Barrie SWEARING IN CEREMONY MINUTES Mayor Hamre advised that due to circumstances beyond his control, Councillor Elliott is unable to attend this evening's meeting and, therefore, the Swearing In Ceremony was completed on Friday, April 22, 1994. Resolution #C-263-94 Moved by Councillor N oval<, seconded by Councillor O'Toole THAT the minutes of a regu1ar meeting of Council held on April 11, 1994 and the minutes of a special meeting of Council held on April 18, 1994, be approved. IICARRIED" Mayor Hamre advised that the Solicitor, Dennis Hefferon and Bill Stockwell, the Chief Administrative Officer, have been meeting with the Solicitors for Mosport Park in an attempt to reach an agreement with respect to their Rezoning Application to allow for rock concerts to be held at Mosport Park. Mr. Stockwell advised that an agreement has just today been reached which should address concerns of the area citizens. He reviewed the high lights of the agreement as follows: . . . Council Minutes - 2- April 25, 1994 1. The Rezoning will be for one year versus the three years originally requested in the application and good faith commitments have been made by both parties to review an extenaion after the one year period. 2. The promoter of the rock concert will enter into an agreement with Mosport Park to honour the municipality's agreement. 3. Security both inside and off the grounds will be provided by the promoter's security forces and off-duty police officers. 4. The concerts will end at 11:00 p.m. and, if an extension is granted, it will only be for one-half hour - the plugs will be pulled at 11:30 p.m. 5. Off-road vehicles will be prohibited from entering the site and locked in a compound. 6. A flre safety plan, satisfying the Fire Chief of the Municipality of C1arington must be submitted. 7. There will be no off-site parking and the area surrounding the facility will be posted by the mw1icipalityat Mosport's costs. Anyone parking on the road will be ticketed and towed. 8. Camping will be allowed in the north-west corner of the grounds, however, that section will be split into an area for parking and an area for camping. The parking will be located at the north end, thereby creating a buffer between the residential area and the camping area. 9. In order to cover any damage to private property, Mosport will deposit a letter of credit with a minimum value of $10,000,000, growing by $1.00 per head in attendance. Mosport will put forward a list of arbitrators from which the mw1icipality will choose one who will deal with claims, damage values and distribution of money from the letter of credit within 30 days from the event. 10. Although a sound barrier is almost impossible to create, Mosport and the promoter are aware of the concerns and will control the noise to the best of their ability. 11. Mosport will review the fencing of their property and address that issue. 12. The number of campers which was originally set at 25,000 has been reduced to 20,000. 13. Mosport will set up a complaint hotline with the telephone number being published in the media and flyers distributed in the neighbourhood so that residents can call into a control centre on the grounds. The staff at the control centre will be able to reach the appropriate people for problems to be dealt with immediately. . . . Council Minutes DELEGATIONS - 3 - April 25, 1994 Mr. Ted Kilpatrick, R.R. #2, Orono, LOB lMO, addressed Council in opposition to the Rezoning Application submitted by Mosport Park to allow for rock concerts to be held on their property. Mr. Kilpatrick indicated that over 300 signatures have been collected in opposition to this application of which 175 are residents within a flve mile radius of the park. In contrast, of the signatures received in favour of the application, only 16 are residents located within the same area The Dll\iority of those signing the petition in favour of the application, do not have to live with the effects of the concerts. In his opinion, the concerts held in the past at Mosport, have been disasters. Mr. Kilpatrick stated that it is hard to patrol outdoor concerts and the 1990's are more violent times than the 1970's were. He indicated that allowing these concerts to proceed is an invitation to disaster. The citizens in the area will be held hostage in their homes during these weekends. Mr. Kilpatrick thanked the mw1icipality for attempting to address the concerns, however, he is still uneasy that the number of events allowed in the year has not been addressed. Mr. Gary Baker, 5216 Darlington/Clarke Townline, RR #5, Bowmanville, L1C 3K6, distributed a diagram to illustrate where his home is located in relation to Mosport Park. He is concerned that the fencing between his property and Mosport is not adequate to keep people off his property during concerts. The road he lives on is not a through road and people travel much too fast on it and quite often rmd themselves stuck. He also indicated his concern with the noise level, garbage, and stragglers hanging around after the security forces have left following a concert. Mr. Clay Taylor, 5505 DarlingtonJManvers Townline, LOA 1KO, addressed Council in opposition to the recommendations contained in Report PD-44-94. He indicated that he resides within 1 1/2 miles of Mosport and presently when functions are happening at Mosport, he has found people lurking around his home. He is concerned if the concerts are allowed to go ahead, policing will not be adequate and he fears for the safety of his family. Currently the noise from Mosport is a serious nuisance to the residents and if concerts are allowed, this nuisance would be increased. Should this application be approved, residents in the area will lose the right to enjoy their homes and properties. Council Minutes DELEGATIONS COMMUNICATIONS - 4- April 25, 1994 Mr. Michael McQuaid, Weir and Foulds, Suite 1600, Exchange Tower, P.O. Box 480, 2 First C",nRc!iRn Place, Toronto, M5X 1J5, addressed Council on behalf of Mr. George Rust-D'Eye with respect to Report PD-44-94. Mr. McQuaid advised Council that the non-conforming use which Mosport presently has under the zoning by-law, does allow concerts and camping but tbe agreement which they have agreed to enter into with the mw1icipality, will give Council more control over the events. He indicated that a Special Events Permit will be required for each and every event. Over the last two years when Mosport and the municipality have been involved in a legal battle, Mosport could not get Durham Region Police Officers to help with security at their events. With the entering into of this proposed agreement, the Durham Regional Police will assist, therefore, security and traffic control will be a much better situation than it has been in the past. He stated that Mosport has agreed to give notice to the municipality and area residents not less than 30 days prior to events taking place of the proposed events. The hotline which was alluded to by the Chief Administrative Officer, will be set up 72 hours prior to an event and no less than 24 hours following commencement of the event, which will allow immediate access to police, fIre and ambulance and public works offICials. The fencing issue raised earlier will certsinly be addressed by Mosport. Mr. McQuaid indicated that the proposed agreement makes for a much better arrsngement for proposed events at Mosport. Krista Dales, 29 Wrenn Boulevard, Bowmanville, L1C 4N1, presented a petition from residents of the Sagewood Subdivision located at Waverley Road and Highway #2, requesting that fencing be established along the railroad tracks lllljacent to Old Highway #2. The stretch of open fleld runs from Rhonda Boulevard to Waverley Road. Mrs. Dales is concerned about the safety of the children in the area as train tracks have always been an interesting place to play, wander or ride bikes upon. The area in which the subject tracks lie has also been used as a shortcut to Highway #2 for children to go to school and to catch the bus. This makes for a potentially dangerous and life- threatening situation and she requested Council's assistance in having the problem addressed.
