THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 2005-104
being a by-law to authorize the execution of an agreement
under section 30 of the Expropriations Act between the
Municipality of Clarington and the owners of 11 Boulton Street,
Newcastle
WHEREAS the solicitors for Robin and Tracy Duetta have requested that the
Municipality of Clarington enter into an agreement with their clients under section
30 of the Expropriations Act, R.S.O. 1990, c.E.26, as amended and its is
expedient to do so,
NOW THEREFORE the Council of The Corporation of the Municipality of
Clarington hereby enacts as follows:
1. THAT the Mayor and the Municipal Clerk on behalf of the Municipality of
Clarington be authorized to execute an agreement with Robin and Tracy
Duetta under section 30 of the Expropriations Act respecting the
expropriation of 11 Boulton Street, Newcastle.
2. THAT the agreement is to provide for a purchase price of $250,000.00
subject to adjustment, the Municipality to pay the reasonable legal
expenses and disbursements of Mr. and Mrs. Duetta, and contain such
other provisions that the Director of Planning Services considers to be
necessary to protect the Municipality's interests.
By-law read a first and second time this 30th day of May, 2005.
By-law read a third time and finally passed this 30th day of May, 2005.
