Vokes Municipal Clerk, P. Barrie Acting Mayor Schell chaired this meeting in the absence of Mayor Hamre. DISCLOSURE OF PECUNIARY INTEREST PRESENTATION '-' There were no disclosures of pecuniary interest stated for this meeting. Craig Binning provided a detailed explanation ofthe Development Charges Background Study which was prepared by Hemson Consulting Limited. Special Council Minutes -2 - June 14, 1999 ~ PUBLIC MEETING A public meeting is being held in accordance with the Development Charges Act to hear comments pertaining to the proposed Development Charges By-law. \.,.. Kelvin Whalen, Chair, Durham Chapter, Urban Development Institute/Ontario, 2025 Sheppard Avenue East, Suite 2208, Willowdale, M2J 1 V6, verbalized the Institute's alarm at the increase in rates being proposed in both the residential and non-residential sectors. With an increase of almost 25% from the current rate, the Municipality of Clarington will have one of highest rates of any municipality in Durham Region, despite having the lowest market rate of all the lakeshore municipalities. He expressed concern over the increase recognized for indoor recreation and requested Council to consider reducing the amount of this component to be more in line with that of other municipalities. Mr. Whalen urged that the eventual by-law s)1ould adopt a policy wherein the charge is payable individually at the time of building permit acquisition, which is the practice followed by the rest of the Region and almost all of the municipalities of the G.T.A. He also requested that the effective date of the by-law be August 31, 1999 rather than the date of passage and suggested that whatever new level of charge is adopted by the municipality, the charge should be phased in to allow the building industry to gradually absorb the new costs into the eventual project. He suggested a preferred model would be to implement 1/3 ofthe increase on September 1, 1999, another 1/3 on March 1, 2000 and the final 113 plus indexing on September 1, 2000. Finally, he noted that the identified land areas for growth have generally been grouped into 0 to 10 year and 10 to 20 year time horizons. While he appreciates the need for some arbitrary denotation for the purposes of the study, he maintains that a number of factors will dictate the timing and location of growth in the municipality and that capital planning should be flexible enough to accommodate theses various scenarios. Wayne Clarke, Second Vice-President, Durham Region Home Builders Association, c/o 177 Nonquon Road, Unit 20, Oshawa, L 1 G 3F2, indicated concurrence with the comments of Kelvin Whalen and he stated that the municipality's increase together with the Regional increase, is in excess of $2,600 per unit. The builders cannot absorb this cost, therefore, it will be passed on to the purchasers. He questioned the need for the large increase in the indoor recreation charge and asked staff and Council to consider phasing in the increase. "'" "'" ~ "'" Special Council Minutes - 3 - June 14, 1999 Jamie McInnes, Durham Region Home Builders Association, 1333 Boundary Road, Oshawa, LlJ 8N8, provided Council with information pertaining to the Development Charges of Pickering, Ajax and Oshawa and stated that Clarington is approximately $2,000 per unit higher than these other municipalities. REPORT Resolution #C-374-99 Moved by Councillor Mutton, seconded by Councillor Novak THAT Report ADMIN-19-99 be received; THAT all comments from the delegations and any subsequent comments with respect to the proposed Development Charges By-law be referred to staff and the consultant for review; THAT staff be directed to finalize the Development Charges By-law and to bring forth a report for Committee and Council's consideration at its meeting ofJuly 19, 1999; and THAT all delegations be acknowledged and thanked, and be advised of Council's decision. "CARRIED" CONFIRMING BY-LAW Resolution #C-375-99 Moved by Councillor Novak, seconded by Councillor Mutton THAT leave be granted to introduce By-law 99-72, being a by-law to confirm the proceedings of the Council of the Municipality of Clarington at this special meeting held on the 14th day of June 1999, and that the said by-law be now read a first and second time.
