The Chairman asked if there were any persons present wishing to speak to these matters. Several people indicated a desire to speak:. Minutes '-' PUBLIC MEETINGS '"'" '-' .3- April 23, 1990 The Deputy Clerk advised that: (a) Public Notices were mailed to all property owners within 120 metres by March 23, 1990; (b) Notices of the public meetings were posted on each of the sites by March 23, 1990; (c) Additional notice for application DEV 87-97, DEV 90-29 and OP 3.11 were placed in the "Orono Weekly Times'; and (c) The notices comply with the regulations under the Planning Act. The Chairman announced that any persons wishing further notice of the passage of the by-laws, if passed, to please leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of Planning and Development to briefly describe the purpose and effect of the by-laws and how the by-laws accomplish the stated purposes. The purpose and effect of the by-laws are as follows: (a) Green-Martin Holdings - to permit the development of a proposed pian of subdivision comprised of 14 single family lots; (b) Kiddicorp Investments Ltd - to permit the development of a proposed pian of subdivision comprised a total of 245 units (73 single family dwellings, 124 semi.detached units & 48 street townhouse units); (c) Careview Manor Special Care Rest Home Inc. - to add, as a for use, a residence that provides supervised living arrangements for up to fIfty (50) persons; (d) Dr. Eleanor Vincent - to permit the development of a medical clinic; (e) Boyes/Wierzbicki - to permit the creation of two (2) residential lots; and (0 Secondary Pian for the Hamlet of Orono - to amend the Town of Newcastle Official Pian to incorporate the Orono Secondary Pian and related amendments to By.law 84-63 in consideration of the Hamlet Pian policies. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-laws and that all questions must be asked through the Chair. Minutes '-" PUBLIC MEETINGS "" '-" - 4- April 23, 1990 (a) Green - Martin Holdings - Report PD-128-90 Noone spoke in opposition to or in support of this application. The applicant's agent was present to answer questions from the Committee. (b) Kiddicorp Investments Ltd. . Report PD-129-90 Noone spoke in opposition to or in support of this application. Devon Biddle. D.G. Biddle and .,4.~es Limited, 96 King Street East, Oshawa, LlH 1B6, appeared on behalf of the applicant to answer questions from the Committee and advised that he is willing to meet the criteria of the Town of Newcastle and the Regional Municipality of Durham. (c) Careview Manor Special Care Rest Home Inc. - Report PD-130-90 Mayor Hubbard made a declaration of interest with respect to Report PD-130-90; vacated her chair and refrained from discussion and voting on the subject matter. Mayor Hubbard's spouse, Dr. E. D. Hubbard, attends to the medical needs of patients who reside in Careview Manor. Councillor P. Deegan made a declaration of interest with respect to Report PD-130-90; vacated his chair and refrained from discussion and voting on subject matter. Councillor Deegan's dental office is in close proximity and attends to the dental needs of some of the residents of Careview Manor. Irwin Hamilton, 99 Church Street, Bowmanville, LIe 1T3, circulated a petition with approximately 83 names requesting the following: 1. That this application be denied; 2. That the rezoning process be expedited and given absolute priority with a fInal decision no later than six weeks from April 23, 1990; 3. That the by-law enforcement offICer stop the existing illegal boarding house use immediately; and 4. That the Town notify the Provincial Government immediately that the existing situation at 106 Church Street, Bowmanville, Ontario is extremely dangerous for the occupants and neighbouring residents and that action should be immediately taken to stop it. A seven year resident of the area, Mr. Hamilton made reference to various intolerable and dangerous incidents generated by residents of Careview Manor which are of great concern to him. He expressed concern that the residents' health is deteriorating because of lack of proper nutrition, sub-standard living conditions and unsupervised prescription drug intake. 204 G.P.A. Minutes \",. PUBLIC MEETINGS "'" '-' - 5 - April 23, 1990 W. Rex Walters, 45 Division Street, BowmanviIle, LlC 2Z5, a 37-year resident of this area, expressed opposition to this rezoning application because he has, over the years, witnessed the unacceptable activities of the residents of Careview Manor, which include drinking, urinating in public places, littering of the Church property, window peeping, screaming and the use of obscene language. He has experienced invasion of privacy and suffered stress and aggravation caused by the residents of this facility. George R. Webster, BowmanviIle Improvement Area Chairman, 27 King Street West, Bowmanville, L1C lR2, articulated opposition to this application because the concentration of a large number of ex-psychiatric patients in the downtown area of Bowmanville is frightening to women, children and shoppers. He questioned the availability of a resident psychiatrist and qualifIed nursing staff to administer prescription drugs. Charlie Trim, 15 Elgin Street, BowmanviDe, LlC 3C9, Board representative of Trinity Church, is opposed to this application because of abusive language generated from residents of Careview Manor during Church weddings and services. He feels that there is a lack of adequate support and supervision and that continued use of this building will cause more serious problems. Several people indicated support of this application. Dr. E. Derry Hubbard, 222 King Street East, BowmanviIle, L1C 1P6, advised that he has been the consulting physician to the residents for 14 years and a Coroner in the Region of Durham for 23 years. He is supportive of the current arlmini.tration of this property. Lydia Carman, 55 WiIIiam Street East, Oshawa, LlG 7C9, has been a Social Worker employed by Oshawa General Hospital for a period of nine months. She has placed many people in Careview Manor and fmds Vera Forrest, part- owner and administrator of this facility, to be a very compassionate person. Patricia MacKay, 29-72 Martin Road, BowmanviIle, LlC 3N3, a volunteer of St. Vincent De Paul Society, has noticed a marked improvement since the acquisition of this facility by Vera Forrest. Her three children, including an 18 month old baby, accompany her during her weekly visits to the home which she feels can now adequately accommodate 50 people. Minutes '-' PUBLIC MEETINGS '-' '-' - 6 - April 23, 1990 Robert Falconer, Whitby Psycbiatric Hospital, P.O. Box 613, Whitby, LlN 5F9, circulated a letter dated April 18, 1990 from Ronald G. Ballantyne, Administrator, Whitby Psychiatric Hospital, who states that the Hospital has referred many individuals who have required accommodation following in- patient treatment to the home located at 106 Church Street in Bowmanville. He advises that since early 1988, Careview Manor, under the ownership of Vera Forrest, has functioned very well. He is satisfied that the quality of the living environment at Careview has been maintained at a high level and that the co-operation and assistance provided by Vera Forrest has been fIrst rate. Mr. Falconer feels that the facility can adequately accommodate 40 residents. DR MulunnrnJld. 154 Ossington Avenue, Toronto, M6S 2Z5, pharmacist for approximately 70 retirement and nursing homes, emphasized that Vera Forrest is liked and trusted by the residents of Careview Manor and by the professional staff from Oshawa General Hospital and Whitby Psychiatric Hospital. Reverend Ken Ford, 7 Sunicrest Court, BowmanviJIe, L1C 3L3, Pastor of Bowmanville Church for 1 year, stated that Vera Forrest is offering good care and an environment of hope to the residents of her facility. Donna Benczenleitner, 17 Doreen Crescent, BowmanviJIe, L1C 3W6, a resident of Bowmanville for 20 years, noted that her father is receiving the best care possible in this clean and tidy facility. She advised that there was no other setting available to her father in his condition and she is pleased that there is a facility available in Bowmanville where she can visit him regularly. Marg Sch",,,,necht, 206 Simpw>n Avenue, Apartment 305, BowmanviJIe, L1C 2.11, stated that her son resides at Careview Manor and seems very happy and is receiving good care and nutrition. Annie Forestall, 31-309 Garden Street, Whitby, LlN 3W3, advised that her son has been ill for many years and requires special medication. He is receiving care and compassion in the Careview Manor setting and his prescription drugs are routinely administered RnnAld Barry, Barry Brian ,,\"""';Ates Limited, Whitby, architect for the applicant, displayed a site pian of the fIrst floor and second floor centre hall of Careview Manor with an area of approximately 10,000 sq. ft. He advised that no changes to the structure or the existing site are being requested. Vera Forrest, 106 Church Street, BowmanviJIe, LIe 1T2, the applicant, stated that, when she purchased this property in March, 1988, she was under the impression that the use was legal. She is attempting to raise the standards of this living accommodation to ensure that the needs of the residents are met. She manages the home with the help of 4 full-time and 3 part-time staff members and with the help of some volunteers. 206 G.PA Minutes '- PUBLIC MEETINGS '- '- - 7- April 23, 1990 (d) Dr. Eleanor Vincent - Report PD-131-90 Don McArthur, 140 Baldwin Street, Newcastle, LOA mo, who has lived directly across the street from the proposal for 20 years, strongly objects to a commercial property being located in the middle of a residential area. His concerns include the Jack of adequate parking space and the fact that the rezoning of this property will set an undesirable precedent for adjacent older homes being rezoned. David Henderson, 152 Baldwin Street, Newcastle, LOA mo, lives across the street from the proposal and voiced displeasure with the intrusion of a medical facility in the residential area. Noone spoke in support of this application. Irwin Hamilton, Hamilton and ~tes, 1 Division Street, Bowmanville, LIC 3K8, was present to answer questions from the Committee. (e) Boyes/Wierzbicki - Report PD-132-90 LJoyd Massey, R.R.#1, Hampton, LOB lJo, resident of the area for 32 years, is opposed to this severance which will create undesirably long and narrow lots. William Kuzenko, R.R.#1, Hampton, LOB lJO, questioned if the right-of-way adjacent to his property would be affected by the proposed severance. Noone spoke in support of this application. Mary Jo Boyes, 4577 Trulls Road, R.R.#1, Hampton, LOB lJO, advised that she now resides on 2 acres adjacent to the proposed severance and has never experienced problems pertaining to her 150' drilled well and water. The frontage of the new lots will be 66.99 metres and 66.76 metres. (0 Secondary Plan for the Hamlet of Orono - Report PD-133-90 Wa,yne King, Chairman, Orono Development Committee, Box 365, Orono, LOB lMO, circulated a letter dated April 23, 1990 expressing opposition to the Orono Hamlet Secondary Plan. He noted two discrepancies: 1. The Proctor and Redfern drawing dated February I, 1989 shows the commercially zoned area of Main Street as commercial CI-2 and on schedule 13 the same area is shown as C6; and 2. The Sears store is shown on some maps as C15 and others as C6. He requested that all rezoning applications be considered under the rules which were in place on the day that the applications were submitted. ;>117 ___ '_ i G.P.A. Lynn Robinson, R.R.#1, Orono, LOB lMO, requested that her application be considered on its own merit because on the date of her purchase, the property was zoned residential and it should not be rezoned agricultural. The re-routing of traffic will be a great improvement to the area and he requested that the Committee give his clients favourable consideration during the land appraisal and conveyance process. Frisina, 8 Shoreview Court, Bowmanville, LIC 3V2, re: Report PD-136-90 expressed disappointment with Veltri & Sons' proposed subdivision because her vision for this area is a gradual process and smoother transition from detached homes on large lots to link homes. She would prefer the erection of single family homes along High Street which would act as a buffer between the single fiuniIy homes and the link homes. (c) George Karakcokldn"", G.M. Sernas and A........;..t_ Ltd, 110 Scotia Court, Unit 41, Whitby, LlN 8Y7 . re: Report PD-136-90 appeared on behalf of the applicant and displayed a site plan of the proposal. He fully concurs with staff recommendations and noted that the construction of the homes will be brick veneer and the square footage will range from approximately 1400 sq. ft. to 2000 sq. ft. Limited, 235 Yorkland Boulevard, Suite 1100, North York, M2J 4Y8 - re: Report PD-149-90 advised that this is a 100-acre site, 25% of which is zoned industrial. She suggested that the industrial parcel could be developed and the remainder of the land be developed later as the employment opportunities are very low in the Courtice area (n) J. Lindenburg, General Delivery, Hampton, LOB lJO, re: Hampton Foot Bridge, resides at the north west corner of King and Mill Streets and appeared before the Committee to express his preference for a foot bridge. He stated that a one-lane bridge could not be used by school buses and Fire Department vehicles. Box 155, Hampton, LOB lJO, re: Hampton Foot Bridge, expressed her preference for a one-lane and pedestrian walkway bridge and feels that this bridge should be kept as part of the heritage of Hampton. She displayed a photograph of the bridge which dates back to 1861. The installation of a footbridge would greatly hamper emergency vehicle access to residents and she suggested that the installation of a stop sign at the corner of Mill Street would reduce traffic hazards to pedestrians.
