"CARRIED" As required under the new Planning Act [Section 34(12)], Council is holding public meeting3 pior to either adopting or rejecting the following: (a) Proposed Officiel Plan Amendment and Zoning By-law Amendment _ Part Lot 28, Concession 2, former Township of Darlington - R.H. Petryshyn; (e) Proposed Amendment to Comprehensive Zoning By-law with Respect to Prohibiting Video Arcades and/or Similar Uses in the Town of Newcastle; and (1) Proposed Official Plan Amendment - Part Lot 32, Concession 3, former Township of Darlington - William Tonno Construction Limited. The Chairman asked if there were any persons present wishing to speak to these matters. Several people indicated a desire to speak. Before proceeding with these matters, the Chairman asked the Deputy Clerk to advise on the manner of notice. The Deputy Clerk advised that: (a) Public Notices were mailed to all property owners within 120 meters by December 8, 1989; (b) Notices of the public meetings were posted on each of the sites by December 8, 1989; (c) Public Notice for application DEV 89-114 (pD-5-90) was completed by placing advertisements in the local newspapers by December 8, 1989; and (d) The notices comply with the regulations under the Planning Act. The Chairman announced that any persons wishing further notice of the passage of the by-laWS, if passed, to please leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of Planning and Development to briefly describe the purpose and effect of the by-laws and how the by-laws accomplish the stated purposes. The purpose and effect of the by-laws are as follows: (a) R.H. Gay Holdings & Liza Development Corp. - to permit the development of a 38,000 sq. ft. commercial retail plaza; (b) Alexandris Investments Ltd. - to permit the development of 44 single family lots and approximately 20 condominium townhouse units; (c) S. & J. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-laws and that all questions must be asked through the Chair. The Chairman announced that Committee would hear from the objectors, then anyone in support, with the applicant speaking last. (a) R.H. Gay Holdings & Liza Development Corp. - Report PD-1-90 Noone spoke in opposition to or in support of this application. Rick Gay, Box 2065, Oshawa, LlH 1V4, the applicant, informed the Committee that he has owned this property since the mid-eighties and, at that time, his application was denied as being premature. In an effort to comply with the Town's requirements, he has removed the gas bar from his proposal. He advised that this project will be similar to that in Prestonvale from an aesthetical point of view. He is willing to co-operate with Town staff in order to meet all development requirements. (b) Alexandris Investments Ltd. - Report PD-2-90 Noone spoke in opposition to or in support of this application. John D. McDermott, Principal Planner, McDermott & A......;Ates Ltd., 1305 Pickering Parkway, Suite 406, Pickering, L1V 3P2, was present on behalf of the applicant and circulated a letter dated January 5, 1990 wherein he states that a preliminary engineering report to address the servicing of the property in terms of the municipal water supply system, the extension of sanitary sewers and the treatment of storm drainage, has been prepared. The Region of Durham Planning Department advised that since the subject lands are bounded by a Regional Arterial Road, it would be necessary for the applicant to undertake a noise impact analysis in order to determine that the necessary attenuation measures are properly addressed in the subdivision approval process. Accordingly, Valcoustics is preparing the fInal draft of the report. The Regional Works Department now considers this proposal to be premature because the subject property is beyond the limit of the urban service area and will involve the construction of major public works which may involve the extension of the existing 600 mm sanitary sewer in the vicinity of Bloor Street and Prestonvale Road. Mr. McDermott advised that since he did not become aware of the Regional Works Department's concerns until January 3, 1990, he has not had an opportunity to meet with the Region and review and discuss this matter in detail. 20.3 '-" '- '- '- '-' "'" '-' G.P.A. Minutes PUBLIC HEARINGS - 4 . January 8, 1990 (c) S. & J. Wood - Report PD-3-90 Three letters of objection were circulated stating opposition to this application as follows: Muriel and Adolf Schlacht Edna and Jack Chapman Carel and Laverne Boyd. Lome B. Crossing, R.R.#1, Orono, lOB lMO, advised that he has been a resident of Best Road for eight years. He expressed opposition to this proposal because of the noise emanating from truck traffIC which travels on Best Road. He also noted that the road is too narrow, thus inhibiting full view of vehicular traffic, and damage is caused to the road by truck traffIC. He further noted that he has no objection to the erection of a second dwelling. Andy VanLith, R.R.#1, Orono, LOB lMO, has no objection to the erection of a second single family dwelling but strongly disapproves of the proposed expansion of the trucking business because the operation generates excessive noise levels and the road on which the trucks travel is too narrow and causes a dangerous traffic situation. Kenneth and Anne WInters, R.R.#1, Orono, LOB lMO, have been twenty year residents of their property which is located south of Mr. Wood's property. They are opposed to the expansion of the trucking business because it would change and destroy the aesthetics of the area. Wiki Lyeett, Box 87, Orono, LOB lMO, read the contents from his letter dated August 31, 1989 sent to the Planning Department wherein he advised that the application was to "provide further living and office accommodations." Noone spoke in support of the application. Stew Wood, R.R.#1, Orono, LOB lMO, advised the Committee that he owns 126 acres and is taking every precaution to ensure that the neighbours in the surrounding area are not adversely affected by his trucking business. His operation is licensed for ten trucks and he is now using eight trucks in his operation. His request is for a ten acre severance and it is not his intention to sell the trucking operation. (d) W. Petryshyn - Report PD-4-90 Noone spoke in opposition to or in support of this application. The applicant was present but did not wish to speak. (e) Proposed Amendment to Comprehensive Zoning By-law with respect to prohibiting Video Arcades and/or similar uses in the Town of Newcastle . PD-5-90 Noone spoke in opposition to or in support of this application. '"' G.P.A Minutes PUBLIC HEARINGS .5- January 8, 1990 (I) William Tonno Construction Limited - Report PD-6-90 Fred ~ R.R.#3, BowmanviJle, LlC 3K4, displayed five charts in conjunction with his presentation. He also circulated a petition with approximately 53 signatures in opposition to this proposal. He noted that this petition represents approximately 90 percent of the surrounding residents. He advised that development adjacent to this proposal is composed of estate residential homes located on one acre lots. This area is designated Major Open Space and Environmentally Sensitive. The residents' reasons for opposition are as follows: - all the trees on the applicant's property have been cut down - the overall environment - forty foot lots are not acceptable - high density impact - the erection of 148 houses will significantly impact Farewell Creek - living conditions - adversely affect wells and septic tanks - Farewell Creek water quality/quantity - Water Table, etc. - property devaluation . fire and police protection - vehicle volume - energy resources/restrictions - school availability/taxes (education) Mr. Finlayson made reference to letters originating from the Regional Planning Department and C.L.O.C.A. stating that environmentally protected areas should be protected development. He requested the Committee to deny this application unless a compromise can be made. Victor Humphreys, Group 24, Box 1, R.R.#3, Bowmanville, LlC 3K4, noted that the Farewell Creek Valley provides a diversity of wildlife habitat and that water diversion will disturb the natural drainage of the land. He noted that the existing school cannot accommodate the future school age generation and that school taxes are now monumental. He requested a moratorium on residential development and encouraged industrial development. Mr. and Mrs. H. WItzky, R.R.#3, Bowmanville, L1C 3K4, were present in support of this application. D.G.Biddle & AARIV'i"t.es Ltd., 96 King St. E~ Osbawa, LlH lB6, was present on behalf of the applicant and is acutely aware of the environmental sensitivity of the area He informed the Committee that a Comprehensive Environmental Impact Analysis has been undertaken to preserve the Farewell Creek Valley in its natural state and that he supports the expansion of the Urban Area Boundaries. Kevin Tunney, Tunney Planning. 340 Byron St. S., Whitby, L1N 4P8, re: Reports PD-10-90, PD-1l-90 and PD-12-90 - displayed a draft plan of subdivision which included the three above referenced applications. Mr. Tunney fully concurs with staff recommendations in the above noted three reports. A considerable number of modifIcations to all the plans have been made in an attempt to satisfactorily address the surrounding area residents' concerns. The three developers are all party to fInancial contributions being made towards the cost of the expansion of sanitary sewer services. He further advised that the widening of Old Scugog Road on the east side will be undertaken at the developer's expense.
