MINUTES Resolution #GPA-113-90 Moved by Councillor Hooper, seconded by Councillor Wotten THAT the minutes of a regular meeting of the General Purpose and Administration Commmittee held on February 5, 1990, be approved. "CARRIED!' Resolution #GPA-114-90 Moved Councillor Wotten, seconded by Councillor Hooper THAT Messrs. Bill Reid, Lloyd Stephenson, Ron Strike and Mahindra Tiwari be added to the list of delegations. "CARRIED' -.. 201 G.P.A Minutes '-' PUBLIC HEARINGS '-' ~ - 2 - February 19, 1990 As required under the new Planning Act [Section 34(12)], Council is holding public meetings prior to either adopting or rejecting the following: (a) Proposed Zoning By-law Amendment - Part of Lot 8, Concession 1, former Township of Clarke - Quadrillium Corporation; (b) Proposed Zoning By-law Amendment - Part of Lot 34, Concession 2, former Township of Darlington - Aloise Construction; (c) Proposed Zoning By-law Amendment - Part Lot 28, Concession 2, former Township of Clarke - Bowling Green Developments; and (d) Proposed Zoning By-law Amendment - Part Lot 30, Concession 3, former Township of Darlington - Lester Little. The Chairman asked if there were any persons present wishing to speak to these matters. Several people indicated a desire to speak. Before proceeding with these matters, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that: (a) Public Notices were mailed to all property owners within 120 meters by January 26, 1990; (b) Notices of the public meetings were posted on each of the sites by January 26, 1990; and (c) The notices comply with the regulations under the Planning Act. The Chairman announced that any persons wishing further notice of the passage of the by-laws, if passed, to please leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of Planning and Development to briefly describe the purpose and effect of the by-laws and how the by-laws accomplish the stated purposes. The purpose and effect of the by-laws are as follows: (a) Quadrillium Corporation - to implement the development of a proposed sixty-four (64) unit subdivision and convenience commercial block; (b) Aloise Construction - to permit the development of 1400 sq.m. of commercial retail and office floorspace and 100 residential units; (c) Bowling Green Developments - to permit the development of eighteen (18) single family dwellings; and 202 G.P.A. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-laws and that all questions must be asked through the Chair. The Chairman announced that Committee would hear from the objectors, then anyone in support, with the applicant speaking last. (a) Quadrillium Corporation - Report PD-66-90 Kathrine Lyall, Box 93, NewtonviIIe, LOA lJO, whose property backs onto the proposed subdivision, noted several concerns pertaining to fencing, noise barriers, traffic impact on Jones Avenue and removal of exiating trees. She questioned how the N ewtonville population can support the commerciaI aspect of this proposal when it cannot adequately support the existing convenience store. Doris Tompkins, Jones Avenue, NewtonviIIe, LOA lJO, concurred with Mrs. Lyall's comments. Noone spoke in support of this application. Kevin Tunney, Tunney pI.mn;ng, 340 Byron St. S., Whitby, LlN 4P8, appeared on behalf of the applicant and advised that several modifIcations have been made to the pian since its original presentation on February 15, 1988. He advised that the lots will be developed with municipsl water and the applicant has contributed approximately one half million dollars to date towards the extension of water to this area. Fencing will be addressed as part of the site pian process and street "D" on the pian will give alternate access onto Regional Road # 18. The commerciaI component of the proposal has been reduced to 500 sq. metres of convenience/commercial space. There is no intention on the applicant's part to remove the existing trees. Lot sizes will range from one half acre and larger. The installation of sidewalks will occcur if it is a requirement of the subdivision agreement. (b) Aloise Construction - Report PD-67.90 Noone spoke in opposition to or in support of this application. J. M. Clarke, Clarke, Freeman, Miller, Barristers and Solicitors, 789 Don Mi1Is Road, Suite 310, Don Mills, MaC 1 T5, was present to answer questions from the Committee and advised that the back of the property will be used for an onsite playground. ;en _ ,...)-) G.P.A. Minutes '-' PUBLIC HEARINGS '-" '-' - 4- February 19, 1990 (c) Bowling Green Developments - Report PD-68-90 Sharon White, 34li North Street, NewcastIe, LOA lBO, circulated a petition with approximately 43 names of people opposing this project for the following reasons: - the zoning change and the density of the project - the location of the playground which is too close to the CPR Railway Tracks the incompatibility of the proposed development with the existing residential component. Narda Hoogl<H111p, 276 Mill Street North, NewcastIe, LOA lBO, strongly objects to what she feels represents low cost housing which will devalue existing properties. She concurred with Mrs. White's comments. Bill Burns, 78 Munroe Street, Box 283, NewcastIe, LOA lBO, stated that the roads are too narrow thus preventing access by fIre and ambulance emergency vehicles. He concurred with Mrs. White's comments. Jack Vanderstarre, 380 Mill Street North, Newcastle, LOA lBO, strongly objects to the location of the CPR Railway Tracks which will cause a safety hazard for children. He concurred with Mrs. White's comments. Brian Hales, 96 Munroe Street, P.O. Box 486, Newcastle, LOA lBO, a resident of the area since 1982, voiced displeasure with this application for the following reasons: - the high density of the project - the size of the lots fIre and ambulance protection the incapacity of the school to enroll additional students the dangerous traffic situation at North and Munroe Streets. Bob Bedard, Box 538, 35 Munroe Street, Newcastle, LOA lBO, concurred with Mrs. White's comments. Joaeph Hand, 42 Munroe Street, Newcastle, LOA lBO, articulated opposition to the location of the playground because it is too close to the CPR Railway Tracks and made reference to the dangerous traffic situation at Munroe and Manvers Streets. He concurred with Mrs. White's comments. Noone spoke in support of this application. Vas W. Kuchar, V. W. Kuchar and A.....MHt.es, Architects Limited, 936 The East MaD, Etobicoke, M9B 6J9, appeared on behalf of the applicant and displayed an Artist's Rendering of the proposal. Minutes '- PUBLIC HEARINGS "" DELEGATIONS '-' - 5 - February 19, 1990 11 houses are allowed under the present zoning and therefore the request to erect 18 houses is not unreasonable the railway tracks will be cushioned by a 100 foot wide strip of roads and trees this will be a single home condominium project where the buyer will purchase the home and the Condominium Corporation will own the Iand maintenance will be offered by joint management in the Condominium Corporation each house will have a garage and a driveway and be able to accommodate two cars frontage of the lots will vary from 33' to 45' and the depth 75' to 100' square footage of the dwellings will range from 1,000 sq. ft. to 2,000 sq. ft. - Mr. Kuchar is willing to schedule a meeting with the concerned residents in order to alleviate their concerns (d) Lester Little - Report PD-69-90 Elsie Horban, Box 16, Group 9, R.R.#6, BowmanviUe, L1C 3K7, resides next door to this proposal and requested that a privacy fence be installed to separate the neighbour's and her property. She expressed concern related to the number of people this proposal will generate. Noone spoke in favour of this application Lester Little, Group 9, Box 16, R.R.#6, BowmanviIle, LlC 3K7, owner and applicant, informed the Committee that the proposal will consist of two link lots (four homes) on the south side of his present residence and one link lot (two homes) on the north side of his property. Lorraine Lover, 59 Mill Street N., Newcastle, LOA lHO, - re: Report PD-71-90, circulated a letter dated February 19, 1990 wherein she states that although she is not opposed to the medical clinic, she feels that the clinic will have signifIcant adverse impact for the following reasons: - garbage, increased traffic on Mill Street North, drainage, noise from increased traffic, the location of the parking lot, access to the back of her barn situated on the property line and devaluation of her property. R.B. Rickard, 182 Mill Street South, Newcastle, LOA lHO, - re: Report PD-71-90, advised that he fully supports the medical clinic but objects strongly to the price requested by the Town from Dr. Spruyt for a 10' strip of land which he feels is totally useless. Kevin Tunney, Tunney pIAnn;ng, 340 Byron St. S., Whitby, LlN 4P8, - re: Report PD-73-90, was present on behalf of the estate of Marg Carruthers whose house is located immediately to the south of this proposal. The resident of this house is concerned with the number of units backing onto her property. It is his intention to meet with the developers consultants to attempt to resolve her concerns. Andy Meima, R.R.#1, Hampton, LOB lJO, - re: Report PD-74-90, concurred with staff recommendations and was present to answer questions from the Committee. He advised that he will liaise with the Region of Durham and a new driveway approximately 110' west of the existing driveway will be constructed to provide safe access onto Taunton Road Murray Taylor, Main Street, Orono, LOB !MO, - re: Report PD-76-90, a member of the Business Improvement Area, spoke on behalf of other business people in Orono. He reiterated that the proposed freeze on development will be detrimental to the business industry in Orono. ""' Bill Reid, R.R.#1, Orono, LOB !MO, - re: Report PD-76-90, indicated that a freeze on future development is unfair and undermines the integrity of the planning process. Lloyd Stephenson, Box 93, NewcastIe, LOA mo, resident of Newcastle Village since 1943, stated that the 10' strip of Iand should not have been offered for sale to Dr. Spruyt because it is located on a water plain. He is in favour of the medical clinic and noted that approximately 98% of area residents support this proposal. Ron Strike, Strike, SaImers & Furlong, Barristers, 38 King Street West, Bowma:nviI1e, LlC lR2, - re: Report PD-71-90, appeared on behalf of Dr. Spruyt and advised that she has purchased Dr. Vincent's interest in this property. He informed the Committee that an offer to purchase has been made by Dr. Spruyt and has been submitted to the Town. He requested that fInal zoning approval be given before Dr. Spruyt before she undertakes to meet all of the Town's requirements. David Chong, Tandy, Koltun, 204-118 Queen Street East, Brompton, L6X 1A5, re: Report PD-73-90, Solicitor for the applicant, appeared on behalf of Mahindra Tiwari and advised that he fully supports the staff recommendations and that he will meet with Mr. Tunney in an endeavour to alleviate his concerns. \or /'0/ , , 0 ~- G.P.A.
