HomeMy WebLinkAbout2005-110 . ~ THE MUNICIPALITY OF CLARINGTON BY-LAW NO. 2005-110 being a by-law to amend Zoning By-law 84-63, as amended, to make certain of its provisions inapplicable to the lands within the Oak Ridges Moraine Plan Area WHEREAS Council has received Report PSD-068-05 recommending that Council pass the Clarington Zoning By-law 2005-109 for the purposes of implementing the provisions of the Oak Ridges Moraine Conservation Act, 2001, S.O. 2001 c. 31, the Oak Ridges Moraine Conservation Plan, and proposed Amendment 33 to the Municipality of Clarington Official Plan; NOW THEREFORE the Council of the Corporation of the Municipality of Clarington hereby enacts as follows: 1. THAT By-law No. 84-63, as amended, being the Comprehensive Zoning By-law of the former Town of Newcastle, is further amended conditional on the approval by the Minister of Zoning within the Municipality of Clarington as shown on the map entitled "Oak Ridges Moraine Conservation Plan Land Use Designation Map" numbered 208, dated April 17 , 2002 and on file in the offices of the Ministry of Municipal Affairs and Housing at Toronto (the Oak Ridges Moraine Boundary) By-law 2005-109 with or without amendments or modifications being made to it pursuant to the Oak Ridges Moraine Conservation Act, 2001, S.O. 2001 c. 31: a) by making the text and schedules of By-law 84-63 inapplicable to the lands within the Oak Ridges Moraine Plan Area within the Municipality of Clarington shown on the map entitled "Oak Ridges Moraine Conservation Plan Land Use Designation Map" numbered 208, dated April 17, 2002 and on file in the offices of the Ministry of Municipal Affairs and Housing at Toronto; and b) by deleting the text of By-law No. 84-63, as amended, respecting the specific exception zones identified in Schedule "A" attached to and forming part of this By-law. 2. THAT this By-law shall come into force on the day on which the Minister approves the Clarington Zoning By-law 2005-109 pursuant to the provisions of the Oak Ridges Moraine Conservation Act 2001.
