THAT Report EGD-32-04 be received; 2. THAT the total costs of $220,000 for the reconstruction of Fourth Avenue be funded from the 2004 Capital account #110-32-330-83236-740 in the amount of $126,210 with the additional funds of $93,790 being funded from the Development Charge - Roads and Related Reserve fund in the amount of $82,798 and the Roads Contribution Reserve Fund in the amount of $10,992; 3. Director of Finance , c ASC*jb June 1, 2004 702 REPORT NO.: EGD-32-04 PAGE 3 1.0 BACKGROUND Identified in our Development Charges Study, the reconstruction of Fourth Avenue from Nash Road to 0.12 km. north, in Courtice was seen as essential because it is necessary to extend services to this subdivision along Fourth Avenue, which will result in the need for full reconstruction to an urban road standard. Typically road reconstruction is dealt with in two stages; the initial stage of construction includes grading and drainage, storm sewers, granular base and sub-base material, as well as hot mix asphalt paving base. The final stage of road reconstruction includes completion of boulevards, sidewalks, and surface asphalt. At each stage of construction budget approval is sought separately and is coordinated in conjunction with the progress of the subdivision. Council, as part of its 2004 Capital Budget, gave approval for road reconstruction of Fourth Avenue to an initial construction stage because the project is integral to the development of the Birchdale Village Plan 18T -95029 (as shown on Attachment #1). The final stage of road reconstruction was to be coordinated and forecast in an upcoming Capital Budget in consideration of the progress of the subdivision and the needs of the residents. Generally, this is the accepted practice when we budget for and reconstruct municipal roads to facilitate a plan of subdivision. In the case of Fourth Avenue, which is in an established residential community, it is desirable to complete both initial and final stage construction works together so as to minimize disruption to the residents in the area. 2.0 RECOMMENDED ROAD CONSTRUCTION SCHEDULE The costs estimate of $126,21 0 (excluding GST) contained in the 2004 Capital Budget provided for the reconstruction of Fourth Avenue to the initial stage of construction only. The final stage of construction was to have been coordinated in conjunction with the progress of the subdivision. To assist the Municipality in achieving a competitive price for completing both the initial and final stage works, (with the exception of surface asphalt) 703 ~ REPORT NO.: EGD-32-04 PAGE 4 Black Creek Developments Ltd. included these works as a provisional item in their 2.75 million dollar subdivision servicing contract with Switz-Con Construction. The developer has provided the Municipality with a cost estimate for the Municipality's portion of the reconstruction works for Fourth Avenue, including initial and final stage works, The costs are a total of $220,000 (excluding GST) which includes $126,210 for initial stage works and approximately $93,790 for final stage works. Staff have reviewed these costs and have concluded that they are competitive. We believe that given the costs it would be advantageous to the Municipality to complete both the initial and final stage works as one project, with the exception of the surface asphalt. From a construction scheduling perspective it would be very beneficial to construct the servicing of the subdivision in conjunction with the reconstruction of Fourth Avenue. This recommendation will result in better service to our residents with less disruption and inconvenience. The construction of Fourth Avenue will be facilitated as part of the works required to service this subdivision and will be subject to the terms and conditions of the subdivision agreement entered into between Slack Creek Developments Ltd. and the Municipality of Clarington dated March 4, 2004. The payment to Black Creek Developments Ltd. for the construction of Fourth Avenue is due upon the issuance of a "Certificate of Completion" for these works by the Director of Engineering Services and is subject to the applicable provisions of the subdivision agreement. In order to accommodate the construction and payment to Black Creek Developments Ltd. for Fourth Avenue, the Purchasing by-law 94-129 must be waived. 3.0 CONCLUSION It is recommended that both the initial and final stages of road construction be completed at this time. The costs of the reconstruction based on tendered costs are 704 I ~ . \ REPORT NO.: EGD-32-G4 PAGE 5 $220,000, which exceeds the budgeted funds of $126,210 by $93,790. The additional costs associated with the final stage works can be funded from the Development Charge - Roads and Related Reserve Fund in the amount of $82,798 and from the Roads Contribution Reserve Fund in the amount of $10,992. In addition we would be required to waive the purchasing by~law to allow us the opportunity to utilize the developer's contract for the works. This report has been reviewed by the Finance Department and they concur with the recommendations contained herein.
