3.1 A2016-0014 Tina Dias

Applicant, Tina Dias explained application and history of her business. The Committee asked
applicant, Tina Dias, if there were any concerns with parking. Tina noted that her driveway is very
large and parking is not an issue. The Committee asked the applicant if the work was completed
without permits. Tina noted the work was completed without permits prior to her purchasing the
property and she is now trying to legalize the use and the work that was completed without permits.
The Committee asked the applicant if she was aware that Staff is recommending the application be
tabled. Tina Dias expressed no concerns with tabling the application to a further meeting of the
Committee of Adjustment.
No persons appeared in opposition to this application.

Agent, Ivars Kulitis explained application. The Committee asked Planner, Amanda
Watson, for clarification on the property boundary issues identified in the report in
regards to the application and issues were clarified. There were no members of the
public in objection or support.

"To table the application to permit the construction of a
sunroom addition by reducing the minimum required rear
yard setback from 7.5 metres to 5.17 metres to a future
meeting of the Committee of Adjustment in order to allow
the applicant time to discuss issues with the property
boundaries with Staff."

3.3 A2016-0016 Lucas Topolie

Applicant, Lucas Topolie explained application and history of the business. The
Committee asked the applicant, Lucas Topolie how many students and staff were
expected to be in the pool at any given time. Lucas quoted the requirements of Zoning
By-law 84-63 and stated no more than three students at any given time with only one
staff member who lives off of the premises. The Committee asked the applicant about
parking, and if there have ever been issues with parking on the property. Lucas
explained that the property can hold upwards of twelve vehicles without parking on the

road, so it has never been an issue. The Committee asked the applicant about the ages
of children the business serves on average. Lucas described the ages from 9 months to
adults. The Committee asked the applicant whether parents tend to stay on the property
while their children are swimming and if so, is there allocated locations for them. Lucas
described that the property has two patio sets for parents, however, they are free to
leave the children for the duration of their lesson and return afterwards. The Committee
asked Planner, Amanda Watson for clarification if Staff are aware of any issues with
parking on the property or other nuisances. Staff described that one letter of objection
was received however, the nuisances described in this letter reflected the business and
the way it operated previously. It has been described to Staff, by the applicant that they
intend to comply with all provisions of the by-law in regards to home occupation uses,
and that should alleviate any nuisances that were listed in the letter of objection moving
forward. There were six members of the public in support of the application. The
applicant's brother, Nick Topolie, explained the company in detail and the benefits it
provides to the community. The Committee asked Planner, Amanda Watson for
clarification on any issues that building has with the proposal and any issues with
washrooms and number of change rooms and none were stated. The Committee asked
Nick Topolie about the hours of operation for the business. Nick described that the
business runs throughout the day, evening and weekends, weather permitting.
Additionally, two members of the public, including two users of the facilities spoke to the
benefits of this business for the community and their personal experiences and that they
wish to see the business continue. Application was approved unanimously by the
Committee.
