BACKGROUND
A policy detailing the regulations for the hiring of employees for the Municipality, titled
Staffing and Recruiting, was approved by senior management effective January 8, 2002
and has formed part of the Policies and Procedures Manual for the Municipality. A
section of the Staffing and Recruiting Policy relates specifically with the Employment of
Relatives and details the parameters of hiring.
The Municipal Act 2001, c. 25, s. 270, states that before January 1, 2005, a municipality
shall adopt policies with respect to the hiring of its employees, including policies with
respect to the hiring of relatives of a member of council and the hiring of relatives of
existing employees of the municipality.
REQUIREMENT
While the policy has been enacted and authorized by senior management for the
Municipality and addresses the concerns of the Province of Ontario, the policy has not
been brought forward to council for approval. By advice of the Ministry of Municipal
Affairs and Housing, it is advisable that the policy be passed as a by-law by council.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 2004-
Being a By-law to recognize and adopt as policy for the Municipality of
Clarington Corporate Policy A 1, Staffing and Recruiting, and to adhere to its
conditions and precepts as set out when hiring employees for the
Municipality.
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY
ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the
Corporation of the Municipality of Clarington and seal with the Corporation
Seal, the adoption of Policy A 1, Staffing and Recruiting, as policy for the said
Corporaton;
2. THAT the policy in substantially the form attached hereto as Schedule "A"
form part of this By-law.
