HomeMy WebLinkAbout2005-092 ; " THE CORPORA nON OF THE MUNICIPALITY OF CLARINGTON BY-LAW NO, 2005-092 Being a by-law to designate the property known for municipal purposes as 4675 Bethesda Road, Part Lot 6, Concession 4, Darlington, now in the Municipality of Clarington as a property of historic or architectural value or interest under the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18 WHEREAS the Ontario Heritage Act, R.S.O., 1990, c,0.18 authorizes the Council of the Municipality to enact by-laws to designate properties to be of historic or architectural value or interest for the purposes of the Act; and WHEREAS the Council of the Corporation of the Municipality of Clarington has caused to be served upon the owner of the property known for municipal purposes as 4675 Bethesda Road, Part Lot 6, Concession 4, Darlington, now in the Municipality of Clarington and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such Notice of Intention to be published in the Canadian Statesman, a newspaper having general circulation in the area of the designation on April 4, 11 and 18,2005; and WHEREAS the reasons for the designation of the aforesaid property under the Ontario Heritage Act are contained in Schedule "A" attached to and forming part of this by-law; and WHEREAS the Local Architectural Conservation Advisory Committee of the Municipality of Clarington has recommenced that the property known for municipal purposes as 4675 Bethesda Road, Part Lot 6, Concession 4, Darlington, now in the Municipality of Clarington, be designated as a property of historic or architectural value or interest under the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation was served upon the Municipal Clerk within the period prescribed by the Ontario Heritage Act; NOW THEREFORE THE COUNCIL OF THE CORPORA nON OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: I, The property known for municipal purposes as 4675 Bethesda Road, Part Lot 6, Concession 4, Darlington, now in the Municipality of Clarington which is more particularly described in Schedule "B" which is attached to and forms part of this by-law, is hereby designated as a property which has historic or architectural value or interest under Section 29 ofthe Ontario Heritage Act, R.S,O. 1990, c,,0.18, 2. The Solicitor for the Municipality of Clarington is hereby authorized to cause a copy of this by-law to be registered against the title to the property described in Schedule "B" hereto, 3, The Municipal Clerk is hereby authorized to cause a copy of this by-law to be served upon the owner ofthe property described in Schedule "B" hereto and on the Ontario Heritage Foundation. The Municipal Clerk also is authorized to cause notice ofthe passing of this by-law to be published in the Canadian Statesman, a newspaper having general circulation in the area of the designation. SCHEDULE 'A' TO BY-LAW 2005-092 This fieldstone three bay by two bay farmhouse was constructed for the Cole family in approximately 1855. It is one of three similar stone houses that were located along Acres Road. The house sat on a 100 acre lot on 5690 Acres Road which had been owned by James Bates. James bequeathed the property to his wife Elizabeth and their children on July 19th, 1832. Charles Bates, possibly the son of James and Elizabeth, became the owner of the lands by 1845. Charlesville, which is now called Haydon, was called such in honour of Charles Bates as he built a mill there that encouraged settlement. Charles Bates sold the property to Roger Cole, who is reputed to have donated the funds to build an Anglican Church in Bowmanville. When Roger died in 1861 his son John Cole became the owner. In 1886 John willed the property to his son John RR Cole. The property remained in the Cole family until 1962. The Ministry of Transportation is the current owner of 5690 Acres Road and the fieldstone farmhouse house was moved to 4675 Bethesda Road in 2004 to save it from demolition. The front and north side of the farmhouse was constructed of Ashlar cut stone, hammered into square and rectangle styles and set in a broken range. The stones range in colour from black to white to pink. The south wall is rubble hammered into a faced stone set in a random coarse pattern. The east wall is split rubble set in a random pattern. An enclosed frame porch covers approximately 30% of the front fa9ade. Approximately 60% of the east wall is covered by a frame addition and there is also evidence of previous addition. The farmhouse is recommended for designation at its new location under the Ontario Heritage Act for its cultural heritage significance and the following exterior architectural features: Exterior: . SCHEDULE "B" TO BY-LAW 2005-092 ALL AND SINGULAR those certain parcels or tracts of land and premises situated, lying and being in the Municipality of Clarington, in the Regional Municipality of Durham and being more particularly described as: FIRSTLY Part of the North one-half of Lot Six (6) in the Fourth Concession of he said Township of Darlington, containing by admeasurement 25.799 acres, be the same more or less, the boundaries of the said parcel being more particularly described as follows: PREMISING that the Northerly limit of said Lot 6 has an astronomic bearing of North 72 degrees 09 minutes East and relating all bearings herein thereto; COMMENCING at an iron bar planted at the point of intersection of the Southerly limit of County Road Number One (Taunton Road) as widened with the Westerly limit of said Lot 6, said iron bar distant Southerly in the last-mentioned limited 8.38 feet measured on a course of South 17 degrees 49 minutes 30 seconds East from the North-Westerly angle of said Lot 6; THENCE South 17 degrees 49 minutes 30 seconds East along the Westerly limit of said Lot 6 a distance of 1972.45 feet to an iron bar marking the North-Westerly angle of the lands described in Instrument Number NI3526 for the Township of Darlington; THENCE North 73 degrees 56 minutes 20 seconds East along the Northerly limit of the aforesaid lands a distance of567.54 feet to an iron bar; THENCE North 17 degrees 49 minutes 30 seconds West a distance of 1989.75 feet more or less to an iron bar planted in the Southerly limit of County Road Number One (Taunton Road) as widened, said iron bar distant Easterly therein 567.27 feet from the point of commencement; THENCE South 72 degrees II minutes 30 seconds West along the last-mentioned limit a distance of 567.27 feet to the POINT OF COMMENCEMENT. The following schedule was created in order to register this by-law in 2011 .
