Mr. Whalen is concerned with the provision of the by-law which does not permit garages to extend greater than 3 metres beyond the facade of single detached and semi-detached dwelling units. He is requesting that the transition date be extended from January I, 2000 to January 1, 200 I due to servicing concerns for the Zone 2 water system. Johansen, Project Manager - Environmental Assessment, Ontario Power Generation, 1675 Montgomery Park Road, P.O. Box 160, Pickering, L 1 V 2R5, providing the Municipality of Clarington with the second issue of their newsletter about the Environmental Assessment being conducted on OPG's Pickering A Return to Service project. Ontario Power held their second round of Environmental Assessment open houses including presentations on health and safety and socio-economic effects. In addition, information was available on the draft Scope of Assessment being issued by the Atomic Energy Control Board for public comments. The open house hours were from 3:00 to 9:00 p.m. on November 17, 1999, at the Pickering Recreation Centre and November 22, 1999, at the Ajax Community Centre. Box 1046, Ottawa, KIP 5S9, advising that the Ontario Power Generation has notified them of its intention to apply for regulatory approval for the return to service of the Pickering NGS-A reactors at the Pickering NGS facility. The AECB has determined that an environmental assessment must be completed in accordance with the Canadian Environmental Assessment Act (CEAA) before a regulatory decision on this licensing request can be made. There are several steps to the CEAA process, including an initial one to establish the scope of the project and the factors to be considered in the assessment. The AECB is inviting public comment on the draft scope of assessment document. Written comments are to be submitted prior to December 2, 1999. Box 190, Uxbridge, L9P 1 Tl, advising that the Council of the Township of Uxbridge at a meeting dated November 8, 1999, passed the following resolution: 1- 15 '- "WHEREAS raccoon rabies has spread into Canada from the central and eastern United States; AND WHEREAS the chances of encounters between raccoons and domestic pets is far more common than with a fox or a skunk thereby increasing the chances of human contact with an infected domestic pet; AND WHEREAS the relocation of nuisance raccoons makes it impossible to contain a possible outbreak of rabies; AND WHEREAS the 'dumping' oflarge quantities of nuisance raccoons into the rural areas increases the potential of the spread of diseases where there are too many raccoons for the carrying capacity of the area as the increased likelihood of the raccoons invading rural homes in search of food and shelter; ~ Council Minutes '- COMMUNICATIONS '- 1-2 Disposal of Dead Animals Ll4.LI '- -6- November 22, 1999 AND WHEREAS clause 3(1)(b) ofthe Fish and Wildlife Conservation Act does provide that "if a person believes on reasonable grounds that wildlife is damaging or is about to damage the person's property, the person may, on the person's land (a) harass the wildlife for the purpose of deterring it from damaging the person's property; or (b) capture or kill the wildlife". This clause has been further regulated by way of Ontario Regulation 667/98 which states, 'A person who captures but does not kill live wildlife under clause 31 (1 )(b) of the Act shall, not later than 24 hours after capture, release the wildlife as soon as possible into the area in close proximity to the capture site unless otherwise directed by the Ministry. . . ' . AND WHEREAS the Ministry has defined 'close proximity' to be within a radius of 1 kilometer. AND WHEREAS a person convicted of an offence under this Act is liable to a fine of not more than $25,000, to imprisonment for a term of not more than one year, or to both. NOW THEREFORE BE IT RESOLVED that the Council of the Township ofUxbridge hereby seeks the support and co-operation of the municipalities within the Region of York, the City of Toronto, the Region of Durham, the Region of Peel, as well as the Ministry of Natural Resources, the Ministry of Health, all Wildlife Control businesses, all Humane Societies and all Animal Control businesses to end the practice ofrelocating nuisance raccoons to rural areas within the Township ofUxbridge." (Received for Information) Ken Gorman, Manager, Environmental Health, Region of Durham, Health Department, responding to the municipality's letter of October 16. The disposal of dead animals, including livestock, is the responsibility of the Ontario Ministry of Agriculture, Food and Rural Affairs. Protection of groundwater sources to ensure safe, potable drinking water supplies is a concern of the Durham Region Health Department. The Ministry of Environment also has regulation(s) under the Ontario Water Resources Act that sets out requirements for water wells. The Health Department believes that the "Dead Animal Disposal Act, RSO, 1990, Chapter D.3" outlines the requirements for the proper disposal of dead animals and/or removal by an approved deadstock operator. The protection of groundwater and surface water sources are an integral part of these regulations and guidelines. Council Minutes '-' COMMUNICATIONS '- 1-5 Waste Diversion Organization E07.WA '- - 7- November 22, 1999 In the interest of protecting the health of our community, the Durham Regional Health Department would be pleased to meet with all of the stakeholders to ensure the protection of our groundwater sources for drinking water. "CARRIED" The foregoing Resolution #C-716-99 was then put to a vote and "CARRIED AS AMENDED." Tony Clement, Minister of the Environment, informing municipalities that the Waste Diversion Organization (WDO) has been established to support our Blue box and other waste diversion programs. A one-year voluntary agreement has been reached between the Province, industry, municipalities, the Liquor Control Board of Ontario and the Recycling Council of Ontario. Industry members and the LCBO have committed up to $14.5 million to develop, implement and fund waste diversion programs through the WDO. A key objective of the organization is to deliver, for his consideration, a sustainable funding plan for the Blue Box program and other waste diversion initiatives. Under the agreement, municipalities will receive $4 million to offset the 1999 costs of recycling liquor and wine bottles collected in the Blue Box and another $4 million in 2000. Council Minutes '- COMMUNICATIONS '--' 1-13 Public Alert P03.NU '- - 8 - November 22, 1999 In addition, the WDO has earmarked $2 million for an organic waste diversion program, $1 million to set up municipal special household waste depots, $2 million to find ways to help us improve the effectiveness and efficiency of Blue box and other waste diversion programs, and $1 million in free advertising space in daily newspapers to help us inform the public about waste management activities. "CARRIED AS AMENDED LATER IN THE MEETING" (SEE FOLLOWING AMENDING MOTION) Resolution #C-719-99 Moved by Councillor Trim, seconded by Councillor Mutton THAT the foregoing Resolution #C-718-99 be amended by adding the following thereto: "and that the Council of the Municipality of Clarington request the Region of Durham to clarify how the Recycling Program for the Municipality will be affected, and the implementation date ofthe Waste Diversion Organization." "CARRIED" The foregoing Resolution #C-718-99 was then put to a vote and "CARRIED AS AMENDED." James G. Young, Assistant Deputy Minister, Public Safety Division, Ministry of the Solicitor General and Correctional Services, 25 Grosvenor Street, 18th Floor, Toronto, M7A 1 Y6, providing a brief summary of the results of the meeting on public alerting which was held on November 2, 1999. The meeting was a constructive attempt by all parties to address the issue of public alerting for the Provincial Nuclear Emergency Plan. It was agreed by all that decisions must be made in the near future as to both the public alerting standard that is to be applied and the technologies that will be used to alert people within the contiguous and primary zones. Council Minutes '- COMMUNICATIONS '- 1-16 Blue Circle Cement Minutes C06.BL '- -9 - November 22, 1999 It is clear that the Region of Durham and its municipalities clearly favour an alerting arrangement that will serve all residents equally in the 10 km primary zone. A study ofthe alternatives for public alerting should; examine all available technologies, assess their efficacy under all operating conditions, clearly set out the advantages and disadvantages of each, explore possible applications other than for nuclear emergency situations, assess their ease of operation by the emergency services, and estimate the costs of installation and operation. It was proposed that the terms of reference for the study be drawn up and circulated as quickly as possible and the job tendered shortly thereafter. It is anticipated that this process, including the tendering, can be achieved by the end of calendar year with the study to commence early in the year 2000. It is hoped that the terms of reference will be specific enough that the study can be undertaken in a relatively quick time in the New Year as all parties agree that early resolution is essential. It is also proposed that a simultaneous effort be undertaken to test the most promising of the technologies, from Telcordia Technologies. Contact will be made with both Telcordia and Bell to try to again scope out the size, cost and timing of such a test. There is consideration of the test being undertaken in either Pickering or Clarington and he is prepared to decide on this once more information is available to him. Councillor Schell stated a disclosure of pecuniary interest with respect to Item I - 16; vacated his chair and refrained from discussion and voting on the subject matter. "CARRIED" Resolution #C-722-99 Moved by Councillor Mutton, seconded by Councillor Trim THAT the Correspondence Items D - 1 and D - 4 be approved as per the agenda. "CARRIED" D-I Correspondence from Mr. and Mrs. Mike Peel, 315 King Street East, Newcastle, LIB IH4, expressing their concerns regarding the proposal of a new gas station and the commercial/retail space to be located at the east end of Newcastle on Highway 2. They are the third generation of Peel's to live in the Village of Newcastle. As a homeowner in the village for many years, they have started a family and they have moved into what they thought would be their dream home. They are happy to see growth in the community, but as a homeowner at 315 King Street East, just three houses west of the proposed site, they have some concerns which include zoning changes, waste and traffic. Morgan, Chair, Ontario Family Fishing Weekend Steering Committee, advising Council that the Province of Ontario, in partnership with many non-government organizations like the Ontario Federation of Anglers and Hunters, declares one summer weekend (Friday, July 7 through Sunday, July 9, 2000) a licence-free fishing weekend. This special weekend includes fish festivals, clinics or educational activities which may be held in your area. They are requesting the municipality's help to publicize the 2000 Ontario Family Fishing Weekend in any calendar of summer events we may publish or participate. COMMUNICATIONS D-2 Library Property R02.GE \... '- - 11 - November 22, 1999 Arnold Bark, Chair, Bowmanville Museum Board, expressing their interest in the Clarington Public Library, Bowmanville Branch building. They understand that it may become available in the near future with the development of a new building for the Library. Both the curator, Charles Taws and he have had an in-depth tour of the facility and they feel it would help solve many of the problems the Museum is currently facing. The Museum would use the building in many different ways. Part would be used to store their collections; currently all excess artifacts are stored in the Hampton Community Hall. This is not convenient or an ideal situation. By having the collection property stored in an area that can be climate controlled they can better ensure that the items will be available for conservation, study and display purposes. Also, the Hampton Hall Board is in need of additional space for their activities, and removal of the Museum artifacts would satisfy that requirement. Some space would be used to expand their displays, in particular their collection of Bowmanville built Dominion pianos and organs, as well as their antique doll and toy collection. Both continue to increase in popularity with visitors. Archive collection storage, provision of proper study space, and more adequate office space would be considerably improved. Volunteer groups could also use this space for their activities and meetings. Council Minutes '- COMMUNICATIONS D - 3 Meadows of Tyrone D12.l8T.89092 '- \." - 12- November 22, 1999 Gerry Meharg, Meadows of Tyrone - 594829 Ontario Limited, 28B Albert Street, Oshawa, LlH 8S5, advising the Municipality of Clarington that they have advised five property owners located on the east side of Liberty Street North that one of the draft plan conditions is that a sidewalk be constructed in front of their properties. All five owners tell them they do not wish to have a sidewalk constructed in that location. Some of the owners are neutral regarding the installation of streetlights while two think lights would be beneficial. Mr. Meharg does not see the need or benefit of a sidewalk in that location and because they were not involved in the draft plan negotiations, they are not sure why this was even included as a requirement. They respectfully ask that the municipality remove this requirement from the draft plan conditions, as they will soon be having their engineer doing the necessary work leading up to the registration. If we would prefer that street lights be a requirement, they would point out that the draft plan conditions relating to the site of the northwest quadrant of Tyrone includes that a contribution be made towards the same street lights on Liberty Street presumably on a pro-rata basis. Ifthis should occur, they would respectfully ask that we set up some mechanism whereby they, as developers of the northeast quadrant, are re-imbursed for the share ofthe street lights to be paid by the developers of the northwest quadrant, when the northwest quadrant development becomes registered. Clark & Associates Limited, 4098 Concession Road 5, RR. #1, Orono, LOB IMO, regarding the payment to elected officials. Ifthere were definite laws or rules for this then there would be no problem. Obviously the problem with rules or laws is that they get outdated and then often exacerbate the condition that they were made to correct. One needs a simple law that will be suitable as long as we have elected officials and that will meet the changing times. Although it is not always obvious by the actions of some elected officials, the electorate perceives that the person elected has entered into a contract with the electorate to do a specific job, for a specific duration and at the time of the election the remuneration for the job was well known to the Candidates. It is the changing of the terms of reference after the election that causes the problem. Many people like himself work on contract rates that are either written or agreed to verbally. These rates extend through the life of the job unless there are unusual circumstances such as the job has changes, the contract goes on for a long period of time and has review clauses or some mutually agreed mechanism. It is seldom that a person can just say that I won't do the job for the agreed price. They will lose the job or be held to it by a legal challenge and they will seldom, if ever, get a second chance at another contract job with the same company, government or individual. When elected officials give themselves a pay raise after they have been elected they are, in fact, breaking the perceived contract that they made with the electorate. In private life this would not be tolerated. This is a problem as we need to have elected officials that are intelligent and are in touch with the world and particularly people that have been in a variety of walks of live so that the people are represented. If the pay scale is inadequate then it will be impossible for some potentially splendid officials to run for office. It would be best if one Federal Law could be put in place that would address this problem if the not withstanding clause did not get in the way. However if should go all the way down the list and someone should start it. Premier Harris could add this to His Common Sense Proposals and make it Ontario Law. If this is not possible, Clarington should instigate it or maybe Toronto. Whoever starts something like this will be looked on as a forward thinking problem solver. This would allow elected officials to get on with their job at least until the end of the term without the distraction of pay negotiations. Tiernay, Administrator, County of Peter borough, 470 Water Street, Peterborough, K9H 3M3, advising that the County of Peter borough at its meeting on November 3, 1999, passed the following resolution: "THAT County Council endorse the resolution from the Township of Burleigh-Anstruther-Chandos being: that the County endorse a collective pricing arrangement with Bell Canada to allow for installation of phone lines in Municipal Operations Control Centres located within the County; AND FURTHER THAT the County approach Bell Canada with this request on behalf of the Municipalities'; AND FURTHER THAT the County of Peter borough circulate this resolution to other municipalities in Ontario and the Association of Municipalities of Ontario (AMO) asking for their support for our motion; AND FURTHER THAT discussions be held with Bell Canada that if a special rate is offered for the installation of phone lines in Municipal Operation Control Centres that those savings be retroactive to the municipalities that have already installed them; AND FURTHER THAT a copy ofthis resolution be forwarded to the CRTC advising them of the urgency of this matter." (O.R.F.A.) has been committed to providing its membership with current relevant and practical professional development opportunities; AND WHEREAS the O.R.F.A. "CARRIED" Councillor Mutton advised that the Durham '99 Celebrations are coming to an end, with a Christmas CD featuring 22 groups from across the Region is currently being sold at all municipal outlets. Revenues from the sale of this CD will go towards music festivals across the Region. The tender award for the Orono sanitary sewer will be considered at a meeting on November 23,1999. Councillor Novak advised that Gerard Kennedy was the guest speaker at a Child Poverty meeting held last week. Mayor Hamre advised that Regional staffhas assured her that they are recommending that the Zone 2 water issue be included in the 2000 budget rather then the 200 I budget as originally planned. Mayor Hamre attended the annual Housing Conference this past weekend. She has come back from the conference with various ideas and suggestions on ways the municipality can assist private enterprises in creating affordable housing. Council Minutes '- OTHER BUSINESS Boards and Committee's Update '- '-' - 23 - November 22, 1999 Councillor Mutton advised that the Ganaraska Region Conservation Authority has taken a position to support Clarington's position on the landfill application submitted by Clarington Waste. Councillor Novak stated that the Bowmanville Museum's Free Fall was very well attended this past weekend. Councillor Rowe advised that the Yuletide at the Mill Event was a resounding success once again and she encouraged everyone to attend the Yuletide Tour of homes in the Tyrone area which LACAC is holding this coming weekend. Friends ofthe Second Marsh are holding their Annual General Meeting on December 14, 1999, and the Courtice Business Association is launching their first tree lighting ceremony. Mayor Hamre reported that the Santa Claus Parade held on November 20, 1999, enjoyed the best crowds ever for the event and stressed what an excellent parade it was. Resolution #C-742-99 Moved by Councillor Schell, seconded by Councillor Novak THAT the Council of the Municipality of Clarington forward a letter to the Santa Claus Parade Committee commending them on their efforts over the past year, which culminated in a wonderful parade on November 20, 1999. "CARRIED" Councillor Schell advised of the Tree Lighting Ceremony and Moonlight Shopping which will be held on December 3,1999, in downtown Bowmanville. Starting December 4,1999, Santa Claus will be at the Bank of Montreal property for all children to visit. Councillor Trim advised that the Ganaraska Conservation Authority has received their millennium grant for work to be completed along the Ganaraska River near Port Hope. Councillor Young advised that the Kawartha Conservation Authority budget will be forthcoming in the near future and that the Tyrone Hall Board held a very successful Yuk Yuk's evening this past weekend.
