Area" perm if the development of communities with defined
boundaries, incorporating the widest possible variety of housing types, sizes and
tenure. The proposal is inconformity with the policies of the Durham Region Official
Plan.
5.2 In the Clarington Official Plan, the subject lands are designated as Urban
Residential, in the Bowmanville Urban Area. The lands are within the Westvale
Neighbourhood and incorporate a High Density Symbol north of Aspen Springs
Drive.
High Density residential uses shall be developed at a density of 61-100 units per net
residential hectare. The predominant housing form shall be high-rise apartments to
a maximum of six stories. The Official Plan Amendment application proposes
changes to the housing target for the Westvale Neighbourhood from "1800" to
"2000" by decreasing the low density from 1025 to 950 and increasing the high
density from 275 to 550.
The population allocation for Westvale Neighbourhood is currently 4800. The
proposed amendment increases the population allocation from 4800 to 5150
persons.
6.0 ZONING BY-LAW
6.1 . Within Comprehensive Zoning By-law 84-63, as amended, the lands are zoned
"Holding"Urban Residential Type One ((H) R1)" Zone. A zoning by-law amendment
is required to facilitate the proposed development.
7.0 PUBLIC MEETING AND SUBMISSIONS
7.1 Public notice was given by mail to each landowner within 120 metres of the subject
site and a public meeting notice sign was installed on the property.
7.2 At the time of the writing of this report two residents have requested further
information with respect to the proposal. One resident raised concerns about
possible traffic increases on Aspen Springs Drive. No other concerns regarding this
development were raised.

8.1 The Clarington Engineering Services Department did not identify any issues with the
proposed Official Plan Amendment and Rezoning, however, they provided the
following comments applicable to a future site plan application:
. Site plan approval for the subject lands can not occur until any traffic and
transportation improvements that are deemed necessary by the Director of
Engineering Services for the Bowmanville Urban Area have been approved by
the Municipal Council and have been implemented. The necessary
improvements may include but not be limited to the construction of new arterial
roads, the construction of grade separations, road construction, road
improvements, traffic signals, sidewalks, illumination, public transit improvements
etc. The required improvements may also include improvements to the Regional
Roads or other regional facilities. Any final decision will be made solely at the
discretion of the Director Engineering Services. .
. Prior to any site plan approval for the subject lands the applicant must provide an
on-site parking plan that is satisfactory to the Director of Engineering Services.
. The required plan must demonstrate that there is sufficient on-site parking to
accommodate the maximum anticipated level of resident and visitor parking.
. Prior to the site plan approval for the subject lands the applicant's engineer must
demonstrate that the site confirms to both the storm sewer design for the
subdivision and to the requirements of the West Side Master Drainage Study.
8.2 Clarington Emergency Services Department and Clarington Building Department
have stated that they have no objection or concerns with regard to this application.
8.3 The Region of Durham Planning Department provided comments with respect to
conformity to the Durham Region Official Plan, Regional Services, Provincial
Policies and Delegated Review Responsibilities. The Region noted that the
proposal is permitted by the policies of the Durham Regional Official Plan and the
applicant is required to submit site servicing drawings to the Regional Works
Department for their review prior to the insurance of building permits by the
Municipality.
8.4 Central Lake Ontario Conservation Authority has no objections to this development
and detailed requirements will be addressed through the site plan approval process.
8.5 At the time of writing this report, comments from St. Lawrence and Hudson Railway
have not been received.
8.6 Clarington Catholic District School Board has commented that provisions should be
made for sidewalks in this development.
8.7 Enbridge Gas, Bell Canada and Rogers Cable TV have no objections to the
development.

9.0 STAFF COMMENTS
9.1 The development proposes 271 apartment units within three 4-storey buildings. The
development has a net density of 99 units per ha. Although site plan details have
not been submitted at this time, the applicant has confirmed that underground
parking will be necessary to accommodate the required parking for the development.
9.2 The concept plan indicates two landscaped courtyards to be developed on-site.
Should the development be approved, through site plan approval both in-door and
out-door on-site amenities will be required.
9.3 The proposed development is at the north limits of the Westvale Neighbourhood in
the vicinity of other medium and high density developments. In addition, it is adjacent
to the future GO Train station and immediately south of the Bowmanville West Main
Central Area. High density residential in this location is appropriate. Provincial,
Regional and Municipal policies all support the greater utilization of transit and the
development of land use patterns that support and can sustain transit operations.
9.4 Prior to further consideration of this application, in addition to addressing the
comments provided by Engineering Services with respect to the road network, and
parking the applicant will be required to submit a traffic impact study in support of the
application.
10.0 CONCLUSIONS
10.1 In consideration of the comments received from circulated agencies and review of
the proposal, it is recommended that the application be referred back to the staff for
further processing. .

2.0 BACKGROUND
2.1 On January 13, 2005, the Planning Services Department received an application to
rezone Blocks 101 and 102 in registered Plan of Subdivision 40M-2172, to be
consistent with the zoning on Blocks 137 and 138 in registered Plan of Subdivision
40M-2096 to permit the construction of two (2) single detached dwellings. The current
zoning is different in each registered Plan.
3.0' LAND CHARACTERISTICS AND SURROUNDING USES
3.1 77 and 85 Stephens Gulch Drive are currently addresses of blocks that need to be
rezoned to permit building permit issuance and dwelling construction. These lands are
vacant and slope gently to the east. The site is surrounded by urban residential uses.
4.0 PUBLIC NOTICE AND SUBMISSIONS
4.1 Public notice was given by mail to each landowner within 120 metres of the subject
property and a public notice sign was installed on the Stephens Gulch Drive frontage.
4.2 As a result of the public notification process, to date, the Planning Services Department
has received no inquiries.
5.0 OFFICIAL PLAN CONFORMITY
5.1 The Clarington Official Plan designates these lands as "Urban Residential, Low Density"
area. The application conforms.

6.0 ZONING BY-LAW COMPLIANCE
6.1 Within Comprehensive Zoning By-law 84-63 of the fonner Town of Newcastle, these
lands, two blocks, are "Urban Residential Type One (R1) Zone". The two blocks
abutting on the north, are "Urban Residential Exception (R2-26) Zone". The proposed
rezoning gives the subject blocks the same zoning as the complementary blocks to the
north, that is, "Urban Residential Exception (R2-26) Zone".
7.0 AGENCY COMMENTS
7.1 The rezoning application was circulated to only the Engineering Services Department
and it had no objection to the rezoning.
8.0 STAFF COMMENTS
8.1 The proposal is a minor technical amendment to the zoning boundary that facilitates the
combining of blocks to create whole lots that pennit the construction of detached
dwellings in compliance with all relevant zoning regulations such as frontage and
setbacks. Staff have not received any inquiries and do not anticipate any objections
being raised at the public meeting.
8.2 The Finance Department advises that the taxes have been paid in full.
9.0 RECOMMENDATION
9.1 Based on the comments in this report, it is respectfully recommended that the rezoning
application be APPROVED.

To amend the "Light Industrial Area" policies in Section 11.5 to
permit 50,300 sq.m. (550,000 sq.ft.) of retail commercial and large
format retail uses.
1.4 Rezoning: To rezone the subject lands from "Agricultural Exception (A-1)
Zone" to implement the proposed official plan amendment.
1.5 Site Area: 21.85 hectares
2.0 LOCATION
2.1 The property under consideration is located at the northwest comer of Highway
401 and Bennett Road south of future Baseline Road in Bowmanville (See
Attachment 1). The site areatotals 21.85 hectares (54.0 acres). The property is
located within Part Lot 5, Broken Front Concession 1, in the former Township of
Darlington.
3.0 BACKGROUND
3.1 A YT Corporation's original applications which were received on November 12,
2004, were in respect of a parcel of land located on the northeast corner of
Highway 401 and Bennett Road. These lands are not located within the
Bowmanville urban area and are therefore subject to the prohibitions of the
Greenbelt Protection Act. Since development applications for urban ul/es cannot
be considered on lands covered by this legislation, Staff returned the original
applications to the applicant.
3.2 On November 25, '2004, Staff received revised Official Plan Amendment and
rezoning applications from Walker Nott Dragecivic Associates Limited on behalf
of AYT Corporation to permit the development of the subject lands. They are in
the Bowmanville urban area and are not subject to the prohibitions of the
Greenbelt Protection Act. The proposed development is intended to contain
50,300 sq.m. (550,000 sq.ft.) of retail commercial and large format retail uses,
including a department store, a food store, a home improvement centre,
restaurants and other retail uses. The development is proposed to proceed on
private communal services.

3.3 Staff note that this report references A YT Corporation's applications to be for the
development of 50,300 sq.m. (550,000 sq.ft.) of retail commercial and large
format retail uses. However, the Public Notice of the General Purpose and
Administration Committee meeting states that the development would comprise
only 46,500 sq.m. (500,000 sq.ft.). While the applications and the preamble to
the proposed Official Plan Amendment submitted by A YT Corporation indicate a
total of 46,500 sq.m., the concept plan also submitted by the applicant indicates
50,300 sq.m. of retail commercial and large format retail uses are intended to be
developed on the subject lands., In subsequent discussions with Staff, the
consultant for AYT advised that the proposed floors pace should be 50,300 sq.m.
for consistency with AYT Corporation's application for its proposed Durham
Region Official Plan Amendment.
4.0 SITE CHARACTERISTICS AND SURROUNDING USES
4.1 The subject lands are currently farmed and contain a large woodlot in the center.
The site slopes gently to the south and west from Bennett Road. The property
contains a small spring-fed watercourse that feeds a pond on the adjacent
property to the west.

S.O OFFICIAL PLAN POLICIES
5.1 The Durham Region Official Plan designates the subject lands "Employment..
Area". This designation permits manufacturing, assembly, processing and
warehousing among other individual type uses. Retail warehouses, which does
not permit a supermarket or department store, may be permitted by local Council
in Employment Areas subject to compliance with the Plan policies. The applicant
has filed an application to amend the Durham Region Official Plan.
5.2 The Clarington Official Plan designates the subject lands "Light Industrial Area".
Permitted uses indude manufacturing, processing, fabricating, repairing,
research and development facilities, and warehousing. Certain commercial,
community and recreational uses, including banks, restaurants, athletic clubs,
banquet facilities, and fraternal organizations may be permitted provided they are
limited in scale and serve the area's employee base.

5.3 Large scale retail warehouses may be permitted by amendment to the Clarington
Official Plan subject to the provisions of Section 10.9.5. This section requires
tha.t:
· The use is sufficiently large so that it is considered not compatible with a
Central Area location.
· A consultant retained by the Municipality at the expense of the applicant
prepares a retail impact analysis.
· The site is located in proximity to an interchange with a freeway.
· The anticipated traffic can be accommodated on the transportation network.
. Vehicular access is obtained from an arterial road.
The proposed official plan amendment submitted by the applicant with the
applications is contained in Attachment 2 of this report.
5.4 The Clarington Official Plan shows that a collector road is designated on the
subject lands. The proposed collector road between Lambs Road and Bennett
Road bisects the property in an east-west manner. The concept plan submitted
by A YT Corporation does not show the future road, nor does the applicant's
proposed amendment to the Clarington Official Plan make any reference to its
deletion.
6.0 ZONING BY-LAW CONFORMITY
6.1 The property is zoned "Agricultural Exception (A-1) Zone". The current zoning
does not permit the proposed commercial development. In order to permit the
proposed development, a rezoning application was submitted for consideration.
7.0 PUBLIC NOTICE AND SUBMISSION
7.1 Public notice was given by mail to each landowner within 120 metres of the
subject site and two public meeting notice signs were installed on the property's
road frontages. Staff have received a number of general inquiries on the
development proposal.
7.2 Several inquiries made of Staff have raised the following concerns.
· Concerns were raised over the intended method of servicing. The use of
communal well and sewage disposal services raises questions of impacts
on the water quantity and quality of wells on adjacent properties.
· Concerns were raised about the impacts that urban development will have
on the agricultural viability of adjacent lands, both within and outside the
urban area.
· A spring feeds a pond on the adjacent property, which is being used for
agricultural purposes. Development on the adjacent lands could either
divert or destroy this groundwater source.

8.2 The Durham Region Health Department indicates that since daily sewage flows
will exceed 10,000 Iitres/day, Ministry of Environment approval will be necessary.
8.3 Due to the limited commenting period, comments from the Clarington
Engineering Services, Durham Region Planning Department, Durham Region
Public Works Department, Central Lake Ontario Conservation Authority, Ministry
of Transportation, and Hydro One Networks Inc. have not been received to date.
9.0 STAFF COMMENTS
9.1 A letter has been sent to the applicant outlining various issues where further
clarification is necessary as well as studies that will be necessary to review the
application.
. Proposed Official Plan Amendment
In reviewing the proposed amendment, Staff raised the following concerns:
)> Map B3 of the Clarington Official Plan shows a proposed collector road on
the subject lands, which links Lambs Road with Bennett Road. Since the
development concept plan does not appear to incorporate this collector
road, it is unclear how this matter will be addressed.
)> The proposed amendment would permit the term "industrial commercial
uses", but provides no definition for this term.
The consultant must clarify both issues.
.. Planning Rationale
The applicant has not provided a detailed planning rationale with the
application. Supporting justification for the statement contained in the
preamble to the proposed official plan amendment is required.
The planning rationale must also examine the impact to the Municipality's
industrial land supply of redesignating the subject lands from industrial to
commercial uses as well as the impact on the ability to develop the
surrounding industrial lands for their designated use.
. Retail Market Impact Study
Terms of Reference for a retail market impact study, which addresses the
requirements of both the Durham Region Official Plan and the Clarington
Official Plan, have been prepared and circulated to urbanMetrics, the retail

market consultant undertaking the Municipality's Commercial Policy Review,
for a proposal. .
The applicant is required to pay for the retail market impact study as is
required by the Clarington Official Plan.
. Site Servicing Study
The application indicates that the development will proceed on communal
servicing until such time as full municipal services are available. No
supporting documentation has been provided as to when full municipal
services will be available. Staff note that Ministry of Environment approval is
necessary for development where sewage flows exceed 10,000 litres per day.
A communal servicing scheme will also require approval from the Durham
Region Public Works Department. The scheme shall include monitoring and
long-term maintenance of the system
The applicant is required to submit a detailed servicing plan for the proposal.
This must include a hydrogeological study satisfactory to the Region and to
the Municipality of Clarington which confirms that sufficient water is available
to serve the development and that there are no adverse impacts on the well
levels of surrounding agricultural and rural residential properties.
. Traffic Study
A traffic study must be prepared by the applicant to the satisfaction of the
Municipality of Clarington, Regional Municipality of Durham, and Ministry of
Transportation addressing, among other matters, the following:
~ The traffic levels and patterns for the ultimate development scenario
must be determined.
~ The existing area road network must be studied to determine the level
of development that can be accommodated.
~ The study must identify the necessary road improvements required to
facilitate development. Development phasing options should be
considered.
~ The concept plan shows the unopened portion of Baseline Road to be
a future road. This portion is not proposed to be improved in
conjunction with the proposed development. The traffic study must
examine the amount of development that can occur based on one
access to the project from Bennett Road. .
. Stormwater Management Study
The applicant's engineer must prepare a stormwater management study
satisfactory to the Municipality's Director of Engineering Services and Central
Lake Ontario Conservation Authority to demonstrate where storm run-off
generated by the development will be directed. The applicant must also

propose appropriate control measures to the satisfaction of the Director and
the Conservation Authority.
. Clarington Science and Technology Park - Secondary Plan and Urban
Design Strategy
The. Municipality is undertaking a secondary plan and urban design analysis
to advance the development of theClarington Science and Technology Park.
The area being studied is a 130 hectare land area bounded by Bennett Road,
Highway 401, Haines Street, and Highway 2. The lands are designated for
employment uses in the Durham Region Official Plan and for prestige
employment, light industrial and general industrial uses in the Clarington
Official Plan. The lands are generally undeveloped and have access to
Highway 401 via the Bennett Road partial interchange..
The planning and urban design firm of Urban Strategies Inc. has been
retained to prepare a concept plan and urban design strategy for
development of this Science Park. The subject lands are located within the
study area.
9.2 Although the subject lands are designated for urban development, much of the
immediate area on the north side of Highway 401 and west of Bennett Road is
actively being farmed. The presence of such a large retail commercial proposal
has raised a number of land use compatibility issues.
Concerns have been raised over impacts that urban development will have on
the agricultural viability of adjacent lands, both within and outside the urban area.
Since the subject lands are designated for urban use, development cannot be
delayed if the proposal has received proper approvals.
In particular, the property immediately west of the subject lands is being actively
farmed and the pond on this property is fed by a spring from the subject lands.
Development on the subject lands could impact this groundwater source. Staff
will have to investigate whether this water source is to be preserved or piped to ..
continue feeding the adjacent pond.
. 10.0 CONCLUSIONS
10.1 As the purpose of this report is to satisfy the requirements for Public Meeting
under the Planning Act, and taking into consideration all of the comments
received, it is respectfully recommended that this report be referred back to Staff
for further processing and the preparation of a subsequent report.

1.0 INTRODUCTION
This document, entitled "Part B - The Amendment", consisting of the following text and
"Schedule A", constitutes Amendment No. to the Official Plan of the Municipality of
Clarington.
2.0 DETAILS OF THE AMENDMENT
The Official Plan is amended as follows:
a. Section 11.5 (Light Industrial Areas) is amended by including the following site-
specific policy for the Subject Land identified on Schedule 'A';
"Permitted uses for the land abutting Bennett Road to the east, the Baseline
Road (Road Allowance) to the north and the King's Highway No. 401 to the south
shall include those permitted as well as retail warehouse commercial uses, retail
uses and industrial commercial uses that are compatible with nearby uses."
3.0 IMPLEMENTATION AND INTERPRETATION
The provisions of the Official Plan as amended from time to time shall apply in this
regard to this Amendment.

1. THAT Report PSD-024-05 be received;

Inventory, as contained in Attachment 1, be APPROVED;
3. THAT each residential property owner be remunerated $50.00 and each private school be
remunerated $150.00 in recognition of the inconvenience and costs associated with the street
name change;
4. THAT the funds for remuneration for street name changes in northwest Bowmanville be paid
from Account #1 00-x-x-x-290 1 Working Funds Reserve;
5. THAT a copy of this Report and Council's decision be forwarded to the Durham Regional Police
and the Region of Durham Planning Department; and '

1.0 BACKGROUND
1.1 . Staff previously reported back to Committee on the result of the public information
centre convened to discuss the possible name change for the portion of Scugog Street
northwest of Middle Road. Staff also recommended changes to a portion of Middle
Road.and Jackman Road. Council, at its January 31,2005 meeting, adopted the
following recommendation contained within staff report PSD-016-05:
"THAT Staff be authorized to take appropriate actions under Section 47 of the Municipal
Act, to advertise and hold a Public Meeting for the proposed street name changes that
were chosen by representatives of affected properties who attended the Public
Information Session".
1.2 Report PSD-016-05 (Attachment 1) explained the chosen street names and these
names were subsequently advertised. The completion date for the advertisements
within the local newspapers was February 9. 2005.
1.3 Staff can now forward a recommendation report and amending by-law to Committee
and Council. The amending by-law (Attachment 2), contains all of the street name
changes that were in the above advertisements. This Report and its attached amending
by-law are presented for Committee and Council's approval.
1.4 The implementation will proceed with the following transition process:
. The effective date is September 1. 2005, save and except for the affected portion of
Jackman Road which would be effective March 1, 2005; and
. The Municipality will advise 43 agencies of the proposed street name changes.
1.5 The remuneration policy used for the "9-1-1" street name changes will be used for the
northwest Bowmanville street name changes, that is, remuneration of $150.00 per
affected business (and the policy categorizes schools as a type of business), and $50.
per residential property owners and residential tenants, on a per household basis. The
estimate of the number of properties affected by the street name and/or street address
changes are as follows:
. Residential owners/tenants
. Two private schools
30 x $50.00 = $ 1,500.00
2 x $150.00 = $300.00
The cost of the remuneration package is less than $2,000.00
. 2.0 CONCLUSION
2.1 It is respectfully recommended that the attached amending by-law be APPROVED.

1.0 BACKGROUND
1.1 The lands between Middle Road and Scugog Street will be developing over the next few
years. In December 2004 draft approved plan of subdivision 18T -87086 was registered as
Plan 40M-2225. Draft approved plan of subdivision 18T-87085 is proceeding quickly
toward registration. With the construction of these subdivisions, the new road network
intersects with Scugog Street in several locations. Consequently, Scugog Street is divided
into several distinct segments that are not continuous (Attachment 1). The discontinuity
will generate some confusion with the street names and numbering. On October 25, 2004
Council authorized Staff to consult with residents with respect to changing the street name
for segments of Scugog Street.
1.2 The purpose of this report is to inform Council of the results of the Public Information
Session that was held on the evening of November 30, 2004 at the Gamet B. Rickard
Recreation Complex. This report also seeks authorization to advertise the proposed street
name changes and hold the subsequent public meeting.
2.0 PUBLIC INFORMATION SESSION
2.1 Staff organized and attended a public information session at the Gamet B. Rickard
Recreation Complex in an effort to obtain input from the various property owners with
respect to the above-mentioned need to change street names. Notices were sent by first
class mail to all landowners on Scugog Street north of the intersection with Middle Road.
At the session a few people were in favour of the street name changes. A few people
were strongly opposed but, the large majority although opposed at the start of the meeting,
came to understand the need for the changes and reluctantly agreed to work with staff on
the selection of the new names.
2.2 Residents were given the opportunity to propose a new street name or select a street
name from an approved list of war dead, war veteran and historical street names. MQst
residents wanted to retain some reference to "Scugog" in the new street name. Thus
North Scugog Court and West Scugog Lane were selected.
. West Scuaoa Lane
This proposed name, used on Scugog Street from Middle Road to 80ns Avenue,
with a new street extension going directly north to Concession Road 3 (Attachment
1) currently has 11 households. Four (4) households were at the session.
. North Scuaoa Court
This proposed name, used on Scugog Street from 80ns Avenue to a future cul-de~
sac immediately south of Concession Road 3 (Attachment 1) will be used by 12
current households. Six (6) households were at the session and representatives of
Knox Christian School were in attendance.

The Durham Region Planning Department has approved the two names selected, for use
by Clarington.
3.0 OTHER STREET SEGMENTS
3.1 Middle Road
It is proposed that Middle Road from its current southern terminus at Scugog Street, north
to Concession Road 3 (Attachment'1) be renamed Scugog Street. The intersection at a
concession road is a more appropriate location for the transition of street names. The only
muniCipal street address for this road segment is St. Stephens Secondary School. The
separate school board, has verbally indicated that they accept the Municipality's right to re-
name a street but ask that the timing be suitable for St. Stephen's Secondary School.
3.2 Jackman Road
The opening of the Longworth Bri9ge and its westerly connection to Regional Road 57 in
December 2004 necessitate the renaming of the portion of Jackman Road between
Longworth Bridge and Regional Road 57 (Attachment 1) at this time, to Longworth Avenue
and therefore, it has been included with the Scugog Street renamings. There are no
municipal street addresses on this segment of Jackman Road.
4.0 NEXT STEPS
4.1 The Municipal Act requires that a Public Notice be given prior to holding a public meeting
on a street name change. It is proposed that a public meeting be held on February 21,
2005.
4.2 It will be important to consider the timing of the street name changes in order to give
people time to give notice of their change of address. It is recommended that the name
changes for Scugog Street and Middle Road be effective September 1, 2005. This timing
works well for the three schools. affected by the street name change since it occurs at the
start of a new school year.
There are no households impacted by the renaming of Jackman Road, thus it would be
renamed effective March 1, 2005.
5.0 CONCLUSIONS
5.1 It is recommended that staff be authorized to advertise a Public Meeting for the street
names changes identified in Sections 2 and 3 of this report.

2.0 COMMENTS
2.1 A2005/001 was an application to reduce the minimum lot frontage of a proposed lot
from 15 metres to 13.83 metres. The application was previously tabled to provide the
applicant with the opportunity to meet with Engineering Services to address concems
regarding the curvature of the street and the possibility that the lot would not properly
accommodate the creation of a driveway while providing adequate storage area for
snow. The applicant provided plans to the Engineering Services Department
demonstrating the proposed lot's ability to meet Engineering's design requirements.
Staff recommended that the application be approved and the Committee concurred.
2.2 Staff has reviewed the Committee's decisions and is satisfied that the applications that
received approval are in conformity with the Official Plan policies, consistent with the
intent of the Zoning By-law and are minor in nature and desirable. Council's
concurrence with the Committee of Adjustment decisions is required in order to afford
Staffs official status before the Ontario Municipal Board in the event of an appeal of any

BACKGROUND
On December 9, 2004, Staff received a request from The Kaitlin Group Limited for the
removal of Part Lot Control with respect to Lots 2 to 9 inclusive, 12 to 17 inclusive, 40 to
45 inclusive, on Plan 40M-2220 and Lots 1 to 19 inclusive, on Plan 40M-2226 (Attachment
1 ).
The plan of subdivision 18T-96013, which encompasses the area of this application
received draft approval for. 54 single detached, 210 semi-detachedllink (105 lots), 132
townhouse and 178 apartment dwelling units. Registration of plans of subdivision 40M-
2220 and 40M-2226 were completed October 6, 2004 and December 3, 2004,
respectively.
COMMENTS
Staff has no objection to the approval of a By-law exempting the subject lands from Part
Lot Control. Attached is a By-law (Attachment 2) to exempt the subject lands from Section
50 (5) of the Planning Act.
In accordance with the procedures established in the delegation of Part Lot Control By-
laws, Planning Staff will forward to the Regional Planning Department the ftUnit Type and
Number Summary Table" (Attachment 3) along with a copy of the Part Lot Control By-law.
The Finance Department advises that the taxes have been paid in full.
Staff recommends that the by-law be in force for a two (2) year period following Council .
approval, ending February 28, 2007.
RECOMMENDATIONS
It is recommended that Council approve this application and adopt the attached Part Lot
Control By-law for Lots 2 to 9 inclusive, 12 to 17 inclusive, 40 to 45 inclusive, on Plan
40M-2220 and Lots 1 to 19 inclusive, on Plan 40M-2226.

WHEREAS the CounCIl of the Corporation of the Municipality of. Clarington deems n
advisable to exempt from Part Lot Control, Lots 2 to 9 inclusive, 12 to 17 inclusive, 40 to
45 inclusive, on Plan 40M-2220 and Lots 1 to 19 inclusive, on Plan 40M-2226, registered
at the Land Trtles Division of Whnby;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. That Subsection 5 of Section 50 of the Planning Act shall not apply to those lands
described in paragraph 2 wnhin the By-law.
2. That this By-law shall come into effect upon being approved by the Municipality of
Clarington and thereafter Subsection 5 of Section 50 shall cease to apply to the
following lands:
a) Lots 2 to 9 inclusive, 12 to 17 inclusive, 40 to 45 inclusive, on Plan 40M-2220;
and,
b) Lots 1 to 19 inclusive, on Plan 40M-2226.
3. Pursuant to Subsection 7.3 of Section 50 of the Planning Act, this By-law shall be in
force for a period of two (2) years ending on February 28, 2007.

1.0 BACKGROUND
1.1 On February 23, 2004, Council authorized staff to study the land use policies and
related issues for the lands identified as the South Courtice Business Park (PSD-
023-04). The report recommended that the consultant not be hired until funding
had been secured. In report PSD-089-04, .presented to Council on June 28,
2004, it was recommended that the consultant team lead by Urban Strategies be
retained to undertake the South Courtice Business Park Study.
1.2 Due to expressed interest in development of the lands, and to provide the
Municipality with a "breathing space" to examine land uses, Council, on March 1,
2004. passed an Interim Control By-law (2004-061) for these lands.
2.0 STAFF COMMENTS AND RECOMMENDATIONS
2.1 Since Council first authorized the Study of the South Courtice Business Park, it
has taken some time to determine the economic development strategy which
would provide the foundation for the land. use planning component of the Study.
In the Spring of 2004, the municipality was participating on a study of the Greater
Toronto Marketing Alliance ofthe Energy and Environment Industries (EN2)in the
Greater Toronto Area. One of the emerging recommendations was for the
concept of an EN2 Park, a physical location for the cluster of companies and
institutions focused on the Energy and Environment sectors. Strong links to
academic institutions, in particular with University of Ontario Institute of
Technology (UOIT), was indicated. .
2.2 Using this as a basis, staff worked jointly with the Region and the UOIT to
develop a proposal for funding to the Federal Government to assist with the
broad range of effort required for this Study, including both land use, urban I
design, infrastructure and marketing. The Study is a joint effort of the
Municipality, the Clarington Board of Trade, the Region of Durham and the UOIT.
The Federal Govemment is contributing 50% of the costs of the Study. Federal
funding was secured in

There has been excellent progress made to date on the Study with three (3)
steering committee meetings, stakeholder interviews and a visioning session with
potential stakeholders being conducted to date. The options analysis component
of the study will be concluded shortly, the outcome of which will be the
identification of a development master plan and a servicing/infrastructure plan. A
public information session will be held in March 2005. The final report will
include a marketing plan, a financial plan for the cost sharing of services and
amendments to the Official Plan, including a secondary plan, amendments to the
zoning by-law and design guidelines. After the completion of the consultants
report, staff will evaluate the recommendations and prepare the proposed
amendments to the Clarington Official Plan and Zoning By-law. It is anticipated
that proposed changes to the planning instruments will be presented for
Council's consideration fall 2005.
2.4 The Interim Control By-law (2004-061) for these lands expires on March 1, 2005.
It is recommended that Council extend the Interim Control By-law for another
year. This will enable the study to be completed and the related amendments to
the Official Plan, including a secondary plan, and the amendments to the zoning
by-law be passed. Once the appropriate amendments to the Official Plan and
Zoning By-law have been approved and are in force Council may consider
repealing the Interim Control By-law.

WHEREAS Staff prepared Report PSD-023-04 identifying the need to undertake a review
or study of the land use planning policies respecting the south Courtice Employment Area
bounded by Highway 401, Solina Road, CN Railway and Courtice Road;
WHEREAS at its meeting on March 1, 2004, Council directed Staff to undertake the review
or study of land use -planning policies for the South Courtice Employment Lands and
adopted Interim Control By~aw 2004-061;
WHEREAS Staff prepared Report PSD-027-05 providing an update on the status of the
South Courtice Business Park Study and advised that a one-year extension to the Interim
Control By-law for the subject lands is appropriate;
WHEREAS By~aw 2004-061 expires on March 1, 2005 and Council deems tt expedient to
pass a By~aw under Section 38 of the Planning Act, R.S.O. 1990, c.P.13, as amended;
NOW THEREFORE, the Council of the Corporation of the Municipaltty of Clarington
hereby enacts as follows:
1. Section 3 of By~aw 2004-061 is amended by deleting the word "one (1)" and
replacing it with the word "tWo (2)".

1.4 Site Area: .1.02 hectares (2.52 acres)
2.0 LOCATION
2.1 The property under consideration is comprised of 1461 - 1469 Durham Highway
2, located on the south side of Durham Highway 2 and east of Darlington
Boulevard in Courtice (see Attachment 1): The site area totals. 1.02 hectares
(2.52 acres). The property is located within Part Lot 34, Concession 2, in the
former Township of Darlington.
3.0 BACKGROUND
3.1 On July 22, 2004, Staff received arezonil'}g application from Truestone Project
Managers Limited on behalf of 1287561 Ontario Limited to permit 2,336 sq.m. of
retail commercial and office uses on the subject lands. The applicant intends to
develop a mixed use project consisting of retail commercial uses and office
space.
3.2 A revised application was submitted on January 24, 2005 to include the
additional lands owned by the applicant abutting the north half of the east
property line not included in the original application (see Attachment 2). Although
these lands are currently residentially zoned, Staff agree that they should be
developed concurrently with the balance of the property. The amount of
developable f100rspace has increased from 2,336 sq.m. to 2,650 sq.m. of retail
commercial and office uses. Staff believe the change in lot area and f100rspace
are minor and do not require a further Public Meeting.
3.3 A statutory Public Meeting was held on September 20, 2004 for the application.
No one spoke in objection to or in support of the application.
3.4 Prior to the Public Meeting, a concern was raised by the adjacent property owner
to the east (yoJayne Bolahood) that storm water from the proposed development
would negatively impact his property. In particular, this owner would like a joint
servicing solution for storm water generated by redevelopment along the south

side of Durham Highway 2 east of Darlington Boulevard. This issue is further
discussed in Section 8.2 of this report.
3.5 An area resident has submitted a letter of objection to the proposal, indicating
that sufficient commercial development is present in Courtice. The following
issues are raised:
. Recent development has increased the amount of traffic and noise in the
area. Additional development will aggravate the situation.
. The existing traffic generates a lot of pollution, especially from idling vehicles.
. The resident experienced vandalism to her own property. Additional
development will lead to more security problems.
These issues are further discussed in Section 8.4 of this report.
4.0 SITE CHARACTERISTICS AND SURROUNDING USES
4.1 The property is currently undeveloped and does not contain any significant
vegetation. Drainage is generally away from Durham Highway 2 towards
Farewell Creek.

5.0 OFFICIAL PLAN POLICIES
5.1 The Clarington Official Plan designates the subject property as "Mixed Use Area"
within the Courtice Sub-Central Area Secondary Plan. This land use designation
permits mixed use buildings with retail and personal service uses on the ground
floor, professional and business offices, medium and high density residential
development, and community facilities. The development proposal conforms to
the policies of the Clarington Official Plan.
6.0 ZONING BY-LAW CONFORMITY
6.1 The property is currently zoned "Special Purpose Commercial (C5) Zone" and
"Holding - Urban Residential Type One ((H)R1) Zone", which does not permit the
proposed retail and office uses. In order to consider the proposed development,
a rezoning application was submitted for consideration.

7.0 AGENCY COMMENTS
7.1 The Clarington Emergency Services Department has no objections to the
proposed development.
7.2 The Clarington Engineering Services Department has no objections to the
rezoning application provided that the following requirements are fulfilled through
site plan approval.
. The applicant must provide a suitable rear driveway that will accommodate
access to adjacent properties, forming a rear lane from the subject lands to
Darlington Boulevard.
. The applicant must submit a site grading and drainage plan for review and
approval.
. Financial securities must be provided for sidewalk restoration.
. An appropriate cash contribution in lieu of parkland must be provided.
7.3 The Durham Region Planning Department has indicated that the proposal
conforms to the Durham Region Official Plan. It is suggested that the
development proposal address environmental site contamination to ensure that
the site is suitable for intended use.
7.4 The Durham Region Public Works Department has no objections to the proposal
provided that the following requirements are fulfilled through site plan approval.
. Suitable water and sanitary services are available from Highway 2. Unused
service connections are to be disconnected and abandoned.
. Since Highway 2 is a Type "B" arterial road, sufficient road widenings to allow
15 metres from centreline of the original right-of-way must be dedicated to the
Regional Municipality of Durham.
. The indicated access points appear to be acceptable, subject to the
implementation of recommendations from the Courtice Highway 2 Corridor
Study. These include construction of a raised median on Highway 2, limiting
the westerly access to a right-in/right-out. .
. Stormwater management and site grading and drainage information must be
provided for review and approval to ensure that post development flows do
not exceed pre-development flows. .
7.5 The Central lake Ontario Conservation Authority has no objections to the
rezoning application. Prior to issuance of site plan approval, the following
information is required for review and approval:
. stormwater management report, detailing quantity and quality controls;
. sediment and erosion control plan; and,
. site grading and drainage plan.
7.6 Since comments have not been received from Hydro One Networks Inc. or the
school boards to date, it is presumed that these agencies have no objections to
the proposal.

8.0 COMMENTS
8.1 Staff have met with the applicant on several occasions to discuss development
issues relating to. the project.
Urban Desion
The urban design policies contained in the Courtice Sub-Central Area Secondary
Plan require that development in the Mixed Use Area designation be street-front
oriented. This allows development to frame the street and significant corners to
create an attractive streetscape. Large parking areas are to be located behind or
beside buildings rather than being prominently located in front. Street-related
buildings frame the street, creating a human scaled environment that fosters
pedestrian activity. Street-related entrances also promote pedestrian activity. All
developments to date within the Mixed Use Area designation provide an example
of this type of development, including the Courtice Medical Clinic, Whitecliffe
Terrace, and Waltzing Weasel restaurant and pub.
Staff have indicated to the applicant both during pre-consultation and upon
submission that the development must contain street-related buildings. Although
the applicant has indicated that the tenants prefer to locate in a typical suburban
form of development, both Shoppers Drug Mart and LCBO have developed
stand-alone sites in other municipalities that are street-related, either to a public
street or to a major laneway in a power centre. As such, the proposed zoning by-
law contains provision that requires two street-related buildings with a minimum
of 25% of the street frontage to be occupied by street-related buildings.
Staff prepared a demonstration plan showing how a. more street-oriented
development could occur on the property (eg. At least 35% of the frontage would
have street-oriented buildings - see Attachment 2). Attachments 3 and 4 are
examples of street-oriented developments, although the Shoppers Drug Store in
Attachment 4 does not have access to the store from the street.
Rear Lane
The Courtice Sub-Central Area Secondary Plan designates a system of rear
lanes serving the commercial areas to the west. The system is designed to
provide an alternative means of connectivity between commercial properties both
fordelivery vehicles and the general public. Although the Secondary Plan does
not designate a rear lane system in this area, the applicant will be required to
provide a 7.0 metre wide rear lane connection with adjacent properties to the
east and west (see Attachment 2). This rear lane will ultimately extend west to
Darlington Boulevard. Long-term cross-traffic easements would be granted
between abutting landowners through the Durham Region Land Division
Committee applications. Alternatively, if the arrangements cannot be made for
reciprocal easements, the Municipality may take a public easement for the rear
lane for joint access purposes.

Shared Accesses with Adiacent Prooerties
The Durham Region and Clarington Official Plans contain policies that limit the
number of access points onto arterial roads. Policies contained in the Courtice
Sub-Central Area Secondary Plan also promote property consolid9tion and
development of joint accesses.
Highway 2 is a Type "B" arterial road under the jurisdiction of Durham Region.
Site plan approval is used to determine the precise location of access points for
development. The development proposal currently indicates access points at
either end of the Highway 2 lot frontage. The applicant is required to develop
shared accesses with the adjacent landowner to the west through site. plan
approval. If this cannot be achieved at this time, the site plan agreement will
contain clauses that require future joint access construction where development
. orredevelopment occurs on adjacent properties.
8.2 The applicant will be required to submit an application for site plan approval. The
following issues must be resolved through the site plan approval process.
· The site plan must be revised to include sufficient street-oriented
development in accordance with the Official Plan policies and the proposed
Zoning By-law contained in Attachment 3.
. The development must incorporate a high level of urban design. Phase 1
development must include the street-front oriented buildings as well as the
office building.
. All necessary site servicing and drainage plans must be submitted for review
by the appropriate agencies. All access and road widening issues must be
finalized with Durham Region Public Works Department.
· A landscaping plan will be necessary. These works should be
complementary with work completed by the Courtice Medical Clinic and
Whitecliffe Terrace on the north side of Highway 2 and consistent with the
Municipality's Landscape Design Guidelines.
. The applicant must submit a concept plan for the area, which demonstrates
possible development on other vacant or underutilized properties south of,
Durham Highway 2 and east of Darlington Boulevard (see Attachment 2).'
The plan would also indicate possible locations of shared access points along
Durham Highway 2 as well as the location of a rear laneway serving these
properties, similar to a system, which is designated west of Darlington
Boulevard. This process could encourage further property consolidation,
would integrate the proposed Esso redevelopment and would ensure that
development potential on surrounding sites is not compromised.
. A storm water management plan will be required to ensure that storm water
generated from the development can be appropriately handled on site.
. A noise. study is necessary to ensure that operational noise levels from the
development will not negatively impact future adjacent residential uses.
. Illumination plan will be necessary to ensure that lighting levels:
o Comply with IESNA guidelines for commercial lighting

o do not negatively impact surrounding existing and future residential
areas
o do not impact road operations on Highway 2.
This plan will be jointly approved with the Durham Region Public Works
Department.
· The applicant will be required to address anyon-site contamination issues
through site plan approval. This condition must be fulfilled prior to removal of
the Holding symbol from the proposed Zoning By-law.
8.3 The adjacent landowner, Mr. Bolahood, has requested that both the Municipality
and Central Lake Ontario Conservation ensure that storm water is handled in an
appropriate manner, preferably through a joint servicing solution through his
property. All of the storm water from Durham Highway 2 flows through Mr.
Bolahood's property into the Farewell Creek, which, according to Mr. Bolahood,
has led to erosion on the property (see Attachment 2). Approximately 15 years
ago, CLOCA determined that area landowners should develop a comprehensive
solution for storm water management for undeveloped commercial lands along
Highway 2 to address this issue. This included all lands where storm water
drained towards Farewell Creek. A consultant prepared a drainage scheme on
behalf of the landowners that would require all benefiting landowners to
contribute towards a system that drained through Mr. Bolahood's property.
Although there was agreement among landowners for the solution, funding for
the project was never secured. Individual development has proceeded on the
basis of large on-site underground chambers that control the rate of storm water
flow through Mr. Bolahood's lands to pre-development levels. Although Mr.
Bolilhood did appeal a development to Ontario Municipal Board on this basis, he
was unsuccessful at the OMB.
8.4 This section addresses the concems raised by an area resident discussed in
Section 3.5 of this report.
· Although recent development has increased traffic levels during the past ten
years, Durham Highway 2 is designed to accommodate these traffic volumes
and more. Having designated lands for commercial and residential
development in the area, traffic levels and the noise associated with these
levels will continue to increase as Courtice grows. Noise fencing, in
accordance with the Ministry of Environment noise criteria of the time, was
erected along the rear of Highway 2 development to protect residents from
excessive noise levels generated by the traffic.
· Although there is. pollution from idling vehicles, the lands are within a
designated Sub-Central Area and are expected to develop more intensely
which will increase traffic levels.
. While the vandalism experienced by the resident is unfortunate, additional
residential or commercial development will not necessarily create further
security problems. Although Staff promote site planning solutions to minimize
dark areas, vandalism and crime cannot be prevented by restricting
development rights on property/hat is designated for development.

9.0 CONCLUSIONS
9.1 The application has been reviewed in consideration of comments received from
the circulated agencies, the policies of the Clarington Official Plan, and the
Zoning By-law regulations. In consideration of the comments contained in this
report, Staff respectfully recommends that the proposed Zoning By-law
amendment contained in Attachment 3 be passed by Council.
9.2 The proposEid Zoning By-law has a Holding (H) provision. A report
recommending removal of the Holding provision will be forwarded to Council
once the applicant has entered into a site plan agreement with the Municipality,
has fulfilled all necessary servicing requirements, has obtained the relevant
access easements, and satisfied all urban design and landscaping requirements.

being a By-Law to amend By-Law 84-63, the Comprehensive Zoning By-law
for the Corporation of the Municipality of Clarington
WHEREAS. the Council of the Corporation of the Municipality of C1arington deems n
advisable to amend By-Law 84-63, as amended. of the Corporation of the former Town or
Newcastle in accordance with application ZBA 2004-034 to permit the development of
2,650 sq.m. of retail commercial and office uses;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Section 16.5 "SPECIAL EXCEPTIONS - GENERAL COMMERCIAL (C1) ZONE"
is hereby amended by adding thereto the following new Special. Exception 16.5.39
as follows:
"16.5.39 GENERAL COMMERCIAL EXCEPTION (C1-39) ZONE
Notwithstanding Sections 3.16 (a) i) and 16.3 (a) i) and (b). those lands zoned C1-39 on
the Schedules
to this By-law shall also be subject to the following zone regulations:
a) Definitions
i) Business Establishment
Shall mean a building that contains one or more permitted uses within the
"C1-39" zone.
i1) Business Establishment Facade
Shall mean the portion of the exterior wall located between finished grade and
the level that is 3 metres above finished grade of a business establishment,
which wall faces an existing improved public street.
iii) Landscaping Strip
Shall mean an area of land used for anyone or more of the planting of
trees. shrubs, flowers. grass, or other horticultural elements, such as
decorative stonework, fencing. or screening.
iv) Street-Related Building
Shall mean a building where the business establishment fa98de is
constructed within 3.0 metres of an existing improved public street.
v) Street-Related Entrance
Shall mean one of the principal entrances to a business establishment, which
shall have a minimum height of 2.1 metres and a minimum width of 0.9
metres and shall be located in the part of the business establishment fa9"de,
which is at or within 0.2 metres above or below finished grade, provided that
the street-related entrance shall be recessed from the business establishment
fa9"de a maximum of 2.0 metres.

1.0 BACKGROUND
1.1 The Engineering Services Department's Road Program has planned for the
reconstruction of the following streets in 2005 and as such has included them in
this year's Capital budget:
. Scugog Street from Middle Road to future Bons Avenue,
Bowmanville
. Hunt Street from Baseline Road to Albert Street, Bowmanville
. Station Street from Main Street (Regional Road 17) to Cobbledick
Street, Orono
All of these projects are time sensitive in that they are large projects that require
either land acquisition to accommodate the future reconstructed road, utility
relocation due to conflicts with the proposed design, or both prior to commencing
with construction.
Based on the times historically taken to complete both land purchase
negotiations and utility relocation it would severely reduce the time available for
construction if these items were not initiated prior to early April when it is
anticipated the budget approval process will be completed. If these items were
left until the budget is approved, completion of these works may not be done until
late Mayor early June cutting nearly 2 months from the time available for the
actual reconstruction works.
Based on the proposed design for the reconstruction of the subject roads it is
estimated that each project will require the following time to complete:
. Scugog Street, Bowmanville - 4 months
. Hunt Street, Bowmanville - 6 months
. Station Street, Orono - 3 months

Should tendering of the projects not be allowed to commence until the budget is
approved, award of the contract would not be made until mid to late May, 2005,
which would lead to completion dates well into late November for the Scugog
Street and Hunt Street projects. If any bad weather is experienced during the
time of construction the completion date could be pushed into December risking
the chance of having less than favourable conditions to complete construction.
The reason that the Station Street project is included in the request for pre-
budget approval is in order to ensure that all works are completed and
established prior to the start of the Durham Central Fair which is scheduled from
September 18 - 11 this year. If not tendered before the anticipated budget
approval date, there is the risk that the works on Station Street and adjoining side
streets will not be completed before September.
In addition to the reasons noted above there are also a couple of other factors
that should be considered when evaluating the merits of providing pre-budget
approval for these projects. Historically projects tendered earlier in the year have
come in with 5% - 15% lower pricing than those tendered just two months later in
the year as most contractors have already secured sufficient work for the
summer and price the later tendered jobs accordingly.
Another factor that will influence the price of construction this year is the
additional work generated by the 2005 Canada Ontario Municipal Rural
Infrastructure Funding program which saw applications submitted by most of
Ontario's municipalities on January 10, 2005 and it is anticipated that approval of
some of these projects will begin in April 2005 and therefore will be competing
with the Clarington's subject projects most likely resulting in inflated pricing due
to the increase in available work.
In consideration of these factors it is requested that the Council provide pre-
budget approval for all three projects.

BACKGROUND:
Pitch In Canada is a national non-profit organization founded in 1967 by several
volunteers about the proliferation of packaging and its effects on the land and
marine environment. They recognized that personal action with assistance from
but not dependant on governments and other stakeholders is needed to
conserve, enhance and protect the environment and to reduce and reuse waste.
Pitch In Canada involves millions of volunteers in various programs from cleaning
up and beautifying streams, wildemess, and urban areas to initiating recycling
and composting programs.
The Municipality of Clarington participated in the 2004 campaign with

2005 INITIATIVES
The 2005 Pitch In Day will take place Saturday, April 23rd across the Municipality
of Clarington.
Staff will be contacting all schools, clubs, organizations and the general public to
participate in cleanup of our roadways, parks and open areas. We will be
concentrating on some specific areas of the Municipality and hopefully through
this campaign we may change the attitude of littering.
Some initiatives that we are investigating for this year include:
. Household hazardous waste drop off
. Habitat Canada Building Materials
. Use of the "Litterbug" in our campaign
. Internet reporting litter violations program
. Increased littering fees and penalties
. Removal of signs off poles/posts

REGION OF DURHAM LITTER INITIATIVE
ADOPT A ROAD PROGRAM
A group or community organization can help keep the streets of Clarington
cleaner by participating in the Municipality's "Adopt-A-Road" program. Under this
program, the groups agree to help remove litter from a section of road. The
Municipality supplies safety vests, traffic control signs and trash bags. The
Municipality also removes large items that are too bulky to bag.
To date the following road sections have been adopted:
1. The Lions Club of Courtice adopted a two kilometer section of Trulls Road,
from Highway #2 south to Bloor Street.
2. The Liberty Dental Office adopted Highway #2 east of Highway #57.
ILLEGAL DUMPING
Staff continues to struggle with the amount of materials that are dumped along
roadsides and unopened road allowances. Most of the materials can be
disposed of through our curbside program, and/or deposited at a Transfer Station
for a minimal cost. It is normal for the Department to receive reports of five to
seven dumpings per month with an average monthly cost for labour and
equipment between $3,500.00 - $5,000.00. Staff will continue to monitor and
work with respective agencies in attempts of controlling this activity.

CONCLUSION
The "Pitch In Week" is an excellent community based program that encourages
Community involvement, promotes volunteerism and instills Clarington pride.
This program will continue to grow and will increase the public's awareness of
our campaign against litter.

BACKGROUND:
The Ontario Drinking Water Standards were established to assist with meeting
the legislated requirement goveming water works under the Ontario Water
Resources Act and are meant to be utilized in conjunction with the Drinking
Water Protection Regulation for larger water works - Ontario Regulation 459/00.
The Ministry of the Environment governs Ontario Regulations 459/00 and is
responsible for ensuring that the water works and that owner's take corrective
action in the event of adverse water quality.
The local Medical Officer of Health and the Ministry of the Environment share
responsibility for protecting the public. The Medical Officer is responsible for
declaring that drinking water is unsafe and advising the public of any precautions
that should be taken such as boiling water.
The primary purpose of the Ontario Drinking Water Standards is to protect public
health through the provision of safe drinking water. Water intended for human
consumption shall not contain disease causing organisms or unsafe
concentrations of toxic chemicals or radioactive substances. Water should also
be aesthetically acceptable.
MUNICIPAL PROCEDURES:
Staff testing the water is the only sure way to determine safety. Staff will take
water samples at each of our municipal buildings on a weekly basis. These
buildings include community buildings in Brownsdale, Kendal, Haydon,
Hampton, Tyrone, Solina and Kirby. There are also three workplaces that are
tested weekly as well.
The water tests will indicate total coliform (bacteria in animal waste and. sewage)
and e.coli, which are bacteria found in the digestive systems of people and
animals. If e.coli readings are 1-760, then the water is unsafe for drinking. If the
total coliform indicates a reading of 6 to 780, then the water is unsafe for
drinking. If total coliform has a reading of 1 to 5, then a second and third sample
is to be taken. A third water quality sample testing is heterotrophic plate count.

Heterotrophs are defined as micro organisms that require organic carbon for
growth. They include bacteria, yeasts and moulds. Elevated HPC levels occur
especially in stagnant parts of piped distribution systems and in domestic
plumbing. Any readings over 500 ml. is considered unacceptable and a boil
advisory is likely to be issued.
Municipal wells can be contaminated by an opening in the well seal, improperly
installed well casing, well casing not deep enough, well casing not sealed and a
source of contamination not related to well construction. Staff will inspect
regularly and take appropriate action to ensure that:
· Sanitary seal on well cap is securily in place and water tight
. Cap is at least 12 inches above the ground
· Joints, cracks and connection in the well casing are sealed
· Surface draining near the well is directed away from the well casing
. Surface water does not pond near the well
. Well pump and distribution systems are checked regularly
· Changes in the quantity and quality of water should be investigated
immediately.
IF A WATER SUPPLY IS CONTAMINATED:
If a water sample from any of the wells is contaminated, the provincially approved
Environmental Lab will deliver the results and contact the Regional Public Health
Department. The Lab will then send the report to the Operations Department
who will notify both the Regional Health Department and Spills Action Centre,
Ministry of the Environment. Staff in consultation with the Health Department will
undertake postings, chlorination, and or any other actions determined at the site.
The Health Department will want to have three separate samples within 72 hours
and readings must be zero prior to lifting of any restrictions.

WELL UPDATE:
Since November 2004, staff has been actively managing the various well
systems at five community buildings where adverse conditions exist. Three of
these buildings have been cleared. Two buildings remain under Advisory to deal
with unacceptable HPC readings. We are currently investigating treatment
requirements needed to ensure that the requirements of the Ministry of the
Environment are met.
As part of this review, we will examine chlorination versus ultra violet disinfection
as well as the Ministry of the Environment criteria for ground water I surface
water.
All affected community buildings are updated weekly by staff, and are to be
thanked for their co-operation during this period.
CONCLUSION:
The Municipality will continue to have the well water system sampled and tested
by an accredited lab on a weekly basis and if adverse conditions exist, report
immediately to the Medical Officer of Health and the Ministry of Environment.
Staff will take the necessary corrective actions in consulting with both the Ministry
of Health and the Ministry of Environment within 24 hourS and keeping our
community partners informed.

Corporate private property owners have traditiorially had the option of approaching Council for
permission to hire security officers to enforce the Clarington Traffic By-law 91-58 on their own
property.
Securitas Canada Ltd., Newton Trelawney and Valiant Property Management have
approached the Municipality and requested that officers from Securitas Canada be authorized
to issue parking tickets on their property at NCC-1 Condominium, The Bridal Path and
Parklane Circle, Bowmanville as well as the Clarington Mall. The officers Securitas is
proposing are James Barr, Christopher Templeton and Munyaradizi Chitngu.
In order for these officers to be able to perform these duties they must be appointed pursuant
to the Police SeNices Act as Parking Enforcement Officers. Securitas is aware that once
appointed these officers must attend at the Municipal Administrative Centre for training prior to
commencing any enforcement duties.

BY-LAW NO. 2005-
Being a By-law to appoint individuals as
Parking Enforcement Officers for Private Property
WHEREAS Section 15(1) of the Police Services Act R.S.O. 1990 Chapter P15,
authorizes a Council of any Municipality to appoint one or more persons who
shall be peace officers for the purpose of enforcing the by-laws of the
Municipality; and
WHEREAS it is desirable to appoint Christopher Templeton, as a Parking
Enforcement Officer for the sole purpose of enforcing the Traffic By-law of the
Municipality of Clarington on the property located at 2377 Highway #2, and NCC
#1 localed on Bridal Path and Park Lane Circle, Bowmanville, in the Municipality
of Clarington;
NOW THEREFORE the Council of the Corporation of the Municipality of
Clarington hereby enacts as follows:
1. Christopher Templeton is hereby appointed as a Parking Enforcement

BACKGROUND
In order to raise awareness of accessibility issues in the Clarington business community and to
illustrate simple steps that can be taken to reduce accessibility challenges in stores and
facilities across the municipality, the Accessibility Committee is undertaking the "Clarington
Accessibility Business Community Challenge". The "Challenge" will determine which
Clarington business community can tackle the highest proportion of accessibility projects within
a three-month period. Starting in March, Clarington business organizations will announce to
their members that the Clarington Accessibility Committee is seeking their cooperation and
participation to implement simple and inexpensive steps to make their establishments more
accessible. A checklist of accessibility suggestions will be available on the municipality's web
site.
All businesses participating in the challenge will be honoured with a Certificate of Accessibility
that can be displayed in their establishment. The business community with the highest
percentage of accessibility projects will be honoured and a sign will be erected in the winning
community to acknowledge them as the Most Accessible Community in Clarington for 2005.
The winners of the Challenge will be announced at the Rick Hansen Wheels in Motion event
planned for June 12, 2005.
In order to kick off the Challenge, Councillors and members of the public are invited to "The
Amazing Challenge" on March 4, 2005 starting at 2:00 p.m. Using assistive devices such as
wheelchairs, walkers or glasses to simulate vision impairment, participants will complete
simple tasks in the downtown Bowmanville area, ie, access an ATM, purchase a chocolate
bar, etc. Following The Amazing Challenge, a short reception will be held in the Council
Chambers during which participants can share their experiences.
It is the hope of the Committee that many local businesses will take part in the Challenge to
improve accessibility issues within the community.

BACKGROUND
Pursuant to Sections 354, 356, 357 and 358 of the Municipal Act, 2001, C25, a list of
applications for cancellation, reduction, apportionments or refund of taxes is presented
to Committee for its review and approval.
Section 357(3 & 4) indicates that the Council shall hear and dispose of every application
not later than the 30th day of April in the year following the year in respect of which the
application is made. The last day for making application for the previous year's tax
reduction is the 28th day of February in the following year.
More specifically, under Section 354, the Treasurer shall recommend to Council that
outstanding taxes be stricken from the roll. To strike taxes from the roll it must be by
reason of a decision under Section 357 or 358, or of a decision of a judge of any court
or that the taxes are uncollectible.
An application for a cancellation, reduction or refund may be made for one of the
following reasons: .
. Ceased to be liable to be taxed at rate it was;
. real property becomes exempt;
. razed by fire, demolition or otherwise;
. damaged by fire, demolition or otherwise (substantially unusable)
. removal of a mobile unit;
. sickness or extreme poverty;
. gross or manifest clerical error; and
. repairs/renovations preventing normal use of period of 3 months. .
The 357 and the 358 process begins when an application is prepared by either the
Regional Assessment Office orthe Tax Department. The neighbourhoodassessorwill
perform anon-site inspection of the property. The assessor will verify the reason for the
application, the period of time, for which the tax relief is claimed, and the amount and
type of assessment that is affected. The application is then sent back to the Tax
Department where the actual tax adjustment is calculated and the taxpayer's account
adjusted.
Section 356, deals with severances or divisions into parcels. These parcels of land
were taxed in blocks in the year(s) prior to severance/consolidation. Taxes are being
apportioned to the individual properties which are now severed/consolidated.
Therefore, tax amounts are removed from one roll number and applied to another roll
number as determined by MPAC.

I am writing this submission on behalf of our related company, 1524103 Ontario Ltd., the
registered owner of approximatel~{ 50 acres, immediately to the north of the Applicant's
lands that are subject to the abovementioned applications. Our respective lands are
separated by an unopened road Clllowance (Baseline Road East).
Our company purchased the lands in the fall of 2004 and on November 18th, 2004, the
Holbum Group of Companies announced the launch of a scientific research and
development park to be located on the lands located at the south-west corner of Bennett
Road and King Street East.
We have already invested a considerable amount of money and resources into this
project, and construction of the first phase is well underway.
Therefore, naturally, we question whether or not the subject application: (a) fits within a
prestige industrial employment area, and (b) is compatible with our scientific research
and development park initiative.

Dear Council,
I We are writing about our concerns for the proposal of amendment to the Clarington Official Plan
and Zoning by-law. It involves the 21.85 hectare parcel located at the northwest corner of
Highway 401 and Bennett Road in Bowmanville.
This property runs adjacent to our land which we have farmed for over 70 years. The last 40
years it has been in the production of vegetables. The parcel ofland mentioned above, the
21.85 hectares, has been used for agricultural production for the last 20 years.
As our land is at a lower elevation, we are very concerned with the runoff from the large parking
lot. The runoff from the parking lot will not be absorbed into the ground. As a result, the water
will run down onto our property. Will there be an allowance to compensate for this runoff?
There is a spring on the 21.85 hectares that feeds a pond on our property. This pond we use for
irrigation for our vegetables. Is there a possibility that this spring could be saved to have a
continuous flow to our pond?
The land adjacent to this parcel (21.85 hectares) is used to grow vegetables. We feel that a fence
is necessary to separate the two properties (ours and the 21.85 hectares) to make this safe for both
parties involved.
These are the concerns we have with this application for an amendment to the Official Plan and
the Zoning By-law of the property located at the northwest corner of Highway 410 and Bennett
Road in Bowmanville
